(1)THE GAZETTE OF INDIA : EXTRAORDINARY 2 [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग षुल्क (दरों का अवधारण और संग्रहण) नियम, 2008, जिसे सा.का.नि 838 (अ), दिनांक 05.12.2008 द्वारा प्रकाषित किया गया था और जिसमें सा.का.नि 950 (अ), तारीख 3 दिसम्बर 2010, सा.का.नि 15 (अ), तारीख 12 जनवरी, 2011 और सा.का.नि 756 (अ), तारीख 12 अक्तूबर , 2011 द्वारा संषोधन किए गए थे (जिन्हेें इसमें इसके पष्चात्‌ ''नियमों'' के रूप में संदर्भित किया गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त षक्तियों का प्रयोग करते हुए, उक्त खण्ड के निर्माण, अनुरक्षण, प्रबंध और प्रचालन पर हुए व्यय, निवेषित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम, यातायात का दबाव और प्राधिकरण तथा रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए, एतद्‌द्वारा यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक वाहनों पर सड़क खण्ड की निवल लम्बाई 79.460 कि.मी. हेतु चार और अधिक लेन के खण्डों के उपयोग के लिए सारणी 1 के स्तम्भ (2) में विनिर्दिष्ट दर पर ( जिसे इसमें इसके पष्चात्‌ ''आधार दर'' संदर्भित किया गया है ) और नीचे सारणी 1 में विनिर्दिष्ट प्रकार के वाहनों पर उन बाइपासों, जिनकी कुल लम्बाई 8.400 कि.मी. है, के लिए आधार दर के 150% पर और दो लेन के बाइपास, जिसकी कुल लम्बाई 32. 600 कि.मी. है, के लिए आधार दर के 90% पर और पचास करोड़ रूपए अथवा अधिक की लागत वाले स्थायी पुल के लिए नीचे सारणी 2 में विनिर्दिष्ट प्रकार के वाहनों पर सारणी 2 में विनिर्दिष्ट आधार दर पर षुल्क उद्‌ग्रहीत एवं संग्रहीत किया जाएगा और उक्त रियायतग्राही को प्राधिकरण द्वारा घोषित वाणिज्यिक प्रचालन की तारीख को और उस तारीख से और प्राधिकरण से समापन प्रमाणपत्र अथवा अनंतिम प्रमाणपत्र, जैसी भी स्थिति हो, प्राप्त करने पर या इस अधिसूचना के राजपत्र में प्रकाषन पर, जो भी बाद में हो, करार में विनिर्दिष्ट समाप्ति की तारीख तक, षुल्क को संग्रहीत और प्रतिधारित करने हेतु प्राधिकृत करती है;

1. नीचे उद्‌ग्रहीत तथा संग्रहीत षुल्क, निम्नलिखित टोल प्लाजा पर, ऐसे टोल प्लाजा (प्लाजाओं) के लिए विनिर्दिष्ट दूरी हेतु , षोध्य और संदेय होगाः टोल प्लाजा का अवस्थान (चैनेज) लम्बाई (कि.मी. में)

2. उपर्युक्त के अतिरिक्त, निम्नलिखित स्थायी पुल, जिसकी लागत नीचे दी गई है, के उपयोग के लिए, ऊपर सारणी 2 में उल्लिखित आधार दरों पर निम्नलिखित षुल्क भी निम्नलिखित टोल प्लाजा (प्लाजाओं) पर षोध्य और संदेय होगा ।

3. उपर्युक्त के अतिरिक्त, निम्नलिखित बाइपास (बाइपासों) के उपयोग के लिए, निम्नलिखित टोल प्लाजा (प्लाजाओं) पर, ऐसे टोल प्लाजा (प्लाजाओं) हेतु बाइपास (बाइपासों) की विनिर्दिष्ट लम्बाई के लिए, निम्नलिखित षुल्क भी षोध्य और संदेय होगाः

4. जिस व्यक्ति का अपना यांत्रिक वाहन गैर-वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से बीस कि.मी. तक की दूरी में ही रहता हो उसके लिए वर्ष 2013-14 के लिए मासिक पास की दर 215.00 रूपए (दो सौ पन्द्रह रूपए मात्र) होगी और राष्ट्रीय राजमार्ग षुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संषोधन किया जायेगा ।

5. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जायेगा, अर्थात्‌ :-

6. जिस जिले में षुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए षुल्क उस श्रेणी के वाहन के लिए निर्धारित षुल्क का 50% होगा बषर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो । 7. जो यांत्रिक वाहन नियमों के अधीन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर षुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए । 8. यांत्रिक वाहनों की श्रेणी, उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्विस रोड वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।

9. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए षुल्क की दरों को प्रदर्षित किया जाएगा।

10. ऊपर सारणी 1 तथा 2 में यथा-उल्लिखित आधार वर्ष 2007-08 के प्रति कि.मी. षुल्क की आधार दर के आधार पर, यांत्रिक वाहनों सेे लिए जाने वाले वास्तविक षुल्क और छूट की गणना प्राधिकरण द्वारा की जाएगी । उसे प्राधिकरण द्वारा अंग्रेजी और स्थानीय भाषा के कम से कम एक-एक समाचार पत्र में प्रकाषित कराया जाएगा और इसके पष्चात्‌ उक्त नियमों के नियम 5 और रियायत करार के प्रावधानों के अनुसार इसमें वार्षिक तौर पर संषोधन किया जाएगा और इसे रियायतग्राही के माध्यम से प्रकाषित किया जाएगा, परन्तु षर्त यह है कि षुल्क के पिछले संषोधन की तारीख से छह मास की अवधि के भीतर को संषोधन नहीं किया जाएगा ।

NOTIFICATION

New Delhi, the 26th November, 2013

S.O. 3522(E).—Whereas by Notification of the Government of India in the Ministry

of Road Transport and Highways number S.O. 910(E), dated 21.04.2010, issued under

Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988),

(hereinafter referred to as said Act), the Central Government has entrusted the stretch

from km 0.600 to km 256.400 of Obedullaganj-Betul-Multai-MP/ Maharashtra Border

section of National Highway No. 69 in the State of Madhya Pradesh to the National

Highways Authority of India (hereinafter referred to as the Authority);

And whereas, pursuant to the provision of section 14 of the said Act, the Authority has entered into an agreement on 30.04.2012 (hereinafter referred to as said agreement) with M/s. Transstroy Obedullaganj-Betul Tollways Pvt. Ltd., having its registered office at 8-3-833/104, Main Road, Kamalapuri Colony, Hyderabad-500073, Andhra Pradesh, India (hereinafter referred to as the "Concessionaire"), for the bid submitted on 16.01.2012 for the development of Obedullaganj - Betul section of NH-69 from 2.800 to 8.300 and from km 20.700 to km 137.000 (design ch. from km 2.800 to km 8.300 & from km 20.7 to km 135.455) on National Highway No. 69 (hereinafter referred to as the "said section") to four lane standards (except two lane with paved shoulder bypass from km 28.000 to km 61.500 and two lane Narmada Bridge of length 0.900 km) and operation and maintenance of the said section on Design, Build, Finance, Operate and Transfer (DBFOT) basis;

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R. 838 (E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated 3rd December, 2010, G.S.R 15(E) dated 12th January, 2011 and G.S.R. 756 (E) dated 12th October, 2011 (hereinafter referred to as the "Rules"), the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length of 79.460 km for use of the four and more lane sections (hereinafter referred to as "base rate") and at 150% of the base rate for bypasses having an aggregate length of 8.400 km on the Type of Vehicles specified in Table 1 below and at 90% of the base rate for two lane bypass having an aggregate length of 32.600 km and at the base rate specified in the Table No. 2 for permanent bridge costing Rupees Fifty Crore or more on the Type of Vehicles specified in Table 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation (COD) declared by the Authority and on getting the Completion Certificate or the Provisional Certificate, as the case may be, from the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the distance specified for such Toll Plaza(s):

2. In addition to above, the following fee shall also be due and payable for the use of the following permanent bridge, cost of which is specified hereunder, at the following Toll Plaza(s) at the base rates mentioned in Table 2 above.

3. In addition to above, the following fee shall also be due and payable for the use of the following bypass(es) at the following Toll Plaza(s) for the length of bypass(es) specified for such Toll Plaza(s):

The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 215.00 (Rupees Two Hundred and Fifteen only) for the year 2013-14, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

5. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

6. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles

7. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.

8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules.

9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules.

10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 & 2, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language and thereafter revised annually and published through the concessionaire in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published provided that no revision shall be effected within a period of six months from the date of the preceding revision of fee.
