संसंसंसं.... एल-1/(5)/2013/केविविआएल-1/(5)/2013/केविविआएल-1/(5)/2013/केविविआएल-1/(5)/2013/केविविआ.—केन्द्रीय विद्युत विनियामक आयोग, विद्युत अधिनियम, 2003 की धारा 178 के अधीन प्रदत शक्तियों तथा इस निमित सामथ्र्यकारी सभी शक्तियों का प्रयोग करते हुए तथा पूर्व प्रकाशन के पश्चात्, केन्द्रीय विद्युत विनियामक आयोग (कारबार संचालन) विनियम 1999 (जिसे इसके पश्चात 'मूल विनियम' कहा गया है) का संशोधन करने के लिए निम्नलिखित विनियम बनाता है, अर्थात्ः-
1111.... सक्षिप्त नाम तथा प्रारंभसक्षिप्त नाम तथा प्रारंभसक्षिप्त नाम तथा प्रारंभसक्षिप्त नाम तथा प्रारंभ (1) इन विनियमों का संक्षिप्त नाम केन्द्रीय विद्युत विनियामक आयोग (कारबार संचालन) विनियम, 2013 है।
(2) ये विनियम राजपत्र में प्रकाशन की तारीख से प्रवृत होंगे।
2222.... मूल विनियमों के मूल विनियमों के मूल विनियमों के मूल विनियमों के विनियम 101 का संशोधनविनियम 101 का संशोधनविनियम 101 का संशोधनविनियम 101 का संशोधन ःःःः मूल विनियम के विनियम 101 के स्थान पर, निम्नलिखित विनियम रखा जाएगा, अर्थात्ः-

101. टैरिफ याचिकाओं तथा अनुज्ञप्ति प्रदान करने के लिए आवेदनों के संबंध में विद्युत अधिनियम, 2003 की धारा 143 के संबंध में तथा विद्युत अधिनियम, 2003 की धारा 143 के अधीन कार्यवाहियों की बाबत न्यायनिर्णयन अधिकारी नियम, 2004 द्वारा जांच करने की प्रक्रिया या पुनर्विलोकन याचिकाओं की बाबत इन विनियमों के विनियम 103 में अन्यथा उपबंधित के सिवाय, आयोग याचिकाओं को स्वीकार करने की तारीख से छह मास की अवधि के भीतर अंतिम रूप से निपटाएगा :
पंरतु यह कि जहां याचिकाओं का छह मास के भीतर निपटान नहीं किया जाता है, वहां आयोग याचिकाओं के निपटान के लिए दिए गए समय हेतु कारणों को अभिलिखित करेगा।"

3333.... विनियम 103 का संशोधन : विनियम 103 का संशोधन : विनियम 103 का संशोधन : विनियम 103 का संशोधन : मूल विनियम के विनियम 103 के स्थान पर, निम्नलिखित रखा जाएगा :

"103.(1) आयोग, इस प्रकार के निर्णय, निर्देश या आदेश के 45 दिनों के भीतर किसी व्यक्ति या संबंधित पार्टी द्वारा आवेदन किए जाने पर इस प्रकार के निर्णय, निर्देशों या आदेशों का पुनर्विलोकन कर सकेगा और ऐसे समुचित आदेश पारित कर सकेगा जैसा आयोग ठीक समझे।
2. ऐसे पुनर्विलोकन के लिए आवेदन को उसी रीति से फाइल किया जाएगा जैसा इन विनियमों के अध्याय II के अंतर्गत याचिकाओं में किया जाता है।
3. पुनर्विलोकन के लिए आवेदन को, ऐसे आवेदन को फाइल करने की तारीख से 15 दिनों की अवधि के भीतर आयोग के समक्ष सूचीबद्ध किया जाएगा।
4. यदि पुनर्विलोकन याचिका को स्वीकार नहीं किया जाता है तो उसे सुनवाई की तारीख से 15 दिनों के भीतर निपटाया जाएगा और यदि आवेदन को स्वीकार किया जाता है तो उसे स्वीकार करने की तारीख से दो मास की अवधि के भीतर निपटाया जाएगा :
परंतु यह कि जहां पुनर्विलोकन आवेदनों को यथाअनुबंधित समय के भीतर निपटाया नहीं जाता है वहां आयोग पुनर्विलोकन आवेदनों के निपटान हेतु लिए गए अतिरिक्त समय के कारणों को अभिलिखित करेगा।
4444.... नए विनियम नए विनियम नए विनियम नए विनियम का अंतःस्थापनका अंतःस्थापनका अंतःस्थापनका अंतःस्थापन ःःःः मूल विनियम के विनियम 103 के पश्चात्, एक नया नियम अंतःस्थापित किया जाएगा।

