सा.का.नि. 81 (अ) . केन्द्रीय सरकार , भारत - तिब्बत सीमा पुलिस बल अधिनियम , 1992 ( 1992 का 35 ) की धारा 156 की उप - धारा ( 2 ) के खंड ( ख ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत - तिब्बत सीमा पुलिस बल सहायक उप- निरीक्षक ( आशुलिपिक ) , समूह ' ग ' भर्ती नियम , 2010 और भारत- तिब्ब्त सीमा पुलिस , योधक अनुसचिवीय काडर और योधक आशुलिपिक काडर , समूह ' ख ' पद और समूह ' ग ' पद भर्ती नियम , 2010 को जहाँ तक उनका संबंध हैड कांस्टेबल ( योधक अनुसचिवीय ) पद से है , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है, या करने का लोप किया गया है, गृह मंत्रालय , भारत- तिब्बत सीमा पुलिस बल में सहायकउप- निरीक्षक ( आशुलिपिक ) और हैड कांस्टेबल ( अनुसचिवीय ) , समूह ' ग ' पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम भारत - तिब्बत सीमा पुलिस बल सहायक उप- निरीक्षक (आशुलिपिक ) और हैड कांस्टेबल ( अनुसचिवीय ) , समूह ' ग ' पद भर्ती नियम , 2013 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं , आदि. उक्त पद पर भर्ती की पद्धति, आयु- सीमा , अर्हताएं और उससे संबंधित अन्य बातें वही होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।
4. निरर्हता. वह व्यक्ति,
(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पदों में से किसी पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । (1)

5. चिकित्सीय दृष्ट्या योग्यता. इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी , केवल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप-1 में हैं , इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे ।
स्पष्टीकरण : इस नियम के प्रयोजन के लिए " शेप -1 " से निम्नानुसार परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है :-
( 1 ) कोड अक्षर : शेप ( एस.एच.ए.पी.ई. ) , जो निम्नलिखित कृत्यों का प्रतिनिधित्व करते हैं , द्वारा उपदर्शित दिए गए कारकों के अधीन अधिकारी की उपयुक्तता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण; अर्थात्:-

मनोवैज्ञानिक
एच श्रवण शक्ति
ए
उपांग ( अपैन्डेजेस )
पी शारीरिक क्षमता
ई दृष्टिशक्ति
( 2 ) प्रत्येक कारक के अधीन , किसी अधिकारी की कार्यात्मक क्षमता , प्रत्येक कोड अक्षर के सामने अंक 1 से 5 की कार्यक्षमता, उपदर्शित करते हुए दर्शाई जाएगी । कोड अक्षर के पश्चात् अंक लिखे जाएंगे , सिवाय उसके जहां कोई अधिकारी सभी कारकों में श्रेणी -1 में है वहां उसका प्रवर्ग एस । एच। ए । पी । ई । लिखने के बजाय शेप -1 लिखकर दर्शाया जा सकेगा । इन अंकों का साधारण मूल्यांकन निम्नानुसार है :
(क) कहीं भी सभी कर्तव्यों के लिए योग्य ।
(ख) सभी कर्तव्यों के लिए योग्य किन्तु क्या, कर्तव्यों में तीव्र कठिनाई या दोनों कानों या आँखों को श्रवण शक्ति/ दृष्टि की तीक्ष्णता की मांग अन्तर्गस्त है या नहीं , पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं ।
(ग) " एस" कारक को छोड़कर , नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान ( 2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रों या पहाड़ी भूखंडों पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती हैं ।
(घ) अस्पताल में भर्ती या बीमारी की छुट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य ।
(ङ) कर्तव्यों के लिए स्थायी रूप से अयोग्य ।
6. गैर भारतीय अपात्रता कोई व्यक्ति, जो भारत का नागरिक नहीं है , लिखित में केन्द्रीय सरकार की पूर्व अनुमति के सिवाय , इन नियमों के अधीन नियुक्त नहीं किया जाएगा :
परन्तु इन नियमों की कोई बात नेपाल या भूटान के नागरिकों की नियुक्ति या नियोजन को वर्जित नहीं करेगी ।
7. अधिवर्षिता. इन नियमों के अधीन नियुक्त किया गया कोई कार्मिक उस मास के, जिसमें वह सत्तावन वर्ष की आयु प्राप्त करता है, अंतिम दिन के अपराह्न में सेवानिवृत होगा;
परन्तु वह व्यक्ति जिसके जन्म की तारीख किसी मास की पहली तारीख होगी , सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराहन में सेवानिवृत होगा ।
(2 ) किसी भी व्यक्ति को अधिवर्षिता पर सेवानिवृति के लिए विहित आयु के पश्चात् सेवा विस्तार प्रदान नहीं किया जाएगा ।
8. शिथिल करने की शक्ति. जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहाँ वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।
9. व्यावृति.-इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ऊपरी आयु-सीमा में अनुसूचित जाति या अनुसूचित जनजातियों के अभ्यर्थियों की दशा में पाँच वर्ष और अन्य पिछड़े वर्गों के अभ्यर्थियों की दशा में तीन वर्ष तक शिथिल की जा सकती है । केन्द्रीय सरकार द्वारा समय- समय पर जारी किए गए आदेशों के अनुसार केन्द्रीय सरकार के सेवकों और भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए भी शिथिल की जा सकती है । ऊपरी आयु- सीमा विभागीय अभ्यर्थियों के लिए सामान्य और अन्य पिछड़े वर्गों की दशा में 40 वर्ष और अनुसूचित जाति/ अनुसूचित जनजाति के अभ्यर्थियों के लिए 45 वर्ष तक शिथिल की जा सकती है ।)
टिप्पणः- आयु सीमा अवधारित करने के लिए निर्णायाक तारीख कार्मिक और प्रशिक्षण विभाग के कार्यालय ज्ञापन संख्या ए०बी ० 14017/ 70/87- स्था०(आर०आर०) तारीख 14/7/1988 अर्थात यदि प्रतियोगी या लिखित परीक्षा पहले अर्द्धवर्ष में संचालित की गयी है तो उस वर्ष जनवरी की पहली तारीख और यदि प्रतियोगी या लिखित परीक्षा दूसरे अर्द्धवर्ष में संचालित की गई है तो उस वर्ष के अगस्त की पहली तारीख आयु सीमा अवधारित करने के लिए निर्णायक तारीख होगी ।
सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं

