सा.का.नि. ८०६(अ).—राष्ट्रपति, संविधान के अनुच्छेद ३०९ के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पुलिस अनुसंधान और विकास ब्यूरो (केन्द्रीय न्यायालयिक विज्ञान प्रयोगशाला समूह 'क' और समूह 'ख' पद) भर्ती नियम, १९७४ को जहां तक इसका संबंध निदेशक, उपनिदेशक, सहायक निदेशक और वरिष्ठ वैज्ञानिक अधिकारी श्रेणी २ के पदों से है और प्रश्नगत दस्तावेजी सरकारी परीक्षक, प्रश्नगत दस्तावेजी सरकारी उप परीक्षक और प्रश्नगत दस्तावेज सरकारी सहायक परीक्षक भर्ती नियम, १९९३ को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, गृह मंत्रालय, न्यायालयिक विज्ञान निदेशालय सेवाएं और इसकी बाहरी इकाईयों में निदेशक एवं वैज्ञानिक 'ई' , उप निदेशक एवं वैज्ञानिक 'डी', सहायक निदेशक एवं वैज्ञानिक 'सी' तथा वैज्ञानिक 'बी' के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :—

१. संक्षिप्त नाम और प्रारंभ.— (१) इन नियमों का संक्षिप्त नाम गृह मंत्रालय, न्यायालयिक विज्ञान सेवाएं निदेशालय, समूह 'क' पद भर्ती नियम, २०१३ cè *

(२) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

२. ãÉÉMÉÚ cÉäxÉÉ.—ये नियम इन नियमों से संलग्न अनुसूची के स्तंभ (१) में विनिर्दिष्ट पदों को लागू होंगे ।

३. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड और ग्रेड वेतन या वेतनमान वह होंगे, जो नियम ६ से उपाबद्ध अनुसूची के स्तंभ (२) से स्तंभ (४) में विनिर्दिष्ट हैं ।

४. पारस्परिक ज्येष्ठता, न्यूनतम अर्हक अवधि इत्यादि.—

(१) उस शर्त के अध्यधीन जिसमें अपनी-अपनी श्रेणियों के भीतर आंतरिक-सह-ज्येष्ठता में व्यवधान नहीं होगा, अपनी-अपनी श्रेणियों के लिए अधिकारियों की नियमित नियुक्ति की तारीख के अनुसार आंतरिक-सह-ज्येष्ठता अवधारित की जाएगी ।

(२) अनुसूची के स्तंभ (१) में उल्लिखित पद, समय-समय पर संशोधित कार्मिक और प्रशिक्षण विभाग द्वारा अधिसूचित नमनीय पूरक स्कीम (जिसे इसमें इसके पश्चात् नमनीय पूरक स्कीम कहा गया है) के अधीन प्रचालित होंगे और नीचे सारणी के स्तंभ (१) में 5494 GI/2013

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] यथाविनिर्दिष्ट पदनामों के साथ उक्त पद उक्त सारणी के स्तंभ (२) में यथाविनिर्दिष्ट वेतन बैंड और ग्रेड वेतन या वेतनमान वहन करेंगे और उसके स्तंभ (३) में यथाविनिर्दिष्ट अगली श्रेणी में प्रोन्नति के लिए श्रेणी में पालन से सहबद्ध न्यूनतम अर्हक अवधि पूरी करेंगे ।

५. नमनीय पूरक स्कीम के अंतर्गत स्वस्थाने प्रोन्नतियों तथा चयन प्रक्रिया या पुनर्विलोकन के लिए विचारणीय मानदंड नमनीय पूरक स्कीम के अंतर्गत वैज्ञानिक 'बी' की श्रेणी से सहायक निदेशक एवं वैज्ञानिक 'सी', सहायक निदेशक एवं वैज्ञानिक 'सी' से उप निदेशक एवं वैज्ञानिक 'डी' तथा उप निदेशक एवं वैज्ञानिक 'डी' से निदेशक एवं वैज्ञानिक 'ई' के पद पर प्रोन्नति के लिए निम्नलिखित मानदंड और चयन प्रक्रिया का पालन किया जाएगा, अर्थात् :—

