काकाकाका. . . . आआआआ. . . . 219 219 219 219 ((((अअअअ))))....————के (cid:3)(cid:4)ीय सरकार ने पे(cid:8)ोिलयम और खिनज पाइइइइपलाइइइइन (भूिम म(cid:13) उपयोग के अिधकार का अज(cid:16)न) अिधिनयम, 1962 (1962 का 50) (िजसे इसम(cid:13) इसके प(cid:20)चात् उ(cid:25) अिधिनयम कहा गया है) क(cid:26) धारा 3 क(cid:26) उप-धारा (1) के अधीन जारी क(cid:26) गई भारत सरकार के पे(cid:8)ोिलयम और (cid:27)ाकृ ितक गैस मं(cid:31)ालय क(cid:26) अिधसूचना सं या का.आ.1774(अ) तारीख 19 जून 2013, जो भारत के राजप(cid:31) तारीख 20 जून 2013, म(cid:13) (cid:27)कािशत क(cid:26) गई थी #ारा उस अिधसूचना से संल$न अनुसूची म(cid:13) िविन&द( भूिम म(cid:13) उ)र (cid:27)देश रा*य म(cid:13) भारतीय रेलवे के डी.एफ.सी. के िलये बी.के .पी.एल. क(cid:26) मुगलसराय और कानपुर के बीच खंड िश+,टग हेतु /े(cid:31) आई ((cid:27)0थािपत पाइपलाइन चैनेज 481.096 से 484.250 तक िजला इलाहाबाद) म(cid:13) पे(cid:8)ोिलयम प2रवहन के िलए इंिडयन ऑयल कॉप5रेशन िलिमटेड #ारा पाइपलाइन िबछाने के (cid:27)योजन के िलए उपयोग के अिधकार के अज(cid:16)न के अपने आशय क(cid:26) घोषणा क(cid:26) थी ;
और उ(cid:25) राजप(cid:31) अिधसूचना क(cid:26) (cid:27)ितयां जनता को तारीख 27 अग0त 2013 तक उपल6ध करा दी गई थी ;
और स/म (cid:27)ािधकारी ने उ(cid:25) अिधिनयम क(cid:26) धारा 6 क(cid:26) उप-धारा (1) के अधीन के (cid:3)(cid:4)ीय सरकार को 2रपोट(cid:16) दे दी है ;
और के (cid:3)(cid:4)ीय सरकार ने, उ(cid:25) 2रपोट(cid:16) पर िवचार करने के प(cid:20)चात् और यह समाधान हो जाने पर 8क उ(cid:25) भूिम पाइपलाइन िबछाने के िलए अपेि/त है, उसम(cid:13) उपयोग के अिधकार का अज(cid:16)न करने का िविन(cid:20)चय 8कया है ;
319 GI/2014 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, के (cid:3)(cid:4)ीय सरकार उ(cid:25) अिधिनयम क(cid:26) धारा 6 क(cid:26) उपधारा (1) #ारा (cid:27)9) शि(cid:25)य: का (cid:27)योग करते ;ए, यह घोषणा करती है 8क इस अिधसूचना से संल$न अनुसूची म(cid:13) िविन&द( भूिम म(cid:13) पाइपलाइन िबछाने के िलए उपयोग के अिधकार का अज(cid:16)न 8कया जाए ;
और के (cid:3)(cid:4)ीय सरकार उ(cid:25) अिधिनयम क(cid:26) धारा 6 क(cid:26) उप-धारा (4) #ारा (cid:27)द) शि(cid:25)य: का (cid:27)योग करते ;ए, यह िनद=श देती है 8क उ(cid:25) भूिम म(cid:13) उपयोग का अिधकार इस घोषणा के (cid:27)काशन क(cid:26) तारीख से के (cid:3)(cid:4)ीय सरकार म(cid:13) िनिहत होने के बजाए, सभी िव>लंगम: से मु(cid:25) होकर इंिडयन ऑयल कॉप5रेशन िलिमटेड म(cid:13) िनिहत होगी।
पे(cid:8)ोिलयम और खिनज पाइपलाइन अिधिनयम, 1962 क(cid:26) धारा 10 के अधीन 8कसी भी /ितपूAत के िलए इंिडयन ऑयल कॉप5रेशन िलिमटेड पूण(cid:16)तया उ)रदायी होगी और पाइपलाइन से सCबि(cid:3)धत 8कसी भी मामले पर के (cid:3)(cid:4)ीय सरकार के िवEF कोई वाद दावा या कानूनी काय(cid:16)वाही नहG हो सके गी ।

NOTIFICATION
New Delhi, the 20th January, 2014
S.O. 219 (E).— Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas S.O. No. 1774(E) dated the 19th June, 2013, issued under sub-section (1) of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962), (hereinafter referred to as the said Act), published in the Gazette of India dated the 20th June, 2013, the Central Government declared its intention to acquire the right of user in the land specified in the Schedule appended to that notification for the purpose of laying pipeline for the "Shifting of Barauni-Kanpur pipeline between Mughalsarai and Kanpur for DFCCIL of Indian Railway" in Part-I (from Existing P/L Ch.- 481.096 to 484.250 in District-Allahabad) by Indian Oil Corporation Limited for the transportation of petroleum products;
And whereas copies of the said Gazette notification were made available to the public up to 27th August, 2013;
And whereas the competent authority has under sub-section (1) of section 6 of the said Act submitted report to the Central Government;
And whereas the Central Government, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire right of user therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 6 of the said Act, the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of section 6 of the said Act, the Central Government hereby directs that the right of user in the said land for laying the pipeline shall, instead of vesting in the Central Government, vest on the date of publication of the declaration, in Indian Oil Corporation Limited, free from all encumbrances.
Indian Oil Corporation Limited shall be exclusively liable for any compensation in terms of Section 10 of the P & MP Act, 1962 and no suit, claim or legal proceeding would lie against the Central Government on any matter relating to the pipeline.
