BÉEÉ.+ÉÉ. 3603(+É).—केन्द्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, १९८६ (१९८६ का २९) की धारा ३ की केन्द्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, १९८६ (१९८६ का २९) की धारा ३ की केन्द्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, १९८६ (१९८६ का २९) की धारा ३ की उप-धारा (३) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के पर्यावरण और वन मंत्रालय क धारा (३) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के पर्यावरण और वन मंत्रालय की अधिसूचना संख्यांक धारा (३) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के पर्यावरण और वन मंत्रालय क का. आ. १५३३ (अ) तारीख १४ सितंबर, २००६ (जिसे इसमें इसके पश्चात्् उक्त राजपत्र अधिसूचना कहा गया है) के अनुसरण का. आ. १५३३ (अ) तारीख १४ सितंबर, २००६ (जिसे इसमें इसके पश्चात्् उक्त राजपत्र अधिसूचना कहा गय् का. आ. १५३३ (अ) तारीख १४ सितंबर, २००६ (जिसे इसमें इसके पश्चात्् उक्त राजपत्र अधिसूचना कहा गय् ण प्राधिकरण (एस ई आई ए ए) पश्चिम में निम्नलिखित सदस्यों से मिलकर बनने वाले राज्य स्तर पर्यावरण समाघात निर्धारण प्राधिकरण (एस ई आई ए ए) पश्चिम में निम्नलिखित सदस्यों से मिलकर बनने वाले राज्य स्तर पर्यावरण समाघात निर्धार बंगाल (जिसे इसमें इसके पश्चात्् पश्चिम बंगाल प्राधिकरण कहा गया है) का गठन करती है, अर्थात् बंगाल (जिसे इसमें इसके पश्चात्् पश्चिम बंगाल प्राधिकरण कहा गया है) का गठन करती है, अर्थात ् :--

ा स्तर विशेषज्ञ आकलन समिति (एस ई ए सी) की इस अधिसूचना द्वारा पश्चिम बंगाल राज्य के लिए गठित राज्य स्तर विशेषज्ञ आकलन समिति (एस ई ए सी) की ४. इस अधिसूचना द्वारा पश्चिम बंगाल राज्य के लिए गठित राज्य् सिफारिशों पर अपने विनिश्चय आधारित करेगी । सिफारिशों पर अपने विनिश्चय आधारित करेगी ।

७. एस ई ए सी पश्चिम बंगाल ऐसी शक्तियों का प्रयोग और ऐसी प्रक्रिया का पालन करेगा जो उक्त राजपत्र अधिसूचना में प्रगणित है ।
८. एस ई ए सी पश्चिम बंगाल सामूहिक उत्तरदायित्व के सिद्धांत पर कार्य करेगा और अध्यक्ष प्रत्येक मामले में मतैक्यता पर पंहुचने का प्रयास करेगा और यदि मतैक्यता पर नहीं पहुंचा जा सकता है तो बहुमत की राय अभिभावी होगी ।
९. पश्चिम बंगाल राज्य सरकार, पश्चिम बंगाल प्राधिकरण के लिए सचिवालय के रूप में कार्य करने के लिए एक अभिकरण को अधिसूचित करेगी और उसके सभी कानूनी कृत्यों की बाबत आवास, परिवहन और ऐसी अन्य सुविधाओं सहित उसे सभी वित्तीय और संभार तंत्र का समर्थन प्रदान करेगी ।

१०. पश्चिम बंगाल प्राधिकरण के अध्यक्ष और सदस्यों तथा एस ई ए सी, पश्चिम बंगाल के अध्यक्ष और सदस्यों की बैठक फीस, यात्रा भत्ता और महंगाई भत्ता को पश्चिम बंगाल राज्य सरकार के विद्यमान नियमों के अनुसार संदत्त किया जाएगा ।

New Delhi, the 9th December, 2013
S.O. 3603(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said Gazette Notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority (SEIAA), West Bengal (hereinafter referred to as the Authority, West Bengal) comprising of the following Members, namely :—

2. The Chairman and Members of the Authority, West Bengal shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
3. The Authority, West Bengal shall exercise such powers and follow such procedures as enumerated in the said Gazette notification.
4. The Authority, West Bengal shall base its decision on the recommendations of the State level Expert Appraisal Committee (SEAC) constituted for the State of West Bengal by this notification.
5. To assist the Authority, West Bengal, the Central Government in consultation with the State Government of West Bengal, hereby constitute the State level Expert Appraisal Committee, West Bengal (hereinafter referred to as SEAC, West Bengal) comprising of the following Chairman and Members, namely :—

6. The Chairman and Members of the SEAC, West Bengal shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
7. The SEAC, West Bengal shall exercise such powers and follow such procedures as enumerated in the said Gazette notification.
8. The SEAC, West Bengal shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.
9. The State Government of West Bengal shall notify an agency to act as Secretariat for the Authority, West Bengal and the SEAC, West Bengal and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions.
10. The sitting fee, travelling allowance and dearness allowance to the Chairman and Member of the Authority, West Bengal and the Chairman and Members of the SEAC, West Bengal shall be paid in accordance with the existing rules of the State Government of West Bengal.
