उक्त अधिनियम के रूप में उल्लिखित) की धारा
की धारा 3 क की उपधारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग करते Kए
शक्तियों को प्रयोग करते (cid:29)ए, दिनांक 15 मई, 2010 को भारतीय आयु(cid:14)व(cid:16)ान परिषद का
को भारतीय आयु(cid:14)व(cid:16)ान परिषद का अधि*मण किया गया और उक्त परिषद के अध्यक्ष, उपाध्य
उपाध्यक्ष एवं सभी अन्य सदस्यों ने अपने पदों को रिक्त कर दिया;
और जबकि परिषद के अधि*मण के उपरांत के न्. सरकार ने उस अंतराल के दौरान परिषद के कार्य और जबकि परिषद के अधि*मण के उपरांत के न्. सरकार ने उस अंतराल के दौरान परिषद के कार्य-निष्पादन हेतु भारत सरकार, स्वास्थ्य एवं परिवार कल्या
एवं परिवार कल्याण मंत्रालय के दिनांक 15 मई, 2010 की अधिसूचना संख्या
अधिसूचना संख्या का.आ. 1123 (अ) के तहत शासी मंडल का गठन किया;
और जबकि भारतीय आयु(cid:14)व(cid:16)ान परिषद (संशोधन) अधिनियम, 2011 (2011 का और जबकि भारतीय आयु(cid:14)व(cid:16)ान परिषद
का 13) द्वारा शासी मंडल का कार्यकाल दो वष9 के लिए बढ़ाया गया था और पुन: भारतीय आयु(cid:14)व(cid:16)ान परिषद (संशोधन) अधिनियम कार्यकाल दो वष9 के लिए बढ़ाया गया था और पुन
अधिनियम, 2012 (2012 का 20) द्वारा उसके कार्यकाल को तीन वष9 के लिए
; को तीन वष9 के लिए बढ़ाया गया, जो 15 मई, 2010 से प्रभावी Kआ था ;
और जबकि शासी मंडल का 3
हो गया और इसलिए भारतीय 3 वष9 का कार्यकाल 14 मई, 2013 को समाप्त हो गया और इसलिए भारतीय आयु(cid:14)व(cid:16)ान परिषद (संशोधन) द्वितीय अध्या
द्वितीय अध्यादेश, 2013 (2013 का 11)- जिसे राष्ट्रपति द्वारा दिनांक
पति द्वारा दिनांक 28 सितंबर, 2013 को प्रख्यापित किया गया जो दिनांक 15 मई
के अनुसार शासी मंडल का पुनर्गठन मई, 2013 से प्रभावी हो गया-में उल्लिखित उपबंधों के अनुसार शासी मंडल का पुनर्गठन आवश्यक हो गया है ;

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और जबकि उक्त अध्यादेश द्वारा जोड़ी गई उक्त अधिनियम की धारा 3 क क में के न्(cid:31) सरकार से अपेक्षा की गई है कि वह धारा 3 की उपधारा (1) के तहत 15 मई, 2013 से प्रभावी एक सौ अस्सी दिनों की अवधि के भीतर परिषद को पुनर्गठित करे ;
और जबकि के न्(cid:31) सरकार ने भारतीय आयु2व3ान परिषद अधिनियम, 1956 (1956 का 102) की धारा 3 की उपधारा (1) के खंड (क) के अनुसरण में तथा संबंधित राज्य सरकारों के परामर्श से निम्निलखित :यक्ति को इस अधिसूचना के जारी होने की तिथि से चार वष? के लिए भारतीय आयु2व3ान परिषद के सदस्य के रूप में euksuhr किया है।
अत: अब उक्त अधिनियम की धारा 3 की उपधारा (1) के उपबंध के अनुसरण में के न्(cid:31) सरकार द्वारा भारत सरकार के तत्कालीन स्वास्थ्य मंत्रालय की दिनांक 9 जनवरी, 1960 की अधिसूचना संख्या का.आ. 138 में निम्नलिखित संशोधन किए जाते हैं ; अर्थात :-

