सा.का.नि. 116 (अ).- पौधा किस्म और कृषक अधिकार संरक्षण प्राधिकरण, पौधा किस्म और कृषक अधिकार संरक्षण अधिनियम, 2001 (2001 का 53) की धारा 95 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केंद्रीय सरकार की पूर्व अनुमति से पौधा किस्म और कृषक अधिकार संरक्षण विनियम, 2006 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात् : --

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन विनियमों का संक्षिप्त नाम पौधा किस्म और कृषक अधिकार संरक्षण ( संशोधन) विनियम, 2013 है ।

(2) ये उनके राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पौधा किस्म और कृषक अधिकार संरक्षण विनियम, 2006 (जिसे इसमें इसके पश्चात् मूल विनियम कहा गया है) के विनियम 10 में " रजिस्ट्रीकरण के लिए " शब्दों के पश्चात् "कृषक, किस्म के रजिस्ट्रीकरण के लिए आवेदन से भिन्न " शब्द अंतःस्थापित किए जाएंगे ।

3. मूल विनियमों के प्ररूप 1 और प्ररूप 2 के स्थान पर निम्नलिखित प्ररूप रखे जाएंगे , अर्थात् : -

(ठ) ट्रांसजेनिक की दशा में, सुसंगत जननिक इंजीनियरी अनुमोदन समिति का अनापत्ति प्रमाणपत्र और अनुमोदन ; और (ड) फीस , जो लागू है

टिप्पण- आवेदक अभ्यर्थी और निर्देश किस्मों के लक्षणों की सारणी के अतिरिक्त प्रजनन, तुलनात्मक परीक्षण और तुलनात्मक आंकड़ों के विवरण से संबंधित प्रकाशनों के आंकड़े, सारणियां, प्रतियां भेज सकते हैं । इस मद के अंतर्गत यह जानकारी प्राधिकरण द्वारा प्रकाशित नहीं की जाएगी किंतु अभ्यर्थी किस्म की परीक्षा को सुकर बनाने के लिए इसका प्रयोग किया जाएगा ।

8. अभ्यर्थी किस्म के लक्षण

कृपया किस्म के लक्षणों का वर्णन उपशीर्षकों में कीजिए पौधा, तना, पत्ती, पुष्प समूह, पुष्प और पुष्प के भाग, फल और फल के भाग , बीज आदि । साधारणतया उपशीर्षकों के अंतर्गत लक्षणों का वर्णन निम्नलिखित क्रम में कीजिए : प्रकृति, ऊंचाई , लंबाई, चौड़ाई, आकार, आकृति, रंग ( संस्करण के साथ आर.एच.एस. रंग चार्ट निर्देश ) वर्णन को स्पष्ट करने के लिए जहां कहीं आवश्यक हो विनिर्दिष्ट दिशानिर्देश का हवाला दें ।

In exercise of the powers conferred by section 95 of the Protection of Plant Varieties and Farmers ' Rights Act, 2001 (53 of 2001) , the Protection of Plant Varieties and Farmers ' Rights Authority with the pervious approval of the Central Government hereby makes the following Regulations further to amend the Protection of Plant Varieties and Farmers ' Rights Regulations, 2006.

1. Short title and Commencement ( 1 ) These Regulations may be called the Protection of Plant Varieties and Farmers ' Rights ( Amendment) Regulations , 2013 .

(2) They shall come into force on the date of their publication in Official Gazette .

2. In regulation 10 of the Protection of the Plant Varieties and Farmers ' Rights Regulations , 2006 ( hereinafter referred to as the principal regulations ) , after the words " for registration " the words " other than application for the registration of farmers , variety " shall be inserted.
