व्यक्तियों से, उस तारीख जिसको उक्त राजपत्र की प्रतियां जनता को उपलब्ध कराई
इंस्टीट्यूट ऑफ कॉस्ट एंड वक्र्स एकाउंटेंट्स ऑफ इंडिया की अधिसूचना सं
करने के लिए मसौदा विनियम इनसे उपलब्ध कराई गई थीं; से पैंतालीस अधिनियम, 1959 (1959 का 23) की धारा 39 की सुझाव आमंत्रित करते हुए लागत एवं कार्य लेखाकार अधिनियम, 1959 (1959 का 23) की धारा 39 की इंडिया की अधिसूचना सं. सीडब्ल्यूआर (1) 2013 के तहत संभावित रूप से प्रभावित होने वाले सभी व्यक्तियों दिनों की अवधि बीतने से पूर्व आपत्तियां एवं सुझाव उप-धारा (3) द्वारा की गई अपेक्षानुसार इंस्टीट्यूट दिनांक 25 अप्रैल, 2013 के भारत के राजपत्र, भाग
अप्रैल, 2013 के भारत के राजपत्र, भाग III, खंड 4 में प्रकाषित किए गए थे;
और यतः उक्त राजपत्र की प्रतियां दिनांक 17 मई, 2013 को
दिनांक 17 मई, 2013 को जनता को उपलब्ध करा दी गई थीं;
और यतः उक्त संस्थान को कोई आपत्ति
आपत्ति तथा सुझाव प्राप्त नहीं हुए थे;
अतः अब लागत एवं कार्य लेखाकार अधिनियम, 1959 (1959 का 23) की धारा 39 की उप
अधिनियम, 1959 (1959 का 23) की धारा 39 की उप-धारा (1) द्वारा प्रदत्त शक्तियों विनियम, 1959 का आगे और संषोधन करने के लिए केन्द्र सरकार के अनुमोदन से एतद्द्वारा
प्रदत्त शक्तियों का प्रयोग करते हुए से एतद्द्वारा निम्नलिखित विनियम परिशद् लागत एवं कार्य लेखाकार विनियम, 1959 का बनाती है, अर्थात््ः - 1. (1) इन विनियमों को लागत एवं कार्य लेखाकार (संषोधन) विनियम, 2013 कहा जाएगा ।
(2) ये सरकारी राजपत्र में इनके प्रकाषन की तारीख को
राजपत्र में इनके प्रकाषन की तारीख को लागू होंगे।
2. लागत एवं कार्य लेखाकार विनियम, 1959 में, - विनियम, 1959 में, -
(i) विनियम 2 में, खंड (ग) के पष्चात् निम्नलिखित खंड
निम्नलिखित खंड अंतःस्थापित किया जाएगा, अर्थात्-
'(गक) "फर्म से अधिनियम में यथा परिभाशित
परिभाशित कोई फर्म अभिप्रेत है;';
विनियम (7) "एआईसीडब्ल्यूए" अथवा "एफआईसीडब्ल्यूए" अक्षरों तथा शब्द के स्थान पर 'एसीएमए' या 'एफसीएमए' अक्षर
पर 'एसीएमए' या 'एफसीएमए' अक्षर (ii) विनियम 7 में, उप-विनियम (7) "एआईसीडब्ल्यूए" तथा शब्द रखे जाएंगे।

No. CWR(1) 2013.—Whereas the draft regulations further to amend the Cost and Works Accountants Regulations, 1959, were published as required by sub-section (3) of section 39 of the Cost and Works Accountants Act, 1959 (23 of 1959) in the Gazette of India, Part III, Section 4, dated the 25th April, 2013 vide the Institute of Cost and Works Accountants of India notification number CWR(1) 2013, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of forty five days from the date on which copies of the said Gazette were made available to the public;
And whereas copies of the said Gazette were made available to the public on the 17th May, 2013;
And whereas no objections and suggestions were received by the said Institute;
Now, therefore, in exercise of the powers conferred by the sub-section (1) of section 39 of the Cost and Works Accountants Act, 1959 (23 of 1959), the Council with the approval of the Central Government hereby makes the following regulations further to amend the Cost and Works Accountants Regulations, 1959, namely :-
1. (1) These regulations may be called the Cost and Works Accountants (Amendment) Regulations, 2013.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. in the Cost and Works Accountants Regulations, 1959, -
(i) in regulation 2, after clause (c), the following clause shall be inserted, namely:-
'(ca) "firm" means a firm as defined in the Act;' ;
(ii) in regulation 7, in sub-regulation (7), for the letters and word "AICWA" or "FICWA", the letters and word "ACMA" or "FCMA" shall be substituted.