परिवीक्षा की अवधि, यदि कोई हो सीधे भर्ती किए जाने वाले व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नही

(ii) कम्पयूटर कौशल परीक्षण मानकः-
श्रुत लेखः 80 शब्द प्रतिमिनट की दर से 10 मिनट
प्रतिलेखन काल- कम्पयूटर पर हिंदी में 65 मिनट या अंग्रेजी में 50 मिनट ।
(iii) शारीरिक मानकः

(iv ) चिकित्सा मानक
(क) दृष्टिः बिना सुधार अर्थात बिना चश्मा या लैंस पहने दोनो आँखों की न्यूनतम दूरी दृश्यतां 6/6 और 6/9 होनी चाहिए ।
(ख) अभ्यर्थी संहृत जानु(नॉक-नी), चपेटा पांव, फूली हुई नसें (वेरीकोस वेन) या भैंगी आंखों वाला नहीं होना चाहिए और रंग दृश्यता उच्च श्रेणी की होनी चाहिए वह अच्छे मानसिक और शारीरिक स्वास्थ्य का और ऐसे शारीरिक दोष से मुक्त होना चाहिए जिससे उसके दक्षतापूर्वक कर्तव्य पालन में बाधा पड़ने
की संभावना है ।
प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे
श्रेणियां जिनसे प्रोन्नति या प्रतिनियुक्ति या आमेलन किया
जाएगा ।
भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले रिक्तियों की प्रतिशतता

सीमित विभागीय प्रतियोगी परीक्षा के माध्यम से चयन द्वारा (i) (ii) 15 प्रतिशत सीमित विभागीय प्रतियोगी परीक्षा (एल.डी.सी.ई. ) के माध्यम से चयन द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा ।
(iii) अधिकतम ऊपरी आयु सीमा 35 वर्ष है ।
(ⅰ ) ऐसे कांस्टेबल (जी०डी०) , हैड कांस्टेबल (अनुसचिवीय ) , कांस्टेबल (ट्रेड- मैन) जिनकी कांस्टेबल या हैड कांस्टेबल श्रेणी में कुल पाँच वर्ष की नियमित सेवा है और जो स्तंभ (7) के अधीन सीधी भर्ती किए जाने वाले व्यक्ति के लिए विहित अर्हताएं रखते हैं , के सीमित विभागीय प्रतियोगी परीक्षा के माध्यम से चयन द्वारा; और
(ii) चिकित्सा प्रवर्ग शेप -1 में हो;
(iii) अच्छी सेवा का रिकार्ड हो ।

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श लिया जाएगा ।

(iv ) चिकित्सा मानक

प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति या प्रतिनियुक्ति या आमेलन किया जाएगा ।
भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले रिक्तियों की प्रतिशतता भारत का राजपत्र असाधारण

