का.आ. 266(अ).—के (cid:28)(cid:29)(cid:5)य सरकार, भारतीय मानक !यूरो अ#ध%नयम, 1986 (1986 का 63) क& धारा 14 (cid:7)वारा 'द(त शि*तय+ का 'योग करते हुए, भारतीय मानक !यूरो से परामश0 करने के प1चात %न3न4ल5खत आदेश करती है, अथा0त ्:—

1. सं:;<त नाम और 'ार3भ —

(1) इस आदेश का सं:;<त नाम >व(cid:7)युत ?ांसफॉम0र (गुणव(ता %नय(cid:28)(cid:16)ण) आदेश, 2014 है। (2) यह आदेश राजप(cid:16) मE 'काशन क& तार(cid:5)ख से छह मास के प1चात लागू होगा।

2. पGरभाषाएं.—इस आदेश मE, जब तक संदभ0 से, अ(cid:28)यथा अपे:;त न हो,—

(1) (क) "अ#ध%नयम" से भारतीय मानक !यूरो अ#ध%नयम, 1986 (1986 का 63) अ4भ'ेत है;

(ख) "समु#चत 'ा#धकार(cid:5)" से,

(i) कोई ऐसा अ#धकार(cid:5), िजसका Kतर भार(cid:5) उ(cid:7)योग >वभाग, भार(cid:5) उ(cid:7)योग और लोक उ(cid:7)यम ् मं(cid:16)ालय मE अवर स#चव के Kतर से कम न हो;

(ii) राLय सरकार+ के िजला उ(cid:7)योग के (cid:28)(cid:29)+ के महा'ब(cid:28)धक, और

(iii) राLय सरकार+ या संघ राLय ;े(cid:16)+ के उ(cid:7)योग+ के %नदेशक या आयु*त; अ4भ'ेत है;

(ग) ">व(cid:7)युत ?ांसफॉम0र" से अनुसूची के Kतंभ (3) मE >व%न(cid:23)द0Nट मदE अ4भ'ेत हP;

(घ) "Qयवहार(cid:5)" से >व(cid:7)युत ?ांसफॉम0र+ के संबंध मE, कोई Qयि*त या कोई फम0 या (cid:23)ह(cid:28)दू अ>वभ*त कु टु 3ब या कोई क3पनी या सहकार(cid:5) सोसाइट(cid:5) अ4भ'ेत है जो '(य; Rप से या अ(cid:28)यथा ऐसे

(छ) ">व%न(cid:23)द0Nट मानक" से >व(cid:7)युत ?ांसफॉम0र+ के संबंध मE अनुसूची के Kतंभ (2) मE त(Kथानी '>विNट मE यथा>व%न(cid:23)द0Nट भारतीय मानक अ4भ'ेत है;

(ज) "भा. Qया. व. (स 'ा) कोड" से >व(cid:7)युत ?ांसफॉम0र+ के संबंध मE अनुसूची के Kतंभ (4) मE त(Kथानी '>विNट मE यथा>व%न(cid:23)द0Nट भारतीय Qयापार वगYकरण (सुसंगत 'णाल(cid:5)) कोड अ4भ'ेत है;

(झ) "राLय सरकार" से संघ राLय ;े(cid:16) के संबंध मE उसका 'शासक अ4भ'ेत है।

(2) सभी अ(cid:28)य श!द+ या पद+ के , जो इसमE 'यु*त हP और इस आदेश मE पGरभा>षत नह(cid:5)ं हP Vक(cid:28)तु अ#ध%नयम मE पGरभा>षत हP उनके अथ0 वह(cid:5) ह+गे जो अ#ध%नयम मE हP।

3. >व%नमा0ण, भ[डारण, \बT& और >वतरण आ(cid:23)द के बारे मE %नषेध:—

1. कोई Qयि*त Kवयं या अपनी ओर से Vकसी Qयि*त के जGरए अनुसूची के Kत3भ (3) मE >व%न(cid:23)द0Nट Vकसी >व(cid:7)युत ?ांसफॉम0र+ का \बT& के 4लए >व%नमा0ण या भ[डारण, \बT& या >वतरण नह(cid:5)ं करेगा जो >व%न(cid:23)द0Nट मानक+ के अनुRप न हो और िजस पर 'माणन #च^न अनु_ि<त 'ा<त करने के बाद !यूरो का मानक #च^न न लगा हो:

पर(cid:28)तु %नया0त के 4लए अपे:;त >व(cid:7)युत ?ांसफॉम0र+ के संबंध मE, इस आदेश क& कोई भी बात लागू नह(cid:5)ं होगी जो >वदेशी खर(cid:5)दार+ (cid:7)वारा अपे:;त >व%नद`शन+ के अनुRप हो। सु%नि1चत %नया0त आदेश के 4लए इसके साथ समु#चत दKतावेज संलWन होने चा(cid:23)हएँ।

2. अव-मानक या दोषपूण0 >व(cid:7)युत ?ांसफॉम0र+, जो >व%न(cid:23)द0Nट मानक के अनुRप न ह+, को !यूरो (cid:7)वारा Vकए गए पर(cid:5);ण और %नर(cid:5);ण Kक&म के अनुसार KTै प के Rप मE %नपटाया जाएगा।

4. 'माणन के 4लए बाbयता:—

(1) >व(cid:7)युत ?ांसफॉम0र+ के सभी >व%नमा0ता इस आदेश के लागू होने क& तार(cid:5)ख से छह मास क& अव#ध के भीतर मानक #च^न के 'योग के 4लए अनु_ि<त 'ा<त करने के 4लए, य(cid:23)द पहले 'ा<त नह(cid:5)ं Vकया हो, !यूरो को आवेदन करEगे।

(2) !यूरो—

(क) भारतीय मानक अ#ध%नयम, 1986 और उसके अधीन बनाए गए %नयम+ और >व%नयम+ के उपब(cid:28)ध+ के अनुसार मानक #च^न के 'योग के 4लए अनु_ि<त 'दान करेगा।

(ख) Vकसी मानक उ(cid:7)योग क& Vकसी वKतु या 'VTया, जो भारतीय मानक के अनुRप हो, को अ#धसू#चत करेगा।

(ग) ऐसी वKतु या 'VTया हेतु अ%नवाय0 अनु_ि<त के अधीन मानक #च^न के 'योग का %नदेश देगा।

(3) कोई Qयि*त !यूरो से >व#धमा(cid:28)य अनु_ि<त 'ा<त Vकए \बना अनुसूची के Kत3भ (3) मE >व%न(cid:23)द0Nट >व(cid:7)युत ?ांसफॉम0र+ का >व%नमा0ण करना 'ारंभ नह(cid:5)ं करेगा।

(4) !यूरो एक या अ#धक >व(cid:7)युत ?ांसफॉम0र+ के 4लए Vकसी भी अनु_ि<त के समा<त होने या रc होने क& सूचना समु#चत 'ा#धकार(cid:5) को देगा।

5. सूचना आ(cid:23)द मांगने के 4लए शि*त:—

(1) समु#चत 'ा#धकार(cid:5) इस आदेश का अनुपालन सु%नि1चत करने क& dिNट से,- (क) Vकसी >व(cid:7)युत ?ांसफॉम0र के >व%नमा0ण, \बT& के 4लए भ[डारण, \बT& या >वतरण मE लगे Vकसी Qयि*त को ऐसी सूचना देने के 4लए बुला सकता है िजसको वह इस आदेश के काया0(cid:28)वयन के 4लए Vकसी >व(cid:7)युत ?ांसफॉम0र क& \बT& के 4लए >व%नमा0ण, भ[डारण, \बT& या >वतरण के संबंध मE आव1यक समझे या Vकसी ऐसे >व(cid:7)युत ?ांसफॉम0र के नमूने 'Kतुत करने के 4लए ऐसा Qयि*त अपे:;त हो;

(ख) Vकसी >व(cid:7)युत ?ांसफॉम0र क& \बT& के 4लए >व%नमा0ण, भ[डारण, \बT& या >वतरण मE लगे Vकसी Qयि*त (cid:7)वारा रखे गए या उससे संबं#धत या उसके अ#धकार मE या %नय(cid:28)(cid:16)ण के अधीन Vकसी बह(cid:5) या अ(cid:28)य दKतावेज का %नर(cid:5);ण कर सके गा या करवा सके गा;

