का.आ. 3912(अ).—चूँकि केन्द्र सरकार को तम्बाकू बोर्ड द्वारा यह सूचना दी गई है कि कर्नाटक राज्य में बड़ी संख्या में पंजीकृत उत्पादकों द्वारा फ्रलू क्योर्ड वर्जीनिया तम्बाकू की अध्कृित मात्राा से अध्कि खेती की गई है तथा अपंजीकृत उत्पादकों ने भी अनध्कृित फ्रलू क्योर्ड वर्जीनिया तम्बाकू की खेती की है, जिससे मांग तथा आपूत की स्थिति में असंतुलन आ गया हैऋ

;खद्ध वर्ष 2013-14 के पफसली मौसम के लिए प्रत्येक अपंजीकृत उत्पादक द्वारा उत्पादित फ्रलू क्योर्ड वर्जीनिया तम्बाकू के लिए 2 रुपए प्रति कि.ग्रा. तथा बिक्री आय का 7.5% ;उत्पादकों द्वारा देय आय के 1% के सामान्य सेवा शुल्क सहितद्ध तम्बाकू निध् िमें जमा किया जाएगाऋ और

;गद्ध वर्ष 2013 के लिए तम्बाकू की पफसल के संबंध् में अध्किारों के रिकार्ड की एक प्रति प्रस्तुत है ।

NOTIFICATION

और चूँकि केन्द्र सरकार इस बात से संतुष्ट है कि फ्रलू क्योर्ड वर्जीनिया तम्बाकू की खरीद की अनुमति देने के लिए तम्बाकू बोर्ड को प्राध्कृित करना आवश्यक एवं समीचीन है और वह कर्नाटक राज्य में तम्बाकू बोर्ड के निदष्ट नीलामी मंचोें पर पंजीकृत उत्पादकों की फ्रलू क्योर्ड वर्जीनिया तम्बाकू की अतिरिक्त पफसल तथा अपंजीकृत उत्पादकों की फ्रलू क्योर्ड वर्जीनिया तम्बाकू की पफसल का निपटान करना उचित समझती हैऋ

New Delhi, the 30th December, 2013

S.O. 3912(E).—Whereas, the Central Government has been informed by the Tobacco Board that a large number of registered growers have cultivated Flue Cured Virginia tobacco in excess of the authorised quantity and unregistered growers have also resorted to unauthorised Flue Cured Virginia tobacco cultivation in the State of Karnataka, causing a mismatch between the demand and supply position;

Now, therefore, in exercise of the powers conferred by section 20A, read with clause (g) of sub-section (2) of section 8 of the Tobacco Board Act, 1975 (4 of 1975), the Central Government hereby authorises the Tobacco Board to admit, from the date of publication of this notification in the Official Gazette and upto the 31st March, 2014, the registered traders and dealers of the Tobacco Board to purchase, at its auction platforms in the State of Karnataka, the excess flue cured virginia tobacco, produced by the registered growers and Flue Cured Virginia tobacco produced by unregistered growers in the State of Karnataka, subject to the following conditions, namely:—

इसलिए, अब, तम्बाकू बोर्ड अध्निियम, 1975 ;1975 का 4द्ध की धरा 8 की उपधरा ;2द्ध के खंड ;छद्ध के साथ पठित धरा 30 की उपधरा ;1द्ध द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्‌्‌द्वारा कर्नाटक राज्य में उक्त अध्निियम की धरा 14-क;1द्ध की उप-धरा ;1द्धके साथ पठित धरा 10 के प्रावधनों के प्रचालन में इस अध्सिूचना के राजपत्रा में प्रकाशित होने की तारीख से शुरू होकर 31 मार्च, 2014 को समाप्त होने वाली अवध् िके लिए ढील प्रदान करती है तथा पंजीकृत उत्पादकों की अतिरिक्त फ्रलूू क्योर्ड वर्जीनिया तम्बाकू पफसल तथा अपंजीकृत उत्पादकों की फ्रलू क्योर्ड वर्जीनिया तम्बाकू पफसल की बिक्री तम्बाकू बोर्ड द्वारा अध्कृित नीलामी मंचों पर करने की अनुमति प्रदान करती है ।

NOTIFICATION

(a) an amount of Rs. 2 per kg., and 7.5 per cent, of the proceeds of the sale (including a normal service charge of 1 per cent of proceeds payable by growers) shall be contributed to the Tobacco Fund by every registered grower for the excess Flue Cured Virginia tobacco produced by them for 2013-14 crop season;

(b) an amount of Rs. 2 per kg., and 15 per cent. of the proceeds of the sale (including a normal service charge of 1 per cent of proceeds payable by growers) shall be contributed to the Tobacco Fund by every unregistered grower for the Flue Cured Virginia tobacco produced by him/her for 2013-14 crop season;

(c) a copy of the Record of Rights in respect of tobacco

crop for the 2013 is furnished.

And, whereas, the Central Government considers it necessary to dispose of the excess Flue Cured Virginia tobacco of the registered growers and Flue Cured Virginia tobacco of unregistered growers at the designated auction platforms of the Tobacco Board in the State of Karnataka;

का.आ. 3913(अ).—चूँकि केन्द्र सरकार इस बात से संतुष्ट है कि ऐसी परिस्थितियां उत्पन्न हो गई हैं जिनके कारण जनहित मेंं यह आवश्यक हो गया है कि तम्बाकू बोर्ड अध्निियम 1975 ;1975 का 4द्धद्वारा लगाए गए प्रतिबंधें में ढील प्रदान की जाए ऋ

और चूँकि केन्द्र सरकार ने यह आवश्यक समझा है कि पंजीकृत उत्पादकों के बेशी फ्रलू क्योर्ड वर्जीनिया तम्बाकू तथा अपंजीकृत उत्पादकों द्वारा उत्पादित फ्रलू क्योर्ड वर्जीनिया तम्बाकू की बिक्री Now, therefore, in exericise of the powers conferred by sub-section (1) of Section 30 read with clause (g) of sub-section (2) of section 8 of the Tobacco Board Act, 1975 (4 of 1975 ), the Central Government hereby relaxes the operation of the provisions of section 10, read with sub-section (1) of 14-A of the said Act in the State of Karnataka for the period commencing from the date of publication of this notification in the Official Gazette and ending upto the 31st March, 2014 and permits the sale of excess Flue Cured Virginia tobacco crop of the registered growers and Flue Cured Virginia tobacco crop of the unregistered growers the auction platforms authorised by the Tobacco Board.