संशोधित किया गया था।
MINISTRY OF HEALTH AND FAMILY WELFARE (Department of Health and Family Welfare) NOTIFICATION New Delhi, the 5th November, 2013
S.O. 3323(E).— Whereas on 15th May, 2010, the Medical Council of India was superseded in exercise of the powers conferred by sub-section (1) of section 3A of the Indian Medical Council Act, 1956 (102 of 1956) (hereinafter referred to as the said Act) and the President, Vice-President and all other Members of the said Council vacated their offices; And whereas, on supersession of the Council, the Central Government constituted the Board of Governors vide notification of the Government of India, Ministry of Health and Family Welfare number S.O. 1123 (E) dated the 15th May, 2010 to perform the functions of the Council during the interregnum; And whereas, the term of the Board of Governors had been extended to two years by the Indian Medical Council (Amendment) Act, 2011 (13 of 2011) and it was further extended upto three years by the Indian Medical Council (Amendment) Act, 2012 (20 of 2012), with effect from 15th May, 2010;
And whereas, the three year term of the Board of Governors had expired on the 14th May, 2013 and therefore, it has become necessary to go for reconstitution of the Board of Governors in accordance with the provisions of the Indian Medical Council (Amendment) Second Ordinance, 2013 (11 of 2013), which was promulgated by the President on 28th September, 2013, which came into force with effect from the 15th day of May 2013; And whereas, section 3AA of the said Act, as inserted by the said Ordinance, requires the Central Government to reconstitute the Council under sub-section (1) of section 3 within a period of one hundred and eighty days with effect from the 15th day of May, 2013;
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]And whereas the Central Government, in pursuance of clause (a) of sub-section (1) of section 3 of the Indian Medical Council Act, 1956 (102 of 1956) and in consultation with the respective State Governments have nominated the following to be a member of the Medical Council of India for four years with effect from the date of issue of this notification. Now, therefore, in pursuance of the provision of sub-section (1) of Section 3 of the said Act, the Central Government hereby makes the following amendment in the Notification of the Government of India in the then Ministry of Health number S.O. 138 dated the 9th January, 1960, namely: -

और जबकि परिषद के अधि(cid:1)मण के उपरांत के न्H सरकार ने उस अंतराल के दौरान परिषद के कार्य-निष्पादन हेतु भारत सरकार, स्वास्थ्य एवं परिवार कल्याण मंत्रालय के दिनांक 15 मई, 2010 की अधिसूचना संख्या का.आ.

और जबकि भारतीय आयु[व)ान परिषद (संशोधन) अिधिनयम, 2011 (2011 का 13) द्वारा शासी मंडल का कार्यकाल दो वषd के लिए बढ़ाया गया था और पुन: भारतीय आयु[व)ान परिषद (संशोधन) अिधिनयम, 2012 (2012 का 20) द्वारा उसके कार्यकाल को तीन वषd के लिए बढ़ाया गया, जो 15 मई, 2010 से प्रभावी 'आ था ;
और जबकि शासी मंडल का 3 वषd का कार्यकाल 14 मई, 2013 को समाप्त हो गया और इसिलए भारतीय आयु[व)ान परिषद (संशोधन) द्वितीय अध्यादेश, 2013 (2013 का 11) - जिसे राष्ट्रपति द्वारा दिनांक 28 िसतंबर, 2013 को प्रख्यापित किया गया जो दिनांक 15 मई, 2013 से प्रभावी हो गया - में उल्लिखित उपबंधों के अनुसार शासी मंडल का पुनर्गठन आवश्यक हो गया है ;
और जबकि उक्त अध्यादेश द्वारा जोड़ी गई उक्त अधिनियम की धारा 3 क क में के न्H सरकार से अपेक्षा की गई है कि वह वह धारा 3 की उपधारा (1) के तहत 15 मई, 2013 से प्रभावी एक सौ अस्सी दिनों की अवधि के भीतर परिषद को पुनर्गठित करे ;
और जबकि के न्H सरकार ने भारतीय आयु[व)ान परिषद अधिनियम, 1956 (1956 का 102) की धारा 3 की उपधारा (1) के खंड (ग) के अनुसरण में पंजीकृ त आयु[व)ान स्नातक निर्वाचन क्षेत्रों से सदस्यों का निर्वाचन किया और निम्नलिखित hयक्ति को इस अधिसूचना के जारी होने की तिथि से चार वषd के लिए भारतीय आयु[व)ान परिषद के सदस्य के रूप में निर्वाचित किया गया है।
अत: अब उक्त अधिनियम की धारा 3 की उपधारा (1) के उपबंध के अनुसरण में के न्H सरकार द्वारा भारत सरकार के तत्कालीन स्वास्थ्य मंत्रालय की दिनांक 9 जनवरी, 1960 की अधिसूचना संख्या का.आ. 138 में निम्नलिखित संशोधन किए जाते हैं ; अर्थात :-

