(2) ये सरकार(cid:28) राजप9

राजप9 म% इनके (cid:10)काशन कF तार(cid:28)ख से लागू ह(cid:18)गे ।

2. पLरभाषाएं : इन (cid:4)नयम(cid:18) म%, जब तक Bक संदभ, से अ$यथा अपे23त न हो, --

(क) "अ(cid:27)ध(cid:4)नयम" से समय-समय पर यथासंशो(cid:27)धत के $*(cid:28)य रेशम बोड, अ(cid:27)ध(cid:4)नयम, 1948 (1948 का 61) अCभ(cid:10)ेत है;

(ख) "(cid:4)नयुि(cid:16)त (cid:10)ा(cid:27)धकार(cid:28)" से के $*(cid:28)य रेशम बोड, (cid:4)नयम, 1955 के (cid:4)नयम 28 के उप(cid:4)नयम (1) म% यथा Hव(cid:4)न?द, ट (cid:10)ा(cid:27)धकार(cid:28) अCभ(cid:10)ेत है;

(ग) "(cid:4)नधा,रण सCम(cid:4)त" से (cid:4)नयम 11 के उप(cid:4)नयम (1) के अधीन ग?ठत सCम(cid:4)त अCभ(cid:10)ेत है;

(घ) "आंतLरक छानबीन सCम(cid:4)त" से (cid:4)नयम 10 उप(cid:4)नयम (1) के अधीन यथा Hव(cid:4)न?द, ट सCम(cid:4)त अCभ(cid:10)ेत है; (ड.) "बोड," से के $*(cid:28)य रेशम बोड, अCभ(cid:10)ेत है;

(च) "पदावास अव(cid:27)ध" से वै.ा(cid:4)नक पद कF Bकसी Hव(cid:4)न?द, ट Qेणी म% अह,क सेवा कF अव(cid:27)ध अCभ(cid:10)ेत है िजसे उRच Qेणी म% :व:थान" (cid:10)ो$न(cid:4)त के Cलए Hवचार Bकया जाना है;

(छ) "वेतन बSड या Tेड वेतन" से समय-समय पर यथा पुनर(cid:28)23त Bकसी वै.ा(cid:4)नक पद के Cलए :वीकृ त वेतन बSड और Tेड वेतन या वेतनमान अCभ(cid:10)ेत है;

(ज) "पद" से (cid:4)नयम 3 के उप(cid:4)नयम (1) के :तंभ (2) के अधीन यथावग8कृ त वै.ा(cid:4)नक(cid:18) के पद अCभ(cid:10)ेत है;

(झ) "चयन सCम(cid:4)त" से (cid:4)नयम 6 के उप(cid:4)नयम (1) के अधीन यथाHव(cid:4)न?द, ट सCम(cid:4)त अCभ(cid:10)ेत है ।

?ट4पणी-सभी अ$य शWद और सं3ेपा3र जो इन (cid:4)नयम(cid:18) म% पLरभाHषत नह(cid:28)ं हS, उनके Bक$तु के $*(cid:28)य रेशम बोड, अ(cid:27)ध(cid:4)नयम, 1948 (1948 का 61) और उसके अधीन बनाए गए समय-समय पर यथासंशो(cid:27)धत (cid:4)नयम(cid:18) म% ?दए गए अथ, और पLरभाषाएं या (cid:4)नव,चन ह(cid:18)गे ।

3. पद(cid:18) कF संXया, वग8करण, वेतन बSड और Tेड वेतन या वेतनमान.—(1) पद(cid:18) कF संXया, उनका वग8करण और उनसे उपाबG वेतन बSड तथा Tेड वेतन या वेतनमान नीचे ?दए गए के अनुसार ह(cid:18)गे:—

(2) उपांतLरत नमनीय मानाथ, :कFम के अधीन HवCभ$न :तर(cid:18) पर समय-समय पर राजप9 अ(cid:27)धसूचना के पLरवत,न(cid:18) के अधीन (cid:10)काशन कF तार(cid:28)ख को सभी कै डर(cid:18) म% कु ल :वीकृ त पद 725 हS ।

(3) कु ल :वीकृ त पद(cid:18) के पांच (cid:10)(cid:4)तशत वै.ा(cid:4)नक-'ग' :तर पर सीधी भत8 के Cलए आर23त ह(cid:18)गे ।

4. भत8 मानक—पद चयन पद हS । उ(cid:16)त पद(cid:18) कF भत8 कF पG(cid:4)त, आयु सीमा, अह,ताएं और उससे संबं(cid:27)धत अ$य बात% (cid:4)नAनानुसार ह(cid:18)गी :

