नई दिल्ली, 7 जनवरी, 2014
का.आ. 72(अ).-केन्द्रीय सरकार ने रेल अधिनियम, 1989 (1989 का 24) (जिसे इसमें इसके पष्चात् उक्त अधिनियम कहा गया है) की धारा 20क की उप-धारा (1) के अधीन जारी, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii), तारीख 3 जुलाई, 2013 में प्रकाषित, भारत सरकार के रेल मंत्रालय (रेलवे बोर्ड) की अधिसूचना संख्यांक का. आ. 2007(अ), तारीख 4 जुलाई, 2013 द्वारा उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिदष्ट भूमि को, गुजरात राज्य में विषेष रेल परियोजना, अर्थात् वेस्टर्न डेडीकेटेड फ्रेट कोरीडोर के निष्पादन, के लिए अर्जित करने के अपने आषय की घोषणा की थी;
और, उक्त अधिसूचना का सार, उक्त अधिनियम की धारा 20क की उप-धारा (4) के अधीन दैनिक स्थानीय समाचार पत्रों, अर्थात् संदेष (गुजराती) तारीख 24 अगस्त, 2013 और दि टाइम्स आफ इंडिया (अंग्रेजी), तारीख 24 अगस्त, 2013 में प्रकाषित किया गया था;
और, सक्षम प्राधिकारी को कोई आक्षेप प्राप्त नहीं हुए थे;
और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 20ङ की उप-धारा (1) के अनुसरण में केन्द्रीय सरकार को अपनी रिपोर्ट सौंप दी है;
अतः, अब, केन्द्रीय सरकार, सक्षम प्राधिकारी से रिपोर्ट प्राप्त होने पर और उक्त अधिनियम की धारा 20ङ की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिदष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी;
और केन्द्रीय सरकार, उक्त अधिनियम की धारा 20ङ की उप-धारा (2) के अनुसरण में यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाषित होने पर इससे उपाबद्ध अनुसूची में विनिदष्ट भूमि सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में आत्यंतिक रूप से निहित हो जाएगी।

NOTIFICATION
New Delhi, the 7th January, 2014
S.O. 72(E).—Whereas, by the notification of the Government of India in the Ministry of Railways (Railway Board), number S.O. 2007(E), dated the 3rd July, 2013 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) dated the 4th July, 2013 and issued under sub-section (1) of Section 20(A) of the Railways Act,1989 (24 of 1989) (hereinafter referred to as the said Act), the Central Government, declared its intention to acquire the land specified in the Schedule annexed to the said notification for the purpose of execution, maintenance, management and operation of the Special Railway Project, namely, Western Dedicated Freight Corridor in the State of Gujarat;
And, whereas, the substance of the said notification was published in the daily local newspapers, namely, "The Times of India" (English) dated the 24th August, 2013 and "Sandesh" (Gujarati) dated the 24th August, 2013 under sub-section (4) of Section 20A of the said Act;
And, whereas, Nil objection has been received from village Bhayali of Vadodara district by the competent authority;
And, whereas, in pursuance of sub-section (1) of Section 20E of the said Act, the competent authority has submitted its report to the Central Government;
Now, therefore, upon receipt of the report of the competent authority and in exercise of the powers conferred by sub-section (1) of Section 20E of the said Act, the Central Government hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose;
And, further, in pursuance of sub-section (2) of Section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances.