काकाकाका....आआआआ....3325 (3325 (3325 (3325 (अअअअ).).).).————जबकि भारतीय आयु[व)ान परिषद अधिनियम, 1956 (1956 का 102) (इसके बाद इसमें उक्त अधिनियम के रूप में उल्लिखित) की धारा 3 क की उपधारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग करते 'ए, दिनांक 15 मई, 2010 को भारतीय आयु[व)ान परिषद का अधि(cid:1)मण किया गया और उक्त परिषद के अध्यक्ष, उपाध्यक्ष एवं सभी अन्य सदस्यों ने अपने पदों को रिक्त कर दिया;
और जबकि परिषद के अधि(cid:1)मण के उपरांत के न्H सरकार ने उस अंतराल के दौरान परिषद के कार्य-निष्पादन हेतु भारत सरकार, स्वास्थ्य एवं परिवार कल्याण मंत्रालय के दिनांक 15 मई, 2010 की अधिसूचना संख्या का.आ.
1123 (अ) के तहत शासी मंडल का गठन किया;
और जबकि भारतीय आयु[व)ान परिषद (संशोधन) अिधिनयम, 2011 (2011 का 13) द्वारा शासी मंडल का कार्यकाल दो वषd के लिए बढ़ाया गया था और पुन: भारतीय आयु[व)ान परिषद (संशोधन) अिधिनयम, 2012 (2012 का 20) द्वारा उसके कार्यकाल को तीन वषd के लिए बढ़ाया गया, जो 15 मई, 2010 से प्रभावी 'आ था ;
और जबकि शासी मंडल का 3 वषd का कार्यकाल 14 मई, 2013 को समाप्त हो गया और इसिलए भारतीय आयु[व)ान परिषद (संशोधन) द्वितीय अध्यादेश, 2013 (2013 का 11) - िजसे राष्ट्रपति द्वारा दिनांक 28 िसतंबर,8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2013 को प्रख्यापित किया गया जो दिनांक 15 मई, 2013 से प्रभावी हो गया-में उल्लिखित उपबंधों के अनुसार शासी मंडल का पुनर्गठन आवश्यक हो गया है ;
और जबकि उक्त अध्यादेश द्वारा जोड़ी गई उक्त अधिनियम की धारा 3 क क में के न्H सरकार से अपेक्षा की गई है कि वह धारा 3 की उपधारा (1) के तहत 15 मई, 2013 से प्रभावी एक सौ अस्सी दिनों की अवधि के भीतर परिषद को पुनर्गठित करे ;
और जबकि के न्H सरकार ने भारतीय आयु[व)ान परिषद अधिनियम, 1956 (1956 का 102) की धारा 3 की उपधारा (1) के खंड ([k) के अनुसरण में और संबंधित विश्वविद्यालयों/स्वास्थ्य वि)ान विश्वविद्यालयों द्वारा यथा सूिचत, निम्नलिखित hयक्ति को इस अधिसूचना के जारी होने की तिथि से चार वषd के लिए भारतीय आयु[व)ान परिषद के सदस्य के रूप में निर्वाचित किया गया है।
अत: अब उक्त अधिनियम की धारा 3 की उपधारा (1) के उपबंध के अनुसरण में के न्H सरकार द्वारा भारत सरकार के तत्कालीन स्वास्थ्य मंत्रालय की दिनांक 9 जनवरी, 1960 की अधिसूचना संख्या का.आ. 138 में निम्नलिखित संशोधन किए जाते हैं ; अर्थात :-