(I) निर्धारण के दो स्तर होंगे । पहला स्तर छानबीन प्रयोजनों के लिए आंतरिक स्तर पर होगा तथा अगला स्तर चयन के लिए बाहय निर्धारण प्रयोजनों के लिए होगा और इस प्रयोजन के लिए,—

(क) नमनीय पूरक स्कीम के अधीन प्रोन्नति के लिए वर्ष में एक बार प्रत्येक वर्ष १ जनवरी से पहले विचार किया जाएगा और उन अधिकारियों का जिनका वर्ष के पूर्ववर्ती वर्ष ३१ दिसम्बर तक जिसमें निर्धारण किया जाना है, और वर्ष के ३० जून तक जिस वर्ष में निर्धारण किया जाना है, ने विशिष्ट पद में अपेक्षित अर्हक अवधि पूरी कर ली है या कर लेंगे, अगली उच्चतर श्रेणी पर प्रोन्नति के लिए विचार किया जाएगा तथा अपेक्षित अर्हक अवधि का निर्धारण करने के लिए निर्णायक तिथि जिस वर्ष के लिए मूल्यांकन किया जाना है, उस वर्ष की १ जनवरी होगी ।

(ख) जहां पात्र अधिकारी विदेश सेवा या भारत में या भारत से बाहर अध्ययन अवकाश पर है तो भी उनके मामले पर विचार किया जाएगा और यदि उनका नमनीय पूरक स्कीम के अधीन अगली उच्चतर श्रेणी में स्वस्थाने प्रोन्नति के लिए अनुमोदन कर दिया गया है तो ऐसी प्रोन्नति की प्रभावी तारीख वह तारीख होगी जिसको वह यथास्थिति, न्यायालयिक विज्ञान सेवाएं निदेशालय या इसकी बाहरी इकाईयां में कार्यभार संभालती हैं और उसी तारीख से उसे वित्तीय लाभ भी देय होंगे । साक्षात्कार में उपस्थित होने के लिए कोई भी यात्रा भत्ता या मंहगाई भत्ता नहीं दिया जाएगा ।

(ग) नमनीय पूरक स्कीम के अधीन सभी पात्र अधिकारियों पर इसके अधीन प्रोन्नति के लिए विचार किया जाएगा किन्तु सभी उत्कृष्ट श्रेणियों वाले आपवादिक सभी मेधावी अभ्यर्थियों को अर्हक अवधि में शिथिलता दी जाएगी, उनके संपूर्ण जीवन वृत्ति में अधिकतम दो अवसरों तक सीमित यह शिथिलता किसी एकल अवसर पर एक वर्ष से अधिक नहीं होगी और अगली श्रेणी के लिए नमनीय पूरक स्कीम के अधीन निर्धारण अगली श्रेणी के लिए केवल तीन बार होगा और वे अधिकारी जिन्हें उपांतरित सुनिश्चित कैरियर प्रगति स्कीम के अधीन कोई श्रेणी प्रदान की गई है, उन पर इस संबंध में समय-समय पर जारी अधिसूचना और आदेशों द्वारा कार्मिक और प्रशिक्षण विभाग द्वारा अधिसूचित पात्रता और उपबंधों के अनुसार नमनीय पूरक स्कीम के अधीन अगली श्रेणी के लिए विचार किया जाएगा ।

(घ) प्रोन्नति प्राप्त कोई अधिकारी अपने साथ पद वहन करता है और परिणामस्वरूप निम्न स्तर पर कोई रिक्ति नहीं हुई है और जहां अधिवर्षिता पर सेवानिवृत्ति या स्वैच्छिक सेवानिवृत्ति या पदत्याग या मृत्यु द्वारा किसी अधिकारी के पद छोड़ने के कारण कोई रिक्ति हुई है, वहां उसे सीधी भर्ती या प्रोन्नति के लिए रोस्टर के अनुसार वैज्ञानिक 'बी' के स्तर पर भरा जाएगा ।

