फा. सं. आईआरडीए /रेग्यु/ 11 /69 /2013. बीमा विनियामक और विकास प्राधिकरण अधिनियम, 1999 ( 1999 का 41 ) के खंड 14 और 26 ( 2 ) ई के साथ बीमा अधिनियम , 1938 ( 1938 का 4 ) की 114ए के खंड 2 जेड डी द्वारा प्रदत्त शक्तियों के प्रयोग में बीमा सलाहकार समिति के साथ विचार विमर्श कर प्राधिकरण एतद्वारा निम्नलिखित नियम बनाता है :-
1. संक्षिप्त नाम और प्रारम्भ
i. इन नियमों को बीमा विनियामक और विकास प्राधिकरण (व्यापार स्थल) विनियम 2013 के नाम से जाना जाएगा।
ii . यह विनियम राजपत्र में प्रकाशन की तिथि से प्रभावी होगा ।
2. परिभाषाएँ (i ) जब तक कि संदर्भ से अन्यथा अपेक्षित न हो -
क) अधिनियम का मतलब बीमा अधिनियम 1938 (1938 का 4 )
ख) सलाहकार समिति का मतलब इरडा अधिनियम (1999 का 41 ) की धारा 25 के अंतर्गत गठित सलाहकार समिति।
ग) प्राधिकार का मतलब आईआरडीए अधिनियम (1999 का 41) 1999 के खंड 3 के उपखंड ( i ) में वर्णित बीमा विनियामक और विकास प्राधिकरण ।
घ) रिटर्न का अर्थ इन नियमों के तहत वर्णित रिटर्न ।
ड) 'अधिनियम' का मतलब बीमा विनियामक और विकास प्राधिकरण (व्यापार स्थल ) विनियम 2013 |
3. वैसे शब्द या भाव जो यहाँ प्रयुक्त किए गए है किन्तु अपरिभाषित हैं, उसके लिए बीमा अधिनियम 1938 (1938 का 4) या जीवन बीमा निगम अधिनियम 1956 (1956 के 31 ) या सामान्य बीमा व्यवसाय (राष्ट्रीयकरण)

अधिनियम, 1972 ( 1972 का 57) या बीमा विनियामक और विकास प्राधिकार अधिनियम 1999 (1999 का 41 ) में वर्णित समान शब्दों के भाव को जरूरत के मुताबिक लिया सकता है ।
4. धारा 64 वी सी की आवश्यकताओं को पूरा करने के क्रम में सभी बीमा कंपनियाँ इन अधिनियमों का अनुपालन करेंगी ।
5. प्रत्येक वित्तीय वर्ष के लिए सभी बीमा कंपनियों के पास उनके बोर्ड के द्वारा अनुमोदित 'वार्षिक व्यवसाय योजना' होनी चाहिए । उनके वार्षिक व्यवसाय योजना में व्यवसाय योजना के अतिरिक्त वैसे भी प्रस्ताव अनुमोदित होने चाहिए जिनमें न केवल शहरी बल्कि उप- नगरीय एवं ग्रामीण क्षेत्रों में भी व्यवसाय के नए स्थल/ कार्यालय खोलने का प्रावधान हो ।
6. अधिनियम 8 (ii ) में वर्णित नियमों के अलावा, आगामी वित्तीय वर्ष में खुलने वाले उन कार्य / व्यापार स्थलों का उल्लेख ' वार्षिक व्यवसाय योजना' में स्पष्ट रूप से होना चाहिए जिन्हें धारा 64 वीसी के तहत अनुमोदन करने की जरूरत हो ।
7. प्रत्येक बीमा कंपनी अपने बोर्डो द्वारा अनुमोदित आगामी 'वार्षिक व्यवसाय योजना' को हर वित्तीय वर्ष की प्रथम तिमाही के अंत (30 जून तक ) प्राधिकार के विचारार्थ प्रस्तुत करेगा ।
8. ( i ) अधिनियम की धारा 64 वीसी के प्रावधानों के अंतर्गत प्रस्तावित नए कार्य / व्यवसाय स्थलों पर विचार करते समय प्राधिकार बीमा कंपनियों के साथ सलाह मशविरा करते हुए निर्दिष्ट वित्तीय वर्ष के कुल प्रस्तावित स्थानों के अनुमोदन पर विचार करेगा । बीमा कंपनियों की व्यावसायिक रणनीतियों एवं विस्तार कार्यक्रम पर प्रत्येक वर्ष चर्चा की जाएगी ।
क) वार्षिक व्यवसाय योजना में निर्दिष्ट व्यापार के स्थानों पर विचार करने के बाद प्राधिकार उसे अनुमति देगा या नहीं देगा ।
ख) व्यापार के नए स्थानों को खोलने के लिए प्राधिकार द्वारा अनुमोदन से इंकार की स्थिति में बीमा कंपनियाँ उसी प्रस्ताव पर उचित कारण बताते हुए पुनर्विचार के लिए तीन महीने बाद भेज सकती है ।