सीमित विभागीय प्रतियोगी परीक्षा के माध्यम से चयन द्वारा (i ) 85 प्रतिशत सीधी भर्ती द्वारा
(ii) 15 प्रतिशत सीमित विभागीय प्रतियोगी
परीक्षा (एल.डी.सी.ई. ) के माध्यम से चयन द्वारा जिसके न हो सकने पर सीधी भर्ती द्वारा
(ⅰ ) ऐसे कांस्टेबल (जी०डी० ), हैड कांस्टेबल (अनुसचिवीय) , कांस्टेबल (ट्रेड-मैन) जिनकी कांस्टेबल या हैड कांस्टेबल श्रेणी में कुल पाँच वर्ष की नियमित सेवा है और जो स्तंभ (7) के अधीन सीधी भर्ती किए जाने वाले व्यक्ति के लिए विहित अर्हताएं रखते हैं , के सीमित विभागीय प्रतियोगी परीक्षा के माध्यम से चयन (iii) अधिकतम ऊपरी आयु सीमा 35 वर्ष है ।
द्वारा; और
(ii ) चिकित्सा प्रवर्ग शेप-1 में हो;
(iii) अच्छी सेवा का रिकार्ड हो ।
यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श लिया जाएगा ।

GS.R.81 (E) -[ n exercise of the powers conferred by clause (b) of sub - section (2 ) of section 156 of the Indo - Tibetan Border Police Force Act , 1992 ( 35 of 1992 ) , and in supersession of the Indo - Tibetan Border Police Force , Assistant Sub - Inspector ( Stenographer ) , Group ' C ' post , Recruitment Rules , 2010 and the Indo - Tibetan Border Police Force , Combatant Ministerial Cadre and Combatant Stenographer Cadre Group ' B ' and Group ' C ' posts Recruitment Rules , 2010 , in so far as it relates to the post of Head Constable ( Combatant Ministerial ) , except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules regulating the method of recruitment to the post of Assistant Sub - Inspector (Stenographer ) and Head Constable ( Ministerial ) , Group ' C ' post in the Indo - Tibetan Border Police Force , in the Ministry of Home Affairs , namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Indo - Tibetan Border Police Force , Assistant Sub - Inspector (Stenographer ) and Head Constable ( Ministerial ) , Group ' C ' post Recruitment Rules , 2013 .
(2 ) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post , classification and pay band and grade pay or pay scale . The number of the said posts , their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .
3. Method of recruitment , age limit , other qualifications , etc ..- The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns (5 ) to ( 13 ) of the said Schedule .
4. Disqualification.- No person ,-
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Medical Fitness ( 1 ) Notwithstanding anything contained in these rules , only those persons who are in medical category SHAPE - I , shall be eligible for appointment on promotion under the provisions of theses rules .
Explanation : For the purpose of this rule , " SHAPE - I " means Medical Category defined as under:
(i) Medical classification done by the Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE , which represent the following function: - S

(ii ) Functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter , indicating declining functional efficiency . The numerals will be written next to the code letter , except that where an officer is in Grade- I in all factors , his category may be denoted by writing SHAPE - I instead of writing SH1A1P1E1 General evaluation of these numerals is as under: -
(a) Fit for all duties anywhere .
(b) Fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve sever stress or demand acuity of hearing or vision of both ears or eyes ;
(c) Excepting " S " factor , fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2700 meters ) extreme cold areas or hilly terrain and for long assignments ;
(d) Temporarily unfit for duties on account of hospitalisation or sick leave ;
(e) Permanently unfit for duties .
6. Ineligibility of non - citizens of India . No person who is not a citizen of India shall , except with the prior permission of Central Government in writing , be appointed under these rules :
Provided that nothing contained in this rule shall debar the appointment or employment of a subject of Nepal or Bhutan in the Force .
7. Superannuation . (1) Every person appointed under these rules shall retire from service on the afternoon of the last day of month in which he or she attains the age of fifty seven years :
Provided that the person whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty seven years .
(2) No person shall be granted extension in service beyond the prescribed age of retirement on superannuation.
8. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons . 589 61/13-3 THE GAZETTE OF INDIA : EXTRAORDINARY

9. Saving . Nothing in these rules shall affect reservations , relaxation of age -limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Note: The crucial date for determining the age limit shall be the first day of January of the year in which examination is held, if the competitive or written examination is conducted in the first half of the year and first day of August of the year, if the competitive or written examination is conducted in the second half of the year .