(ङ) वैज्ञानिक क्रियाकलापों में क्षेत्रीय अनुभव और सेवाएं, नमनीय पूरक स्कीम के अधीन उच्चतर श्रेणियों में वैज्ञानिकों की प्रोन्नति के लिए अनिवार्य है ।

(२) आंतरिक छानबीन के प्रथम स्तर को उपनियम (६) के अधीन सारणी के स्तंभ (३) में विनिर्दिष्ट छानबीन समिति द्वारा पूरा किया जाएगा जो नमनीय पूरक स्कीम के अधीन उन्नयन के लिए मानदंड के अनुसार वार्षिक कार्य रिपोर्टों का मूल्यांकन करेगी और सभी पात्र अधिकारी जो सहायक निदेशक और वैज्ञानिक 'सी' के लिए 'अच्छा' और उपनिदेशक या वैज्ञानिक 'डी' और ऊपर के लिए 'बहुत अच्छा' बेंचमार्क को पूरा करते हैं, छानबीन की जाएगी और ऐसे अधिकारियों द्वारा किए कार्य की वैज्ञानिक अंतर्वस्तु पर रिपोर्ट छानबीन समिति द्वारा निर्धारण बोर्ड को उपलब्ध कराए जाने के लिए निम्नलिखित फार्मेट में दी जाएगी, अर्थात :-

छानबीन समिति पुनर्विलोकन रिपोर्ट :-

१. रिपोर्ट किए गए कार्य की वैज्ञानिक और तकनीकी अंतर्वस्तु का श्रेणीकरण

२. मान्यताप्राप्त विनिर्दिष्ट नवप्रवर्तन तत्व

३. रिपोर्ट किए गए कार्य का सापेक्ष निर्धारण अर्थात् क्षेत्र में आंकन

[शिखर १०% ,३३-५०% , ५०-७५%, निम्न २५%]

४. अर्हता अवधि के दौरान किए गए कार्य का निर्धारण

५. किए गए कार्य की वैज्ञानिक और तकनीकी अंतर्वस्तु के विनिर्दिष्ट मुख्य बिंदु

६. अर्हता अवधि के लिए वैज्ञानिक और तकनीकी कार्य रिपोर्ट का समस्त श्रेणीकरण

[शिखर १०%, १०-३३%,३३-५०% , ५०-७५%, निम्न २५%]

"छानबीन समिति के सदस्यों के हस्ताक्षर" (३) उपनियम (६) के अधीन सारणी के स्तंभ (४) में विनिर्दिष्ट अनुमोदन प्राधिकारी (छानबीन) छानबीन समिति द्वारा सिफारिश किए गए सभी मामलों पर विचार करेगा और उसे अनुमोदित करेगा और यदि यह विनिश्चय करता है कि कोई अधिकारी निर्धारण बोर्ड द्वारा प्रोन्नति के लिए विचार हेतु अर्हित नहीं है तो उसका मामला एक वर्ष पश्चात् इसके विचार के लिए छानबीन समिति के समक्ष रखा जाएगा और उपनियम (२) में यथाविनिर्दिष्ट छानबीन के लिए प्रक्रिया का पुन:अनुसरण किया जाएगा ।

(४) बाहय निर्धारण के दूसरे स्तर के प्रयोजनों के लिए ;

(क) स्वस्थाने प्रोन्नति के लिए अधिकारियों की उपयुक्तता के मूल्यांकन के लिए ; सभी अधिकारी जिनकी छानबीन की गई है और छानबीन समिति द्वारा सिफारिश की गई है और छानबीन समिति द्वारा सिफारिश की गई है और अनुमोदन प्राधिकारी (छानबीन) द्वारा अनुमोदन किया गया है, उपनियम (६) के अधीन सारणी के स्तंभ (५)में विनिर्दिष्ट निर्धारण बोर्ड द्वारा उनका निर्धारण किया जाएगा ।

