आआआआ....अअअअ.... 3(अ)3(अ)3(अ)3(अ)....----संसदीय और विधान सभा निर्वाचन क्षेत्रों में अनुसूचित जातियों और अनुसूचित जनजातियों के प्रतिनिधित्व का पुनर्समायोजन (तृतीय) अध्यादेश, 2013 (2013 की सं. 10) की धारा 6 की उप-धारा (1) के अनुपालन में, उक्त अध्यादेश की धारा 4 की उप-धारा (3) के खण्ड (घ) के अन्तर्गत संसदीय और विधान सभा निर्वाचन क्षेत्रों का परिसीमन आदेश, 2008 की अनुसूची II और अनुसूची XXVIII (उत्तर प्रदेश राज्य से संबंधित) को संशोधित करने के लिए (ऐसे आदेश में दिए गए किसी भी निर्वाचन क्षेत्र की सीमा में परिवर्तन किए बिना) उत्तर प्रदेश के संबंध में अनुसूचित जातियों और अनुसूचित जनजातियों के बारे में भारत के महारजिस्ट्रार द्वारा यथाअधिसूचित 2001 के संशोधित जनसंख्या आंकड़ों के आधार पर, भारत निर्वाचन आयोग, निम्नलिखित आदेश, दिनांक 12 जनवरी, 2014, एतद्द्वारा, प्रकाशित करता है।
{उत्तर प्रदेश राज्य के बारे में अनुसूचित जातियों और अनुसूचित जनजातियों के वर्ष 2001 के संशोधित जनसंख्या आंकड़ों के आधार पर संसदीय और विधान सभा क्षेत्रों में अनुसूचित जातियों और अनुसूचित जनजातियों के प्रतिनिधित्व का पुनर्समायोजन}

यतः, संसदीय और विधान सभा निर्वाचन क्षेत्रों में अनुसूचित जातियों और अनुसूचित जनजातियों के प्रतिनिधित्व का पुनर्समायोजन (तृतीय) अध्यादेश, 2013 (2013 की सं. 10) (इसके बाद इसे अध्यादेश के रूप में संदर्भित किया गया है) की धारा 4 की उप-धारा (3) के अनुपालन में संसदीय और विधान सभा निर्वाचन क्षेत्रों का परिसीमन आदेश, 2008 की अनुसूची II और अनुसूची XXVIII (उत्तर प्रदेश राज्य के संबंध में) को संशोधित करने के लिए (ऐसे आदेश में दिए गए किसी भी निर्वाचन क्षेत्र की सीमा को परिवर्तित किए बिना) संसदीय और विधान सभा निर्वाचन क्षेत्रों में अनुसूचित जातियों और अनुसूचित जनजातियों के प्रतिनिधित्व का पुनर्समायोजन अध्यादेश, 2013 (2013 का 2) की धारा 3 की उप-धारा (3) के अन्तर्गत, दिनांक 1 अप्रैल, 2013 के भारत के राजपत्र के असाधारण अंक के खण्ड III भाग 4 में भारत के महारजिस्ट्रार द्वारा यथा अधिसूचित एवं प्रकाशित उत्तर प्रदेश के संबंध में अनुसूचित जातियों और अनुसूचित जनजातियों की जनसंख्या के संशोधित आंकडों के आधार पर, उत्तर प्रदेश राज्य की विधान सभा निर्वाचन क्षेत्रों की कुल 403 सीटों में से अनुसूचित जातियों और अनुसूचित जनजातियों के लिए क्रमशः '84' और '2' सीटें आरक्षित किए जाने संबंधी सीटों की संख्या को पुनर्निधारित किए जाने और ऐसे निर्वाचन क्षेत्रों को निर्दिष्ट करते हुए जिनमें ऐसी सीटों की अवस्थिति प्रस्तावित की गई थी या जिनकी स्थिति परिवर्तित की जानी प्रस्तावित थी; से संबंधित अपने प्रस्तावों को भारत निर्वाचन आयोग ने भारत के राजपत्र के असाधारण अंक में और उत्तर प्रदेश राज्य के राजपत्र में दिनांक 5 दिसम्बर, 2013 को प्रकाशित कर दिया गया था; और

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)] यतः भारत निर्वाचन आयोग ने दिनांक 5 दिसम्बर, 2013 की अपनी उक्त अधिसूचना के द्वारा अपने उपर्युक्त प्रस्तावों के संबंध में जनसाधारण से सुझाव एवं आपत्तियां दिनांक 16 दिसम्बर, 2013 को या उससे पहले आमंत्रित की थी और उक्त तारीख (16 दिसम्बर, 2013) को ऐसी तारीख के रूप में निर्दिष्ट किया था जिसको या जिसके बाद आयोग के उपरोक्त प्रस्तावों पर और आगे विचार किया जाएगा; और
यतः, अध्यादेश की धारा 4 की उक्त उप-धारा (3) के अनुसरण में आयोग के उपर्युक्त प्रस्ताव को दिनांक 05 दिसंबर, 2013 को दैनिक जागरण समाचार-पत्र में भी प्रकाशित किया गया था तथा आयोग की वेबसाइट, रेडियो तथा टेलीविज़न और जनसंपर्क के अन्य माध्यमों द्वारा उसका व्यापक प्रचार किया गया था; और
