सा.का.नि. 60(+É).—केन्द्रीय सरकार, कीटनाशी नियम, १९७१ का और संशोधन करने के लिए कीटनाशी अधिनियम, १९६८ (१९६८ का ४६) की धारा ३६ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित प्रारूप नियम का प्रस्ताव करते हुए उक्त धारा की अपेक्षा के अनुसार ऐसे सभी व्यक्तियों की जानकारी के जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियम पर उस तारीख से जिसको इस अधिसूचना के भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा;
अब, केंद्रीय सरकार की यह राय है कि ऐसी परिस्थितियां उत्पन्न हो गई हैं जो बोर्ड के साथ परामर्श किए बिना नियम बनाने की आवश्यकता प्रदान करती है;
केंद्रीय सरकार, अधिनियम की धारा ३६ के परंतुक के निबंधनों के अनुसार, इन नियमों के बनाए जाने के छह मास के भीतर केंद्रीय कीटनाशी बोर्ड से परामर्श करेगी और उन सुझावों पर विचार करेगी जो बोर्ड इन नियमों के संशोधन के संबंध में दे;
उक्त नियम के संबंध में किसी व्यक्ति से उक्त पैंतालीस दिन की अवधि के समाप्त होने के पहले आक्षेपों और सुझावों को प्राप्त किया जा सकेगा और केंद्रीय सरकार उन पर विचार करेगी;
उक्त नियम के संबंध में आक्षेपों और सुझावों को संयुक्त सचिव (पादप संरक्षण), कृषि मंत्रालय, कृषि और सहकारिता विभाग, कृषि भवन, नई दिल्ली-११०००१ को भेजा जाएगा ।

१. (१) इन नियमों का संक्षिप्त नाम कीटनाशी (संशोधन) नियम, २०१४ है ।
(२) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
२. कीटनाशी नियम, १९७१ में,—
(i) नियम ९ के उपनियम (३) के खंड (vi) और खंड (vii) को हटा दिया जाएगा ।
(ii) पहली अनुसूची के प्ररूप V में शीर्षक 'शर्तें' संख्यांक (६) और संख्यांक (७) को हटा दिया जाएगा ।

NOTIFICATION
New Delhi, the 27th January, 2014
G.S.R. 60(E).—The following draft rule further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), is hereby published, as required by said section, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of forty- five days from the date on which copies of this notification as published in the Gazette of India are made available to the public;
Whereas, the Central Government is of the opinion that circumstances have arisen, which render it necessary to make the rules without consulted with the Board;
In terms of proviso to section 36 of the Act, the Central Insecticide Board shall be consulted within six months of the making of the rules and the Central Government shall take into consideration any suggestions which the Board may make in relation to the amendment of the said rules;
The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the period of forty-five days aforesaid will be considered by the Central Government;
Objections and suggestions in respect to the said draft rules may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture, Department of Agriculture and Co-operation, Krishi Bhawan, New Delhi-110 001.
DRAFT RULES
1. (1) These rule may be called the Insecticides (Amendment) Rules, 2014.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Insecticides Rules, 1971,—
(i) In rule 9, in sub-rule (3) clauses (vi) and (vii) shall be omitted.
(ii) In FIRST SCHEDULE, in FORM V, under the heading 'conditions' numbers (6) and (7) shall be omitted.