(ख) निर्धारण बोर्ड प्रत्येक अधिकारी का उनके कार्य के निबंधनों में निष्पत्ति का मूल्यांकन कार्य करेगा और उच्चतर श्रेणी में प्रोन्नति के लिए उसकी उपयुक्तता की सिफारिश करेगा और उक्त बोर्ड विचाराधीन अवधि के भीतर ऐसे अधिकारी के कार्यों के अतिरिक्त उसकी वृत्ति के अनुपालन में ऐसे अधिकारी द्वारा दर्शित उत्सुकता और अधिक जिम्मेवारी जिसमें वैज्ञानिक क्रियाकलाप और सेवाएं तथा विकास क्षमताओं, प्रबंधकीय या नेतृत्व गुण सम्मिलित हैं, लेने की योग्यता को ध्यान में रखेगा ।

(ग) निर्धारण अधिकारी, प्रत्येक अधिकारी के पालन और योग्यता पर विचार करने के पश्चात् विनिर्दिष्ट रूप से एक पृष्ठ के सारांश के माध्यम से नमनीय पूरक स्कीम के अधीन विचार के लिए उनकी योग्यता को न्यायोचित ठहराते हुए किए गए कार्य की अंतर्वस्तु का दस्तावेज रखेगा और प्रमाणित करेगा कि इस प्रकार सिफारिश किए गए अधिकारी नमनीय पूरक स्कीम के अधीन उन्नयन के लिए मानदंड को पूरा करते हैं ।

(घ) इसमें निर्धारण के आधार पर, निर्धारण बोर्ड निम्नलिखित में से किसी एक की सिफारिश कर सकेगा :

(i) अगली उच्चतर श्रेणी में अधिकारी की प्रोन्नति ; या

(ii) यथास्थिति,- अर्थात् श्रेणी में कोई परिवर्तन नहीं ।

(ङ) उन अधिकारियों के मामलों का पुनर्विलोकन जिनकी निर्धारण बोर्ड द्वारा यथास्थिति, सिफारिश कर रही है एक वर्ष की अवधि के पश्चात् छानबीन समिति द्वारा पुन:विचार किया जाएगा और उपनियम (२) से उपनियम (४) में विनिर्दिष्ट प्रक्रिया का पुन:पालन किया जाएगा ।

(५) निर्धारण बोर्ड द्वारा की गई सिफारिशों पर उपनियम (६) के अधीन सारणी के स्तंभ (६) में विनिर्दिष्ट अनुमोदन प्राधिकारी (निर्धारण) द्वारा विचार किया जाएगा और इसका निर्णय प्रत्येक मामले में अंतिम होगा ।

(६) छानबीन समिति, अनुमोदन प्राधिकारी (छानबीन) निर्धारण बोर्ड और अनुमोदन प्राधिकारी (निर्धारण) की संरचना नीचे सारणी में यथारूप से दी जाएगी :-

६. भर्ती की पद्धति, आयु-सीमा और अर्हताएं : (१) भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (५) से स्तंभ (१३) में विनिर्दिष्ट हैं ।

(२) स्वस्थाने प्रोन्नति के लिए नमनीय पूरक स्कीम का उन विभागीय अधिकारियों की बाबत अनुसरण किया जाएगा जो नियम ५ में विनिर्दिष्ट प्रक्रिया के अनुसार सहायक निदेशक एवं वैज्ञानिक 'सी', उप निदेशक एवं वैज्ञानिक 'डी' तथा निदेशक एवं वैज्ञानिक 'ई' के ग्रेड में हो तथा अनुसूची में उल्लिखित प्रत्येक प्रवर्ग में पूर्ण पारस्परिक परिवर्तनशीलता बिना किसी निबर्ंधन के होगी सिवाए पदधारियों की कुल संख्या अनुमोदित पदों की कुल संख्या से अधिक नहीं होगी ।

