का.आ. 465(अ) .- यत; केंन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खण्ड ) की अधिसूचना संख्या का.आ. 465 (अ ), तारीख 26 अप्रैल, 2002 का.आ. 78 (अ ) , तारीख 4 फरवरी , 1999 द्वारा उत्तरप्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 25 के 80.000 कि.मी. से 256.000 किमी ( मध्यप्रदेश/उत्तरप्रदेश सीमा से शिवपुरी से भोगनीपुर ) और 256.000 किमी से 281.000 किमी ( भोगनीपुर से बराह ) , तथा राष्ट्रीय राजमार्ग संख्या 2 के 93.000 किमी से 479.000 किमी ( हरियाणा/ उत्तरप्रदेश सीमा से कानपुर ) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् "प्राधिकरण " संदर्भित किया गया है ) को सौंपा था;
और यतः , केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1939 (अ ), तारीख 7 जून, 2010 द्वारा उत्तरप्रदेश राज्य में क्रमशः राष्ट्रीय राजमार्ग संख्या 25 और 2 के 220.000 किमी से 255.000 किमी और 421.200 किमी से 449.000 किमी (कुल लम्बाई 62.800 किमी ) तक के चार लेन के खण्ड के उपयोग हेतु यात्रिक वाहनों पर , अनुसूची में विनिर्दिष्ट प्रकार के वाहनों और दर पर शुल्क उद्ग्रहीत और संग्रहीत करने के लिए भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को प्राधिकृत किया था ।

और अत; , . खण्ड के विकास तथा राष्ट्रीय राजमार्ग सं. का पुनः नामांकन किए जाने के पश्चात्, परियोजना की संशोधित चैनेज / लम्बाई निम्नप्रकार हो गयी है ;

अतः अब , केन्द्रीय सरकार , समय - समय पर यथासंशोधित, राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम , 2008 ( जिसे इसमें इसके प्रश्चात् " उक्त नियम" संदर्भित किया गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और अधिसूचना संख्या का.आ. 1339 (अ ) , तारीख 7 जून , 2010 का अधिक्रमण करते हुए , सड़क खण्ड की निवल लम्बाई 68.513 किमी के लिए सारणी 1 के स्तम्भ ( 2 ) मे विनिर्दिष्ट दर ( जिसे इसमें इसके पश्चात् "आधार दर " संदर्भित किया गया है ) पर चार या अधिक लेन के उपयोग हेतु नीचे सारिणी 1 के स्तम्भ ( 1 ) में विनिर्दिष्ट प्रकार के वाहनों पर, राष्ट्रीय राजमार्ग संख्या 25 के 220.000 किमी से 288.513 किमी ( उरई- बराह ) खण्ड ( जिसे इसमें इसके प्रश्चात् " उक्त खण्ड" संदर्भित किया गया है ) के उपयोग के लिए एतद् द्वारा शुल्क उद्ग्रहीत करती है और प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क का संग्रहण करने हेतु प्राधिकृत करती है , अर्थात्ः

1. नीचे उद्ग्रहीत तथा संग्रहीत शुल्क, निम्नलिखित टोल प्लाजा पर , ऐसे टोल प्लाजा (प्लाजाओं ) के लिए निर्दिष्ट सड़क की निवल लम्बाई हेतु शोध्य और संदेय होगाः

2. जिस व्यक्ति का अपना यांत्रिक वाहन और गैर - वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से 20 कि.मी. तक की दूरी में ही रहता हो उसके लिए वर्ष 2012-13 के लिए मासिक पास की दर 200.00 रूपए ( दो सौ रूपए मात्र ) प्रतिमाह होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण ) नियम , 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जाएगा ।
3. अर्थात्ः राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किया जायेगा,

4. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर ) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50 % होगा बशर्ते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।

[PART II-SEC . 3 ( ii) ] 5. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
6. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार , छूट प्राप्त वाहनों के प्रवर्ग , सर्विस रोड , वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
7 . उक्त नियमों के नियम 12 के अनुसार , उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
8. ऊपर सारणी 1 में यथा उल्लिखित , आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा तथा उसे, तदनुसार, अंग्रेजी और स्थानीय भाषा के कम- से- कम एक- एक समाचारपत्र में प्रकाशित किया जाएगा ।
9. परियोजना की अनुमानित पूंजीगत लागत 390.27 करोड़ रूपये हैं । प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के बाद लगाए गए शुल्क की दरों को घटाकर 40% कर दिया जाएगा और उक्त नियमों के अनुसार इसमें वार्षिक रूप से संशोधन किया जाएगा । 31.3.2012 की गई उगाही से, कुल 69.77 करोड़ रूपए की वसूली की गई ।

S.O. 465( E ) . Whereas , vide notifications of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing ) number S.O. 465 (E) dated the 26th April , 2002 and S.O.78 (E) dated the 4th February , 1999 issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Central Government entrusted the stretch from Km 80.000 to km 256.000 ( Madhya Pradesh /Uttar Pradesh Border to Shivpuri to Bhognipur) and km 256.000 to km 281.000 (Bhognipur to Barah ) of National Highway No. 25 and from Km . 93.000 to Km 479.000 (Haryana/Uttar Pradesh Border to Kanpur) of National Highway No. 2 in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the " Authority ") ;
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with the National Highways Fee ( Determination of Rates and Collection ) Rules , 2008 , the Central Government by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1339 (E) dated the 7th June , 2010 , authorised Authority for

levying and collecting fee on mechanical vehicles for the use of four - laned stretch from km 220.000 to km 255.000 and km 421.200 to km 449.000 (Total length being 62.800 km ) of National Highway No. 25 and 2 respectively in the State of Uttar Pradesh at the rates and category of vehicles specified in its schedule .
And whereas , after the development of the section and re- designation of the National Highway Nos. , the revised project chainage / length comes as under:

Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act , 1956 ( 48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 and amended from time to time (hereinafter referred to as the " said Rules " ) , and in supersession of the notification bearing S.O. No. 1339 (E) dated the 7th June , 2010, the Central Government hereby levies the fee at the base rate specified in column (2) of Table 1 for net road section length of 68.513 km (hereinafter referred to as " base rate " ) , for use of the four and more lane sections on the type of Vehicles specified in column ( 1 ) of Table 1 below, for the use of the stretch from km 220.000 to km 288.513 ( Orai- Barah ) of National Highway No. 25 (hereinafter referred to as the "said Stretch " ) and authorises the Authority to collect , either through its officials or through a contractor , the said fee , namely: -

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 ( Rupees Two Hundred only ) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection ) Rules, 2008 .

3. namely: For multiple journey on the highway section , passes shall be issued at the following rates ,

4. Fee for commercial vehicle (excluding vehicles plying under National Permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the said rules.
7 . The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules .
8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table - 1 , the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper , each in English and vernacular language accordingly .
9. The estimated capital cost of the project is Rs . 390.27 Crores . The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules . A total of Rs . 69.77 Crores has been recovered from the users fee realized till 31.03.2012 .