?ट4पणी: (1) के $*(cid:28)य सरकार (cid:7)वारा जार(cid:28) Bकए गए अनुदेश(cid:18) या आदेश(cid:18) के अनुसार सरकार(cid:28) सेवक(cid:18) या :वाय(cid:12)त (cid:4)नकाय(cid:18) या लोक उप'म के कम,चाLरय(cid:18) के Cलए 5 वष, तक Cश(cid:27)थल कF जा सकती है ।

(2) आयु-सीमा अवधाLरत करने के Cलए (cid:4)नणा,यक तार(cid:28)ख भारत म% अoय(cid:27)थ,य(cid:18) से आवेदन (cid:10)ा4त करने के Cलए (cid:4)नयत कF गई अं(cid:4)तम तार(cid:28)ख होगी (न Bक वह अं(cid:4)तम तार(cid:28)ख जो असम, मेघालय, अpणाचल (cid:10)देश, Cमजोरम, मKणपुर, नागालSड, q9पुरा, Cसि(cid:16)कम, जAमू-कkमीर रा(cid:31)य के लrाख खंड, ?हमाचल (cid:10)देश के लाहौल और :पी(cid:4)त िजले तथा चAबा-िजले के पांगी उपखंड, अंदमान और (cid:4)नकोबार (cid:7)वीप या ल3(cid:7)वीप के अoय(cid:27)थ,य(cid:18) के Cलए Hव?हत कF गई है।)

(3) अनुभव कF अव(cid:27)ध अपे23त Hव(cid:7)या या काय, के 3े9 म% उ(cid:16)त Qेणी म% Hव?हत $यूनतम शै23क अह,ता (cid:10)ा4त करने कF तार(cid:28)ख से (cid:10)भावी pं प म% (cid:10)गKणत होगी ।

5. भत8 कF पG(cid:4)त.—(1) भत8 या तो सीधी भत8 या समामेलन या (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त (िजसके अंतग,त अ@पकाCलक संHवदा भी है) के आधार पर कF जाएगी और (cid:10)(cid:12)येक पद के Cलए भत8 कF HवCश ट र(cid:28)(cid:4)त काय, कF अपे3ा के अनुसार पद को Hव.ाHपत करने से पहले HवCश ट पद के Cलए अपे23त शै3Kणक अह,ता और अनुभव बोड, के अनुसार (cid:10)(cid:12)येक पद कF भत8 कF HवCश ट र(cid:28)(cid:4)त होगी ।

(2) भूतपूव, सै(cid:4)नक - (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त या पुन(cid:4)न,योजन

(3) के $*(cid:28)य या रा(cid:31)य या HवkवHव(cid:7)यालय(cid:18) या मा$यता(cid:10)ा4त अनुसंधान सं:थान(cid:18) या अध,सरकार(cid:28) कानूनी या भारत म% या भारत से बाहर :वाय(cid:12)तशासी संगठन(cid:18) म% काय,रत वै.ा(cid:4)नक समामेलन या (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त (िजसके अंतग,त अ@पकाCलक संHवदा भी है) के आधार पर (cid:4)नAनCलKखत शतs को पूरा करने के अधीन भत8 हो सक% गे, अथा,त ्:—

(i) वै.ा(cid:4)नक (cid:4)नयम 4 म% Hव(cid:4)न?द, ट शै3Kणक अह,ताएं और अनुभव रखते ह(cid:18); और

(ii) वै.ा(cid:4)नक आवे?दत पद के सt ़श पद धारण करते ह(cid:18) या

(क) वै.ा(cid:4)नक-'ग' के Cलए: वेतन बSड-3, 15600-39100 रुपए +Tेड वेतन 5400 रुपए या समतु@य पद म% पांच वष, कF सेवा कF हो; और[भाग II—खण्ड 3;iद्ध] भारत का राजपत्रा : असाधरण 5 (ख) वै.ा(cid:4)नक-'घ' के Cलए: वेतन बSड-3, 15600-39100 रुपए +Tेड वेतन 6600 रुपए या समतु@य पद म% पांच वष, कF सेवा कF हो;

(iii) (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त कF अव(cid:27)ध, िजसके अंतग,त के $*(cid:28)य सरकार के उसी या Bकसी अ$य संगठन/ Hवभाग म% इस (cid:4)नयुि(cid:16)त से ठvक पहले धाLरत Bकसी अ$य काडर बाwय पद पर (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त कF अव(cid:27)ध है साधारणतया 3 वष, से अ(cid:27)धक नह(cid:28)ं होगी ।