(३) नमनीय पूरक स्कीम के अंतर्गत की गई प्रोन्नति संबंधित अधिकारी हेतु वैयक्तिक होंगी, परिणामस्वरूप इस कारण निम्नतर श्रेणी में कोई रिक्ति पैदा नहीं होगी तथा संबंधित अधिकारी द्वारा धारित वर्तमान धारित पद का प्रोन्नति पर उसके रूकने की अवधि के लिए उन्नयन कर दिया जाएगा, तथा जैसे ही कोई अधिकारी अपने उच्चतर पद को छोड़ देता है यह पद अपने मूल स्तर पर वापस हो जाएगा ।

(४) नमनीय पूरक स्कीम के अंतर्गत प्रोन्नत के लिए पाए गए पात्र अधिकारियों की प्रभावी तारीख अनुमोदन प्राधिकारी (निर्धारण) द्वारा प्रोन्नति के अनुमोदन की तारीख से होगी । (५) वे अधिकारी जो अवकाश पर हैं, उन्हें उच्चतर वेतनमान में वेतन उसी तारीख से ही अनुज्ञात किया जाएगा जिस तारीख को अपने उच्चतर पद के कार्यभार को संभालते हैं । (६) वे अधिकारी जो प्रतिनियुक्ति पर बाहर हों उन्हें प्रोन्नति उनके यथास्थिति न्यायालयिक विज्ञान सेवाएं निदेशालय या इसकी बाहरी इकाईयों में वापिस आकर पदभार ग्रहण करने की तारीख से ही दी जाएगी किंतु ऐसे मामलों में प्रोफॉर्मा प्रोन्नति लागू नहीं होगी । (७) वे अधिकारी जो अवकाश या प्रतिनियुक्ति या विदेश सेवा के कारण मूल्यांकन हेतू प्रत्यक्ष तौर पर उपस्थित होने में असफल रहते हैं वे प्रोन्नति के लिए पात्र नहीं होंगे । (८) वे अधिकारी जिन्हें धारणाधिकार के प्रतिधारण के साथ तकनीकी त्याग पत्र के लिए अनुज्ञात किया गया हो, उन्हें यथास्थिति, उनके न्यायालयिक विज्ञान सेवाएं निदेशालय व इसकी बाहरी ईकाईयों में वापिस आकर पद ग्रहण करने की तारीख से ही प्रोन्नत किया जाएगा । (९) छानबीन समिति केवल उन्हीं अधिकारियों पर विचार करेगी जो पूर्वोक्त अनुसूची में अधिकथित सभी पात्रता शर्तों को पूरा करते हो तथा किसी भी प्राधिकारी के पास नमनीय पूरक स्कीम के अंतर्गत प्रोन्नति के लिए अधिकारियों के किसी प्रवर्ग के लिए उक्त पात्रता शर्तों को शिथिल करने की कोई स्वेच्छा निर्णय शक्ति नहीं होगी और वह अधिकारी जो अपेक्षित पात्रता शर्त पूरा नहीं करता है उसे केवल इस आधार पर कि उसका कनिष्ठ जो विचारित किए जाने के लिए अपेक्षा पूरी करता है, नमनीय पूरक स्कीम के अधीन प्रोन्नति के लिए विचार किए जाने का पात्र होगा । (१०) ऐसी प्रतिनियुक्ति या किसी अन्य वैज्ञानिक पद पर विदेश सेवा में लगाई गई अवधि जो उस अधिकारी के वैज्ञानिक अनुभव या क्षेत्र अनुभव में मददगार हो तथा अध्ययन छुट्टी या कोई अन्य अवकाश जो शैक्षिक कौशल में सुधार करने को लिया गया हो या केन्द्रीय सिविल सेवा (छुट्टी) नियम, १९७२ के अंतर्गत स्वीकृत मातृत्व अवकाश के साथ-साथ अधिकतम १ वर्ष की अवधि का स्वीकृत अवकाश एक बार में १८० दिन से अनधिक स्वीकृत अर्जित अवकाश (केन्द्रीय सिविल सेवा (नियम) १९७२ के अंतर्गत सीमा) के अनुरूप ऐसी अवधियों को प्रोन्नति हेतू अर्हक सेवा के रूप में गणना की जाएगी किन्तु गैरवैज्ञानिक पदों पर प्रतिनियुक्ति या विदेश सेवा की अवधि तथा चिकित्सा के आधार पर छुट्टी सहित अवकाश अवधि और व्यक्तिगत कारणों से लिए गए असाधारण छुट्टी की अवधि, अर्हता अवधि के लिए गणना में नहीं ली जाएगी ।