संसंसंसं.... सीडब्ल्यूआर (2) 2013सीडब्ल्यूआर (2) 2013सीडब्ल्यूआर (2) 2013सीडब्ल्यूआर (2) 2013.—यतः लागत एवं कार्य लेखाकार विनियम, 1959 का आगे और संषोधन करने के लिए मसौदा विनियम इनसे संभावित रूप से प्रभावित होने वाले सभी व्यक्तियो ंसे, उस तारीख जिसको उक्त राजपत्र की प्रतियां जनता को उपलब्ध कराई गई थीं; से पैंतालीस दिनों की अवधि बीतने से पूर्व आपत्तियां एवं सुझाव आमंत्रित करते हुए लागत एवं कार्य लेखाकार अधिनियम, 1959 (1959 का 23) की धारा 39 की उप-धारा (3) द्वारा की गई अपेक्षानुसार इंस्टीट्यूट ऑफ कॉस्ट एंड वक्र्स एकाउंटेंट्स ऑफ इंडिया की अधिसूचना सं. सीडब्ल्यूआर (1) 2013 के तहत दिनांक 5 जुलाई, 2013 के भारत के राजपत्र, भाग III, खंड 4 में प्रकाषित किए गए थे;
और यतः उक्त राजपत्र की प्रतियां दिनांक 10 जुलार्ई, 2013 को जनता को उपलब्ध करा दी गई थीं;
और यतः उक्त संस्थान को कोई आपत्ति तथा सुझाव प्राप्त नहीं हुए थे;
अतः अब लागत एवं कार्य लेखाकार अधिनियम, 1959 (1959 का 23) की धारा 39 की उप धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए परिशद् लागत एवं कार्य लेखाकार विनियम, 1959 का आगे और संषोधन करने के लिए केन्द्र सरकार के अनुमोदन से एतद्द्वारा निम्नलिखित विनियम बनाती है, अर्थात् : -
1. (1) इन विनियमों को लागत एवं कार्य लेखाकार (द्वितीय संषोधन) विनियम, 2013 कहा जाएगा।
(2) ये सरकारी राजपत्र में इनके प्रकाषन की तारीख से लागू होंगे।
2. लागत एवं कार्य लेखाकार विनियम 1959, में, विनियम 20 ख में, खंड (क) में,-
(क) मद (i) के स्थान पर निम्नलिखित मद को रखा जाएगा, अर्थात् :-
"(i) उसे विनियम 20 क के अंतर्गत फाउंडेषन पाठ्यक्रम के लिए प्रवेष दिया गया है और उसे ऐसी परीक्षा शुरू होने से कम से कम एक सौ पचास दिन पूर्व डाक द्वारा या मौखिक या ई-लर्निंग अध्ययन करने के लिए नामांकित किया गया है;";
(ख) मद (iii) के स्थान पर निम्नलिखित मद को रखा जाएगा, अर्थात् :-
"(iii) वह परीक्षा शुरू होने से कम से कम पैंतालीस दिन पूर्व परिशद् द्वारा अनुमोदित प्रपत्र में आवेदन करता है :
परन्तु परिशद् ऐसे विलंब शुल्क, जिसे वह उचित समझती हो, के साथ उक्त अवधि को दस दिन से अनधिक अवधि तक बढ़ा सकती है।"

(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Cost and Works Accountants Regulations, 1959, in regulation 20B, in clause (a),-
(A) for item (i), the following item shall be substituted, namely:-
"(i) he has been admitted to the Foundation Course under regulation 20A and has been enrolled for undergoing postal or oral or e-learning tuition for at least one hundred and fifty days prior to the commencement of such examination;";
(B) for item (iii), the following item shall be substituted, namely:-
"(iii) he makes an application in the form approved by the Council, at least forty-five days prior to the commencement of the examination:
Provided that the Council may extend the said period for not more than ten days with such late fees as it thinks fit.".
