द्वारा सचिवालय के अध्किारियों के लिए लागू मूल नियमावली के नियम 45 द्वारा प्रदत्त शक्तियों के अनुसरण में, लोक द्वारा सचिवालय के अध्किारियों के लिए लागू मूल नियमावली के नियम 45 द्वारा प्रदत्त क्तियों के अनुसरण में, लोक सभा अध्यक्ष, लोक सभा सचिवालय ;आवास आबंटनद्ध नियमावली, 1974 में आगे और संशोध्न करने के लिए एतद्द्व लोक सभा सचिवालय ;आवास आबंटनद्ध नियमावली, 1974 में आगे और सं ोध्न करने के लिए एतद्द्वारा निम्नलिखित नियम बनाती हैं, अर्थात् :—

;1द्ध इन नियमों को लोक सभा सचिवालय ;आवास आबंटनद्ध सं ;2द्ध ये नियम 23 अप्रैल, 2013 से लागू माने जायेंगे । ये नियम 23 अप्रैल, 2013 से लागू माने जायेंगे ।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] नियम 17 में, परन्तुक में अनुब( किया गया है कि मृत्यु के मामले को छोड़कर विशेष मामलों में, प्रशासन शाखा-II द्वारा किसी अध्किारी को नियम 8 के उप-नियम ;2द्ध के अंतर्गत अनुमेय अवध् िसे आगे छह माह से अनध्कि अवध् िके लिए मानक लाइसेंस शुल्क के दोगुने अथवा मूल नियम 45-क के अंतर्गत पूलित मानक लाइसेंस शुल्क के दोगुने अथवा उस लाइसेंस शुल्क के दोगुने जिसका वह भुगतान कर रहा था, जो भी अध्कि हो, के भुगतान पर किसी आवास के प्रतिधरण के लिए अनुमति दी जा सकती है । इस परन्तुक को निम्नलिखित से प्रतिस्थापित किया जाएगा :—

लोक सभा सचिवालय (आवास आबंटन) नियम, 1974 वे नियम 8 वे उपबंधों वे अनुसार, सेवानिवृत्ति/सेवांत छुट्टी वे मामले में सरकारी आवास वे प्रतिधारण की अनुमेय अवधि सामान्य लाइसेंस शुल्क वे भुगतान पर 2 महीने और सामान्य लाइसेंस शुल्क वे दोगुने के भुगतान पर आगे और 2 महीने है। इसवे बाद आगे और चार महीनों वे लिए आवास वे प्रतिधारण की अनुमति सामान्य लाइसेंस शुल्क वे चार गुने के भुगतान पर पहले दो महीने के लिए और सामान्य लाइसेंस शुल्क वे छह गुने वे भुगतान पर आगे और दो महीने के लिए अस्वस्थता/शिक्षा वे आधार पर दी जाती है किंतु इसके लिए प्रतिधारण की पूवर्ोत्त अवधि वे लिए बढ़े हुए लाइसेंस शुल्क का भुगतान करने के साथ-साथ तत्संबंधी दस्तावेजी प्रमाण प्रस्तुत करना होगा । इसवे अलावा, लोक सभा सचिवालय (आवास आबंटन) नियमावली वे नियम 17 में उपबंध किया गया है कि मृत्यु वे मामले को छोड़कर विशेष मामलों में, प्रशासन शाखा - II द्वारा किसी अधिकारी को नियम 8 वे उप-नियम (2) वे अंतर्गत अनुमेय अवधि से आगे छ्ह माह से अनधिक अवधि वे लिए मानक लाइसेंस शुल्क वे दोगुने अथवा मूल नियम 45-क वे अंतर्गत पूलित मानक लाइसेंस शुल्क वे दोगुने अथवा उस लाइसेंस शुल्क वे दोगुने जिसका वह भुगतान कर रहा था, जो भी अधिक हो, वे भुगतान पर किसी आवास वे प्रतिधारण वे लिए अनुमति दी जा सकती है।

भारत सरकार ने एस.आर.-317-बी-11 वे उप-नियम (2) में अब संशोधन कर दिया है जिसवे द्वारा उन सेवानिवृत्त अधिकारियों को जिन्हें 1.7.2013 से पूर्व आवास आबंटित किया गया था, आबंटी द्वारा कोई प्रमाणपत्र प्रस्तुत किये बिना अथवा अनुरोध किये बिना आठ महीने वे लिए अर्थात्् सामान्य लाइसेंस शुल्क पर पहले 2 महीने, सामान्य लाइसेंस शुल्क वे दोगुने पर आगे 2 महीने, सामान्य लाइसेंस शुल्क वे चार गुने पर आगे और 2 महीने तथा सामान्य लाइसेंस शुल्क वे छह गुने पर आगे और 2 महीने आवास वे प्रतिधारण की अनुमति है। तथापि, उन सेवानिवृत्त अधिकारियों वे मामले में, जिन्हें 1.7.2013 को या इसवे पश्चात् आवास आबंटित किया गया था, आबंटी द्वारा कोई प्रमाणपत्र प्रस्तुत किये बिना अथवा अनुरोध किये बिना छ: महीने वे लिए अर्थात्् पहले २ महीने सामान्य लाइसेंस शुल्क पर सामान्य लाइसेंस शुल्क वे दोगुने पर आगे और 2 महीने और सामान्य लाइसेंस शुल्क वे चार गुना पर आगे और 2 महीने आवास वे प्रतिधारण की अनुमति है। इसवे अलावा, एस आर-317-बी-22 में भी संशोधन कर नया उपबंध किया गया है कि "मृत्यु तथा सेवानिवृत्ति अथवा सेवांत छुट्टी वे मामले को छोड़कर विशेष मामलों में, सम्पदा निदेशालय द्वारा किसी अधिकारी को नियम 8 वे उप-नियम (2) वे अंतर्गत अनुमेय अवधि से आगे छ्ह माह से अनधिक अवधि वे लिए लाइसेंस शुल्क की सपाट दर वे दोगुने अथवा उस लाइसेंस शुल्क वे दोगुने जिसका वह भुगतान कर रहा था, जो भी अधिक हो, वे भुगतान पर किसी आवास वे प्रतिधारण की अनुमति दी जा सकती है ।
भारत सरकार द्वारा उत्त अनुदेश भूतलक्षी प्रभाव से लागू किये जाने को ध्यान में रखते हुए, लोक सभा सचिवालय (आवास आबंटन) नियमों में 23 अप्रैल, 2013 से भूतलक्षी प्रभाव से संशोधन किया जा रहा है ।