७. निरर्हता : वह व्यक्ति -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है ; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

८. शिथिल करने की शक्ति :-- जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

९. व्यावृत्ति :--इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

अनुसूची

(ii) अनुभव - केन्द्रीय सरकार या राज्य सरकार संगठन या केन्द्रीय सरकार या राज्य सरकार के अधीन किसी अन्य मान्यताप्राप्त अनुसंधान संस्थान या न्यायालयिक विज्ञान प्रयोगशाला में सुसंगत क्षेत्र में विश्लेषणात्मक पद्धति और अनुसंधान का तीन वर्ष का अनुभव ।

टिप्पण १ - शैक्षणिक अर्हताएं और वह वे क्षेत्र जिनमें अनुसंधान अनुभव अपेक्षित है, में सुसंगत शाखा(एं) भर्ती के समय आवश्यकता के अनुसार विनिर्दिष्ट की जाएगी ।

टिप्पण २ : अर्हता अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकेंगी । टिप्पण ३ : अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार अनुभव संबधी अर्हता नमनीय हैं यदि चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में नहीं है । II) वांछनीय (i) न्यायलयिक विज्ञान प्रयोगशाला में कार्य का अनुभव ।

NOTIFICATION

New Delhi, the 30th December, 2013

G.S.R. 806(E).—In exercise of powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Bureau of Police Research and Development (Central Forensic Science Laboratories, Group 'A' and Group 'B' posts) Recruitment Rules, 1974, in so far as it relates to the posts of Director, Deputy Director, Assistant Director and Senior Scientific Officer Grade II, and the Bureau of Police Research and Development Government Examiner of Questioned Documents, Deputy Government Examiner of Questioned Documents and Assistant Government Examiner of Questioned Documents Recruitment Rules, 1993,except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods of recruitment to the posts of Director, Deputy Director or Government Examiner of Questioned Document, Assistant Director or Deputy Government Examiner of Questioned Documents and Senior Scientific Officer Grade II or Assistant Government Examiner of Questioned Documents respectively re- designated as Director & Scientist 'E', Deputy Director & Scientist 'D', Assistant Director & Scientist 'C', and Scientist 'B' in the Ministry of Home Affairs, Directorate of Forensic Science Services and its outlying Units, namely:—

1. Short title and commencement.- (1) These rules may be called the Ministry of Home Affairs, Directorate of Forensic Science Services, Group 'A' Posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the posts specified in the column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.- The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Inter-se-seniority and minimum qualifying period.-

(1) The inter-se seniority shall be determined in accordance with the date of regular appointment of the officers to the respective grades subject to the condition that the inter-se-seniority shall not be disturbed within their respective grades.

(2) The posts mentioned in column (1) of the Schedule shall be operated under Flexible Complementing Scheme notified by the Department of Personnel and Training and amended from time to time (hereinafter referred to as the Flexible Complementing Scheme) and the said posts with designations as specified in column (1) of the table below shall carry the pay band and grade pay or pay scale as specified in column (2) of said table and shall have the minimum qualifying period linked to performance in a grade for promotion to the next grade as specified in column (3) thereof.

