का.आ. 3454(अ) .-नालंदा विश्वविद्यालय अधिनियम, 2010 (2010 का 39) ( जिसे इसमें इसके पश्चात् " नालंदा अधिनियम" कहा गया है) 21 सितंबर, 2010 को अधिनियमित किया गया था और उक्त अधिनियम के उपबंधों को 25 नवंबर, 2010 को प्रवृत्त किया गया था;
और, नालंदा अधिनियम की धारा 7 विश्वविद्यालय के शासी बोर्ड के गठन के लिए उपबंध करती है;
और , नालंदा अधिनियम की धारा 8 की उपधारा (2) का परंतुक यह उपबंध करता है कि नालंदा परामर्शदाता समूह , शासी बोर्ड की शक्तियों का प्रयोग और कर्तव्यों का निर्वहन एक वर्ष की अवधि या धारा 7 की उपधारा ( 1 ) के खंड (ग) से खंड (छ) में निर्दिष्ट सदस्यों को नामनिर्देशित किए जाने तक, इनमें से जो भी पूर्वतर हो, करेगा;

और नालंदा परामर्शदाता समूह 25 नवंबर , 2010 से शासी बोर्ड के रूप में कृत्य कर रहा है और नालंदा अधिनियम की धारा 8 की उपधारा (2) के परंतुक के उपबंधों के अनुसार उसकी सेवाधृति 24 नवंबर , 2011 तक था;
और , नालंदा अधिनियम की धारा 41 की उपधारा ( 1 ) के उपबन्धों के अधीन, कठिनाइयों को दूर करने के प्रयोजन से, धारा 8 की उपधारा (2 ) के परन्तुक में " एक वर्ष" की अवधि को तारीख 24 नवम्बर , 2011 को का.आ. सं. 2626 (अ ) द्वारा बढ़ा कर "दो वर्ष " कर दिया गया था; और उसके पश्चात् तारीख 23 नवंबर, 2012 को का.आ. सं. 2774 (अ ) द्वारा बढ़ाकर " तीन वर्ष" कर दिया गया था;
और , सरकार ने नालंदा अधिनियम की धारा 7 के उपबंधों के अनुसार शासी बोर्ड के सदस्यों का चयन करने और नामनिर्देशन करने की प्रक्रिया पहले ही आरंभ कर दी है , जिसमें कुछ और समय लगने की संभावना है;
और , नालंदा अधिनियम की धारा 7 शासी बोर्ड के गठन के लिए उपबंध करती है , जो अन्य बातों के साथ -साथ , पूर्वी एशिया शिखर सम्मेलन के सदस्य देशों में से पांच सदस्यों और ऐसे व्यक्तियों में से, जो कि प्रख्यात् विद्वान या शिक्षाविद् हैं के तीन सदस्यों से मिलकर बनेगा , जिन्हें केंद्रीय सरकार द्वारा नामनिर्देशित किया जाएगा;
और, नालंदा अधिनियम की धारा 7 के निबंधनों के अनुसार शासी बोर्ड के सदस्यों के चयन के लिए उक्त अधिनियम में न केवल संशोधन करने होंगे , बल्कि पूर्वी एशिया शिखर सम्मेलन के सदस्य देशों के साथ विचार- विमर्श और प्रख्यात विद्वानों और शिक्षाविदों के चयन पर विचार किए जाने की अपेक्षा होगी;
और , जबकि सरकार ने नालंदा अधिनियम, जो 26 अगस्त, 2013 को राज्य सभा में नालंदा विश्वविद्यालय (संशोधन) विधेयक, 2013 पुनःस्थापना करके शासी बोर्ड के गठन का मार्ग प्रशस्त करती है , नालंदा अधिनियम की धारा 7 में परिवर्तन करने की प्रक्रिया पहले ही प्रारंभ कर दी थी , और संसद द्वारा विधेयक पारित करने में कुछ और समय लगने की संभावना है;
और, नालंदा परामर्शदाता समूह , जो विश्वविद्यालय के शासी बोर्ड के रूप में कार्य कर रहा है, के आज की तारीख में विघटन के कारण विश्वविद्यालय और उसके शासन के चल रहे कार्यक्रमों का कार्यान्वयन रुक जाएगा;
और , यद्यपि, सरकार शासी बोर्ड का गठन करने के लिए तत्परता से सभी उपाय कर रही है , किंतु नालंदा अधिनियम के उपबंधों को प्रभावी करने में यह एक वास्तविक कठिनाई है और इसलिए इस कठिनाई को दूर करने के लिए एक आदेश जारी करने का प्रस्ताव किया जाता है;
अतः , अब केंद्रीय सरकार, नालंदा अधिनियम की धारा 41 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ऐसी कठिनाइयों को दूर करने के लिए निम्नलिखित आदेश करती है , अर्थात्ः- 3