NOTIFICATION
New Delhi, the 18th December, 2013
G.S.R. 799(E).— In exercise of the powers conferred by rule 45 of Fundamental Rules as made applicable to the officers of the Lok Sabha Secretariat by Recruitment and Conditions of Service Order No. 185, dated the 19th December, 1957, the Speaker of the Lok Sabha hereby makes the following rules further to amend the Lok Sabha Secretariat (Allotment of Residences) Rules, 1974, namely :—
(1) These rules may be called the Lok Sabha Secretariat (Allotment of Residences) Amendment Rules, 2013.
(2) They shall be deemed to have come into force on 23rd April, 2013.
2. In Rule 8, in the table below, sub-rule 2, against item (ii) relating to retirement or terminal leave, i.e. " Two months on normal licence fee and another two months on double the normal licence fee. Further two months on payment of four times of normal licence fee and subsequent two months on payment of six times the normal licence fee for special reasons involving medical/educational grounds subject to appropriate certificate by the authorities concerned", shall be substituted by :—
(a) "In cases of accommodation allotted prior to 1.7.2013: 2 months on normal licence fee, another 2 months on double of the normal licence fee, further 2 months on four times of the normal licence fee and subsequent 2 months on six times of the normal licence fee, (b) In cases of accommodation allotted on or after 1.7.2013: 2 months on normal licence fee, another 2 months on double of the normal licence fee and further 2 months on four times of the normal licence fee."
In Rule 17, the proviso stipulates that an officer, in special cases, except in case of death, be allowed by the Administration Branch-II to retain a residence on payment of twice the standard licence fee, or twice the pooled standard licence fee, under F.R. 45-A or twice the licence fee he was paying, whichever is higher for a period not exceeding six months beyond the period permitted under sub-rule (2) of rule 8, shall be substituted by :—
" Provided that an officer, in special cases, except in case of death and retirement or terminal leave may be allowed by Administration Branch-II to retain a residence on payment of twice the flat rate of licence fee, or twice the licence fee he was paying, whichever is higher for a period not exceeding 6 months beyond the period permissible under sub-rule (2) of Rule 8."

EXPLANATORY MEMORANDUM
As per the provisions of Rule 8 of Lok Sabha Secretariat (Allotment of Residence) Rules, 1974, the permissible period of retention of government accommodation in the case of retirement/terminal leave is two months on payment of normal rate of licence fee and further two months on payment of double the normal licence fee. Further retention of the quarter for another four months is allowed on payment of four times of normal licence fee for first two months and six times of normal licence fee for subsequent two months on medical/educational grounds, subject to production of documentary proof in this regard, along with payment of enhanced licence fee for the period of said retention. Further in Rule 17 of Lok Sabha Secretariat (Allotment of Residences) Rules, 1974 it is provided that an officer in special cases, except in case of death be allowed by the Administration Branch-II to retain a residence on payment of twice the standard licence fee, or twice the pooled standard licence fee, under F.R. 45-A or twice the licence fee he was paying, whichever is higher: for a period not exceeding six months beyond the period permitted under sub-rule (2) of Rule 8.
The Government of India has since made amendments in sub-rule (2) of SR-317-B-11 whereby retired officers who were allotted accommodation prior to 1.7.2013 are allowed to retain the accommodation for eight months i.e. first 2 months on normal licence fee, another 2 months on double of the normal licence fee, further two months on four times of the normal licence fee and subsequent two months on six times of the normal licence fee without any request or production of certificate by the allottees. However in the case of retired officers who were allotted accommodation on or after 1.7.2013, were allowed to retain the accommodation for 6 months i.e. first 2 months on normal licence fee, another 2 months on double the normal licence fee and further 2 months on four times of the normal licence fee without any request or production of certificate by the allottees. Further, SR-317-B-22 has also been amended with the new provision that "an officer in special cases, except in case of death and retirement or terminal leave may be allowed by Directorate of Estates to retain a residence for a period not exceeding 6 months beyond the period permissible under sub-rule (2) of Rule 8 on payment of twice the flat rate of licence fee, or twice the licence fee he was paying, whichever is higher.
In view of the retrospective implementation of the above instructions by the Government of India, the amendments in Lok Sabha Secretariat (Allotment of Residences) Rules, 1974 are being given effect retrospectively, with effect from 23rd April, 2013.