ग) चालू वित्तीय वर्ष के दौरान भी बीमा कंपनियाँ अपने बोर्ड द्वारा अनुमोदित योजना में नए स्थानों को शामिल करने या वार्षिक व्यापार योजना में प्रस्तावित व्यापार के स्थानों में उचित संशोधन करने हेतु प्राधिकार को भेज सकती है ।
(ii ) अधिनियम 8 ( i ) में वर्णित नियमों के बावजूद , वैसी सभी बीमा कंपनियों को 2011 की जनगणना (या ऐसी अन्य जनगणना जो भविष्य में हो सकती है ) के आधार पर टीयर ॥ एवं निम्नस्तरीय स्थानों पर अपने कार्य / व्यापार स्थल खोलने की अनुमति दी जाती है जो निम्न वर्णित शर्तों को पूरा करते हैं -
घ) गत वर्ष उनकी न्यूनतम शोधन क्षमता 1.50 या ऐसे अनुपात में हो जो प्राधिकार द्वारा समय- समय पर निर्धारित की गई हो।
ड) बीमा कंपनी के गत वर्ष का प्रबंधन व्यय , बीमा नियम 1939 में वर्णित 17 डी एवं 17 ई के मानदंडों के नियमानुकूल हो अथवा बीमा अधिनियम की धारा 40 बी एवं 40 सी में उल्लिखित एवं समय - समय पर संशोधित शर्तों को पूरा करता हो ।
9. अधिनियम 8 ( i ) के अनुसार नए खोले जाने वाले प्रस्तावित कार्य / व्यापार स्थल का नाम फार्म पीबीआई (अनुसूची-1) में उल्लेख करें । बोर्ड द्वारा अनुमोदित/ संशोधित वार्षिक व्यवसाय योजना एवं गत तीन वर्षों की कंपनी की शोधन क्षमता अनुपात एवं प्रबंधन व्यय (बीमा नियम 1939 के नियम 17 डी/ई के अनुसार) की प्रति [ भाग III-खण्ड 4 ]

3 10. अधिनियम 8 (i ) के अनुसार कार्य / व्यापार स्थल को खोलने का प्रस्ताव रखने अथवा 8 ( ii ) के अनुसार कार्य/ व्यापार स्थल खोलते समय सभी बीमा कंपनियाँ उस स्थान पर लंबे समय तक बीमा कारोबार करने का मामला ध्यान में रखेगी एवं कम अवधि के लिए कार्य / व्यापार स्थल खोलने से बचेंगी ।
11. अधिनियम 8 ( i ) के तहत प्रस्तावित एवं प्राधिकार द्वारा अनुमोदित नए कार्य / व्यापार स्थलों को अनुमोदन की तिथि अथवा 30 जून से जो भी बाद में हो, एक वर्ष के भीतर खोला जाना चाहिए । ज्ञात हो कि -
क) समय सीमा समाप्त होने के बाद अनुमोदन को कालातीत ( लैप्स) माना जाएगा ।
ख) समय सीमा के अंदर न खोले गए शाखाओं को आगामी वित्तीय वर्ष में बीमा कंपनियाँ चाहे तो अपने नए प्रस्ताव में जोड़ सकती हैं ।
12. बीमा कंपनियाँ अपने मासिक प्रतिवेदन में कार्य / स्थल के खोले जाने की सूचना, खोलने की तिथि के साथ, प्राधिकार के पीबी-2 फार्म में अगले महीने की 15 तारीख के अंदर भेजेगी ।
13. बीमा कंपनियाँ यह सुनिश्चित करेगी कि सभी नए खोले गए कार्य / व्यापार स्थलों (क्षेत्रीय कार्यालयों, बैंक अप कार्यालयों को छोड़कर) पर पॉलिसी धारकों हेतु न्यूनतम सेवाएँ यथा प्रीमियम जमा, प्रस्ताव पत्र जमा एवं पॉलिसी संबंधी सेवाएँ आदि की सुविधा हो ।
14. (i ) कार्य / व्यापार स्थल के बंद या उसी क्षेत्र में स्थानांतरित करने के संबंध में बीमा कंपनियाँ , बीमा धारकों को होने वाली संभावित सभी असुविधाओं का ध्यान रखेंगी तथा निम्नलिखित अनुदेशों का पालन करेगी ।
क ) धारा 64 वीसी के अंतर्गत अनुमोदन होने योग्य सभी प्रकार के कार्यस्थल जिन्हें बंद या पुनर्भवस्थित किया जाता है, उसे बीमा कंपनियों के अपने संबंधित बोर्ड का पुर्वानुमोदन अनिवार्य है ।
ख) धारा 64 वीसी के तहत पुनर्भवस्थित होने वाले वैसे सभी कार्य / व्यापार स्थल की सूची प्राधिकार के पास (आवश्यकतानुसार) विचारार्थ भेजी जानी चाहिए ।
ग) कार्य / व्यापार स्थलों के बंद या पुनर्भवस्थित किए जाने की सूचना संबंधित पॉलिसी धारकों को दो महीने पूर्व में दी जानी चाहिए एवं साथ ही उन्हें पॉलिसी सेवा संबंधी, वैकल्पिक सुविधाओं की भी जानकारी देनी चाहिए ।