यतः, अध्यादेश की धारा 4 की उक्त उप-धारा (3) के अनुसरण में आयोग ने 05 दिसंबर, 2013 और 26 दिसंबर, 2013 को सार्वजनिक सूचनाएं भी जारी की थी जिनमें इसके द्वारा प्राप्त की गई सभी आपत्तियों और सुझावों पर विचार करने के लिए सार्वजनिक बैठकों के स्थान और तारीखों का उल्लेख किया गया था; और
यतः, अध्यादेश की धारा 4 की उक्त उप-धारा (3) के अनुसरण में आयोग ने 26 दिसंबर, 2013 को वाराणसी, 30 दिसंबर, 2013 को सहारनपुर तथा 03 जनवरी, 2014 को झांसी में सार्वजनिक बैठकें आयोजित की थीं, जिनमें जनता के प्रतिनिधियों को सुना गया और उन्हें आयोग को पहले से भेजे गए लिखित आवेदनों, यदि भेजे हैं, के अतिरिक्त मौखिक और लिखित निवेदन करने का भी पूरा अवसर दिया; तथा
यतः, आयोग द्वारा संविधान, परिसीमन अधिनियम, 2002 तथा उक्त अधिनियम के सुसंगत प्रावधानों के आलोक में अपने उक्त प्रस्ताव के संबंध में इसके द्वारा उपरोक्त सार्वजनिक बैठकों में या और अन्यथा प्राप्त सभी आपत्तियों तथा दिए गए सुझावों पर विचार किया गया; और यतः, इस प्रकार विचार करने पर, आयोग ने (1) 402 ओबरा तथा (2) 403-दुद्धी (अनुसूचित जाति) विधान सभा निर्वाचन क्षेत्रों को उत्तर प्रदेश राज्य की विधान सभा में अनुसूचित जनजाति हेतु आरक्षित करने का निर्णय लिया है और उत्तर प्रदेश राज्य में किसी अन्य संसदीय निर्वाचन क्षेत्र और विधान सभा निर्वाचन क्षेत्र में आरक्षण की स्थिति में कोई परिवर्तन नहीं होगा;
अतः, अब, अध्यादेश की धारा 4 की उप-धारा (3) के खंड (घ) के अनुसरण में निर्वाचन आयोग संसदीय और विधान सभा निर्वाचन क्षेत्रों का परिसीमन ओदश, 2008 की अनुसूची II और अनुसूची XXVIII में एतद्द्वारा निम्नलिखित संशोधन करता है :-
I अनुसूची अनुसूची अनुसूची अनुसूची II में, स्तंभ (1), (2), (3), (4), (5), (6), तथा (7) में उत्तर प्रदेश राज्य से संबंधित क्रम संख्या 27 में विद्यमान प्रविष्टियों को क्रमशः निम्नलिखित प्रविष्टियों से प्रतिस्थापित किया जाए :-
''27 उत्तर प्रदेश 403 89 - 403 84 2'';
II अनुसूची अनुसूची अनुसूची अनुसूची XXVIII, उत्तर प्रदेश राज्य में विधान सभा निर्वाचन क्षेत्रों से संबंधित भाग क में,-
(i) 'क्रम संख्या और नाम' शीर्ष के अंतर्गत '402 ओबरा' क्रम संख्या पर विद्यमान प्रविष्टि के
लिए '402 ओबरा' (अनुसूचित जनजाति) प्रविष्टि प्रतिस्थापित की जाएगी;
(ii) 'क्रम संख्या और नाम' शीर्ष के अंतर्गत '403 दुद्धी (अनुसूचित जाति) क्रम संख्या पर
विद्यमान प्रविष्टि के लिए '403 दुद्धी (अनुसूचित जनजाति) प्रविष्टि प्रतिस्थापित की
जाएगी;
III अनुसूची अनुसूची अनुसूची अनुसूची XXVIII,,,, उत्तर प्रदेश राज्य में संसदीय निर्वाचन क्षेत्रों से संबंधित भाग ख में,-
'क्रम संख्या और नाम' और 'विधान सभा निर्वाचन क्षेत्रों के अर्थ में विस्तार' शीर्षों के अंतर्गत '80-राबर्ट्सगंज (अनुसूचित जाति) को निम्नलिखित प्रविष्टियों से प्रतिस्थापित किया जाएगाः-
'80- राबर्ट्सगंज (अ.जा.) 383-चकिया (अ.जा.), 400-घोरावल, 401- राबर्ट्सगंज, 402-ओबरा (अ.ज.जा.) तथा 403-दुद्धी (अ.ज.जा)'।

NOTIFICATION
New Delhi, the 13th January, 2014
O. N. 3(E).—In pursuance of sub-section (1) of Section (6) of the Readjustment of Representation of Scheduled Castes and Scheduled Tribes in Parliamentary and Assembly Constituencies (Third) Ordinance, 2013 (No. 10 of 2013), the following Order dated 12th January, 2014, made by the Election Commission under clause (d) of sub-section (3) of Section 4 of the said Ordinance to amend Schedule II and Schedule XXVIII (relating to the State of Uttar Pradesh) to the Delimitation of Parliamentary and Assembly Constituencies Order, 2008 (without altering the extent of any constituency as given in such Order) on the basis of the revised census figures, 2001, for Scheduled Castes and Scheduled Tribes in respect of Uttar Pradesh, as notified by the Registrar General of India, is hereby published.