1. ( 1 ) इस आदेश का संक्षिप्त नाम नालंदा विश्वविद्यालय (कठिनाइयों को दूर करना) आदेश , 2013 है ।
(2) ये शासकीय राजपत्र में प्रकाशन की तारीख से प्रवृत्त होगा ।
2. नालंदा अधिनियम की धारा 8 की उपधारा (2) के परंतुक में, निम्नलिखित परंतुक रखे जाएंगे :-
"परंतु यह कि नालंदा परामर्शदाता समूह शक्तियों का प्रयोग करेगा और धारा 7 की उप- धारा ( 1 ) के खण्ड (ग) से (छ) में निर्दिष्ट सदस्यों के नामनिर्देशित किए जाने तक शासी बोर्ड के कार्यों का निष्पादन करेगा। "

ORDER New Delhi , the 21st November , 2013 .
3454 ( E ) .-Whereas , the Nalanda University Act , 2010 (39 of 2010 ) (hereinafter referred to as the 'Nalanda Act' ) was enacted on 21st September , 2010 and the provisions of the said Act were brought into force on the 25th day of November, 2010 ;
And whereas , Section 7 of the Nalanda Act makes provision for constitution of the Governing Board of the University;
And whereas , the proviso to Sub - section (2 ) of Section 8 of the Nalanda Act provides that the Nalanda Mentor Group shall exercise the powers and discharge the functions of the Governing Board for a period of one year or till such time the members referred to in clauses (c ) to (g ) of Sub - section ( 1 ) of Section 7 are nominated , whichever is earlier ;
And whereas , the Nalanda Mentor Group has been functioning as the Governing Board since 25th November , 2010 and its tenure in terms of the proviso to Sub - section (2 ) of Section 8 of the Nalanda Act was upto the 24th day of November , 2011 ;
And whereas , under the provisions of Sub - section ( 1 ) of Section 41 of the Nalanda Act, for the purpose of removal of difficulties , the period of 'one year' in the proviso to Sub- section (2) of Section 8 was first extended to ' two years ' vide order number S.O. 2626 (E ) , dated the 24th November, 2011 , and thereafter to' three years' vide order number S.O. 2774 (E ) , dated the 23rd November , 2012;
And whereas , the Government had already initiated the process to select and nominate members of the Governing Board in terms of Section 7 of the Nalanda Act, and the same is likely to take some more time ;
And whereas, Section 7 of the Nalanda Act provides for the composition of the Governing Board which, inter alia, consists of five members from amongst the Member States of the East Asia Summit and three members from amongst the persons being renowned academicians or educationists ,to be nominated by the Central Government;
And whereas , the process for selection of the members of the Governing Board in terms of Section 7 of the Nalanda Act would not only require amendments to the said Act, but also consultations with the Member States of the East Asia Summit and consideration of selection of the renowned academicians and educationists ;

And whereas , the Government had already initiated the process of making changes in Section 7 of the Nalanda Act which provides for the composition of the Governing Board, by introducing the Nalanda University ( Amendment) Bill, 2013 in the Rajya Sabha on the 26th August, 2013 , and the passing of the Bill by Parliament is likely to take some more time;
And whereas , the dissolution of the Nalanda Mentor Group which is working as the Governing Board of the University as on date will cause discontinuity in the implementation of the ongoing programmes of the University and its governance;
And whereas , though the Government is taking all steps to promptly constitute the Governing Board , but there is genuine difficulty in giving effect to the provisions of the Nalanda Act and , therefore , it is proposed to issue an Order further to remove this difficulty .
Now, therefore , in exercise of the powers conferred by Sub- section ( 1 ) of Section 41 of the Nalanda Act , the Central Government hereby makes the following order, to remove such difficulty , namely: -
1. (1 ) This order may be called the Nalanda University (Removal of Difficulties ) Order, 2013 .
(2) It shall come into force on the date of its publication in the Official Gazette .
2. In the Nalanda Act, in Section 8 , in sub- section (2) , for the proviso , the following proviso shall be substituted , namely:-
"Provided that the Nalanda Mentor Group shall exercise the powers and discharge the functions of the Governing Board until the members referred to in clauses (c) to (g ) of Sub - section ( 1 ) of Section 7 are nominated. "