(ग) Vकसी पGरसर मE 'वेश कर सकता है या तलाशी ले सकता है तथा Vकसी >व(cid:7)युत ?ांसफॉम0र का अ#धeहण कर सकता है य(cid:23)द उसके पास यह >व1वास करने का कारण हो Vक इस आदेश का उ(cid:24)लंघन Vकया गया है या उ*त >व(cid:7)युत ?ांसफॉम0र >व%न(cid:23)द0Nट मानक का नह(cid:5)ं है;

(घ) कोई भी >व%नमा0ता या Qयवहार(cid:5) कोई सूचना देने से मना नह(cid:5)ं करेगा या उसके क!जे या उसके %नयं(cid:16)ण मE रखी Vकसी बह(cid:5), दKतावेज या >व(cid:7)युत ?ांसफॉम0र को %छपाएगा, नNट करेगा, >वकृ त या >वg>पत नह(cid:5)ं करेगा।

(2) तलाशी और अ4भeहण से संबं#धत दंड 'VTया सं(cid:23)हता, 1973 (1974 का 2) के उपब(cid:28)ध, जहां तक संभव हो सके , इस धारा के अधीन तलाशी और अ4भeहण को लागू ह+गे।

6. नमून+ का पर(cid:5);ण:—मानक #च^न लगे और उपयु*त 'ा#धकार(cid:5) (cid:7)वारा >व%न(cid:23)द0Nट मानक क& अनुgपता सु%नि1चत करने के 4लए गए Vकसी >व(cid:7)युत ?ांसफॉम0र के नमूने का !यूरो (cid:7)वारा अनुमो(cid:23)दत 'योगशाला मE संगत भारतीय मानक मE यथा>व%न(cid:23)द0Nट संगत भारतीय मानक के अनुसार पर(cid:5);ण Vकया जाएगा।

7. >व%नमा0ताओं और QयवहाGरय+ को %नदेश जार(cid:5) करने क& शि*त:—समु#चत 'ा#धकार(cid:5) >व%नमा0ताओं और QयवहाGरय+ को इस आदेश के उपबंध+ को काया0ि(cid:28)वत करने के 4लए, ऐसे %नदेश जार(cid:5) कर सके गा जो यथािKथ%त अ#ध%नयम या इस आदेश के उपबंध+ के अनुRप ह+।

8. %नदेश+ का अनुपालन:—अनुसूची मE (cid:23)दए गए Vकसी >व(cid:7)युत ?ांसफाम0र क& \बT& के 4लए >व%नमा0ण, भंडारण, \बT& या >वतरण मE लगा '(येक Qयि*त, िजसको इस आदेश के अधीन कोई %नदेश जार(cid:5) Vकया गया हो, ऐसे %नदेश का पालन करेगा।

ORDER

New Delhi, the 27th January, 2014

S.O. 266(E).—In exercise of the powers conferred by section 14 of the Bureau of Indian Standards Act, 1986 (63 of 1986), the Central Government after consulting the Bureau of Indian Standards hereby makes the following Order, namely :—

1. Short title and commencement.—(1) This Order may be called the Electrical Transformers (Quality Control) Order, 2014.

(2) This Order shall come into force after six months from the date of its publication in the Official Gazette.

2. Definitions- In this Order, unless the context otherwise requires, -

(1) (a) "Act" means the Bureau of Indian Standards Act, 1986 (63 of 1986);

(b) "Appropriate authority" means, -

(i) an officer not below the rank of an Under Secretary in the Department of Heavy Industry, Ministry of Heavy Industries and Public Enterprises;

(ii) General Managers, District Industries Centres of State Governments; and

(iii) Directors or Commissioners of Industries of the State Governments or Union territories;

(c) "electrical Transformers" mean the items specified in column (3) of the Schedule;

(d) "dealer" in relation to electrical Transformers, means a person who, or a firm or a Hindu undivided family or a company or a co-operative society, which carries on, directly or otherwise, the business of buying, selling, supplying and distributing electrical Transformers whether in cash or for deferred payment or for commission, remuneration or other valuable consideration;