ORDER NO. 1
Whereas, in pursuance of sub-section (3) of Section 4 of the Readjustment of Representation of Scheduled Castes and Scheduled Tribes in Parliamentary and Assembly Constituencies (Third) Ordinance, 2013 (No.10 of 2013) (hereinafter referred to as the Ordinance), the Election Commission published its proposals in the extraordinary issue of the Gazette of India and the Uttar Pradesh State Gazette on 5th December, 2013, to amend Schedule-II and Schedule XXVIII (with regard to the State of Uttar Pradesh ) to the Delimitation of Parliamentary and Assembly Constituencies Order, 2008 (without altering the extent of any constituency as given in such Order) on the basis of the revised population figures for the Scheduled Castes and Scheduled Tribes in respect of the State of Uttar Pradesh, as notified and published by the Registrar General of India in an extraordinary issue of the Gazette of India, Part III, Section 4, dated 1st April, 2013, under sub-section (3) of Section 3 of the Readjustment of Representation of Scheduled Castes and Scheduled Tribes in Parliamentary and Assembly Constituencies Ordinance, 2013 (2 of 2013), re-determining the number of seats to be reserved for the Scheduled Castes and Scheduled Tribes in the Legislative Assembly of the State of Uttar Pradesh as '84' and '2' respectively, out of 403 seats in that Assembly, and also specifying the constituencies in which such seats were proposed to be located or whose status was proposed to be changed; and
Whereas, by its said notification dated 5th December, 2013, the Election Commission invited from the public the suggestions and objections in relation to its above proposals on or before the 16th December, 2013, and specified the said date (16th December, 2013) as the date on or after which the aforesaid proposals of the Commission will be further considered by it; and
Whereas, in pursuance of the said sub-section (3) of Section 4 of the Ordinance, the Commission's proposals, referred to above, were also published in Dainik Jagran newspaper on 5th December, 2013 and further publicity was given thereto through the Commission's website, radio and television and other media of mass communication; and
Whereas, in pursuance of said sub-section (3) of Section 4 of the Ordinance, the Commission also issued public notices on 5th December, 2013 and 26th December, 2013 specifying the places and dates of its public sittings to consider all objections and suggestions received by it; and
Whereas, in pursuance of the said sub-section (3) of Section 4 of the Ordinance, the Commission held public sittings on 26th December, 2013 at Varanasi, on 30th December, 2013 at Saharanpur and on 3rd January, 2014 at Jhansi, and heard the members of the public and afforded them full opportunity of making oral and written submissions, in addition to the written representations already sent, if any, to the Commission; and
Whereas, the Commission has considered all objections and suggestions made at the aforesaid public sittings and/or received by it otherwise, in relation to its said proposals, in the light of the relevant provisions of the Constitution, the Delimitation Act, 2002 and the said Ordinance; and
Whereas, on such consideration, the Commission has decided to reserve (1) 402 Obra and (2) 403 Duddhi (SC) Assembly Constituencies for the Scheduled Tribes in the Legislative Assembly of the State of Uttar Pradesh and that there shall be no change in the reservation status of any other Assembly or Parliamentary Constituency in the State of Uttar Pradesh;
Now, therefore, in pursuance of clause (d) of sub-section (3) of Section 4 of the Ordinance, the Election Commission hereby makes following amendments to Schedule II and Schedule XXVIII to the Delimitation of Parliamentary and Assembly Constituencies Order, 2008 :—
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)]I. In Schedule II, the existing entries at serial number 27 relating to the State of Uttar Pradesh in columns (1), (2), (3), (4), (5), (6) and (7), the following entries shall be substituted respectively :—
"27. Uttar Pradesh 403 89 -- 403 84 2";
II. In Schedule XXVIII, Part A relating to Assembly Constituencies in the State of Uttar Pradesh,—
(i) for the existing entries at serial number '402 Obra', under the heading 'Serial Number and Name', the entries '402 Obra (ST)' shall be substituted;
(ii) for the existing entries at serial number '403 Duddhi (SC)', under the heading 'Serial Number and Name', the entries '403 Duddhi (ST)' shall be substituted;
III. In Schedule XXVIII, Part B relating to Parliamentary Constituencies in the State of Uttar Pradesh,—
for the existing entries at serial number '80-Robertsganj (SC)', under the headings 'Serial Number and Name', and 'Extent in terms of Assembly Constituencies' the following entries shall be substituted:—
'80-Robertsganj (SC) 383-Chakia (SC), 400-Ghorawal, 401-Robertsganj,
402-Obra (ST) and 403-Duddhi (ST)'.
