काकाकाका....आआआआ. . . . 74((((v).).).).————जबकि भारतीय चिकित्सा परिषद््, संशोधन अध्यादेश, 2013 की धारा 3क की उप-धारा (1) द्वारा प्रदत्त
शक्तियों का प्रयोग करते हुए दिनांक 06 नवम्बर, 2013 को भारतीय चिकित्सा परिषद का पुनर्गठन किया गया; जबकि भारतीय चिकित्सा परिषद अधिनियम, 1956 (1956 का 102) की धारा 3 की उप-धारा (1) (ख) के उपबंध के अनुपालन में डॉ केशव कुमार अग्रवाल को एम जे पी रूहेलखण्ड विश्वविद्यालय, बरेली के प्रतिनिधि के रूप में दिनांक 06 नवंबर 2013 से भारतीय चिकित्सा परिषद का सदस्य बनाया गया;
जबकि भारतीय चिकित्सा परिषद ने सूचित किया है कि डॉ केशव कुमार अग्रवाल, जो आई एम सी अधिनियम, 1956 की धारा 3(1)(ख) के तहत एम जे पी रूहेलखण्ड विश्वविद्यालय, बरेली का प्रतिनिधित्व कर रहे हैं, के विरूद्ध विशेष न्यायाधीश, भ्रष्टाचार विरोधी अदालत सी बी आई, लखनऊ में दायर केस नं आर सी 0062010 ए 0014 में केंद्रीय अन्वेषण ब्यूरो (सी बी आई) द्वारा आरोप पत्र दाखिल किया गया है । अतः आई एम सी संशोधन द्वितीय अध्यादेश, 2013 की धारा 30 क (2) में निहित उपबंधों के अनुसार, डॉ केशव कुमार, जो आई एम सी अधिनियम की धारा 3(1)(ख) के तहत एम जे पी रूहेलखण्ड विश्वविद्यालय, बरेली का प्रतिनिधित्व कर रहे थे, अब भारतीय चिकित्सा परिषद के सदस्य नहीं हैं;
अतः अब आई एम सी (संशोधन) अध्यादेश, 2013 की धारा 30 क (2) के उपबंध के अनुपालन में यह समझा जाएगा कि डॉ केशव कुमार अग्रवाल, जो एम जे पी रूहेलखण्ड विश्वविद्यालय, बरेली का प्रतिनिधित्व कर रहे थे, दिनांक 26 दिसंबर 2013 से भारतीय चिकित्सा परिषद के सदस्य नहीं हैं ।

New Delhi, the 26th December, 2014
S.O. 74(E).—Whereas on 6th November, 2013, the Medical Council of India was re-constituted in exercise of the powers conferred by sub-section (1) of section 3A of the Indian Medical Council (Amendment) Ordinance, 2013;
Whereas in pursuance of the provision of sub-section (1)(b) of Section 3 of the Indian Medical Act, 1956 (102 of 1956) Dr. Keshav Kumar Aggarwal was elected as a member of the Medical Council of India representing MJP Rohilkhand University, Bareilly with effect from 06-11-2013;
Whereas the Medical Council of India has informed that Dr. Keshav Kumar Aggarwal who is representing MJP Rohilkhand University, Bareilly under section 3(1)(b) of IMC Act, 1956 has been charge sheeted by the Central Bureau of Investigation (CBI) in the case No. RC0062010A0014 filed in the Court of Special Judge, Anti-corruption, CBI, Lucknow. Therefore, Dr. Keshav Kumar Aggarwal has ceased to be a member of Medical Council of India representing MJP Rohilkhand University, Bareilly under section 3(1)(b) of IMC Act, 1956 as per the provisions contained section 30A(2) of IMC (Amendment) Second Ordinance, 2013.
Now, therefore, in pursuance of the provision of section 30A(2) of IMC (Amendment) Second Ordinance, 2013, Dr. Keshav Kumar Aggarwal shall be deemed to have ceased to be a member of the Medical Council of India representing MJP Rohilkhand University, Bareilly with effect from 26-12-2013.
