का.आ. 467(अ).-यतः केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्या का.आ. 465 ( अ ) , तारीख 26 अप्रैल, 2002 द्वारा तमिलनाडु राज्य में राष्ट्रीय राजमार्ग संख्या 47 के 0.000 कि.मी. से 182.040 कि.मी. ( सेलम से केरल तमिलनाडु सीमा सेक्शन ) और केरल राज्य में राष्ट्रीय राजमार्ग संख्या 47 के 182.40 कि.मी. से 316.000 कि.मी. तक और 332.600 कि.मी. से 349.000 कि.मी. ( तमिलनाडु/ केरल सीमा से कोच्चि सेक्शन ) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् " प्राधिकरण " संदर्भित किया गया है ) को सौंपा है ;

और यतः , प्राधिकरण ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 14 के प्रावधान के अनुसरण में, मैसर्स आइ वी आर सी एल चेंगापल्ली टोलवेज लिमिटेड, जो 26-11-2009' को प्रस्तुत की गई बोलियों के सफल बोलीदाता हैं, जिसका पंजीकृत कार्यालय एम 22/3 आर टी , विजयनगर कालोनी हैदराबाद-500057 , आन्ध्रप्रदेश , भारत में हैं ( जिसे इसमें इसके पश्चात् " रियायतग्राही " कहा गया है ) , के साथ चेंगापल्ली में 100.000 कि.मी. ( डिजाइन चैनेज 102.035 कि.मी. ) से कोयम्बतूर बाइपास के प्रारम्भ पर 141.660 कि.मी. ( डिजाइन चैनेज 144.680 कि.मी. तक, और कोयम्बतूर बाइपास की समाप्ति पर 167.830 कि.मी. डिजाइन चैनेज 170.880 कि.मी. ) से राष्ट्रीय राजमार्ग 47 के कोयम्बतूर बाइपास के वलयार छोर पर 182.250 कि.मी. ( डिजाइन चैनेज 183.010 ) तक के खण्ड के छः लेन तथा चार लेन के विभाजित सड़क मार्ग के विकास ( जिसे इसमें इसके पश्चात् " उक्त खण्ड " कहा गया है ) उक्त खण्डों के प्रचालन और अनुरक्षण के लिए करार किया है ( जिसे इसमें इसके पश्चात् " उक्त करार " कहा गया है ) ।

अतः अब , केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम , 2008 ( जिसे इसमें इसके पश्चात् " नियम " कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त खण्ड के निर्माण , अनुरक्षण, प्रबंध और प्रचालन , निवेशित पूंजी पर ब्याज, उचित लाभ , यातायात का परिणाम और प्राधिकरण तथा रियायतग्राही के बीच हुए करार अवधि को ध्यान में रखते हुए, यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक वाहनों पर चार या अधिक लेने के 792GI/2013 (1) 2

अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक वाहनों पर चार या अधिक लेने के खण्डों के उपयोग हेतु निवल सड़क खण्ड की 30.160 किमी लम्बाई के लिए सारणी 1 के स्तम्भ (2 ) में निर्दिष्ट दर पर (जिसे इसमें इसके पश्चात् " आधार दर " कहा गया है ) और पुलों/संरचना / बाइपास जिनकी लागत पचास करोड़ या अधिक है, का उपयोग हेतु नीचे सारणी । और 2 में निर्दिष्ट प्रकार के वाहनों पर सारणी सं. 2 में निर्दिष्ट आधार दरों पर शुल्क उद्‌ग्रहीत और संग्रहीत किया जायेगा , और वाणिज्यिक प्रचालन की तारीख को और उस तारीख से या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, जो भी बाद में हो , करार में निर्दिष्ट समापन की तारीख तक, शुल्क का संग्रहण तथा उसे प्रतिधारित के लिए उक्त रियायतग्राही को प्राधिकृत करती है;

त्रै मासिक पास की दर 200.00 रुपए ( दो सौ रुपए मात्र ) है जो राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम , 2008 के उपबंधों के अनुसार, प्रत्येक वर्ष संशोधन के अध्यधीन है ।

4. राजमार्ग सेक्शन पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किये जाएंगे, अर्थात्: - संदेय राशि

विधिमान्यता की अवधि एकतरफा अनुज्ञात यात्राओं की अधिकतम संख्या

एकतरफा यात्रा के लिए शुल्क का डेढ़ गुणा

पचास या अधिक एकल यात्राओं के लिए संदेय शुल्क की राशि का दो -तिहाई दो

संदाय के समय से चौबीस घंटे

पचास या अधिक

मास संदाय की तारीख से एक

5. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए।

6. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।

7 . उक्त नियमों के नियम 12 के अनुसार , उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।

8. ऊपर सारणी 1 और 2 में यथा उल्लिखित , आधार वर्ष 2007-08 के लिए प्रति कि.मी की आधार दरों के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा, परन्तु शर्त यह है कि छह महीने के अन्दर कोई संशोधन नहीं किया जाएगा तथा उसे तदनुसार , अंग्रेजी और स्थानीय भाषा के कम- से - कम एक - एक समाचारपत्र में प्रकाशित किया जाएगा ।

NOTIFICATION

New Delhi , the 26th February, 2013

S.O.467(E). Whereas by notification of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways ) number S.O. 465 (E) , dated the 26thApril, 2002, issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988 ) , the Central Government has entrusted the stretch from kilometer 0.000 to kilometer 182-040 (Salem to Kerala/Tamil Nadu Border section) ofNational Highway No. 47 in the State ofTamil Nadu and Kilometer 182-040 to Kilometer 316-000 and Kilometer 332-600 to Kilometer 349-000 (Tamil Nadu/Kerala Border to Kochi section ) ofNational Highway No. 47 in the State ofKerala to the National Highways Authority of India (hereinafter referred to as the " Authority " ) ;

And whereas , pursuant to the provision of section 14 of the National Highways Authority of India Act , 1988 (68 of 1988) , the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/ s IVRCL Chengapalli Tollways Limited , having its registered office at M22/ 3RT , Vijayanagar Colony , Hyderabad- 500057 , Andhra Pradesh, India, (hereinafter referred to as the "Concessionaire " ) , the successful bidder for bids submitted on 26.11.2009 for the development of Chengapalli to Start of Coimbatore Bypass from Km 102.035 (Design Chainage) to Km 144.680 ( Design Chainage) and End of Coimbatore Bypass to Tamil Nadu/Kerala Border from Km 170.880 (Design Chainage) to Km 183.010 (Design Chainage) on National Highway No. 47 (hereinafter referred to as the " said section") to six lane and four lane divided carriageway respectively and operation and maintenance of the said section.

Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 (hereinafter referred to as the "Rules " ) , the Central Government, having regard to the expenditure involved in building, maintenance , management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length of 30.160 Kms for use of the four and more lane sections (hereinafter referred to as " base rate " ) and at the base rates specified in the Table No. 2 for bridges / structure/ bypass costing Rupees Fifty crore or more on the Type of Vehicles specified in Table 1 and 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the agreement;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 ( Rupees Two Hundred only) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .

4. Formultiple journeys on the highway section, passes shall be issued at the following rates , namely.

5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section.unless the excess load has been removed from such mechanical vehicle .

6. All 'definitions including category of mechanical vehicles , its permissible load, category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the Rules .

7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .

8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table - 1 & 2, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper , each in English and vernacular language accordingly.
