का.आ. 403(अ).-यतः, केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खण्ड ) की अधिसूचना संख्या 465 ( अ ) , तारीख 26 अप्रैल , 2002 द्वारा आंध्र प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 7 के 34.800 कि.मी. से 463.632 कि.मी. ( हैदराबाद- कर्नाटक/ आंध्र प्रदेश सीमा सेक्शन ) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् " प्राधिकरण " संदर्भित किया गया है ) को सौंपा है;
और यतः , केन्द्रीय सरकार ने , राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार की अधिसूचना द्वारा खंडों का प्रयोग के लिए यांत्रिक वाहनों पर निम्नानुसार शुल्क उद्ग्रहीत एवं संग्रहीत करने हेतु प्राधिकरण को प्राधिकृत किया था;
( 1 ) आंध्र प्रदेश राज्य में राष्ट्रीय राजमार्ग -7 पर 211.000 कि.मी. से 295.000 कि.मी. तक के खण्ड हेतु का.आ. सं. 1937 ( अ) , तारीख 22 अगस्त , 2012 द्वारा
( 2 ) आंध्र प्रदेश राज्य में राष्ट्रीय राजमार्ग -7 पर 295.000 कि.मी. से 374.000 कि.मी. तक के खण्ड हेतु का.आ. सं. 1340 ( अ ) , तारीख 7 जून , 2010 द्वारा
(3 ) आंध्र प्रदेश राज्य में राष्ट्रीय राजमार्ग -7 पर 374.000 कि.मी. से 462.164 कि.मी. तक के खण्ड हेतु का.आ. सं. 1835 ( अ ) , तारीख 14 अगस्त, 2012 द्वारा
और यतः , प्राधिकरण ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 ( 1988 का 68 ) की धारा 14 के प्रावधान के अनुसरण में, मैसर्स एमइपी हैदराबाद - बंगलौर टोल रोड प्रा.लि. जो 31-10-2011 को प्रस्तुत की गयी बोलियों के सफल बोलीदाता हैं, जिनका पंजीकृत कार्यालय 410 बूमरैंग, चांदीवली फार्म रोड, चांदीवली स्टूडियो के पास , अंधेरी ईस्ट -400072 , महाराष्ट्र में है ( जिसे इसमें इसके पश्चात् " रियायतग्राही " संदर्भित किया गया है ) के साथ प्रचालन , अनुरक्षण और हस्तांतरण ( ओएमटी ) आधार पर राष्ट्रीय राजमार्ग संख्या 7 के 211.000 कि.मी. 462.164 कि.मी. , हैदराबाद- बंगलौर सेक्शन ( जिसे इसमें इसके पश्चात् " उक्त खण्ड " कहा गया है ) , के विकास हेतु एक करार किया है ( जिसे इसमें इसके पश्चात् उक्त करार कहा गया है )

अतः अब केन्द्रीय सरकार समय - समय पर यथासंशोधित , राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण ) नियम, 2008 ( जिसे इसमें इसके प्रश्चात् " नियम" कहा गया है ) , के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचनाओं संख्या का.आ. 1937 (अ ) तारीख 22 , अगस्त, 2012 का.आ.1340 ( अ ) तारीख 7 जुन, 2010 और का. आ. 1835 (अ ) , तारीख 14 , अगस्त, 2012 का अधिक्रमण करते हुए , सिवाय उन बातों के ऐसे अतिक्रमण से पहले कर ली गई है या करने से लोप करा दी गई हों, उक्त खण्ड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन पर हुए व्यय , निवेशित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम, यात्रा का परिमाण तथा प्राधिकरण और रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए , एतद्वारा यह अधिसूचित करती है कि उक्त खण्ड के उपयोग हेतु यांत्रिक वाहनों पर सड़क खण्ड की निवल लम्बाई 208.303 किमी के लिए चार या अधिक लेन के प्रयोग पर सहमति 1 के स्तम्भ ( 2 ) में विनिर्दिष्ट दर पर ( जिसे इसमें इसके पश्चात् "आधार दर " कहा गया है ) , और दस करोड़ रूपये या अधिक की लागत वाले बाईपासों के उपयोग के लिए नीचे सारणी 1 के स्तम्भ (1 ) में विनिर्दिष्ट प्रकार के वाहनों पर आधार दर के डेढ़ गुना के हिसाब से शुल्क उद्ग्रहीत तथा संग्रहीत किया जायेगा , और उक्त रियायतग्राही को वाणिज्यिक प्रचालन की तारीख को और उस तारीख से अथवा इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, जो भी बाद में हों, समापन की तारीख तक , जैसा कि करार में निर्दिष्ट किया गया है । शुल्क को संग्रहित और उसे प्रतिधारित करने के लिए प्राधिकृत करती है;

