का.आ. 376(अ).- यतः केंन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल (सड़क खण्ड) मंत्रालय की अधिसूचना संख्या का.आ. 1097 (अ) तारीख 4 अगस्त, 2005 द्वारा तमिलनाडु राज्य में राष्ट्रीय राजमार्ग संख्या 4 के 0.000 किमी से 107.200 किमी ( चैन्नई- रानीपेट सेक्शन) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् " प्राधिकरण " संदर्भित किया गया है) को सौंपा है;
' और यतः , केन्द्रीय सरकार ने , राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्गों के खण्ड और स्थायी पुल के उपयोग के लिए शुल्क-सार्वजनिक वित्तपोषित परियोजना) नियम , 1997 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48) की धारा 7 , राष्ट्रीय राजमार्ग ( शुल्क की दर ) नियम 1997 और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम , 2008 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार की अधिसूचना द्वारा खण्ड के उपयोग के लिए यांत्रिक वाहनों पर निम्नानुसार शुल्क उद्ग्रहीत और संग्रहीत करने हेतु प्राधिकरण को प्राधिकृत किया था :
(i) तमिलनाडु राज्य में राष्ट्रीय राजमार्ग संख्या 4 कांचीपुरम - चैन्नई सेक्शन के 60.100 किमी से 13.800 किमी तक के खण्ड हेतु का.आ. सं. 944 (अ) , तारीख 30 अप्रैल, 2012द्वारा

(ii) तमिलनाडु राज्य में राष्ट्रीय राजमार्ग संख्या 4 के वलाहजापेट-कांचीपुरम सेक्शन के 107.200 किमी-60.100 किमी तक के खण्ड हेतु का.आ. संख्या 2841 (अ) , तारीख 6 दिसम्बर , 2012द्वारा
और यतः , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68) की धारा 14 के प्रावधान के अनुसरण में , प्राधिकरण में मैसर्स एस्सेल वलाहजापेट पूनामल्ली) टोल रोड्स प्राइवेट लिमिटेड, जो 27.04.2012 को प्रस्तुत की गई बोलियों के सफल बोलीदाता हैं, जिनका पंजीकृत कार्यालय एस्सेल हाउस , बी-10, लारेन्स रोड, इंडस्ट्रियल एरिया , नई दिल्ली-110035 में है (जिसे इसमें इसके पश्चात् " रियायतग्राही " संदर्भित किया गया है , के साथ राष्ट्रीय राजमार्ग संख्या 4 दर 106.800 किमी से 13.800 किमी तक वलाजाहपेट-पूनामल्ली सेक्शन (जिसे इसमें इसके पश्चात् " उक्त खण्ड" संदर्भित किया है के खण्ड लेन में विकास तथा उक्त खण्ड के प्रचालन और अनुरक्षण हेतु शक करार किया गया है ( जिसे इसमें इसके पश्चात्त् उक्त करार संदर्भित किया गया है)
अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण ओर संग्रहण) नियम, 2008 (जिसे इसमें इसके पश्चात् " नियम " संदर्भित किया गया है) के नियम 3 के साथ पठित राष्ट्रीय
राजमार्ग अधिनियम , 1956 ( 1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त खण्ड के निर्माण , प्रबंध और प्रचालन पर हुए व्यय निवेशित पूंजी पर ब्याज , युक्तियुक्त प्रत्यागम , यातायात का परिणाम तथा प्राधिकरण और रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए , एतद्दारा यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक वाहनों पर सड़क खण्ड की निवल लम्बाई 93.000 किमी हेतु चार या अधिक लेन के उपयोग पर नीचे सारणी 1 में विनिर्दिष्ट प्रकार के वाहनों पर सारणी । के स्तम्भ (2 ) में विनिर्दिष्ट दर (जिसे इसमें इसके पश्चात् " आधार दर " संदर्भित " किया गया है ) पर शुल्क उद्ग्रहीत एवं संग्रहीत किया जाएगा, और उक्त रियायतग्राही को वाणिज्यिक प्रचालन की तारीख को और उस तारीख से अथवा इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, जो भी बाद में हो, समापन की तारीख तक जैसा कि करार में निर्दिष्ट किया गया है, शुल्क को संग्रीहित और उसे प्रतिधारित करने के लिए प्राधिकृत करती है:

टिप्पणियां:
1. नीचे उद्ग्रहीत तथा संग्रहीत शुल्क निम्नलिखित टोल प्लाजा पर ऐसे टोल प्लाजा के लिए निर्दिष्ट दूरी शोध्य और संदेय होगा :
टोल प्लाजा (प्लाजाओं) का अवस्थान (चैनेज)
लंबाई (कि.मी. में) जिसके लिए फीस संदेय है
46.500 किमी/चैनेज 37.800 ( कांचीपुरम जिले में नेमिली श्रीपेरमवदूर गांव के पास)
46.500 किमी /चैनेज 194.900 ( वेल्लोर जिले में चेन्नासमुद्रम गांव के पास)
2. जिस व्यक्ति का अपना यांत्रिक वाहन गैरवाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से बीस कि.मी. तक की दूरी में ही रहता हो उसके लिए वर्ष 2012-13 के लिए मासिक पास की दर 200.00 रूपए (दो सौ रूपए मात्र) प्रतिमाह होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम , 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जाएगा ।
3. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जायेगा, अर्थात्ः
संदेय धनराशि
विधिमान्यता की अबधि
अनुज्ञात एकतरफा यात्राओं की अधिकतम संख्या
दो
संदाय के समय से चौबीस घंटे
एकतरफा यात्रा के लिए शुल्क का डेढ़ गुना
पचास या अधिक संदाय की तारीख से एक मास
पचास या अधिक एकल यात्राओं के लिए संदेय शुल्क की राशि का दो - तिहाई
4. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।
5. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भारत को हटा न दिया जाए ।

6. यांत्रिक वाहनों के प्रवर्ग, उनके लिए अनुज्ञेय भार, छूटप्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
7. उक्त नियमों के नियम 12 के अनुसार, उपयोगकताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
8. ऊपर सारणी 1 में यथा उल्लिखित , आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा परन्तु शर्त यह है कि कुछ महीने अन्दर कोई संशोधन नहीं किया जाएगा तथा उसे, तदनुसार, कम- से- कम अंग्रेजी और स्थानीय भाषा के एक - एक समाचारपत्र में प्रकाशित किया जाएगा ।

NOTIFICATION
New Delhi , the 14th February, 2013
S.O. 376 (E ) -- Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing ) , number S.O. 1097 (E) dated the 4th August , 2005, issued under Section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ), the Central Government has entrusted the stretch from kilometer 0.000 to kilometer 107.200 ( Chennai Ranipet section) of National Highway No. 4 in the State of Tamil Nadu to the National Highways Authority of India (hereinafter referred to as the " Authority ") ;
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with National Highways (Fees for the Use of National Highways Section and Permanent Bridge Public Funded Project) Rules , 1997 , National Highways (Rate of Fee) Rules , 1997 and National Highway Fee (Determination of Rates and Collection) Rules 2008 , the Central Government by notification of the Government of India authorized the Authority for levying and collecting fee on mechanical vehicles for the use of stretch as follows :
(i) Vide S.O. No. 944 (E) dated 30th April , 2012 for the stretch from Km 60.100 to Km 13.800 Kancheepuram - Chennai section on National Highway No 4 in the State of Tamil Nadu.
( ii ) Vide S.O. No. 2841 (E ) dated 6th December , 2012 for the stretch from Km 107.200 Km 60.100 Walajahpet - Kanchipuram section on National Highway No. 4 in the State of Tamil Nadu.
And whereas , pursuant to the provision of Section 14 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/ s Essel Walajahpet Poonamallee Toll Roads Private Limited having its registered office at Essel House , B - 10 , Lawrence Road , Industrial area, New Delhi 110035 5

(hereinafter referred to as the "Concessionaire ") , the successful bidder for bids submitted on 27/04/2012 for the development of the Walajahpet - Poonamallee section from Km 106.800 to Km 13.800 on National Highway No. 4 (hereinafter referred to as the " said section " ) to Six lane operation and maintenance of the said section.
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 ( hereinafter referred to as the " Rules ") , the Central Government, having regard to the expenditure involved in building , maintenance , management and operation of the said section, interest on the capital invested, reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length 93.000 km for use of the four and more lane (hereinafter referred to as "base rate ") on the Type of Vehicles specified in Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the agreement ;

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 (Rupees Two Hundred Only) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .

3. For multiple journey on the highway section, passes shall be issued at the following rates , namely.

4. Fee for commercial vehicle ( excluding vehicles plying under national permit ) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the Rules .
7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .
8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table - I, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper , each in English and vernacular language accordingly .