5. Criteria for considering in-situ promotions and procedure for selection or review under the Flexible Complementing Scheme. The following criteria and procedure for selection or review shall be followed for in-situ promotion of scientists from the grade of Scientist 'B' to Assistant Director & Scientist 'C', Assistant Director & Scientist 'C' to Deputy Director & Scientist 'D' and Deputy Director & Scientist 'D' to Director & Scientist 'E' under the Flexible Complementing Scheme, namely:-

(1) There shall be two levels of assessment, the first level shall be at internal level for screening purposes and the next level shall be for external assessment purposes for selection and for this purpose,-

(a) consideration for promotion under the Flexible Complementing Scheme shall be done once in a year before 1st January of every year and those officers who have completed or shall complete the required qualifying period in a particular post during the period of six months up to 31st December of the year preceding the year in which assessment is to be done and up to 30th June of the year in which the assessment is to be done, shall be considered for promotion to the next higher grade and the crucial date for determining requisite qualifying period shall be the 1st January of the year in which assessment is to be done;

(b) where an eligible officer is on foreign service or study leave in India or abroad, his or her case shall be considered and if such person has been approved for in-situ promotion under Flexible Complementing Scheme to the next higher grade, the effective date of such promotion shall be from the date of resumption of duty in the Directorate of Forensic Science Services or any of its outlying Units, as the case may be, and financial benefit shall accrue from the same date and no traveling allowance or dearness allowance shall be provided to attend the interview.

(c) all officers eligible under the Flexible Complementing Scheme shall be considered for promotion there under but exceptionally meritorious candidates with all outstanding grading may be granted relaxation in the qualifying period, the relaxation being not more than one year on any single occasion, limited to a maximum of two occasions in their entire career and the assessment under the Flexible Complementing Scheme for next grade shall only be three times and officers who have been granted any grade under Modified Assured Career Progression Scheme may be considered for next grade under the Flexible Complementing Scheme according to the eligibility and provisions notified by the Department of Personnel and Training vide their notification and orders issued from time to time in this regard;

(d) an officer promoted carries the post with him and consequently no vacancy is caused at the lower level and where a vacancy is caused due to an officer vacating a post by retirement on superannuation or voluntary retirement or resignation or death, the same shall be filled in at the level of Scientist 'B' in accordance with the roster for direct recruitment or promotion;

(e) field experience in scientific activities and services is compulsory for promotion of scientists to higher grades under the Flexible Complementing Scheme.

(2) The first level of internal Screening shall be done by the Screening Committee specified in column (3) of the table under sub rule (6) which shall evaluate the annual work reports in accordance with the criteria for upgradation under the Flexible Complementing Scheme and all eligible officers who meet with the benchmark of 'Good' for Assistant Director & Scientist 'C', 'Very Good' for Deputy Director & Scientist 'D' and above, shall be screened in and a report on the scientific content of work done by such officers shall be given by the screening committee in the following format for being made available to the Assessment Board, namely:-

Screening Committee Review Report:

1. Grading of the Scientific and Technical content of work reported

2. Specific Innovation elements recognized

3. Relative Assessment of the work reported vis-à-vis Peers in the area:

[ Top 10%, 10-33% , 33-50%, 50-75% Bottom 25%.]

4. Assessment of the work done during the qualifying period

5. Specific highlights of the scientific and technical content of the work done

6. Overall grading of the scientific and technical work report for the qualifying period:

[ Top 10% 10-33% 33-50% 50-75% Bottom 25%]

"Signatures of the Members of the Screening Committee".

(3) The Approving Authority (Screening), specified in column (4) of the table under sub-rule 6), shall consider all cases recommended by the Screening Committee and approve the same and in case it decides that any officer does not qualify for consideration for promotion by the Assessment Board, his or her case shall be placed before the Screening Committee after one year for its consideration and the procedure for screening as specified in sub- rule (2) shall be followed again.

