सा.का.नि. 88 (अ).-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुकं द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सरकारी चिकित्सीय भंडार संगठन जीव विज्ञान प्रयोगशाला (समूह " क" पद ) भर्ती नियम, 1976 को जहां तक इसका संबंध निदेशक के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया। स्वास्थ्य और परिवार कल्याण मंत्रालय , स्वास्थ्य सेवाएं महानिदेशालय में और केंद्रीय औषधि परीक्षण प्रयोगशाला. चेन्नई में निदेशक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं. अर्थात- 1. संक्षिप्त नाम और प्रारंभः ( 1 ) इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्रालय , स्वास्थ्य सेवा महानिदेशालय ( निदेशक, केन्द्रीय औषधि , परीक्षण और प्रयोगशाला , चेन्नई ) भर्ती नियम , 2013 है ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा रोड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं।
3. भर्ती की पद्धति , आयु सीमा और अन्य अर्हताएँ उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के संतभ (5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट है ।

4. निरर्हताः वह व्यक्ति-
(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या;
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है;
उक्त पद पर नियुक्ति का पात्र नहीं होगाः-
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्तिः जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्तिः इन नियमों की कोई बात, ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों भूतवर्ग सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

स्पष्टीकारक ज्ञापनः तत्कालीन विद्यमान भर्ती नियमों के अनुसार उन्नयन से पूर्व 12000-16500 रूपए पूर्व पुनरीक्षित वेतनमान में निदेशक, केंद्रीय औषधि परीक्षण प्रयोगशाला चेन्नई का पद संघ लोक सेवा आयोग के माध्यम से सीधी भर्ती द्वारा भरा गया है और विद्यमान पदधारी 22 दिसंबर , 2019 को पद पर नियुक्त हुआ था। उपरोक्त उल्लिखित पद, स्वास्थ्य और परिवार कल्याण मंत्रालय के पत्र संख्यांक ए; 11013 / 1 / 2009-डीएफक्यूसी तारीख 13 जुलाई, 2010 द्वारा वेतन बैंड 4 धन ग्रेड वेतन 8700 रु. की पुनरीक्षण वेतन संरचना में उन्नत किया गया था जो उस तारीख से प्रभावी है जिसका भरा गया है भर्ती नियमों के संशोधन करने में असम्यक विलंब को देखते हुए यह सुनिश्चित करना आवश्यक हो गया है कि विद्यमान पदधारी का हित खतरे में न हो और उसे उन्नत पुनरीक्षित वेतन संरचना की मंजूरी और निरंतरता बनाए रखने के लिए उसमें विधि सम्मत अधिकार को प्रत्यावर्तित करने के लिए उसमे निर्धारण ओर संघ लोक सेवा आयोग द्वारा उपयुक्त पाए जाने के अधीन निदेशक , केंद्रीय औषधि परीक्षण प्रयोगशाला, चेन्नई के पद पर उन्नयन की तारीख 13 जुलाई , 2010 में उपयुक्तता के निर्धारण को ध्यान में रखते हुए इन नियमों की अनुसूची में स्तंभ ( 10 ) के अधीन उपबंध को भूतलक्षी प्रभाव देना न्यायोचित होगा। संशोधन को भूतलक्षी प्रभाव देने से सरकारी सेवकों के किसी सेक्शन या वर्ग पर प्रतिकूल प्रभाव नहीं पड़ेगा । î

NOTIFICATION
New Delhi , the 15th February, 2013
GS.R. 88(E). In exercise ofthe powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Government Medical Stores Organisation Biological Laboratory (Group A posts ) Recruitment Rules , 1976 in so far as it relates to the post of Director , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Director , Central Drugs Testing Laboratory , Chennai in the Ministry of Health and Family Welfare , Directorate General of Health Services , namely: -
1. Short title and commencement.- ( 1 ) These rules may be called the Ministry of Health and Family Welfare , Directorate General of Health Services , (Director , Central Drugs Testing Laboratory , Chennai ) Recruitment Rules , 2013 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post , classification, pay band , grade pay and pay scale . The number of post , its classification and the pay band, pay scale and grade pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .
3. Method of recruitment , age limit , qualifications , etc. The method of the recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns ( 5) to (13 ) of the said Schedule .

