का.आ. 426(अ) .- जबकि केन्द्रीय सरकार ने राष्ट्रीय राजमार्ग अधिनयम 1956 ( 1956 का 48 ) की धारा 8 क के अंतर्गत दिनांक 01.07.2009 को जारी भारत सरकार , सड़क परिवहन और राजमार्ग मंत्रालय के का.आ. 1610 ( अ) और महाराष्ट्र राज्य में किमी 399/00 पर फेकरी गांव तालुक भुस्वाल , जिला- जलगांव के निकट इसके पहुंचमार्गों सहित रारा -6 के सूरत - धुले - नागपुर खंड ( इसके पश्चात् राष्ट्रीय राजमार्ग सं. 6 के उक्त खंड के रूप में संदर्भित ) के निर्माण , अनुरक्षण, प्रबंधन और प्रचालन में सम्मिलित व्यय पर ध्यान देते हुए मैसर्स फेकरी इंफ्रास्ट्रक्चर प्रा. लि. (इसके पश्चात् रियायतग्राही के रूप में संदर्भित ) को इसकी अनुसूची में उल्लिखित दरों पर राष्ट्रीय राजमार्ग सं . 6 के उक्त खंड के उपयोग के लिए यांत्रिक वाहनों पर शुल्क लगाने और संग्रहण करने के लिए प्राधिकृत किया था ।
और , जबकि, भारत सरकार , सड़क परिवहन और राजमार्ग मंत्रालय ने रियायतग्राही के साथ 01 फरवरी , 2013 को अनुपूरक करार किया है ।
इसलिए , अब राष्ट्रीय राजमार्ग अधिनयम 1956 ( 1956 का 48 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार , सड़क परिवहन और राजमार्ग मंत्रालय ने अधिसूचना संख्या का.आ. 1610 (अ ) दिनांक 01.07.2009 में निम्नलिखित संशोधन करती है:

(i ) चैनेज किमी 390/00 को किमी 399/00 के रूप में पढ़ा जाए ।
( ii) अनुसूची इस प्रकार प्रतिस्थापित की जाएगी :

NOTIFICATION
New Delhi , the 22nd February, 2013
S.O. 426 ( E ) . Whereas in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , the Central Government by notification of the Government of India in the Ministry of Road Transport and Highway number S.O. 1610 (E) , dated the 1st July, 2009 and having regard to the expenditure involved in building , maintenance , management and operation of the Surat- Dhule - Nagpur Section of National Highway No. 6 with approaches near village Fekari , Taluka Bhusawal , District Jalgaon in Km. 399/00 in the State of Maharashtra (hereinafter referred to as the said section of National Highway No. 6) , authorized M/ s . Fekari Infrastructure Private Limited ( hereinafter referred as Concessionaire) for levying and collecting fee on mechanical vehicles for the use of the said section of National Highway No. 6 at the rates specified in its schedule .
And whereas the Government of India in the Ministry of Road Transport and Highway has entered into a Supplementary Agreement on February 1 , 2013 with the Concessionaire .
Now, therefore , in exercise of the powers conferred by National Highways Act, 1956 (48 of 1956) , the Government of India in the Ministry of Road Transport and Highway makes the following amendments in the Notification number S.O. 1610 (E) , dated the 1st July , 2009:
(i) The chainage Km. 390/00 shall be read as Km. 399/00 .
(ii) The Schedule shall be substituted as follows :