(ii ) विदित हो कि अधिनियम 8 ( ii ) के अंतर्गत बीमा कंपनियों द्वारा खोले जाने वाले
कार्य / व्यापार स्थलों के लिए भी अधिनियम 14 (i ) लागू होगा ।
( iii ) यदि प्राधिकार को यह सूचना मिलती है या ज्ञात होता है कि किसी कार्य / व्यापार स्थल को बंद या
पुनर्स्थापित करने का निर्णय, बंद या पुनर्भवस्थित करना, वर्णित अधिनियमों के तहत नहीं हुआ है तो प्राधिकार सभी संबंधित परिस्थितियों पर विचार करते हुए बीमा कंपनी को यथोचित निर्देश दे सकता है ।
15. कार्यस्थल के पुनर्भवस्थित किए जाने संबंधी विवरण (नया पता, पुनर्स्थापित होने की तिथि आदि ) फार्म पीबी -2 अनुसूची 1 में भरकर आगामी महीने के 15 दिनों के अंदर प्राधिकार को भेजी जानी चाहिए ।
16. कार्यस्थल के बंद होने की सूचना फार्म पीबी-2 अनुसूची 1 में भरकर आगामी महीने के 15 दिनों के अंदर प्राधिकार को भेजी जानी चाहिए ।
17. एक समेकित मासिक आंकड़े (प्रतिवेदन) फार्म पीबी -2 अनुसूची 1 में भरकर आगामी महीने के 15 दिनों के अंदर प्राधिकार को भेजी जानी चाहिए ।
18. प्राधिकार, जरूरत पड़ने पर इस अधिनियम के अंतर्गत और भी कोई आंकड़े समय - समय पर मांग सकता है ।

INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY
NOTIFICATION
Hyderabad , the 16th February, 2013
Insurance Regulatory and Development Authority ( Places of Business) Regulations , 2013 F. No. IRDA/Reg ./11/ 69/2013 . In exercise of the powers conferred by section 114A (2 ) (zd) of the Insurance Act, 1938 ( 4 of 1938 ) read with sections 14 and 26 (2 ) (e ) of the Insurance Regulatory and Development Authority Act , 1999 (41 of 1999) the Authority in consultation with the Insurance Advisory Committee , hereby makes the following regulations , namely: -
1. Short title and commencement - ( 1 ) These regulations shall be called the Insurance Regulatory and Development Authority ( Places of Business) Regulations , 2013.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions- (1 ) Unless the context otherwise requires ,
(a) " Act" means the Insurance Act , 1938 (4 of 1938) ;
(b) "Advisory Committee " means the Advisory Committee constituted under section 25 of the Insurance Regulatory and Development Authority Act ( 41 of 1999) ;
(c) "Authority " means the Insurance Regulatory and Development Authority established under sub - section (1) of section 3 of Insurance Regulatory and Development Authority Act , 1999 (41 of 1999 ) ;
(d) "Return " means the returns specified under these regulations ;
( e) " Regulations " means Insurance Regulatory and Development Authority (Places of Business ) Regulations , 2013 ;
(3) Words and expressions used and not defined in these regulations but defined in the Insurance Act , 1938 (4 of 1938) , or the Life Insurance Corporation Act, 1956 (31 of 1956) or the General Insurance Business (Nationalisation ) Act, 1972 (57 of 1972 ) , or Insurance Regulatory and Development Authority Act, 1999 (41 of 1999) shall have the meanings respectively assigned to them in those Acts or the rules and regulations made thereunder , as the case may be .
(4) All the Insurers shall follow these regulations while complying with the requirements of Section 64 VC of the Act.
