यह प्रकरण जवाहरलाल नेहरू पत्तन न्यास ;जेएनपीटीद्धस्थित भारत पैट्रोलियम कार्पोरेशन लिमिटेड ;बीपीसीएलद्ध द््वारा प्रचलित लीक्विड कार्गो जैटट््ी के प्रचलित प्रशुल्क की वैध्ता के विस्तार से संबंध्ति है ।
2. कथित लीक्विड कार्गो जैटट््ी का प्रचलित प्रशुल्क इस प्राध्किरण द््वारा पिछली बार आदेश सं. टीएएमपी/10/2010-बीपीसीएल दिनांक 3 सितंबर, 2010 के जरिये अनुमोदित किया गया था जिसे 12 अक्तूबर, 2010 को भारत का राजपत्रा में अध्सिूचित किया गया था । वह आदेश दरमान/प्रशुल्क कीे वैध्ता 31 मार्च, 2013 तक प्रदान करता है बाद में, प्रचलित दरमान/प्रशुल्क की वैध्ता इस प्राध्किरण द््वारा दिनांक 9 मई, 2013 के अपने पत्रा द््वारा 30 सितंबर, 2013 तक विस्तारित की गई थी ।
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]4. प्रचलित दरमान/प्रशुल्क की वैध्ता 30 सितंबर, 2013 को समाप्त हो गई है इस प्रकरण पर अंतिम विचारार्थ परिपक्व होने में लगने वाले समय को स्वीकार करते हुए, ऊपर वणत स्थिति को देखते हुए यह प्राध्किरण बीपीसीएल के प्रचलित दरमान/प्रशुल्क की वैध्ता इसके समाप्त होने की तिथि से 31 दिसंबर, 2013 तक अथवा संशोध्ति दरमान के क्रियान्वयन की प्रभावी तिथि तक इनमें से जो भी पहले हो, विस्तारित करता है ।
5. इसकी निष्पादनता की समीक्षा के दौरान 1 अप्रैल, 2013 के बाद की अवध् िके लिये स्वीकार्य लागत और अनुमेय प्रतिलाभ से अध्कि यदि कोई अतिरिक्त अध्शिेष उभरता है तो ऐसा अतिरिक्त अध्शिेष निर्धरित किये जाने वाले प्रशुल्क में पूरा-पूरा समायोजित किया जाएगा ।

TARIFF AUTHORITY FOR MAJOR PORTS
NOTIFICATION
Mumbai, the 12th November, 2013
No. TAMP/10/2010-BPCL.— In exercise of the powers conferred under Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the tariff at the liquid cargo jetty operated by the Bharat Petroleum Corporation Limited at the Jawaharlal Nehru Port Trust as in the Order appended hereto.

This relates to extension of the validity of the existing tariff at the liquid cargo jetty operated by the Bharat Petroleum Corporation Limited (BPCL) at the Jawaharlal Nehru Port Trust (JNPT).
2. The existing tariff at the said liquid cargo jetty was last approved by this Authority vide Order No.TAMP/10/ 2010-BPCL dated 3 September, 2010 which was notified in the Gazette of India on 12 October, 2010. The Order prescribes the validity of the SOR till 31 March, 2013. Subsequently, the validity of the existing SOR was extended by this Authority till 30 September, 2013 vide Order its dated 9 May, 2013.
3. The BPCL has filed its proposal vide its letters dated 16 October, 2012 and 18 February, 2013 which is registered as tariff case and is taken on consultation. Joint hearing on the proposal was held on 30 August, 2013. As agreed at the joint hearing, the BPCL and JNPT were requested to initiate action and furnish information on a few points and also furnish the additional information/ clarifications sought vide our letter dated 18 June, 2013 by 6 September, 2013. The BPCL vide letters dated 2 September, 2013 and 3 September, 2013 has furnished response on the queries raised vide our letter dated 18 June, 2013. The JNPT has also furnished its response vide its letter dated 15 October, 2013. Considering the time will be required to examine the information /clarifications furnished by BPCL, and from JNPT on receipt of response from the port it will take some more time for the case to mature for consideration of the Authority.
4. The validity of the existing SOR expired on 30 September, 2013. Recognizing the time required for this case to mature for final consideration, in view of the position explained above, this Authority extends the validity of the existing SOR of the BPCL from the date of its expiry till 31 December, 2013 or till the effective date of implementation of the revised Scale of Rates, whichever is earlier.