(iv) पोषक (cid:10)वग, के ऐसे Hवभागीय अ(cid:27)धकार(cid:28), जो :व:थाने (cid:10)ो$न(cid:4)त कF सीधी पंि(cid:16)त म% है, (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त पर (cid:4)नयुि(cid:16)त के Cलए Hवचार Bकए जाने के पा9 नह(cid:28)ं ह(cid:18)गे इसी (cid:10)कार (cid:10)(cid:4)त(cid:4)नयु(cid:16)त व्यक्ति (cid:10)ो$न(cid:4)त (cid:7)वारा (cid:4)नयुि(cid:16)त के Cलए Hवचार Bकए जाने के पा9 नह(cid:28)ं ह(cid:18)गे ।

(v) (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त पर (cid:4)नयुि(cid:16)त (िजसके अंतग,त अ@पकाCलक संHवदा भी है) के Cलए अ(cid:27)धकतम आयु-सीमा आवेदन (cid:10)ा4त करने कF अं(cid:4)तम तार(cid:28)ख को 56 वष, से अ(cid:27)धक नह(cid:28)ं होगी ।

6. सीधी भत8 के Cलए चयन सCम(cid:4)त.—(1) चयन सCम(cid:4)त या (cid:4)नधा,रण बोड,: (cid:4)नयम(cid:18) के अधीन आने वाले पद(cid:18) कF सीधी भत8 के Cलए चयन सCम(cid:4)त कF संरचना (cid:4)नAनानुसार होगी :

अyय3 : सद:य स(cid:27)चव, के $*(cid:28)य रेशम बोड, या उसके नाम (cid:4)नदzCशती ।

सद:य : (i) भारत सरकार के अ$य वै.ा(cid:4)नक संगठन के वै.ा(cid:4)नक-'ङ' के :तर से अ$यून दो Hवशेष.;

(ii) के $*(cid:28)य रेशम बोड, के वै.ा(cid:4)नक-'घ' के :तर का एक Hवशेष.;

(iii) उप स(cid:27)चव या (cid:4)नदेशक कF पंि(cid:16)त के व:9 मं9ालय का एक नाम(cid:4)नदzCशती ।

(2) सद:य स(cid:27)चव, के $*(cid:28)य रेशम बोड,, चयन सCम(cid:4)त या (cid:4)नधा,रण बोड, कF संरचना का अनुमोदन (cid:10)ा(cid:27)धकार(cid:28) होगा । चयन सCम(cid:4)त, िजनसे वह ग?ठत होगी, के सद:य, उस पद से कम से कम एक :तर के ऊपर के ह(cid:18)गे, िजसका चयन Bकया जाना है ।

(3) चयन सCम(cid:4)त या (cid:4)नधा,रण बोड, कF CसफाLरश(cid:18) का अनुमोदन (cid:10)ा(cid:27)धकार(cid:28) के $*(cid:28)य रेशम बोड, (cid:4)नयम, 1955 के (cid:4)नयम 28 के उप(cid:4)नयम (1) म% यथाHव(cid:4)न?द, ट (cid:4)नयु(cid:16)त (cid:10)ा(cid:27)धकार(cid:28) होगा ।

(4) चयन सCम(cid:4)त या (cid:4)नधा,रण बोड, कF बैठक के Cलए गणपू(cid:4)त, चार सद:य ह(cid:18)गे िजसके अंतग,त अyय3 भी होगा । अyय3 से Cभ$न (cid:4)नधा,रण बोड, के Bकसी सद:य कF अनुपि:थ(cid:4)त (cid:4)नधा,रण बोड, कF काय,वाह(cid:28) को अHव(cid:27)धमा$य नह(cid:28)ं करेगी ।

(5) म?हला सद:य(cid:18) और अ@पसंXयक समुदाय का (cid:10)(cid:4)त(cid:4)न(cid:27)ध(cid:12)व करने वाले सद:य(cid:18) के नाम(cid:4)नदzशन के Cलए समय- समय पर के $*(cid:28)य सरकार (cid:7)वारा जार(cid:28) अनुदेश लागू ह(cid:18)गे ।