(5) All the Insurers shall have in place the Board approved Annual Business Plan for every Financial Year . The Annual Business Plan, in addition to the business plans of the Insurer, shall contain the proposals, if any , for opening new places of business taking into account the need for opening new places of business not only in the urban centers but also in semi - urban and rural centers .
(6) The Annual Business Plan shall specifically contain all the names of places of business proposed to be opened, other than those referred at Regulation 8 ( ii ) , during the ensuing Financial Year for which an approval is required in accordance to the provisions of Section 64 VC of the Act .
(7) Every insurer shall submit their respective Board approved Annual Business Plan for the Financial Year April - March before the end of its first Quarter , that is , by June 30th of the same financial year for consideration of the Authority.
(8) ( i ) While considering applications for new places of business in accordance to the provisions of Section 64 VC of the Act, the Authority considers according aggregate approvals on an annual basis , through a consultative and interactive process . Discussions will be held every Financial Year , with the insurers on their business strategies and expansion programme.

a. The Authority after considering the places of Business specified in the Annual Business Plan may grant or deny permission.
b. In the event of denial of approval by the Authority for opening new places of business , the insurer may seek a review of the decision after three months bringing in valid reasons for reconsideration ofthe same.
C. Insurers are also permitted to file the Board approved incremental or modified Business Plans during the course of Financial Year for incorporating new places of business or for modifying the places of business proposed in the Annual Business Plan .
ii. Notwithstandinganything contained in Regulation 8 ( i ) , all the Insurers that fulfill the following conditions are permitted to open the places of business in Tier -2 and below centers , as per 2011 Census classification or such other census classification that may be adopted in future which is corresponding to Tier 2 and below centers ' classification of Census 2011 and inform the Authority in accordance to Regulation (12) of these Regulations .
a. An Insurer shall have a minimum Solvency Ratio of at least 1.50 or such ratio as prescribed by IRDA from time to time, in the preceding Financial Year .
b. Expenses of Management of the Insurer is within the applicable norms prescribed in Rule 17D and Rule 17 E of Insurance Rules , 1939 , as the case may be or any other conditions as specified by IRDA from time to time in accordance to the provisions of Section 40 B and 40 C of Insurance Act, 1938 in the preceding Financial Year.