NOTIFICATION
New Delhi, the 5th November, 2013
S.O. 3325 (E).—Whereas on 15th May 2010, the Medical Council of India was superseded in exercise of the powers conferred by sub-section (1) of section 3A of the Indian Medical Council Act, 1956 (102 of 1956) (hereinafter referred to as the said Act) and the President, Vice-President and all other Members of the said Council vacated their offices;
And whereas, on supersession of the Council, the Central Government constituted the Board of Governors vide notification of the Government of India, Ministry of Health & Family Welfare number S.O. 1123 (E) dated the 15th May, 2010 to perform the functions of the Council during the interregnum;
And whereas, the term of the Board of Governors had been extended to two years by the Indian Medical Council (Amendment) Act, 2011 (13 of 2011) and it was further extended upto three years by the Indian Medical Council (Amendment) Act, 2012 (20 of 2012), with effect from 15th May, 2010;
And whereas, the three year term of the Board of Governors had expired on the 14th May, 2013 and therefore, it has become necessary to go for reconstitution of the Board of Governors in accordance with the provisions of the Indian Medical Council (Amendment) Second Ordinance, 2013 (11 of 2013), which was promulgated by the President on 28th September, 2013, which came into force with effect from the 15th day of May 2013;
And whereas, section 3AA of the said Act, as inserted by the said Ordinance, requires the Central Government to reconstitute the Council under sub-section (1) of section 3 within a period of one hundred and eighty days with effect from the 15th day of May, 2013;
And whereas the Central Government, in pursuance of clause (b) of sub-section (1) of section 3 of the Indian Medical Council Act, 1956 (102 of 1956) and as informed by the respective universities/health science universities, the following have been elected to be a member of the Medical Council of India for four years with effect from the date of issue of this notification.
Now, therefore, in pursuance of the provision of sub section (1) of Section 3 of the said Act, the Central Government hereby makes the following amendment in the Notification of the Government of India in the then Ministry of Health number S.O. 138 dated the 9th January, 1960, namely: -

14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]और जबकि शासी मंडल का 3 वषd का कार्यकाल 14 मई, 2013 को समाप्त हो गया और इसिलए भारतीय आयु[व)ान परिषद (संशोधन) द्वितीय अध्यादेश, 2013 (2013 का 11)- जिसे राष्ट्रपति द्वारा दिनांक 28 िसतंबर, 2013 को प्रख्यापित किया गया जो दिनांक 15 मई, 2013 से प्रभावी हो गया-में उल्लिखित उपबंधों के अनुसार शासी मंडल का पुनर्गठन आवश्यक हो गया है ;
और जबकि उक्त अध्यादेश द्वारा जोड़ी गई उक्त अधिनियम की धारा 3 क क में के न्H सरकार से अपेक्षा की गई है कि वह धारा 3 की उपधारा (1) के तहत 15 मई, 2013 से प्रभावी एक सौ अस्सी दिनों की अवधि के भीतर परिषद को पुनर्गठित करे ;
और जबकि के न्H सरकार ने भारतीय आयु[व)ान परिषद अधिनियम, 1956 (1956 का 102) की धारा 3 की उपधारा (1) के खंड (ड.) के अनुसरण में निम्नलिखित hयक्ति को इस अधिसूचना के जारी होने की तिथि से चार वषd के लिए भारतीय आयु[व)ान परिषद के सदस्य के रूप में euksuhr किया है।
अत: अब उक्त अधिनियम की धारा 3 की उपधारा (1) के उपबंध के अनुसरण में के न्H सरकार द्वारा भारत सरकार के तत्कालीन स्वास्थ्य मंत्रालय की दिनांक 9 जनवरी, 1960 की अधिसूचना संख्या का.आ. 138 में निम्नलिखित संशोधन किए जाते हैं ; अर्थात :-
उक्त अधिसूचना में, ''धारा 3 की उपधारा (1) के खंड (ड.) के तहत euksuhr'' शीर्षक के अंतर्गत के न्H सरकार निम्निलिखत को euksuhr करती है :