(6) चयन सCम(cid:4)त या (cid:4)नधा,रण बोड, यथाHव.ाHपत (cid:10)(cid:12)येक पद या पद(cid:18) के समूह के Cलए यो~यता के 'म म% अoय(cid:27)थ,य(cid:18) के पैनल कF CसफाLरश करेगा । पैनल एक वष, के Cलए Hव(cid:27)धमा$य होगा और Hव.ाHपत (cid:4)नयुि(cid:16)तय(cid:18) कF संXया म% Hव:तार के Cलए के वल चय(cid:4)नत अoय(cid:27)थ,य(cid:18) को (cid:4)नयुि(cid:16)त का (cid:10):ताव जार(cid:28) करने के Cलए (cid:10)भावी होगा । य?द कोई अoयथ8 या अoय(cid:27)थ,य(cid:18) िजसे (cid:4)नयुि(cid:16)त का (cid:10):ताव जार(cid:28) Bकया गया है, अ(cid:27)धसू(cid:27)चत Lरि(cid:16)तय(cid:18) से Hव:तार होने तक (cid:10):ताव को :वीकार नह(cid:28)ं करता है/करते हS या (cid:4)नयत तार(cid:28)ख को पद Tहण नह(cid:28)ं करता है/करते हS तो पैनल के अगले अoयथ8 को पद का (cid:10):ताव भेजा जाएगा ।

(7) Lरि(cid:16)तयां िजनके Cलए चयन अपे23त है सद:य स(cid:27)चव, के $*(cid:28)य रेशम बोड, (cid:7)वारा Hव(cid:4)निkचत ह(cid:18)गी। Lरि(cid:16)तयां के $*(cid:28)य काया,लय, के $*(cid:28)य रेशम बोड,, बंगलौर (cid:7)वारा Hव.ाHपत ह(cid:18)गी ।

7. पLरवी3ा - (1) चय(cid:4)नत अoयथ8 एक वष, कF अव(cid:27)ध के Cलए पLरवी3ा पर ह(cid:18)गे जो (cid:10)(cid:12)येक अवसर पर अ(cid:27)धकतम छह माह कF अव(cid:27)ध के Cलए दो बार Hव:तारयो~य होगी ।

(2) पLरवी3ा कF अव(cid:27)ध पूण, होने या इसके Hव:तार होने पर वै.ा(cid:4)नक, य?द उपयु(cid:16)त पाए जाते हS, पद(cid:18) पर पु ट ह(cid:18)गे, य?द वे (cid:10)वेश Qेणी म% पहले से ह(cid:28) पु ट नह(cid:28)ं हS ।

8. :थानांतरण -बोड, कF सेवा म% सभी वै.ा(cid:4)नक भारत म% कह(cid:28)ं भी सेवा के Cलए दायी ह(cid:18)गे ।

9. (cid:4)नधा,रण और (cid:10)ो$न(cid:4)त -(1) इन (cid:4)नयम(cid:18) के अधीन वै.ा(cid:4)नक(cid:18) कF एक Qेणी से अगले उRच Qेणी म% (cid:10)ो$न(cid:4)त समय- समय पर यथापुनर(cid:28)23त भारत सरकार के का..ा. सं.एबी-14017/37/2008-:था.(आरआर) तार(cid:28)ख 10.09.2010 (िजसे इसम% इसके पkचात ् उ(cid:16)त का..ा. कहा गया है) के (cid:4)नबंधन(cid:18) म% उपांतLरत नमनीय पूरक :कFम के आधार पर बनाई जाएगी । एक Qेणी से अगल(cid:28) उRच Qेणी म% Bकसी वै.ा(cid:4)नक कF (cid:10)ो$न(cid:4)त पर, संबं(cid:27)धत वै.ा(cid:4)नक को काCम,क के pप म% :वत: उRच Qेणीकृ त पद पर होगा और अ(cid:27)धवHष,ता के पkचात ् पद उस Qेणी म% उ$ह% वापस हो जाएगा िजसम% वो आरंCभकत: (cid:27)चि$हत पद था ।

(2) उपांतLरत नमनीय पूरक :कFम के अधीन :व:थाने (cid:10)ो$न(cid:4)त के Cलए (cid:4)नधा,रण सि$नयम वै.ा(cid:4)नक और तकनीकF जांच के मू@यांकन पर जोर देने के साथ कठोर ह(cid:18)गे िजससे Bक के वल वै.ा(cid:4)नक(cid:18) कF जो उनके Hवkवसनीय (cid:10)दश,नयो~य उपलिWधय(cid:18) या तकनीकF यो~यता का उRच :तर उपांतLरत नमनीय पूरक :कFम के अधीन CसफाLरश कF जाएगी ।

