का.आ. 432(अ).- केंन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या क का.आ. 985 (अ ) , तारीख 18/06/2007 द्वारा उत्तरप्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 24बी के 70.000 कि.मी. से 188.050 कि.मी. ( लखनऊ- रायबरेली - इलाहाबाद खण्ड ) तक के खण्ड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् "प्राधिकरण " कहा गया है ) को सौंपा है ;
और प्राधिकरण ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 14 के उपबंधों के अनुसरण में , मैसर्स रायबरेली इलाहाबाद हाईवे प्रा. लिमिटेड , जो 11.06.2010 को प्रस्तुत की गई बोलियों के सफल बोलीदाता हैं, और जिसका रजिस्ट्रीकृत कार्यालय पंकज गैल्क्सी 1 , दूसरा तल , प्लॉट नं. , 8 , सेक्टर -12 , द्वारका, नई दिल्ली 110 075 भारत (जिसे इसमें इसके बाद "रियायतग्राही " कहा गया है ) , जो राष्ट्रीय राजमार्ग संख्या 24 बी के रायबरेली- इलाहाबाद के 82.000 कि.मी. से 188.600 कि.मी. तक के खण्ड ( जिसे इसमें इसके प्रश्चात् "उक्त खण्ड" कहा गया है ) के विकास के लिए प्रस्तुत की गई बोलियों का सफल बोली बोलने वाला है को दो लेन के पेवड शोल्डर करने और उक्त खण्ड के प्रचालन और अनुरक्षण के लिए करार (जिसे इसमें इसके प्रश्चात् उक्त करार कहा गया है ) किया है ।
अतः अब, केन्द्रीय सरकार , राष्ट्रीय राजमार्ग फीस ( दरों का अवधारण और संग्रहण ) नियम , 2008 (जिसे इसमें इसके प्रश्चात् " नियम" कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग 739 GI/2013 (1) 2

अधिनियम , 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त खण्ड के निर्माण , अनुरक्षण, प्रबंध और प्रचालन में अंतर्वलित व्यय निवेशित पूंजी पर ब्याज, युक्तियुक्त रिटर्न यातायात का परिमाण और प्राधिकरण और रियायतग्राही के बीच हुए करार में निहित अवधि को ध्यान में रखते हुए , यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक वाहनों पर चार या अधिक लेन के खण्ड के उपयोग हेतु नीचे सारणी 1 में विनिर्दिष्ट यानों के प्रकार पर चार और अधिक लेन के उपयोग के लिए 106.600 किमी निवल सड़क सेक्शन की लम्बाई के लिए सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट दर ( जिसे इसमें इसके पश्चात् "आधार दर " कहा गया है ) पर यांत्रिक वाहन पर और वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से जो भी पश्चातवर्ती हो करार में विनिर्दिष्ट अवसान की तारीख तक फीस का संग्रहण करने तथा उसे प्रतिधारित करने के लिए उक्त रियायतग्राही को प्राधिकृत करती है;

1. इसके अधीन फीस का उद्ग्रहण और संग्रहण निम्नलिखित टोल प्लाजाओं पर ऐसे टोल प्लाजाओं के लिए निर्दिष्ट दूरी के लिए शोध्य और संदेय होगा:

2. वर्ष 2012-13 के लिए , स्थानीय निजी यातायात के संबंध में मासिक पास की दर 200.00 रूपए ( दो सौ रूपए मात्र ) है जो राष्ट्रीय राजमार्ग फीस ( दरों का अवधारण और संग्रहण ) नियम , 2008 के उपबंधों के अनुसार प्रत्येक वर्ष पुनरीक्षण के अध्यधीन है । :
3. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जायेगा, अर्थात्ः-

4. जो यांत्रिक यान नियमों के अधीन अपने प्रवर्ग के लिए विनिर्दिष्ट अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन दरों पर फीस का संदाय करना होगा जो उनसे ले उच्च प्रवर्ग के यानों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक यान से अधिक भार को हटा न दिया जाए ।
5. यांत्रिक यानों के प्रवर्ग , उनके लिए अनुज्ञेय भार, छूट प्राप्त यानों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
6. उक्त नियम के नियम 12 के अनुसार , उपयोक्ताओं की जानकारी के लिए फीस की दरों को प्रदर्शित किया जाएगा ।
7. फीस की दरों का पुनरीक्षण उक्त नियमों के नियम 5 के अनुसार वार्षिक रूप से किया जाएगा परन्तु छः मास की अवधि के भीतर कोई पुनरीक्षण प्रभावी नहीं होगा ।

NOTIFICATION
New Delhi , the 22nd February , 2013
S.O. 432 (E) . Whereas by notification of the Government of India in the erstwhile Ministry ofShipping Road Transport and Highway number S.O. 985 (E) , dated 18/06/2007, issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch from kilometer 70.000 to kilometer 188.050 (Lucknow Raebareilly Allahabad section) of National Highway No. 24B in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the "Authority");
And whereas , pursuant to the provision of Section 14 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Authority has entered into an Agreement (hereinafter referred to as said agreement ) with M / s Raebareilly Allahabad Highway Pvt . Ltd. having its registered office Pankaj Galaxy 1 , 2nd Floor , Plot No.8 , Sector- 12 , Dwarka , New Delhi- 110075, India, ( hereinafter referred to as the " Concessionaire " ) , the successful bidder for bids submitted on 11/06/2010 for the development of Raebareilly Allahabad section from Km 82.000 to Km 188.600 on National Highway No. 24B (hereinafter referred to as the " said section " ) to two lane paved shoulder standards and operation and maintenance ofthe said section .

Now , therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 ( hereinafter referred to as the "Rules" ) , the Central Government , having regard to the expenditure involved in building , maintenance, management and operation of the said section , interest on the capital invested, reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length 106.600 km for use of the four and more lane sections (hereinafter referred to as " base rate " ) on the Type of Vehicles specified in Table 1 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

2. The rate of monthly pass for local personal traffic is Rs . 200.00 ( Rupees Two Hundred Only) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 . :

4. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
5. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the Rules .
6. The fee rates shall be displayed for information of the users in accordance with Rules 12 of the said Rules .
7. The fee rates shall be revised annually in accordance with the Rule 5 of the said Rule provided that no revision shall be effected within six months .