"103(क) आदेशों में लिपिकीय या गणितीय त्रुटियों या किसी आकस्मिक चूक से उद्भूत गलतियों को आयोग द्वारा किसी भी समय स्वप्रेरणा से या किसी पक्षकार द्वारा किए गए आवेदन के आधार पर सुधारा जा सकेगा।"

मूल विनियमों को तारीख 26.4.1999 को भारत के राजपत्र, भाग III, खंड 4 में अधिसूचित किया गया था और उनका समय-समय पर निम्नानुसार संशोधन किया गया था :
(i) इन विनियमों के शुद्धिपत्र को तारीख 31.5.1999 को भारत के राजपत्र (असाधारण), भाग III, खंड 4 में प्रकाशित किया गया था।
(ii) केंद्रीय विद्युत विनियामक आयोग (कारबार संचालन) (प्रथम संशोधन), विनियम, 2000 तारीख 10.5.2000 को भारत के राजपत्र (असाधारण), भाग III, खंड 4 में प्रकाशित किए गए थे।
(iii) केंद्रीय विद्युत विनियामक आयोग (कारबार संचालन) (पहला संशोधन) विनियम, 2002 तारीख 9.12.2002 को भारत के राजपत्र (असाधारण), भाग III, खंड 4 में प्रकाशित किए गए थे।
(iv) केंद्रीय विद्युत विनियामक आयोग (कारबार संचालन) (पहला संशोधन) विनियम, 2009 तारीख 28.5.2009 को भारत के राजपत्र (असाधारण), भाग III, खंड 4 में प्रकाशित किए गए थे।

CENTRAL ELECTRICITY REGULATORY COMMISSION
NOTIFICATION
New Delhi, the 12th November, 2013
No. L-1/(5)/2013/CERC.—In exercise of powers conferred under Section 178 of the Electricity Act, 2003 and all other powers enabling it in this behalf, and after previous publication, the Central Electricity Regulatory Commission hereby makes the following regulations, to amend Central Electricity Regulatory Commission (Conduct of Business) Regulations, 1999, (hereinafter referred to as "the Principal Regulations"), namely :
1. Short title and commencement : (1) These regulations may be called the Central Electricity Regulatory Commission (Conduct of Business) (Amendment) Regulations, 2013.
(2) These regulations shall come into force with effect from the date of their publication in the Official Gazette.
2. Amendment of Regulation 101 of the Principal Regulations: Regulation 101 of the Principal Regulations shall be substituted as under, namely :
Time limit for disposal of petitions other than review petitions
"101. Save as otherwise provided in the Electricity Act, 2003 with regard to tariff petitions and applications for grant of license or in the Procedure for holding Inquiry by Adjudicating officer Rules, 2004 in respect of the proceedings under Section 143 of the Electricity Act, 2003 or in Regulation 103 of these regulations in respect of review petitions, the Commission shall dispose of the petitions finally within a period of six months from the date of admission.
Provided that where the petitions are not disposed of within six months, the Commission shall record the reasons for the time taken for disposal of the petitions."
3. Amendment of Regulations 103: Regulation 103 of Principal Regulations shall be substituted as under:
Review of Decisions, Directions and orders "103.(1) The Commission may, on an application of any of the persons or parties concerned made within 45 days of making such decision, directions or order, review such decision, directions or orders and pass such appropriate orders as the Commission deems fit. (2) An application for such review shall be filed in the same manner as a Petition under Chapter II of these Regulations. (3) An application for review shall be listed before the Commission within a period of 15 days from the date of filing such application. (4) The Review applications shall be disposed of within 15 days from the date of hearing if the review is not admitted and within a period of two months from the date of admission if the application is admitted.
Provided that where the review applications cannot be disposed of within the period as stipulated, the Commission shall record the reasons for the additional time taken for disposal of the review applications." 4. Insertion of new Regulation: The following new Regulation shall be inserted after Regulation 103 of the Principal Regulations.
Amendment of orders "103A. Clerical or arithmetical mistakes in the orders or errors arising therein from any accidental slip or omission may at any time be corrected by the Commission either of its own motion or on the application of any of the parties."