(3) qबना Bकसी (cid:4)नब(cid:127)धन(cid:18) के वै.ा(cid:4)नक पद पूण, अंतरपLरवत,नीय यो~य ह(cid:18)गे, Cसवाय वै.ा(cid:4)नक-'ख', 'ग' और 'घ' पद(cid:18) कF कु ल Cमलाकर :वीकृ त पद(cid:18) कF कु ल संXया से अ(cid:27)धक नह(cid:28)ं ह(cid:18)गे ।

(4) वै.ा(cid:4)नक-'ख', 'ग' और 'घ' के :तर कF सभी (cid:10)ो$न(cid:4)त (cid:4)नAनCलKखत आधार पर होगी:

(i) उपांतLरत नमनीय पूरक :कFम के अधीन उRच Qेणीकरण के Cलए मानदंड तुलना म% वाHष,क काय, Lरपोटs Lरपोटs के मू@यांकन के Cलए (cid:4)नयम 10 के उप(cid:4)नयम (1) के अनुसार ग?ठत आंतLरक छानबीन सCम(cid:4)त (cid:7)वारा आरंCभक छानबीन; और[भाग II—खण्ड 3;iद्ध] भारत का राजपत्रा : असाधरण 7 (ii) (cid:4)नयम 11 के उप(cid:4)नयम (1) के अनुसार ग?ठत (cid:4)नधा,रण सCम(cid:4)त (cid:7)वारा (cid:4)नधा,रण और मौKखक पर(cid:28)3ा ।

(5) अगल(cid:28) उRच Qेणी म% (cid:4)नधा,रण को Hवचार करने के Cलए Bकसी Qेणी म% पूण, करने के Cलए $यूनतम पदावास कF अव(cid:27)ध पूण, करनी होगी जो नीचे द(cid:28) गई है :

(6) उपांतLरत नमनीय पूरक :कFम के उपबंध(cid:18) के अनुसार सभी पा9 वै.ा(cid:4)नक उ(cid:16)त काया,लय .ापन के उपाबंध 1 के (cid:4)नब(cid:127)धन(cid:18) म% और जो वै.ा(cid:4)नक-'ग' के Cलए 'अRछा' और वै.ा(cid:4)नक-'घ' और ऊं पर के Cलए 'बहुत अRछा' तल (cid:27)चwन(cid:18) को पूरा करते ह(cid:18), छानबीन होगी ।

आंतLरक छानबीन सCम(cid:4)त Lरपो?ट(cid:127)ग pं प Hवधान के भाग 'ग' म% वै.ा(cid:4)नक(cid:18) के कायs कF Lरपोट, आंतLरक छानबीन सCम(cid:4)त करेगी िजसे (cid:4)नधा,रण सCम(cid:4)त को उपलWध कराएगी ।

(6) (cid:4)नधा,रण सCम(cid:4)त कF CसफाLरश(cid:18) का अनुमोदन (cid:10)ा(cid:27)धकार(cid:28) के $*(cid:28)य रेशम बोड, (cid:4)नयम, 1955 के (cid:4)नयम 28 के उप(cid:4)नयम (1) म% यथाHव(cid:4)न?द, ट (cid:4)नयु(cid:16)त अ(cid:27)धकार(cid:28) होगा ।

(7) (i) जहां कोई पा9 वै.ा(cid:4)नक Hवदेशी सेवा म% या भारत म% या भारत से बाहर अyययन छु €ी पर है, उस दशा म% के $*(cid:28)य रेशम बोड, म% कत,(cid:129)य के पुन:(cid:10)ारंभ कF तार(cid:28)ख से Hवचारणीय होगा और Hव(cid:12)तीय लाभ उसी तार(cid:28)ख से उदभूत ह(cid:18)गे ।

(ii) मूल (cid:4)नयम 51 के अधीन भारत म% या भारत से बाहर (cid:10)Cश3ण या (cid:10)(cid:4)त(cid:4)नयुि(cid:16)त कर रहे Bकसी अ(cid:27)धकार(cid:28) कF दशा म% उस मामले म% अपे23त पदावास कF अव(cid:27)ध पूण, करने के पkचात ् :व:थाने (cid:10)ो$न(cid:4)त Hवचारणीय होगी ।

12. वै.ा(cid:4)नक जो (cid:4)नलंबन के अधीन हS/या िजनके Hवpं G अनुशासना(cid:12)मक काय,वा?हयां लंqबत हS, के (cid:4)नधा,रण के Cलए (cid:10)B'या-वै.ा(cid:4)नक जो (cid:4)नलंबन के अधीन हS/या िजनके HवरुG अनुशासना(cid:12)मक काय,वा?हयां लंqबत हS, का (cid:4)नधा,रण मुहरबंद Cलफाफे ((cid:10)B'या के अनुसार) म% रखना होगा ।