4. Disqualification.- No person , -
[PART II-SEC. 3 ( i) ]
(a) who , has entered into or contracted a marriage with a person having a spouse living; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post:
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order , in consultation with the Union Public Service Commission , and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .
6 . Saving. - Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Schedules Caste , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Union Public Service Commission for appointment to the upgraded post of Director in Pay band-4, pay scale of rupees (i) Doctorate Degree in Chemistry or Biochemistry or Pharmacy or Pharmaceutical Chemistry or Pharmacology or Bacteriology from a recognised University or Institute;
(ii) administrative experience and ability in Laboratory organisation.
Note 1.- Qualifications are relaxable at the discretion of the Union Public Service Commission incase of candidates otherwise well qualified.
37400-67000 with grade pay of rupees 8700 ; if assessed ' suitable ' , he shall be deemed to have beenappointed to the post at the initial constitution . If assessed ' not suitable ' for appointment to the upgraded scale of pay , he shall continue to be in the scale of pay band- 3, pay scale of rupees 15600-39100 with grade pay rupees 7600 and his casewould be reviewed every year.
Note 2.- The crucial date for determining the age limit shall be the closing date for receipt of applications from candidates in India (and not the closingdate prescribed for those in Assam, Meghalaya , Arunachal Pradesh , Mizoram, Manipur , Nagaland, Tripura , Sikkim , Ladakh Divisionof Jammu and Kashmir State , Lahaul and Spiti District and Pangi Sub-Division of Chamba District of Himachal Pradesh , Andaman and Nicobar Islands and Lakshadweep).
Note 2. The qualification regarding experience is relaxable at the discretion of the Union Public Service Commission in the caseof candidates belonging to the Scheduled Castes and the Scheduled Tribes if, at any stage of selection , the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

(II) . The departmental Senior Scientific Officer Grade I in the in the revised pay structure pay band- 3 , pay scale of rupees 15600-39100 with grade pay rupees 6600 with ten years ' service shall also be considered along with other candidates and in case he is selected , the post shall be deemed to have been filled by promotion .
Note 1.- The Departmental officers in the feeder category who are in the direct line of promotion will not be eligible forconsideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion . Note 2.- Period of deputation (short- term contract ) including period of deputation in another ex -cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed five years . The maximum age limit for appointment by deputation (including short-term contract) shall be not exceeding fifty - six years as on the closing date of the receipt of application .

"Explanatory Memorandum: The post of Director , Central Drugs Testing Laboratory. Chennai in the pre -revised scale of pay of rupees 12000-16500 /-- prior to up- gradation has been filled up by direct recruitment through the Union Public Service Commission in accordance with the then existing recruitment rules and the existing incumbent was appointed to the post with effect from the 22nd December, 2009. The afore-mentioned post was upgraded to the revised pay structure in pay band 4 plus grade pay of rupees 8700/- vide the Ministry of Health and Family Welfare letter No.A.11013 /1 /2009- DFQC , dated the 13th July, 2010 which is effective from the date the upgraded post is filled up . Following the undue delay in making amendment to the recruitment rules, it has become necessary to ensure that the interest of the existing incumbent is not jeopardised and in order to restore his legitimate right for grant of upgraded revised pay structure to him and to maintain continuity , it will be justified to give retrospective effect to the provision under column(10) of the Schedule to these rules with regard to assessment of suitability with effect from the 13th July, 2010, the date of up- gradation of the post of Director , Central Drugs Testing Laboratory, Chennai subject to his being assessed and found suitable by the Union Public Service Commission . The retrospective effect given to the amendment will not affect any section or class of Government servants adversely. "