(9) Proposals for opening places of business referred at Regulation 8 (i ) shall be submitted in Form - PB 1 of Schedule 1 of these regulations along with the copy of Board approved Annual Business Plan / Modified Annual Business Plan , Statement of Solvency Ratios and Expenses of Management ( Refer Rule 17 D/E of Insurance Rules , 1939) for the preceding three Financial Years .
(10) While submitting the proposals for opening new places of business referred at Regulation 8 ( i ) and while opening places of business referred at Regulation 8 ( ii ) , all the insurers shall keep in view the long - term nature of insurance business that warrants the continuous presence in the new places of business throughout and shall avoid opening the new places of business for shorter durations .
(11) ( i ) New places of business proposed at Regulation 8 ( i ) and approved by the Authority shall be opened within a period of one year from the date of approval letter of the Authority or from June 30th of the Financial Yearwhichever is later .
a. After the expiry of the time limit, the approval stands lapsed.
b. Insurers may incorporate those places of business that could not be opened within the stipulated time prescribed at Regulation ( 11 ) ( i ) in the succeeding Annual Business Plans .
(12) Insurers shall submit to the Authority, the monthly statistics , as returns , on the places of business along with date of opening of the newplace of business , in Form - PB 2 within fifteen days of the succeeding month .
(13) All the new places of business opened shall at minimum offer policy holders ' services such as collection of premiums /proposal deposits and attending policy service requests .
a. However, Insurers may seek exemption at the time of seeking approval , from the applicability of these provisions in respect of those places of business that do not have any customer interface , like regional offices , back up centers etc.
(14) ( i ) Closure or relocation of the places of business , shall be after due consideration of all the factors , including the possible inconvenience to its policyholders . All the Insurers shall comply the following while closing or relocating the places of business .

a. Closure of places of business or relocation of places of business , requiring to be approved by the Authority in accordance to the provisions of Section 64 VC of the Act , shall be approved by the respective Boards of Insurers in advance .
b. Relocation of places of business , requiring approval by the Authority in accordance to the provisions of Section 64 VC of the Act , shall be submitted for Authority's consideration as and whenrequired.
с. A minimum of two months advance notice on the proposed relocations or the closures , whether within the same city, town or village or otherwise , shall be given to policyholders serviced by that place of business along with the information on alternate arrangements being made to provide services to them .
ii. It is reiterated that the conditions on Closure of places of business and relocation of places of business stipulated at Regulation 14 ( i ) are also applicable to the places of business opened by the insurers in accordance to Regulation 8 ( ii ) .
Where it has come to the notice of the Authority that the decision to close or relocate , or the action of closure or relocation ; of a place of business is not in accordance with these regulations , the Authority may direct the Insurer to take such action or the Authority may take such action as deemed fit taking in to consideration the circumstances of the case .
(15) The details of relocations ( i.e. new address , date of shifting etc. ) of places of business shall be reported to IRDA as Returns in Form PB 2 referred at Schedule 1 of these Regulations , within 15 days of the succeeding month of relocation .
(16) Closure of all places of businessshall be reported to the Authority as Returns in Form - PB 2 referred at Schedule 1 of these Regulations , within 15 days of the succeeding month of closure .
(17) Aconsolidated monthly statistics shall be filed as Returns in Form - PB 2 referred at Schedule - 1 of these Regulations , within 15 days of the succeeding month .
(18) The Authority may call for any further Statistics and Data related to these Regulations in the manner and format as may be prescribed under these regulations from time to time.