14. (cid:129)यावृ(cid:12)(cid:12)य इन (cid:4)नयम(cid:18) कF कोई बात, ऐसे आर3ण(cid:18), आयु-सीमा म% छू ट और अ$य Lरयायत(cid:18) पर (cid:10)भाव नह(cid:28)ं डालेगी, िजनका के $*(cid:28)य सरकार (cid:7)वारा इस संबंध म% समय-समय पर जार(cid:28) Bकए गए आदेश(cid:18) के अनुसार अनुसू(cid:27)चत जा(cid:4)तय(cid:18), अनुसू(cid:27)चत जनजा(cid:4)तय(cid:18), भूतपूव, सै(cid:4)नक(cid:18) और अ$य Hवशेष (cid:10)वग, के व्यि(cid:16)तय(cid:18) के Cलए उपबंध करना अपे23त है ।

NOTIFICATION

G.S.R. 758 (E).— In exercise of the powers conferred by Section 13 of the Central Silk Board Act, 1948 (61 of 1948) and in supersession of the Central Silk Board (Consolidated) Recruitment Rules, 1989, insofar as they relate to the posts of Joint Director, Deputy Director, Deputy Director (Reeling & Spinning), Assistant Director or Senior Research Officer, Assistant Director or Senior Research Officer (Reeling & Spinning), Senior Research Assistant and Senior Research Assistant (Reeling & Spinning), except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Scientists 'B', 'C', and 'D' in Central Silk Board, a body corporate under the Ministry of Textiles, namely:-

1. Short title and commencement.— (1) These Rules may be called the Ministry of Textiles, Central Silk Board, Scientist Group `A' Post, Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—In these Rules, unless the context otherwise requires:

(a) "Act" means the Central Silk Board Act, 1948 (61 of 1948) as amended from time to time;

(b) "Appointing Authority" means the authority as specified in sub-rule (1) of rule-28 of the Central Silk Board Rules, 1955;

(c) "Assessment Committee" means the Committee constituted under sub-rule (1) of rule 11;

(d) "Internal Screening Committee" means the Committee as specified under sub-rule (1) of rule 10;

(e) "Board" means the Central Silk Board;

(f) "Residency period" means the period of qualifying service in a specific grade of scientist post which is considered for in-situ promotion to the next higher grade;

(g) "Pay band or grade pay" means the pay band and grade pay or pay scale sanctioned for a scientific post as revised from time to time;

(h) "Post" means the post of scientists as classified under Column (2) of sub-rule (1) of rule 3;

(i) "Selection Committee" means the Committee as specified under sub-rule (1) of rule 6.

Note: All other words and abbreviations, which are not defined under these rules, shall have the same meaning and definition or interpretation as given in the Central Silk Board Act, 1948 (61 of 1948) and rules made thereunder as amended from time to time.

3. Number of posts, classification, pay band and grade pay or pay scale.- (1) The number of posts, their classification, pay band and grade pay or pay scale attached thereto shall be as under :

(2) Total sanctioned posts in all the cadres is 725 as on the date of publication of the Gazette notification subject to change from time to time at various levels under Modified Flexible Complementing Scheme.

(3) Five per cent of the total sanctioned posts shall be reserved for direct recruitment at the level of Scientist-`C'.

4. Recruitment norms.—The posts are selection posts. The method of recruitment to the said posts, age limit, qualification and other matters connected therewith shall be as under:

Note : (1) Relaxation for Government servants and employees of Government autonomous bodies or Public Sector Undertakings upto five years in accordance with the instructions and orders issued by the Central Government.

(2) The crucial date for determining the age limit shall be the closing date prescribed for receipt of applications from candidates in India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of Jammu and Kashmir State, Lahaul and Spiti Districts and Pangi Sub-division of Chamba District of Himachal Pradesh, Andaman and Nicobar Island or Lakshadweep).

(3) The period of experience in the requisite discipline or area of work shall be counted with effect from the date of acquiring the prescribed minimum educational qualification in that grade.

5. Method of recruitment.- (1) The recruitment shall be made either by direct recruitment or absorption or deputation (including short-term contract) basis and the particular method of recruitment for each post shall be decided by the Board as per the educational qualification and the experience required for the particular post before advertising the post, as per the job requirements.

(2) For ex-serviceman – Deputation or re-employment.

