विषयः आईटीसी (एचएस), 2012, अनुसूची-I (आयात नीति) के अध्याय 87 में नई नीतिगत श्शर्त सं. 10 जड़ना।

का.आ. 51(अ).-समय-समय पर यथा-संशधित विदेश व्यापार नीति, 2009-14 के पैरा 2.1 के साथ पठित विदेश व्यापार (विकास एवं विनियमन) अधिनियम, 1992 ( 1992 की सं. 22) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, एतद्‌द्वारा आईटीसी (एचएस) 2012, अनुसूची-I (आयात नीति) के अध्याय 87 की नीतिगत शर्तं में निम्नानुसार संशोधन करती है :

2. आईटीसी (एचएस) 2012, अनुसूची-I (आयात नीति) के अध्याय 87 में नीतिगत शर्त सं. 9 के बाद एक नई नीतिगत शर्त सं.10 निम्नानुसार जड़ी गई हैः

"10. रेस स्पर्धाअं के लिए आवष्यक अनुकूलित कारं/मटरसाइकिलं अर उनके पुर्जं का आयात निम्नलिखित शर्तं के अधीन किया जाएगाः

(क) उपर्युक्त क्रम सं.1 अर 2 की शर्तें अनुकूलित कारं/मटरसाइकिलं तथा उनके पुर्जं के आयात के लिए लागू नहीं हंगी।

(ख) सीमाशुल्क निकासी के समय में उत्पाि देश की किसी अन्तर्राष्ट्रीय मान्यताप्राप्त एजेंसी से टाइप अनुमदन प्रमाणपत्र/सीअपी की आवश्यकता नहीं हगी।

(ग) नडल एजेंसी (भारत सरकार द्वारा नामित की जाने वाली) से यह दर्शाते हुए एक प्रमाण-पत्र कि सीमा-शुल्क निकासी के समय वाहन के विवरण की आवश्यकता हगी। आयात केवल ऐसे सीमा-शुल्क पानं से अनुमत हगा ज नीतिगत शर्त (1), (II) घ (iv) के अनुसार हंगे।

(घ) इन वाहनं का केवल उसी प्रयजन के लिए उपयग किया जाएगा जिसके लिए इनका आयात किया गया ह। इस प्रावधान के तहत आयातित वाहन सीवीएम अधिनियम/नियमावली के तहत पंजीकृत नहीं हंगे; न ही इनका भारत में कहीं भी किसी व्यक्ति/संगठन/संख्या आदि क हस्तांतरित/विक्रय किया जाएगा। ये वाहन सार्वजनिक सड़कं पर नहीं चलेंगे अर इनका केवल अपेक्षित सुरक्षा की पूर्व शर्तं के साथ सीमित परिसरं के भीतर उपयग किया जा सकता है तथा इन्हें किसी प्रकार के वाणिज्यिक कार्यकलापं में नहीं लगाया जाएगा। 92 GI/2014 (1) 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (ड.) स्पर्धा समाप्त हने के 30 दिनं के भीतर या ऐसी बढ़ायी गई अवधि जैसा कि उपयुक्त अधिकारी उचित कारण बताए जाने के बाद अनुमति देता है, के भीतर वाहन (वाहनं) के पुनःनिर्यात हेतु आयातक क पर्याप्त प्रतिभूति सुरक्षा/प्रतिभूति के साथ सीमा-शुल्क के साथ बंधपत्र निष्पादित करना हगा।"

3. इस अधिसूचना का प्रभावः

रेस स्पर्धाओंं के लिए आवश्यक अनुकूलित कारं/मटर-साइकिलं तथा उनके पुर्जं का आयात आसान बनाने के लिए आईटीसी (एचएस), 2012, अनुसूची-I (आयात नीति) के अध्याय 87 में एक नई नीतिगत षर्त सं.10 जड़ी गई है।

Subject: - Addition of a new Policy Condition No. 10 to Chapter 87 of ITC (HS), 2012 Schedule 1 (Import Policy).

S.O. 51(E).— In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No. 22 of 1992), read with paragraph 2.1 of the Foreign Trade Policy, 2009—2014, as amended from time to time, the Central Government hereby amends Policy Conditions to Chapter 87 of ITC (HS) 2012, Schedule 1 (Import Policy) as under:

2. After Policy Condition No. 9, a new Policy Condition No. 10 is added to Chapter 87 of ITC (HS), 2012 Schedule 1 (Import Policy) as follows:—

"10. The import of customized Cars/Motorcycles and parts thereof required for the race events shall be subject to the following conditions:-

(a) The conditions at Sl. Nos. 1 & 2 above shall not be applicable on import of customized Cars/Motorcycles and parts thereof.

(b) At the time of Customs clearance, a Type Approval Certificate/COP of an international accredited agency from the country of origin will not be required.

(c) A certificate from Nodal Agency (to be nominated by Govt. of India) indicating the details of the vehicle shall be required at the time of Customs clearance. Import shall be permitted only through such Customs ports as per Policy Condition (1) (II) (d) (iv).

(d) These vehicles will be used only for the purpose for which these are imported. Vehicles imported under this provision will not be registered CMV Act/ Rules; nor be alienated/sold to any individual/organization/ institution etc. anywhere in India. These vehicles shall not ply on public roads and can only be used within the enclosed premises with requisite safety precautions and will not be engaged in any sort of commercial activities.

(e) The importer shall be required to execute a Bond with Customs with adequate security/surety to re-export the vehicle(s) within 30 days of the completion of the event or within such extended period as the appropriate officer may allow after being shown a reasonable cause."

3. Effect of this notification:

A new Policy Conditions No. 10 is added to Chapter 87 of ITC (HS), 2012 Schedule-1 (Import Policy) for facilitating the import of customized Cars/Motorcycles and parts thereof required for the race events.
