काकाकाका....आआआआ. . . . 78 ((((अअअअ)))).---- आयकर अिधिनयम, 1961 (1961 का 43) की धारा 10 के खंड (46) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:26)ए के न्(cid:29)ीय सरकार एतदद्वारा उड़ीसा राज्य ए"स नियंत्रण सोसाइटी (उड़ीसा स्टेट ए"स कं ट्रोल सोसाइटी), उड़ीसा सरकार द्वारा गठित एक निकाय को, उक्त सोसाइटी को उ,भूत होने वाली निम्नलिखित विनि3दष्ट आय के संबंध में उक्त खंड के प्रयोजनों के लिए अधिसूचित करती है, अर्थात:-
(क) के न्(cid:29)ीय सरकार से सहायता अनुदान के रूप में प्राप्त रािश;
(ख) सहायता अनुदान पर अDजत ब्याज।
2. इस अधिसूचना को वित्त वर्ष 2011-12 और 2012-13 के लिए लागू किया (cid:26)आ माना जाएगा तथा यह Gमश: वित्त वर्ष 2013-14, 2014-15 एवं 2015-16 के िलए भी लागू होगी।
3. यह अधिसूचना निम्नलिखित शतH के अधीन प्रभावी होगी, अर्थात:-
(क) उड़ीसा राज्य ए"स नियंत्रण सोसाइटी कोई भी वाणिज्यिक कार्यकलाप नहI करती है;
(ख) उड़ीसा राज्य ए"स नियंत्रण सोसाइटी के कार्यकलाप और विनि3दष्ट आय के स्वरूप पूरे वित्तीय वर्ष में अपरिवर्तनीय रहते हैं; तथा
(ग) उड़ीसा राज्य ए"स नियंत्रण सोसायटी, अपनी आय की विवरणी आयकर अधिनियम, 1961 की धारा 139 की उपधारा (4ग) के खंड (छ) के उपबंध के अनुसार दायर करती है।
4. उक्त सोसाइटी को प्राप्त होने वाली अनुदानों की राशि को मौजूदा प्रचलित नियमों और विनियमों के अनुसार प्राप्त किया जाएगा और उपयोग में लाया जाएगा।

NOTIFICATION
New Delhi, the 10th January, 2014
S.O.78 (E).- In exercise of the powers conferred by clause (46) of Section 10 of the Income-tax Act, 1961 (43 of 1961), the Central Government hereby notifies for the purposes of the said clause, the Orissa State AIDS Control Society, a body constituted by the Government of Orissa in respect of the following specified income arising to that Society, namely:—
(a) amount received in the form of grants-in-aid from the Central Government;
(b) interest earned on grants-in-aid.
2. This notification shall be deemed to have been applied for the financial years 2011-2012 and 2012-2013 and shall be applicable for the financial years 2013-2014, 2014-2015 and 2015-2016.
3. The notification shall be effective subject to the following conditions, namely:—
(a) the Orissa State AIDS Control Society does not engage in any commercial activity;
(b) the activities and the nature of the specified income of the Orissa State AIDS Control Society remain unchanged throughout the financial year; and
(c) the Orissa State AIDS Control Society files return of income in accordance with the provision of clause (g) of sub-section (4C) section 139 of the Income-tax Act, 1961.
4. The grants received by the said Society shall be received and applied in accordance with the prevailing rules and regulations.