(3) The scientists working in the Central or State Governments or Universities or Recognised Research Institutions or Semi Government, Statutory or autonomous organisations in India or abroad may be recruited on absorption or deputation (including short-term contract) basis subject to fulfillment of the following conditions, namely:—

(i) the scientists possess minimum educational qualifications and experience as specified in rule 4; and

(ii) the scientists should be holding a post analogous to the post applied for; or

(a) for Scientist `C' : with five years' service in the post in the pay band ` 15600-39100 plus grade pay of ` 5400 or equivalent; and

(b) for Scientist `D' : with five years' service in the post in the pay band ` 15600-39100 plus grade pay of ` 6600 or equivalent;

(iii) The period of deputation, including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/Department of the Central Government, shall ordinarily not exceed three years;

(iv) the departmental candidates in the feeder category, who are in the direct line of in-situ promotion under Modified Flexible Complementing Scheme (MFCS) shall not be eligible for consideration for appointment on deputation except for the ex-cadre post for which they are not the feeder grade officer. Similarly, deputationists shall not be eligible for consideration for in-situ promotion under Modified Flexible Complementing Scheme (MFCS); and

(v) The maximum age limit for appointment by deputation (including short-term contract) shall not be exceeding fifty-six years as on the closing date of receipt of applications.

6. Selection Committee for direct recruitment.- (1) Selection Committee or Assessment Board: The composition of

the Selection Committee for making direct recruitment to the posts covered under the rules shall be as under : —

Chairperson : Member Secretary, Central Silk Board or his/her nominee.

Members : (i) Two experts not below the level of Scientist `E' from other scientific organisation of the Government of India;

(ii) one scientist of Central Silk Board of the level of Scientist-D;

(iii) a nominee of the Ministry of Textiles of the rank of Deputy Secretary or Director.

(2) The approving authority of the composition of the Selection Committee or Assessment Board shall be the Member-Secretary, Central Silk Board. The members of the Selection Committee so constituted shall be at least one level above the post for which selection is being made.

(3) The approving authority of the recommendation of the Selection Committee or Assessment Board will be the appointing authority as specified in sub-rule (1) of rule 28 of Central Silk Board Rules, 1955.

(4) The quorum for the meeting of the Selection Committee or Assessment Board shall be four members including the Chairperson. The absence of a member of the Assessment Board other than Chairperson shall not invalidate the proceedings of the Assessment Board.

(5) Instructions for nomination of women members and members representing the minority community asissued by the Government of India from time to time shall be applicable.

(6) The Selection Committee or Assessment Board shall recommend a panel of candidates in the order of merit for each post or group of posts as advertised. The panel shall be valid for one year and operated for issuing the offer of appointment to the selected candidates, only to the extent of number of vacancies advertised. If any of the candidate(s) who has/have been issued the offer of appointment upto the extent of the notified vacancies does/do not accept the offer or does / do not join by the stipulated date, the next candidate in the panel shall be offered the post.

(7) Vacancies for which the selections are required to be made by the Board shall be decided by the Member- Secretary, Central Silk Board. The vacancies shall be advertised by the Central Office, Central Silk Board, Bangalore.

7. Probation.—(1) The selected candidates shall be on probation for a period of one year extendable twice by a period of six months maximum on each occasion.

(2) On completion of period of probation or extension thereof, the scientists shall if considered fit, be confirmed against the posts, if not already confirmed in the entry grade.

8. Transfer.—All scientists in the service of the Board service shall be liable to serve anywhere in India.

9. Assessments and Promotions.—(1) Promotion of scientists under these rules from one grade to the next higher grade, shall be made on the basis of Modified Flexible Complementing Scheme in terms of Government of India's O.M. No. AB-14017/37/2008-Estt. (RR), dated 10.09.2010 (hereinafter referred to as the said OM) as revised from time to time. On promotion of a scientist from one grade to the next higher grade, the post shall stand upgraded automatically as personal to the scientist concerned and after superannuation, the post shall revert back to the grade in which the post was earmarked initially.

(2) The assessment norms for in-situ promotion under Modified Flexible Complementing Scheme shall be rigorous with due emphasis on evaluation of scientific and technical knowledge so that only the scientists who have to their credit demonstrable achievements or higher level of technical merit shall be recommended for promotion under the Modified Flexible Complementing Scheme.

(3) There will be complete interchangeability of scientific posts without any restriction except that the total number of posts of Scientist-`B', `C', and `D', all together shall not exceed the total number of the sanctioned posts.

