काकाकाका....आआआआ.... 14141414(अ)(अ)(अ)(अ)....—राजपुरा (पंजाब) में सरकार द्वारा निर्मित कुछ भवनों के साथ-साथ 46.93 एकड़ माप की सरकारी भूमि सरकारी अनुदान अधिनियम, 1895 के अधीन नाम मात्र के 1 रुपये के वार्षिक किराये पर कस्तूरबा सेवा मंदिर ट्रस्ट (केएसएमटी), राजपुरा को पट्टे पर दी गई थी। 2. पट्टे का खादी और ग्रामोद्योग आयोग (केवीआईसी) की विभिन्न स्कीमों के अधीन विकास क्रियाकलाप आरंभ करने के लिए राजपुरा के नए टाउनषिप, पंजाब में भूमि और भवन के लिए भारत के राष्ट्रपति तथा केएसएमटी के बीच भूतलक्षी प्रभाव के साथ 17 जनवरी, 1959 से 30 वर्षों के लिए निष्पादन किया गया। 3. पट्टे का 16 जुलाई, 2000 से 15 जुलाई, 2004 तक चार वर्ष की अवधि के लिए अंतिम विस्तार प्रदान करने के साथ समय-समय पर विस्तार किया गया इन शर्तों के अध्ययीन कि कस्तूरबा सेवा मंदिर ट्रस्ट (केएसएमटी) :-
(i) अपने क्रियाकलापों को पूरा करने के लिए आनुकल्पिक इंतजाम करेगा और 16 जुलाई, 2004 से पहले सरकारी भूमि को खाली करेगा। (ii) केंद्रीय लोक निर्माण विभाग द्वारा उस समय यथा निर्धारित प्रचलित बाजार दरों पर भूमि खरीदेगा। (iii) विद्यमान खाली भूमि सरकार को तुरन्त सौंपेगा।
4. 16 जुलाई, 2004 को पट्टा व्यपगत होने के बावजूद, केएसएमटी ने 46.93 एकड़ माप की भूमि जिस पर पहले ही कुछ भवन निर्मित कर लिए गए थे उसे खाली नहीं किया। 5. ट्रस्ट ने भूमि खरीदने के लिए अपनी असमर्थता अभिव्यक्त की है और तत्कालीन संयुक्त सचिव की अध्यक्षता वाली टीम द्वारा यह अवलोकन किया गया कि ट्रस्ट खादी और ग्रामोद्योग आयोग की विभिन्न स्कीमों के अधीन विकास क्रियाकलापों के स्थान पर भूमि पर बर्फ फैक्टरी, गोदाम किराये पर देने, कृषि उत्पादों तथा चारे के विक्रय जैसे निजी क्रियाकलापों में सम्मिलित है। 6. माननीय मंत्री (सूलमउ) के अनुमोदन तथा विधि और न्याय मंत्रालय के परामर्ष से उक्त भूमि को सूचना देने की तिथि अर्थात् 11 जून, 2012 से तीन माह की अवधि के भीतर खाली करने के लिए ट्रस्ट को एक विधिक नोटिस दिया गया। 7. ट्रस्ट ने विधिक नोटिस के तीन माह की नियत अवधि के भीतर भूमि खाली नहीं की। 8. अब, इसीलिए, केन्द्रीय सरकार, सरकारी स्थान (अप्राधिकृत अधिभोगियों की बेदखली) अधिनियम, 1971 की धारा 3 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अधिनियम की धारा 3 के अर्थ में एक सम्पदा अधिकारी अर्थात् श्री एल. हौकिप, उप सचिव, सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय, उद्योग भवन, नई दिल्ली-110011 को राजपुरा की नई टाउनषिप, पंजाब में 46.93 एकड़ माप की ऐसी भूमि को उस पर पहले ही निर्मित भवनों के साथ अनधिकृत दखलकार अर्थात् कस्तूरबा सेवा मंदिर ट्रस्ट (केएसएमटी), राजपुरा से खाली करवाने के लिए नियुक्त करती है। 16 GI/2014 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
9. पूर्ववर्ती पैरा में निर्दिष्ट सम्पदा अधिकारी सरकारी राजपत्र में इस अधिसूचना के प्रकाषन की तारीख से तीन माह की अवधि के भीतर संयुक्त सचिव (एआरआई), सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय, उद्योग भवन, नई दिल्ली को अपनी रिपोर्ट प्रस्तुत करेगा। 10. यह माननीय सूक्ष्म, लघु और मध्यम उद्यम मंत्री द्वारा अनुमोदित है।

NOTIFICATION
New Delhi the 30th December, 2013
S.O. 14(E).—Whereas, the Government land at Rajpura (Punjab) measuring 46.93 acre alongwith some buildings constructed by the Government was leased under the Government Grants Act, 1895 at a nominal yearly rental of Rs. 1/- to the Kasturba Seva Mandir Trust (KSMT), Rajpura.
2. And whereas the lease was executed between the President of India and KSMT with retrospective effect from 17th January, 1959 for land and building in the New Township of Rajpura, Punjab for 30 years for taking up the development activities under various schemes of Khadi & Village Industries Commission (KVIC).
3. And whereas the lease was extended from time to time with the last extension granted for a period of four years from the 16th July, 2000 to the 15th July, 2004 subject to the conditions that KSMT shall :-
(i) make alternative arrangements for carrying out its activities and vacate the Government land before the 16th July, 2004.
(ii) purchase the land at market rates prevailing at that times as fixed by the Central Public Works Department.
(iii) handover the existing vacant land to the Government immediately.
4. And whereas, despite the lapse of lease on the 16th July, 2004 KSMT did not vacate the land measuring 46.93 acre alongwith some buildings already constructed thereon.
5. And whereas, the trust has expressed its inability to purchase the land and it was observed by the team headed by the then Joint Secretary that the trust is involved in private activities on the land such as ice factory, renting of godowns, sale of agricultural products and fodders instead of development activities under various schemes of KVIC.
6. And whereas, a legal notice was served to the trust with the approval of Hon'ble Minister (MSME) and in consultation with the Ministry of Law and Justice to vacate the said land within a period of three months from the date of the notice i.e., 11th June, 2012.
7. And whereas, the trust did not vacate the land within the stipulated period of three months of the legal notice.

8. Now, therefore, in exercise of the powers conferred under section 3 of the Public Premises( Eviction of Unauthorized Occupants) Act, 1971, the Central Government hereby appoints an Estate Officer, namely, Shri L. Haokip, Deputy Secretary, Ministry of Micro, Small and Medium Enterprises, Udyog Bhavan, New Delhi-110011 within the meaning of the Section 3 of the said Act to get the said land measuring 46.93 acre in the new township of Rajpura, Punjab alongwith buildings already constructed thereon vacated by the unauthorized occupant namely the Kasturba Seva Mandir Trust (KSMT), Rajpura.
9. The Estate Officer referred to in the preceding paragraph shall submit his report to the Joint Secretary (ARI), Ministry of Micro, Small and Medium Enterprises, New Delhi within a period of three months from the date of publication of this notification in the Official Gazette.
10. This has the approval of Hon'ble Minister of Micro, Small and Medium Enterprises.