(e) "manufacturer" in relation to electrical Transformers, means a person who or a firm or a Hindu undivided family or a company or a co-operative society, which produces, makes, assembles, manufactures or repairs electrical Transformers and includes a person who, or such firm, Hindu undivided family, a company or co- operative society which claims such electrical Transformers to be produced, made, assembled or manufactured by such person or firm or Hindu undivided family or company or co-operative society, as the case may be;

(f) "Schedule" means the Schedule annexed to this Order;

(g) "Specified standard" in relation to electrical Transformers means the Indian Standard as specified in the corresponding entry in column (2) of the Schedule;

(h) "ITC (HS) Code" in relation to electrical Transformers means the Indian Trade Classification (Harmonised Systems) Codes as specified in the corresponding entry in column (4) of the Schedule;

(i) "State Government" in relation to a Union territory, means the Administrator thereof.

(2) All other words and expressions used but not defined in this order shall have the meanings respectively assigned to them in the Act.

3. Prohibition regarding manufacture, storage, sale, distribution etc.-

(1) No person shall by himself or through any person on his behalf manufacture or store for sale, sell or distribute any electrical Transformers specified in column (3) of the Schedule, which do not conform to the specified standards and do not bear Standard Mark of the Bureau, on obtaining certification marks licence:

provided that nothing in this Order shall apply in relation to electrical Transformers required for export conforming to specifications required by the foreign buyer. This should to be supported by proper documentation for confirmed export order.

(2) The sub-standard or defective electrical Transformers, which do not conform to the specified standard, shall be disposed of as scrap as per the scheme of testing and inspection made by the Bureau.

4. Obligation for certification.—(1) All manufacturers of electrical Transformers shall make an application to the Bureau for obtaining licence for use of the Standard Mark, within a period of six months from the date of coming into force of this Order, if not already obtained.

(2) The Bureau shall —

(a) grant licence for use of the Standard Mark as per the provisions of the Bureau of Indian Standard Act 1986 and the rules and regulations made there under.

(b) notify any article or process of any standard industry which shall conform to the Indian Standard. (c) direct the use of Standard mark under a licence as compulsory on such article or process.

(3) No person shall commence manufacture of electrical Transformers specified in column (3) of the Schedule, without obtaining a valid licence from the Bureau.

(4) Bureau shall inform to the appropriate authority of the expiry of any licence or cancellation thereof for one or more of the electrical Transformers.

5. Power to call for information, etc.- (1) The appropriate authority may, with a view to securing compliance with this Order,-

(a) require any person engaged in the manufacture, storage for sale, sale or distribution of any electrical Transformers to give such information as he/she deems necessary relating to the manufacture, storage for sale, sale or distribution of any Electrical Transformers for the implementation of this Order or require any such person to furnish to him samples of any such electrical Transformer;

(b) inspect or cause to be inspected any book or other document kept by or belonging to or in the possession or under the control of any person engaged in the manufacture, storage for sale, sale or distribution of any electrical Transformers;

(c) enter and search any premises and seize any electrical Transformer in respect of which it has reason to believe that a contravention of this Order has been committed or the said electrical Transformer is not of the specified Standard;

(d) No manufacturer or dealer shall, refuse to furnish any information or conceal, destroy, mutilate or deface any book, document or electrical Transformers kept in his possession or under his control.

(2) The provisions of the Code of Criminal Procedure, 1973 (2 of 1974) relating to search and seizure shall, so far as may be, apply to searches and seizures under this clause.

6. Testing of samples.—Sample of any electrical Transformer bearing the Standard Mark and drawn by the appropriate authority, for ascertaining whether it conforms to the specified standard, shall be tested as per the relevant Indian Standard in the laboratory approved by the Bureau and as specified in the relevant Indian Standard.

7. Power to issue directions to manufactures and dealers.—The appropriate authority may issue such directions to manufacturers and dealers, consistent with the provisions of the Act or this Order, as may be necessary, for carrying out the provisions of this Order.

8. Compliance of directions.—Every person engaged in the manufacture, storage for sale, sale or distribution of any Electrical Transformers specified in the Schedule to whom any direction is issued under this Order, shall comply with such direction.
