lk-dk-fu- 53¼v½-&केन्द्रीय सरकार, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 27, धारा 41, धारा 50 और धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, प्रस्तावित केन्द्रीय मोटरयान नियम, 1989 का और संषोधन करने के लिए उक्त अधिनियम की धारा 212 की उप-धारा (1) द्वारा यथा अपेक्षित निम्नलिखित प्रारूप अधिसूचना को उन सभी व्यक्तियों की जानकारी के लिए जिनको उससे प्रभावित होने की संभावना है, प्रकाषित करती है; और यह सूचना देती है कि उक्त प्रारूप पर उस तारीख से तीस दिन के पश्चात् विचार किया जाएगा, जिसको भारत के राजपत्र में यथा प्रकाषित उक्त अधिसूचना की प्रतियां जनता को उपलब्ध थी।
2. उपरोक्त विनिर्दिष्ट अवधि समाप्त होन के भीतर उक्त प्रारूप नियम के संबंध में किसी व्यक्ति से प्राप्त आक्षेपों या सुझावों पर केंद्रीय सरकार द्वारा विचार किया जाएगा।
3. आक्षेपों या सुझावों, यदि कोई हो, संयुक्त सचिव (परिवहन), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद मार्ग, नई दिल्ली-110001 को भेजा जा सकेगा।

1. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान (संषोधन) नियम, 2014 है।
(2) इन नियमों में अन्यथा उपबंधित के सिवाय, ये नियम राजपत्र में अंतिम प्रकाषन की तारीख को प्रवृत होंगें।
2. केन्द्रीय मोटर यान नियम, 1989 (जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) के नियम 2 में खंड (ब) के पष्चात् निम्नलिखित खंडों को अंतःस्थापित किया जाएगा, अर्थात् :-
''(भ) 'टी श्रेणी'-से एक स्वतः आगे न बढ़ने वाला संचालित सड़क यान अभिप्रेत है जिसके अंतर्गत न्यूनतम दो पहियों वाला अर्धट्रेलर भी है जो अपनी डिजाइन और तकनीकी विषिष्टताओं के कारण व्यक्तियों और मालों को ढ़ोने में प्रयुक्त होता है और किसी मोटर यान द्वारा खीचने के लिए आषयित है;
परंतु यह वर्गीकरण और मान्यता के प्रयोजन के लिए निम्नलिखित श्रेणियों पर लागू होगा :
(भ क) ''टी1 श्रेणी'' से टी श्रेणी का 0.75 टन से अनधिक के अधिकतम वजन का यान अभिप्रेत है;
(भ ख) ''टी2 श्रेणी'' से टी श्रेणी का 3.5 टन से अधिक और 0.75 टन से अनधिक के अधिकतम वजन का यान अभिप्रेत है;

(भ ग) ''टी3 श्रेणी'' से टी श्रेणी का 3.5 टन से अधिक और 10 टन से अनधिक के अधिकतम वजन का यान अभिप्रेत है;
(भ घ) ''टी4 श्रेणी'' से टी श्रेणी का अधिकतम 10 टन वजन का यान अभिप्रेत है;
(भ ड.) ''टी5 श्रेणी'' से खींचने वाला तिपहिया ट्रेक्टर द्वारा खींचने के लिए आषयित टी श्रेणी का अर्ध यान अभिप्रेत है;
3. मूल नियम 71 के उपनियम (ग) में ''किसी ट्रेलर या अर्धट्रेलर के मामले में'' षब्दों के स्थान पर ''टी श्रेणी से भिन्न ट्रेलर के मामले में'' शब्दों को रखा जाएगा।
4. मूल नियम 125ग के पश्चात् निम्नलिखित नियम अंतःस्थापित किए जाएंगें, अर्थात् :-
''125घ. टी श्रेणी का अनुमोदन
(1) भारतीय मानक ब्यूरो अधिनियम, 1986 (1986 का 63) के अधीन तत्संबंधी भारतीय मानक ब्यूरो के विनिर्देषों के अधिसूचित किए जाने तक, 1 अप्रैल, 2016 को और उसके पश्चात् टी श्रेणी के लिए टाइप अनुमोदन और प्रमाणन की प्रकिया समय-समय पर यथा संषोधित टी श्रेणी के ट्रेलरों जो एन2 आर एन3 श्रेणी के मोटर यानों द्वारा खींचे जातें हैं, के टाइप अनुमोदन के लिए व्यवहार संहिता -ए आई एस : 113 के अनुसार होगी।
(2) 1 अप्रैल, 2016 को और उसके पश्चात् निम्नलिखित यानों को समय-समय पर यथा संषोधित आई एस ः 8007-2004 और या ए आई एस ः 09 (भाग-1) का खींचने वाले यान और ट्रेलर/अर्धट्रेलर का कुल सम्मिलित वजन की अनुज्ञेय सीमा के भीतर अंतर्बदल के सभी प्रयोजनों के लिए पालन करना होगा।
(क) एन2 और एन3 श्रेणी के यान जो टी श्रेणी के यान को खीचने के लिए प्राधिकृत हैं;
(ख) टी श्रेणी जो एन2 और एन3 श्रेणी के यानों द्वारा खीचें जाने के लिए प्राधिकृत हैं।''

NOTIFICATION
New Delhi, the 24th January, 2014
G.S.R. 53 (E).—The following draft rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by sections 27, 41, 50 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification as published in Gazette of India, are made available to the public.
2. Any objections or suggestions which may be received from any person with respect to the said draft rules within the expiry of the period above specified will be considered by the Central Government.
3. Objections or suggestions, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi- 110 001.
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (Amendment) Rules, 2014.
(2) Save as otherwise provided in these rules, they shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicle Rules, 1989 (hereinafter referred to as the principal rules), in rule 2, after clause (w), the following clauses shall be inserted, namely:-
"(x) "Category T" - means a non‐self propelled driven road vehicle, including a semi-trailer, having at least two wheels which, on account of its design and technical features, is used to transport persons or goods and is intended to be towed by a motor vehicle;.
Provided that the following categories apply for purposes of classification and recognition:
(xa) "Category T1" means a category T vehicle having a maximum weight not exceeding 0.75 tonnes;

(xb) "Category T2" means a category T vehicle having a maximum weight exceeding 0.75 tonnes but not exceeding 3.5 tonnes;
(xc) "Category T3" means a category T vehicle having a maximum weight exceeding 3.5 tonnes but not exceeding 10 tonnes;
(xd) "Category T4" means a category T vehicle having a maximum weight exceeding 10 tonnes.
(xe) "Category T5" means a semi category T vehicle intended to be drawn by a three – wheeled haulage tractor.
3. In rule 47 of the principal rules, in sub rule (c), for the words "in the case of a trailer or a semi-trailer ", the words " in the case of a trailer other than Category T " shall be substituted.
4. After rule 125C of the principal rules, the following rule shall be inserted, namely:-
"125D. Approval of Category T (1) On and from the 1st day of April, 2016, the procedure for type approval and certification for Category T, referred in AIS:053, shall be in accordance with AIS:113 - Code of Practice for Type Approval of Category T, Trailers/ Semi-trailers towed by Motor Vehicles of Category N2 and N3, as amended from time to time, till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986). (2) On and from the 1st day of April, 2016, the following vehicles shall conform to IS:8007 - 2004 and / or AIS:091 ( Part-1), as amended from time to time, for all purposes of inter-changeability within the permissible Gross Combination Weights of the towing vehicle and the trailer / semi-trailer.
(a) vehicles of Category N2 and Category N3 which are authorised to tow Category T;
(b) Category T which are authorised to be towed by vehicles of Category N2 and Category N3."
