S.O. 368 ( E) . Whereas the Joint Secretary to the Government of India, specially empowered under sub- section ( 1 ) of Section 3 of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act, 1974 (52of1974) issued order F. No. 673/ 11 /2012-Cus . VIII , dated 11-01-2013 under the said sub - section directing that Shri Swadhin Sarkar , S/o Late Narayan Sarkar, R/ o Village- Jot Chaipara, P.O. Jayenpur , P.S. Baishnavnagar, Distt . Malda, West Bengal , be detained and kept in custody in the Berhampore Correctional Home , Berhampore with a view to preventing him from engaging in smuggling, transporting, concealing and keeping the smuggled goods in future.
का.आ. 368(अ).-जबकि , विदेशी मुद्रा संरक्षण और तस्करी निवारण अधिनियम , 1974 ( 1974 का 52 ) की धारा 3 की उप - धारा ( 1 ) के तहत विशेष रूप से अधिकार प्राप्त संयुक्त सचिव , भारत सरकार द्वारा कथित उप- धारा के तहत फाइल सं. 673/ 11/2012-सी. शु.- VIII से दिनांक 11-01-2013 को जारी आदेश के तहत निदेश दिया गया था कि श्री स्वाधीन सरकार, पुत्र स्व. श्री नारायण सरकार , निवासी ग्राम -जोट चायपारा , पी.ओ.जायेनपुर, पी.एस. वैश्नवनगर , जिला मालदा , पश्चिम बंगाल को भविष्य में चीजों की तस्करी और तस्करी चीजों के परिवहन , छुपाने और रखने में संलिप्त होने से रोकने के उद्देश्य से हिरासत में लिया जाए और बेरहामपोर करेक्शनल होम , बेरहामपोर में अभिरक्षा में रखा जाए ।
2. जबकि केन्द्र सरकार के पास यह विश्वास करने के कारण हैं कि पूर्वोक्त व्यक्ति भगोड़ा है या अपने को छिपाये हुए है ताकि आदेश तामील न किया जा सके ।
2. Whereas the Central Government has reasons to believe that the aforesaid person has absconded or has been concealing himself so that the order cannot be executed.
3. Now, therefore, in exercise ofthe powers conferred by Clause (b) of sub - section ( 1 ) of Section 7 of the said Act, the Central Government hereby directs the aforesaid person to appear before the Director General of Police, Government of West Bengal , Kolkata within 7 days of the publication of this order in the Official Gazette .
3. अतः अब , कथित अधिनियम की धारा 7 की उप - धारा ( 1 ) के खण्ड ( ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार एतद्वारा पूर्वोक्त व्यक्ति को निदेश देती है कि सरकारी राजपत्र में इस आदेश के प्रकाशन की तिथि से सात दिन के अंदर वह पुलिस महानिदेशक , पश्चिम बंगाल सरकार , कोलकाता के सामने उपस्थितहो ।

का.आ. 369(अ).- जबकि, विदेशी मुद्रा संरक्षण और तस्करी निवारण अधिनियम , 1974 ( 1974 का 52 ) की धारा 3 की उप-धारा ( 1 ) के तहत विशेष रूप से अधिकार प्राप्त संयुक्त सचिव , भारत सरकार द्वारा कथित उप - धारा के तहत फाइल सं. 673/ 12/2012-सी. शु.- VIII से दिनांक 11-01-2013 को जारी आदेश के तहत निदेश दिया गया था कि श्री इक्रामुल सैख उर्फ इक्रामुल शैख पुत्र श्री रहीम शैख उर्फ रहीम सैख , निवासी- जोट चायपारा , पी.ओ. जायेनपुर , पी. एस. वैश्नवनगर , जिला मालदा , पश्चिम बंगाल को भविष्य में तस्करी चीजों के परिवहन , छुपाने और रखने में संलिप्त होने से रोकने के उद्देश्य से हिरासत में लिया जाए और बेरहामपोर करेक्शनल होम , बेरहामपोर में अभिरक्षा में रखा जाए ।
