का.आ. 399(अ). यद्यपि केन्द्र सरकार ने पटसन पैकेजिंग सामग्री (पैकिंग मदों में अनिवार्य उपयोग) अधिनियम 1987 ( जिसे इसके बाद जेपीएम अधिनियम कहा जाएगा) की धारा 3 के प्रावधानों के अधीन जारी दिनांक 31 अक्तूबर , 2012 के आदेश सं. का.आ.2659(ई) (जिसे इसके पश्चात मूल आदेश कहा जाएगा) के द्वारा खाद्यान्नों के लिए एचडीपीई/पीपी बोरों की 3.5 लाख गाठों की अग्रिम छूट देने के पश्चात पटसन वर्ष 2012-13 के लिए आरक्षित चीनी के उत्पादन का 40 प्रतिशत और खाद्यान्नों के उत्पादन का 90 प्रतिशत पटसन पैकेजिंग सामग्री में पैक किया जाएगा । उक्त मूल आदेश की वैधता 30.06.2013 तक है ।
तथा, यद्यपि जेपीएम अधिनियम की धारा 16( 1 ) के प्रावधानों के अधीन केन्द्र सरकार , यदि यह राय रखती हो कि ऐसा करना सार्वजनिक हित में अनिवार्य अथवा लाभप्रद हो , किसी व्यक्ति अथवा व्यक्तियों के वर्ग को किन्हीं मदों अथवा मदों की श्रेणी के लिए आपूर्ति करने अथवा वितरण करने से इस अधिनियम की धारा 3 के अधीन निर्मित आदेश के प्रचालन से छूट दे सकती है ।
तथा, यद्यपि, केन्द्र सरकार ने दिनांक 2 जनवरी , 2013 के आदेश संख्या का.आ.26(ई ) के तहत जेपीएम अधिनियम की धारा 16( 1 ) के अंतर्गत अपनी शक्ति का प्रयोग करते हुए राज्य की एजेन्सियों को पटसन वर्ष 2012-13 के दौरान जनवरी- मार्च , 2013 तक की अवधि के लिए 3.48 लाख गांठ की कुल मात्रा तक मूल आदेश के प्रचालन की छूट प्रदान कर दी है (और इस प्रकार पटसन के अलावा सामग्री में खाद्यान्न की पैकिंग के लिए अनुमति प्रदान कर दी है)
तथा, यद्यपि, खाद्य एवं सार्वजनिक वितरण विभाग ने सूचित किया है कि आरएमएस 2013-14 में जनवरी , 2013 तक 5.52 लाख गांठ की मांग की तुलना में पटसन उद्योग ने पटसन के बोरों का केवल 5.08 लाख गांठ की आपूर्ति की है जिससे 0.44 लाख गांठ की कमी हुई है और इसलिए अनुरोध है

कि वस्त्र मंत्रालय की मौजूदा नीतिगत अधिसूचना के अनुसार आरएमएस 2013-14 के दौरान गेहूं की खरीद के लिए उपयोग किए जाने वाले एचडीपीई/पीपी बोरों (आरएमएस 2013-14 के लिए पहले ही प्रदान की गई छूट के अलावा) के 0.44 लाख गांठ का उपयोग करने के लिए और छूट प्रदान की जाए ।
तथा, यद्यपि केन्द्र सरकार ने पटसन आयुक्त, कोलकाता के परामर्श से पटसन वर्ष 2012-13 के लिए खाद्यान्न की पैकिंग के लिए बी.ट्विल पटसन बोरों की अनुमानित मांग तथा सरकारी खरीद एजेन्सियों को आपूर्ति के संबंध में पटसन उद्योग की तदनुरूपी अनुमानित आपूर्ति क्षमता की समीक्षा की है।
अब, इसलिए , केन्द्र सरकार की राय है कि दिनांक 2 जनवरी , 2013 के इस मंत्रालय के आदेश संख्या का.ओ.26(ई) का अधिक्रमण करते हुए जनहित में तथा जेपीएम अधिनियम की धारा 16 ( 1 ) के प्रावधान के तहत शक्तियों का प्रयोग करते हुए ऐसा करना एतदद्वारा राज्य एजेंसियों को पटसन वर्ष 2012-13 के लिए 3.92 लाख गांठ की कुल मात्रा तक मूल आदेश के प्रचालन से छूट देना (और इस प्रकार खाद्यानों की पैकिंग के लिए पटसन के अलावा अन्य सामग्री की अनुमति देना) एवं खरीदना आवश्यक अथवा उचित है ।
(i) 31 जनवरी , 2013 तक एचडीपीई/पीपी बोरों की संचयी 1.27 लाख गांठ से अधिक नहीं ।
(ii) 28. फरवरी , 2013 तक ( जनवरी-फरवरी के लिए) एचडीपीई/ पीपी बोरों की संचयी 3.43 लाख गांठों से अधिक नहीं ।
(iii) 31 मार्च , 2013 ( जनवरी- मार्च के लिए) तक एचडीपीई/ पीपी बोरों की संचयी 3.92 लाख गांठ से अधिक नहीं ।
एचडीपीई/पीपी बोरों के समग्र आदेश 10 मार्च, 2013 तक प्रस्तुत किए जायेंगें और आपूर्तियां 31 मार्च , 2013 तक पूरी की जाएंगीं ।
प्रस्तावित छूट चालू पटसन वर्ष के लिए ऐसी एजेंसियों द्वारा की गई खाद्यान की कुल खरीद के 30 प्रतिशत की सीमा के भीतर होगी । इस पर यह शर्त भी होगी कि एचडीपीई/ पीपी बोरों का उपयोग केवल अत्यावश्यकता की स्थिति में अर्थात मांगकर्ताओं / राज्य एजेंसियों द्वारा पटसन बोरों के लिए समय पर अनुमानित मासिक इंडेट (आर्डर) दिए जाने के बावजूद भी पटसन बोरे उपलब्ध न होने की स्थिति में किया जाएगा और राज्य एजेंसियों द्वारा एचडीपीई और पटसन बोरों का अंतिम शेष केंद्र सरकार को सूचित करना होगा । इस प्रयोजनार्थ एचडीपीई/ पीपी बोरों की खरीद के लिए राज्य एजेंसी- वार, माह-वार बंटवारा खाद्य तथा सार्वजनिक वितरण विभाग द्वारा वस्त्र मंत्रालय के परामर्श से समय - समय पर इस आदेश में निहित मानदण्डों के अंतर्गत किया जाएगा ।
इसके अलावा , चूंकि यह छूट पैकिंग की अनुमानित मांग के आधार पर दी जाती है , अतः पूर्वानुमानों अथवा राज्य एजेन्सियों से वास्तविक मांग / इंडैंट्स में परिवर्तनों को देखते हुए इसे संशोधित अथवा कम किया जाए ।

