नई दिल्ली , 20 फरवरी , 2013 सं. 04/2013 - केन्द्रीय उत्पाद शुल्क
सा.का.नि. 113(अ).-केन्द्रीय सरकार, केन्द्रीय उत्पाद शुल्क अधिनियम, 1944 (1944 का 1 ) की धारा 5क की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है, भारत सरकार के वित्त मंत्रालय (राजस्व विभाग ) की अधिसूचना सं० 64/95- केन्द्रीय उत्पाद शुल्क तारीख 16 मार्च, 1995 जो भारत के राजपत्र, असाधारण में सा0का0नि0 256 (अ) , तारीख 16 मार्च , 1995 में प्रकाशित की गई थी, में निम्नलिखित और संशोधन करती है, अर्थात्ः-
उक्त अधिसूचना में , सारणी में , क्रम सं0 32 और उससे संबंधित प्रविष्टियों के पश्चात निम्नलिखित क्रम सं० और प्रविष्टियां अंतः स्थापित की जायेंगी, अर्थातः

यदि, -
(क) उनका प्रदाय रक्षा मंत्रालय के अधीन एल आर एस ए एम प्रोग्राम के लिया किया जाता है; और
रक्षा मंत्रालय के, लंबी दूरी के सतह से हवा में मार करने वाले मिसाइल (एलआरएसएएम) कार्यक्रम के प्रयोजनों के लिए अपेक्षित मशीनरी, उपस्कर, उपकरण , संघटक, अतिरिक्त, पुर्जे, जिंग फिक्वर, डाई, औजार उपसाधन, कम्प्यूटर साफ्टवेयर, कच्ची सामग्री, और खपने वाली सामग्री
(ख ) माल की निकासी से पूर्व, कार्यक्रम निदेशक, एलआर- एसएएम कार्यक्रम से, इस आशय का एक प्रमाण- पत्र कि ऐसे माल उक्त एलआर- एसएम कार्यक्रम के लिए है, उचित

No. 04/2013 - Central Excise
GS. R. 113 (E ). In exercise of the powers conferred by sub - section ( 1 ) of section 5A of the Central Excise Act , 1944 ( 1 of 1944) , the Central Government , on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance ( Department of Revenue) , No.64 / 95- Central Excise , dated the 16th March, 1995 which was published in the Gazette of India , Extraordinary, vide number G.S.R.256 ( E) , dated the 16th March , 1995 , namely: -
In the said notification , in the Table, after S.No. 32 and the entries relating thereto , the following S.No. and entries shall be inserted, namely: -

( i ) supplied to the Programme LR - SAM under the Ministry of Defence; and
Machinery , equipment , instruments , If, - components , spares , jigs , fixtures , dies , tools , accessories , computer software, raw materials and consumables required for the Long Range Surface to Air Missile ( LR - SAM ) Programme of Ministry of Defence
( ii ) before clearance of the said goods , a certificate from the Programme Director , Programme LR- SAM to the effect that such goods are intended for the said Programme LR- SAM, is produced to the proper officer .
Explanation . Nothing contained in this exemption shall have effect on or after the 25th day of May, 2013. "

सा.का.नि. 114(अ).-केन्द्रीय सरकार सीमाशुल्क अधिनियम 1962 ( 1962 का 52) की धारा 25 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग) की अधिसूचना सं 0 39/96- सीमाशुल्क, तारीख 23 जुलाई , 1996 जो भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उपखंड ( i ) , में , सा0का0नि0 291 ( अ) , तारीख 23 जुलाई, 1996 में, निम्नलिखित और संशोधन करती है, अर्थातः-
उक्त अधिसूचना में, सारणी में, क्रम सं0 40 और उससे संबंधित प्रविष्टियों के पशचात, निम्नलिखित क्रम सं ० और प्रविष्टियां अंतः स्थापित की जायेंगी, अर्थातः-

यदि, -
रक्षा मंत्रालय के, लंबी दूरी के सतह से हवा में मार करने वाले मिसाइल (एलआरएसएएम) कार्यक्रम के प्रयोजनों के लिए अपेक्षित मशीनरी, उपस्कर, उपकरण , संघटक , अतिरिक्त, पुर्जे, जिंग फिक्चर, डाई , औजार उपसाधन , कम्प्यूटर साफ्टवेयर, कच्ची सामग्री, और खपने वाली सामग्री
(क) उक्त माल का आयात लंबी दूरी के सतह से हवा में मार करने वाले मिसाइल (एलआरएसएएम) कार्यक्रम के अधिकृत कर्मशाला केन्द्रों द्वारा , जो किसी ऐसे अधिकारी द्वारा अभिहीत किया गया हो, जो कि भारत सरकार के रक्षा मंत्रालय में उप सचिव कीपंक्ति से नीचे का न हो, और
(ख ) अधिकृत कर्मशाला केन्द्र, प्रत्येक मामले में , आयात के समय , उक्त माल की सुसंगत वर्णन सहित एक सूची, जो कि कार्यक्रम निदेशक, एल आर एस ए एम कार्यक्रम कार्यालय द्वारा अभिहित किया गया है, सीमाशुल्क उपायुक्त या सहायक सीमाशुल्क आयुक्त, यथास्थिति, को प्रस्तुत करेगा ।
(i) सूची में वर्णित माल एल आर एस ए एम के लिए चाहिए;
(ii) आयातित माल जो कि उपरोक्त कहे गए सूची में वर्णित है,, रक्षा मंत्रालय के एलआरएसएएम कार्यक्रम द्वारा अभिहीत होना चाहिए और उक्त माल का उपयोग केवल सम्युक्त कार्यक्रम के लिए किया जाएगा ।
स्पष्टीकरण. इस छूट का लाभ 25 मई, 2013 को या उसके पश्चात लागू नहीं होगा । "

In exercise of the powers conferred by sub - section ( 1 ) of section 25 of the Customs Act , 1962 (52 of 1962) , the Central Government, on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance ( Department of Revenue) , No. 39 /96 - Customs , dated the 23rd July , 1996 , published in the Gazette of India, Extraordinary , vide number G.S.R. 291 (E ) , dated the 23rd July , 1996, namely: -
In the said notification , in the Table , after S.No.40 and the entries relating thereto , the following S.No. and entries shall be inserted, namely: -

If, -
Machinery, equipment, instruments , components , spares , jigs , fixtures , dies, tools , accessories , computer software , raw materials and consumables required for the Long Range Surface to Air Missile ( LR- SAM) Programme of Ministry of Defence
(a) the said goods are imported by authorized works centres of the Long Range Surface to Air Missile (LR- SAM ) Programme , as may be designated by an officer not below the rank of Deputy Secretary to the Government of India in the Ministry of Defence ; and
(b) the authorized works centre produces to the Deputy Commissioner of Customs or the Assistant Commissioner of Customs , as the case may be , at the time of import, in each case , a list of the said goods with their relevant description duly certified by the Programme Director , Programme Office LR - SAM , to the effect that -
i) the goods mentioned in the said list are required for the purposes of the LR - SAM;
(ii) the import of the goods mentioned in the said list are authorized by the Ministry of Defence under LR- SAM programme and these goods shall be used only for the purpose of भारत का राजपत्र असाधारण

the LR - SAM programme .
Explanation . Nothing contained in this exemption shall have effect on or after the 25th day of May, 2013. "