1. नीचे उद्ग्रहीत तथा संग्रहीत शुल्क, निम्नलिखित टोल प्लाजा पर ऐसे टोल प्लाजाओं के लिए विनिर्दिष्ट दूरी हेतु शोध्य और संदेय होगा;

3. जिस व्यक्ति का अपना यांत्रिक वाहन गैरवाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से 20 कि.मी. तक की दूरी में ही रहता हो उसके लिए वर्ष 2012-13 के लिए मासिक पास की दर 200.00 रूपए (दो सौ रूपए मात्र ) होगी और राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जाएगा ।
4. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जायेगा, अर्थात्ः संदेय धनराशि

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर ) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।
6. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
7. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार , छूटप्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
9. ऊपर सारणी 1 में यथा उल्लिखित , आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा तथा उसे, तदनुसार , अंग्रेजी और स्थानीय भाषा के कम - से - कम एक-एक समाचारपत्र में प्रकाशित किया जाएगा ।

NOTIFICATION
New Delhi , the 18th February, 2013
S.O. 403 ( E) -Whereas by notification of the Government of India in the Ministry of Surface Transport (Roads Wing ) number S.O. 465 ( E) , dated the 26th April , 2002, issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) , the Central Government has entrusted the stretch from kilometer 34.800 to kilometer 463.632 ( Hyderabad Karnataka / Andhra Pradesh Border Section ) of National Highway No. 7 in the State of Andhra Pradesh to the National Highways Authority of India ( hereinafter referred to as the " Authority " ) ;
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with National Highway Fee ( Determination of Rates and Collection ) Rules 2008 , the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows :
(i ) Vide S.O. No. 1937 ( E) dated 22nd August , 2012 for the stretch from km . 211.000 to km . 295.000 on NH - 7 in the State of Andhra Pradesh .
( ii ) Vide S.O. No. 1340 ( E ) dated 7th June , 2010 for the stretch from km . 295.000 to km . 374.000 on NH - 7 in the State of Andhra Pradesh .
( iii ) Vide S.O. No. 1835 (E) dated 14th August, 2012 for the stretch from km . 374.000 to km 462.164 on NH - 7 in the State of Andhra Pradesh .
And whereas , pursuant to the provision of section 14 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) , the Authority has entered into an Agreement ( hereinafter referred to as said agreement ) with M/s MEP Hyderabad Bangalore Toll Road Pvt . Ltd. , having its registered office at 410 Boomerang , Chandivali Farm Road , Near Chandivali Studio , Andheri East 400 072 , Maharashtra (hereinafter referred to as the " Concessionaire " ) , the successful bidder for bids . submitted on 31.10 . 2011 for the development of Hyderabad Bangalore section from Km 211.000 Km 462.164 on National Highway No. 7 ( hereinafter referred to as the " said section " ) on Operate , Maintain and Transfer (OMT) basis .
Now , therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 ( 48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008 and amended from time to time (hereinafter referred to as the " Rules " ) , and in supersession of the notifications of the Government of India in the Ministry of Road Transport and Highways number S.O. 1937 ( E ) , dated the 22nd August , 2012 , S.O. 1340 ( E ) , dated the 07th June, 2010 and S.O. 1835 ( E ) , dated the 14th August , 2012 except as respects things done or omitted to be done before such supersession , the Central Government , having regard to the expenditure involved in building , maintenance , management and 67045713-2 6

operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2 ) of the Table 1 for net road section length of 208.303 Kms for use of the four and more lane sections ( hereinafter referred to as " base rate " ) and at one and one half times the base rate for bypasses costing Rupees ten Crore or more on the Type of Vehicles specified in column ( 1) of the Table 1 below , and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the agreement ;

The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 (Rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008 .
4. For multiple journey on the highway section , passes shall be issued at the following rates , namely .

5. Feefor commercial vehicle (excluding vehicles plying under national permit ) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle .
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
7 . All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road, alternative road etc. shall be as per definitions specified in the Rules .
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .
9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table - 1 , the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper , each in English and vernacular language accordingly, provided that no revision shall be effected within six months .