ORDER
New Delhi , the 18th February, 2013
S.O. 399 (E ). Whereas the Central Government vide Order No. S.O.2659 (E ) dated 31st October, 2012 ( hereinafter referred to as the Principal Order) issued under the provision of section 3 of the Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (hereinafter referred to as the JPM Act) reserved a minimum of 40% of the production of sugar & 90% of the production of foodgrains , after providing for upfront exemption of 3.5 lakh bales of HDPE /PP bags for foodgrains shall be packed in jute packaging material for the jute year 2012-13 . The validity of the said Principal Order is upto 30.06.2013 .
And, whereas , under the provisions of Section 16(1 ) of the JPM Act , the Central Government, if it is of the opinion that it is necessary or expedient so to do in the public interest, may exempt any person or class of persons , supplying or distributing any commodity or class of commodities , from the operation of an order made under Section 3 of the Act .
And, whereas , the Central Government in exercise of its power under section 16( 1 ) of the JPM Act , vide Order No. S.O. 26 (E) , dated 2nd January , 2013 have exempted the state agencies from the operation of Principle Order ( and thus allowing for packaging foodgrains in material other than jute) upto the extent of a total quantity of 3.48 lakh bales for the period from January -March , 2013 during jute year 2012-13 .
And, whereas , the Department of Food & Public Distribution has informed that against the demand of 5.52 lakh bales upto January 2013 in RMS 2013-14, the jute industry has supplied only 5.08 lakh bales of jute bags leaving a shortage of 0.44 lakh bales and hence requested that further exemption to use 0.44 lakh of HDPE/PP bags ( over and above already relaxed for RMS 2013-14) to be used for wheat procurement during RMS 2013-14 in accordance with the existing policy notification of the Ministry of Textiles .
And, whereas, the Central Government has reviewed the projected demand of B.Twill jute bags for packing foodgrains for jute year 2012-13 and the corresponding projected supply capacity ofjute industry in respect of supply to the Government procurement agencies in consultation with Jute Commissioner , Kolkata .
Now, therefore, the Central Government being of the opinion that it is necessary or expedient so to do in the public interest, and in exercise of the powers under the provision of Section 16 ( 1 ) of the JPM Act, hereby in supersession of this Ministry's Order No. S.O. 26 (E ) , dated 2nd January, 2013 , exempt the State Agencies from the operation of the Principal Order (and thus allowing for packaging foodgrains in material other than jute ) upto the extent of a total quantity of 3.92 lakh bales for the jute year 2012-13 to be procured as under:
(i) Not more than a cumulative of 1.27 lakh bales of HDPE/PP bags upto 31st January, 2013 .
(ii) Not more than a cumulative amount of 3.43 lakh bales of HDPE/PP bags ( for January - February) upto 28th February , 2013 .
(iii) Not more than a cumulative amount of 3.92 lakh bales of HDPE /PP bags ( for January -March) upto 31st March, 2013 .

The entire orders of HDPE/PP bags shall be placed by 10th March, 2013 and supplies shall be completed by 31st March, 2013 .
The proposed relaxation would be within the limit of 30 % of the total procurement of foodgrain made by such agencies for the current jute year . It is subject to the condition that the HDPE /PP Bags would be used only in case of emergency i.e. only when and to the extent the Jute bags are not available inspite of the indentors / State agencies having placed the projected monthly indents for Jute bags in time and the closing balance of HDPE and Jute Bags would need to be furnished by the State Agencies to the Central Government. The State/Agency wise , month wise apportionment of procurement of HDPE /PP bags would be done by the Department of Food & Public Distribution within the parameters contained in this order from time to time in consultation with the Ministry of Textiles.
Further, since this exemption is allowed on the basis of the projected demand for packing material , it may be modified or reduced in view of the changes in projection or of the actual demand/ indents from the State Agencies .
