NOTIFICATION
New Delhi, the 3rd January, 2014
No. 01/2014 –Customs (ADD) G.S.R. 3(E).—In exercise of the powers conferred by sub-section (1) and (5) of section 9A of the Customs Tariff Act, 1975 (51 of 1975), read with rules 18 and 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government hereby makes the following amendments in notification of the Government of India, in the Ministry of Finance (Department of Revenue), No. 121/2009-Customs, dated the 30th October, 2009, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), vide number G.S.R. 792(E), dated the 30th October, 2009, namely :—
In the said notification, in the Table,—
(a) against serial number 1, for the entry in column (7), the entry "JSC Grodno Azot" shall be substituted;
(b) against serial number 2,
(i) for the entry in column (7), the entry "JSC Grodno Azot" shall be substituted;
(ii) for the entry in column (8), the entry "JSC Grodno Azot" shall be substituted.

सासासासा.काकाकाका.िनिनिनिन. 4((((अअअअ).).).).—अिभfgत प्राधिकारी ने, चीन गणराज्य में मूलत: उ(cid:26)मित या वहां से निर्यातित "कम्पैक्ट %लोरोसेंट लैम्प" आयात के मामले में अधिसूचना सं. 15/22/2013-डीजीएडी, तारीख 14 नवम्बर, 2013, जो भारत के राजपत्र, असाधारण, भाग II, खंड 1 में तारीख 14 नवम्बर, 2013 के द्वारा प्रकाशित की गई थी के द्वारा भारत सरकार के वित्त मंत्रालय (राजस्व िवभाग) की अधिसूचना सं. 55/2009-सीमा शुल्क, तारीख 26 मई, 2009, भारत के राजपत्र, असाधारण, भाग II,खंड 3, उप-खंड (i) में सा.का.िन. 360 (अ) तारीख 26 मई, 2009 के द्वारा प्रकाशित के तहत अधिरोपित प्रतिपाटन शुल्क के संबंध में, सीमा शुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की धारा 9क की उप-धारा (5) तथा सीमा-शुल्क टैरिफ (पाटित वस्तुओं की पहचान, उस पर प्रतिपाटित शुल्क का निर्धारण और सं9हण तथा क्षति का अवधारण) िनयम, 1995 (जिसे इसमें इसके पश्चात उक् त िनयम भी कहा गया है) के िनयम 23 के तहत प्रतिपाटन शुल्क जारी रखने के मामले में समीक्षा आरंभ की थी और उक्त टैरिफ अधिनियम की धारा 9क की उप-धारा (5) के तहत, अधिरोपित प्रतिपाटन शुल्क समाप्त होने की तारीख से एक वर्ष और ब<+ने की सिफारिश की थी;
अत: अब के न्Aीय सरकार, उक्त अधिनियम की धारा 9क की उप-धारा (1) तथा उप-धारा (5) तथा उक्त िनयम के िनयम 23 के द्वारा प्रदत्त शक्तियों का प्रयोग करते Dए, भारत सरकार के वित्त मंत्रालय (राजस्व िवभाग) [भाग II—खण्ड 3;iद्ध] भारत का राजपत्रा : असाधरण 3
की अधिसूचना सं. 55/2009-सीमा शुल्क, तारीख 26 मई, 2009 भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में सा.का.िन. 360(अ) तारीख 26 मई, 2009 के द्वारा प्रकाशित Dई थी, में निम्निलिखत संशोधन करती है, अर्थात् :—
उक्त अिधसूचना में, स्पष्टीकरण के पश्चात््, निम्नलिखित पैरा9ाफ अंत:स्थापित किया जा,गा, अर्थात्:—
र्क्त िनिहत के बावजूद, उपरोक्त सारणी के Gम संख्या 1 से 28 में अधिरोपित izतिपाटन शुल्क, "2. उपयु 20 नवम्बर, 2014 जिसमें यह तारीख भी सम्मििलत है, तक प्रभावी रहेगी ।"

G.S.R. 4 (E).—Whereas, the designated authority vide notification F. No. 15/22/2013-DGAD, dated the 14th November, 2013, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 14th November, 2013, had initiated review in terms of sub-section (5) of section 9A of the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the said Customs Tariff Act) and in pursuance of rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (hereinafter referred to as the said rules), in the matter of continuation of anti-dumping duty on imports of Compact Fluorescent Lamps originating in or exported from China PR, imposed vide notification of the Government of India, in the Ministry of Finance (Department of Revenue), No. 55/2009-Customs, dated 26th May, 2009, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 360(E), dated the 26th May, 2009, and has recommended for extension of anti-dumping duty, in terms of sub-section (5) of section 9A of the said Customs Tariff Act;
Now, therefore, in exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the said Customs Tariff Act and in pursuance of rule 23 of the said rules, the Central Government hereby makes the following amendment in the notification of the Government of India, in the Ministry of Finance (Department of Revenue), No. 55/2009-Customs, dated the 26th May, 2009, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 360(E), dated the 26th May, 2009, namely :—
In the said notification, after Explanation, the following shall be inserted, namely :—
"2. Notwithstanding anything contained hereinabove, the anti-dumping duty imposed against serial numbers 1 to 28 of the TABLE above shall remain in force up to and inclusive of the 20th day of November, 2014.".