(4) For the purposes of second level of external assessment;

(a) for evaluating suitability of officers for in-situ promotion; all officers who have been screened-in and recommended by the screening committee and approved by the Approving Authority (Screening) shall be assessed by the Assessment Board specified in column (5) of the table under sub-rule (6);

(b) the Assessment Board shall evaluate the accomplishments of each officer in terms of their work and recommend his or her suitability for promotion to the higher grade and the said Board shall, apart from the accomplishments of such officer during the period under consideration, also keep in mind the keenness exhibited by such officer in the pursuit of his or her profession and ability to take up higher responsibilities including scientific activities and services and development capabilities, managerial or leadership qualities;

(c) the Assessment Board shall,after taking into consideration the performance and merit of each officer, document, specifically through one page summary, the specific content of the work done justifying their merit for consideration under the Flexible Complementing Scheme and certify that the officers so recommended meet with the criteria for in situ up-gradation under the Flexible Complementing Scheme ;

(d) on the basis of its assessment, the Assessment Board may recommend any one of the following:-

(i) Promotion of the officer to the next higher grade; or

(ii) Status quo – i.e. no change in the grade

(e) review of cases of those officers who have been recommended status quo by the Assessment Board shall again be considered by the Screening Committee after a period of one year and the procedure specified in sub-rules(2) to (4) shall be followed again .

(5) The recommendations made by the Assessment Board shall be considered by the Approving Authority (Assessment) specified in column (6) of the table under sub-rule (6) and its decision on each case shall be final.

(6) The Composition of Screening Committee, Approving Authority (Screening), Assessment Board and Approving Authority(Assessment) shall be as given in the table below:—

6. Method of recruitment, age limit and qualifications, etc.- (1) The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

(2) The Flexible Complementing Scheme for in-situ promotion shall be followed in respect of departmental officers, to the grades of Assistant Director & Scientist 'C', Deputy Director & Scientist 'D' and Director & Scientist 'E' in accordance with the procedure specified in rule 5 and there shall be complete interchangeability within each category mentioned in the Schedule without any restriction except that the total number of incumbents shall not exceed the total number of sanctioned posts.

(3) In-situ Promotions under the Flexible Complementing Scheme shall be personal to the officer concerned not resulting in specific vacancy in the lower grade on that account and the post being currently held by the concerned officer shall be upgraded for the duration of his or her stay in the promotion post and the post shall revert to the original level once the officer vacates the higher post.

(4) The effective date of promotion of officers found eligible for promotion under the Flexible Complementing Scheme shall be from the date of approval of promotion by Approving Authority (Assessment).

(5) The officers who are away on leave shall be allowed pay in the higher pay scale only from the date they join back and assume the duties of the higher post.

(6) The officers who are away on deputation shall be given promotion with effect from the date they repatriate and join in the Directorate of Forensic Science Services or any of its outlying units, as the case may be, but proforma promotion shall not apply.

(7) The officers who fail to appear physically for the assessment for reasons of leave or deputation or Foreign Service shall not be eligible for promotion.

(8) The officers who have been allowed to take technical resignation with retention of lien shall be promoted only with effect from the date they join back in the Directorate of Forensic Science Services or any of its outlying units, as the case may be.

(9) The Screening Committee shall consider the candidature of only those officers who fulfill all the eligibility conditions as laid down in the aforesaid Schedule and discretion shall not be available with any authority for relaxing the said eligibility conditions for any category of officers for promotions under the Flexible Complementing Scheme and the officer who does not fulfill the requisite eligibility condition shall not be entitled to be considered for promotion under the Flexible Complementing Scheme on the ground that his junior who fulfills the requirement is being considered.

(10) The period spent on deputation or foreign service to another scientific post which helps the officer to acquire scientific experience or field experience and period of study leave or any other leave availed for improving academic accomplishments, maternity leave sanctioned as per the Central Civil Services (Leave) Rules, 1972, leave of a maximum period of one year sanctioned in continuation of maternity leave as per said leave rules, earned leave sanctioned for a period not exceeding 180 days at a time (the ceiling under Central Civil Services (Leave) Rules, 1972) shall count as qualifying period for promotion but periods spent on deputation or foreign service to non-scientific posts and period of leave including leave on medical grounds and extraordinary leave availed on personal grounds shall not count towards qualifying period.

7. Disqualification.- No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

8. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

9. Saving. - Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
