सासासासा....काकाकाका....िनिनिनिन.... 52(अ).—राष्ट्रपित, संविधान के अनु(cid:22)छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते $ए वित्त मंत्रालय, राजस्व िवभाग, प्रवर्तन निदेशालय में स्टाफ कार चालक (िवशेष .ेणी) के पद पर भर्ती की प3ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1111. . . . संक्षिप्तसंक्षिप्तसंक्षिप्तसंक्षिप्त नाम और प्रारंभ नाम और प्रारंभ नाम और प्रारंभ नाम और प्रारंभ – (1) इन नियमों का संक्षिप्त नाम िवत्त मंत्रालय, राजस्व िवभाग, प्रवर्तन निदेशालय, स्टाफ कार चालक (विशेष .ेणी) समूह 'ख' पद भर्ती नियम, 2014 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

4444.... निरर्हतानिरर्हतानिरर्हतानिरर्हता : वह Hयक्ति -
(क) जिसने ऐसे Hयक्ति से जिसका पति या जिसकी पत्नी जीिवत है, विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते $ए किसी Hयक्ति से विवाह किया है,
उक्त पदों पर नियुक्ति का पात्र नहK होगा:
परन्तु यदि के न्Lीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे Hयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुMेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी Hयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
5555. . . . शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति - जहां के न्Lीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं, उन्हें लेखब3 करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Hयक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।
6666. . . . -या-या-या-यावृत्तिवृत्तिवृत्तिवृत्ति - इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहK डालेगी, जिनका के न्Lीय सरकार द्वारा इस संबंध में समय-समय पर िनकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के Hयक्तियों के लिए उपबंध करना अपेक्षित है ।

NOTIFICATION
New Delhi, the 24th January, 2014
G.S.R. 52 (E). — In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Staff Car Driver ( Special Grade) in the Ministry of Finance, Department of Revenue, Directorate of Enforcement, namely :-
1. Short title and commencement. — (1) These rules may be called Ministry of Finance, Department of Revenue, Directorate of Enforcement, Staff Car Driver (Special Grade), Group 'B' Post, Recruitment Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, pay band and grade pay or pay scale. — The number of said post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification. – No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax .— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. — Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time.

| Promotion :- Staff Car Driver Grade-I in pay band- 1, Rs. 5200-20200 plus grade pay of Rs. 2,800/- with three years regular service in the grade in the Directorate of Enforcement rendered after appointment thereto on a regular basis. Note:-1 Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. Note:2 For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1.1.2006 or the date from which the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission. | Group 'B' Departmental Promotion Com- mittee (for promotion) consisting of :— 1.