S.O. 3326 (E).— Whereas on 15th May 2010, the Medical Council of India was superseded in exercise of the powers conferred by sub-section (1) of section 3A of the Indian Medical Council Act, 1956 (102 of 1956) (hereinafter referred to as the said Act) and the President, Vice-President and all other Members of the said Council vacated their offices;
And whereas, on supersession of the Council, the Central Government constituted the Board of Governors vide notification of the Government of India, Ministry of Health & Family Welfare number S.O. 1123 (E) dated the 15th May, 2010 to perform the functions of the Council during the interregnum;
And whereas, the term of the Board of Governors had been extended to two years by the Indian Medical Council (Amendment) Act, 2011 (13 of 2011) and it was further extended upto three years by the Indian Medical Council (Amendment) Act, 2012 (20 of 2012), with effect from 15th May, 2010;
And whereas, the three year term of the Board of Governors had expired on the 14th May, 2013 and therefore, it has become necessary to go for reconstitution of the Board of Governors in accordance with the provisions of the Indian Medical Council (Amendment) Second Ordinance, 2013 (11 of 2013), which was promulgated by the President on 28th September, 2013, which came into force with effect from the 15th day of May 2013;
And whereas, section 3AA of the said Act, as inserted by the said Ordinance, requires the Central Government to reconstitute the Council under sub-section (1) of section 3 within a period of one hundred and eighty days with effect from the 15th day of May, 2013;
And whereas the Central Government, in pursuance of clause (e) of sub-section (1) of section 3 of the Indian Medical Council Act, 1956 (102 of 1956), the following have been nominated to be a member of the Medical Council of India for four years with effect from the date of issue of this notification.
Now, therefore, in pursuance of the provision of sub-section (1) of Section 3 of the said Act, the Central Government hereby makes the following amendment in the Notification of the Government of India in the then Ministry of Health number S.O. 138 dated the 9th January, 1960, namely:

काकाकाका....आआआआ.... 3327 (3327 (3327 (3327 (अअअअ).).).).———— जबकि भारतीय आयु[व)ान परिषद अधिनियम, 1956 (1956 का 102) (इसके बाद इसमें उक्त अधिनियम के रूप में उल्लिखित) की धारा 3 क की उपधारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग करते 'ए, दिनांक 15 मई, 2010 को भारतीय आयु[व)ान परिषद का अधि(cid:1)मण किया गया और उक्त परिषद के अध्यक्ष, उपाध्यक्ष एवं सभी अन्य सदस्यों ने अपने पदों को रिक्त कर दिया;
और जबकि परिषद के अधि(cid:1)मण के उपरांत के न्H सरकार ने उस अंतराल के दौरान परिषद के कार्य-निष्पादन हेतु भारत सरकार, स्वास्थ्य एवं परिवार कल्याण मंत्रालय के दिनांक 15 मई, 2010 की अधिसूचना संख्या का.आ.
1123 (अ) के तहत शासी मंडल का गठन किया;
और जबकि भारतीय आयु[व)ान परिषद (संशोधन) अिधिनयम, 2011 (2011 का 13) द्वारा शासी मंडल का कार्यकाल दो वषd के लिए बढ़ाया गया था और पुन: भारतीय आयु[व)ान परिषद (संशोधन) अिधिनयम, 2012 (2012 का 20) द्वारा उसके कार्यकाल को तीन वषd के लिए बढ़ाया गया, जो 15 मई, 2010 से प्रभावी 'आ था ;