(4) Promotion at the level of Scientist-`B', `C', and `D' shall be made on the basis of:

(i) preliminary screening by an Internal Screening Committee constituted as per sub-rule (1) of rule 10 for evaluation of annual work reports vis-à-vis the criteria for upgradation under Modified Flexible Complementing Scheme; and

(ii) assessment and interview by the Assessment Committee constituted as per sub-rule (1) of rule 11.

(5) The minimum residency period to be completed in a grade for consideration of assessment to the next grade shall be as under :

(6) All scientists eligible according to the provisions of Modified Flexible Complementing Scheme and who meet the benchmark of 'Good' for Scientist-C and 'Very Good' for Scientist-D and above would be screened in terms of Annexure-I to the said OM. The Internal Screening Committee shall report the work of the scientists in Part-C of the reporting format which shall be available to the Assessment Committee.

(7) Exceptionally meritorious candidates having outstanding gradings shall be considered for relaxation in the residency period based on the recommendations of the Assessment Committee. The relaxation shall be for one year in a single occasion and it shall be limited to maximum of two occasions in their entire career. However, the assessment under Modified Flexible Complementing Scheme for next grade would only be three times and thereafter the scientist would be covered under Modified Assured Career Progression Scheme according to provisions of that Scheme. The scientist who has been granted any grade under Modified Assured Career Progression Scheme can be considered for next grade under Modified Flexible Complementing Scheme according to the eligibility and other provisions of Modified Flexible Complementing Scheme.

(8) Review for promotion by the Internal Screening Committee and Assessment Committee shall be done twice a year – before 1st January and 1st July of every year.

10. Internal Screening Committee for Assessment and Promotion.—(1) The Member-Secretary, Central Silk Board shall constitute an Internal Screening Committee in every case for evaluation of annual work reports vis-à-vis the Annual Performance Assessment Reports and other relevant records of all Scientists completing the prescribed residency period for short-listing.

(2) The Internal Screening Committee shall comprise of:

(i) Director, Central Silk Board —Chairperson;

(ii) One external expert —Member;

(iii) A senior officer from Central Silk Board, Administration —Convener.

11. Assessment Committee for Assessment and Promotion.- (1) The Member-Secretary shall constitute an Assessment Committee to assess the work of the candidates who have qualified in the screening as per the recommendations of the Internal Screening Committee for their promotion. The members of the Assessment Committee so constituted shall be at least one level above the post for which selection is being made.

(2) The composition of the Assessment Committee shall comprise of:

(i) An eminent external expert —Chairperson;

(ii) two experts from other

scientific organisation of Government —Members;

(iii) a Director of any of the Central Silk Board

Research Institutes —Member;

(iv) a nominee of the Ministry of Textiles of the rank —Member.

(3) The quorum for the meeting of the Assessment Committee shall be four Members including the Chairperson. The absence of a Member of the Committee except Chairperson shall not invalidate the proceedings of the Assessment Committee.

(4) All the scientists who are screened in will be called for an interview by the Assessment Committee. The Assessment Committee would have the characteristic of an independent peer group for the assessment of the scientific content of the14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] work. The Assessment Committee shall document specifically through one page summary, the specific content of the work done justifying the merit for consideration under Modified Flexible Complementing Scheme.

(5) Scientists recommended by the Committee as `Fit' for promotion' shall be so promoted from 1st January or 1st July as the case may be. Scientists who are found `Not fit for promotion' as also those not qualified in the screening will be considered after a gap of one year if they are again recommended by the Internal Screening Committee. The effective date of promotion of those found eligible shall be from a prospective date only after the Appointing Authority has approved the recommendations of the Assessment Committee and no promotion with retrospective effect shall be admissible in any case under Modified Flexible Complementing Scheme.

(6) The approving authority of the recommendation of the Assessment Committee shall be the Appointing Authority as specified in sub-rule(1) of rule-28 of Central Silk Board Rules, 1955.

(7) (i) Where an eligible scientist is on foreign service or study leave in India or abroad, his /her case shall be considered from the date of resumption of duty in the Central Silk Board and financial benefit will accrue from the same date.

(ii) In case of an officer undergoing training or deputation in India or abroad under Fundamental Rules-51, his /her case shall be considered for in-situ promotion after completing the required residency period.

12. Procedure for assessment of scientists who are under suspension / against whom disciplinary proceedings

are pending.—The assessment of the scientists who are under suspension or against whom disciplinary proceedings are pending shall be kept in sealed cover (as per procedure).

13. Power to Relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

14. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions, required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time.

15. Interpretation.—Any question relating to interpretation of these rules shall be decided by the Central Government.
