सा.का.नि. 108 (अ) .-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , परमाणु ऊर्जा विभाग में क्रय एवं भंडार काडर के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम परमाणु ऊर्जा विभाग ( क्रय एवं भंडार ) भर्ती नियम , 2013 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या , वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो उक्त अनुसूची के स्तंभों में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु-सीमा, अर्हताएं , आदि-उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो इन नियमों के साथ संलग्न अनुसूची के स्तंभों में विनिर्दिष्ट हैं ।
4. आरंभिक गठन.-अनुसूचियों में विनिर्दिष्ट ऐसे पदधारी जो विभाग के कार्यालय ज्ञापन सं. 22/ 1/4/90- सीसीएस/838 तारीख 19-07-1990 , 5/2(8) /77-( आरआरसी ) प्रशा. - 11 तारीख 10-09-1979, 22/1/1/84- सीसीएस/ 1030 तारीख 16-11-1993 , 5/2 ( 8 ) / 77- ( आरआरसी ) प्रशा. - 1 । तारीख 29-04-1980 , 16/5 ( 10 ) / 75- पीपी ( आरआरसी ) तारीख 25-05-1977 , 22/1 ( 1 ) /92 - सीसीएस/ 262 तारीख 28-04-2000 एवं 25/1 ( 1 ) /84 - सीनीएस/ 357 तारीख 23-06-1992 के उपबंधों के अनुसार नियमित आधार पर उक्त पदों को धारण किए हुए हैं , इन नियमों के उपबंधों के अनुसार नियुक्त किए गए समझे जाएंगे और इन नियमों के प्रारंभ से ठीक पहले अनुसूची 1 से 12 में उल्लिखित पदों पर उनकी नियमित और निरंतर सेवा को प्रोन्नति, पुष्टि और पेंशन के लिए परिवीक्षा , अर्हक सेवा के प्रयोजन के लिए गणना में लिया जाएगा ।
5. निरर्हताएं. वह व्यक्ति ,-
( क ) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है या
( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ;
उक्त पदों पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।
स्पष्टीकारक ज्ञापन : परमाणु ऊर्जा विभाग खंड 4 में उल्लिखित अपने कार्यालय ज्ञापनों के उपबंधों के अनुसार क्रय एवं भंडार काडर में अधिकारियों की नियुक्तियाँ करेगा । ऐसा आरंभिक गठन इस विभाग द्वारा बनाए गए इन नियमों के उपबंधों के अधीन सेवा को जारी रखने के लिए अपेक्षित है। इस आरंभिक गठन के उपबंध करने से और इन नियमों के उपबंधों के भूतलक्षी प्रभाव से किसी पर भी प्रतिकूल प्रभाव नहीं पड़ रहा है ।

NOTIFICATION
Mumbai , the 11th February, 2013
GS.R. 108 (E) . In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the posts in Purchase and Stores Cadre , Department ofAtomic Energy (DAE), namely:-
1. Short title and commencement . ( 1 ) These rules may be called the Department ofAtomic Energy (Purchase and Stores) Recruitment Rules , 2013 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post , classification and the pay band and grade pay/pay scale . The number of the said posts, its classification and the Pay Band and Grade Pay or Pay Scale attached thereto shall be as specified at columns of the Schedules annexed to these rules .
3. Method of recruitment , age - limit , qualifications , etc.-The method of recruitment , age - limit, qualifications and other matters relating to the said post , shall be as specified at columns of the said Schedules annexed to these rules .
4. Initial Constitution . The incumbents of the posts specified in the Schedules holding the said posts on regular basis in accordance with the provisions of the Department's OM Nos . 22/ 1 /4/90 - CCS/838 dated 19-07-1990 , 5/2(8 )/77- (RRC) Admn. II dated 10-9-1979 , 22/ 1 / 1 /84-CCS/ 1030 dated 16-11-1993 , 5/2 ( 8 )/ 77 -RRC/Admn . II dated 29-4-1980, 16/5 (10) / 75-PP(RRC) dated 25-05-1977, 22/1 ( 1 )/92 -CCS/262 dated 28-04-2000 and 25/1 ( 1 )/84-CCS/357 dated 23-06-1992 shall be deemed to have been appointed in accordance with the provisions of these rules and their regular and continuous service as the posts mentioned in Schedules 1 to 12 immediately before the commencement of these rules shall be accounted for the purpose ofprobation , qualifying service for promotion , confirmation and pension .
5. Disqualifications . No person,
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who , having a spouse living , has entered into or contracted a marriage , with a person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax.--- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category ofpersons .
7. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions , required to be provided for the Scheduled Castes , the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .
Explanatory Memorandum.--The Department of Atomic Energy made the appointments of officers in Purchase and Stores cadres in accordance with provisions of its Office Memoranda mentioned in clause 4. As such the initial constitution is required for continuation of service under the provisions of these rules being made by the Department . By providing this initial constitution and retrospective effect to the provisions of the rules no one is being adversely affected.
