यह मामला जवाहरलाल नेहरू पत्तन न्यास (जेएनपीटी) में भारत पेट्रोलियम कार्पोरेषन लिमिटेड (बीपीसीएल) द्वारा प्रचालित लिक्विड कार्गो जेट्टी में मौजूदा प्रषुल्क की वैधता विस्तारित करने से सम्बंधित है ।
2. उक्त लिक्विड कार्गो जेट्टी में मौजूदा प्रषुल्क आदेष सं. टीएएमपी/10/2010-बीपीसीएल दिनांक 3 सितम्बर, 2010 द्वारा अनुमोदित किया गया था जिसे 12 अक्तूबर, 2012 को भारत के राजपत्र में अधिसूचित किया गया था। यह आदेष दरमान की वैधता 31 मार्च, 2013 तक निर्धारित करता है। यह प्राधिकरण बीपीसीएल के दरमान की वैधता दो बार विस्तारित कर चुका है। इस प्राधिकरण ने बीपीसीएल के मौजूदा दरमान की वैधता पिछली बार अपने आदेष दिनांक 29 अक्तूबर, 2013 द्वारा 31 दिसम्बर,, 2013 तक विस्तारित की थी।
3. बीपीसीएल ने अपने पत्रों दिनांक 16 अक्तूबर, 2012 और 18 फरवरी, 2013 द्वारा अपना प्रस्ताव दाखिल किया था जिसे प्रषुल्क मामला के रूप में पंजीकृत किया गया है और विचार-विमर्ष के लिए लिया गया है। प्रस्ताव पर संयुक्त सुनवाई 30 अगस्त 2013 को आयोजित की गई थी। संयुक्त सुनवाई में यथा सहमत, 565 GI/2014

बीपीसीएल और जेएनपीटी से कार्रवाई शुरू करने और कुछ बिन्दुओं पर सूचना भेजने और हमारे पत्र दिनांक 18 जून, 2013 द्वारा मांगी गई अतिरिक्त सूचना/स्पश्टीकरण भी 6 सितम्बर 2013 तक भेजने का अनुरोध किया गया था। बीपीसीएल ने अपने पत्रों दिनांक 2 सितम्बर, 2013 और 3 सितम्बर, 2013 द्वारा हमारे पत्र दिनांक 18 जून, 2013 द्वारा उठाए गए बिन्दुओं पर अपना जवाब भेजा है। जेएनपीटी ने अपने पत्र दिनांक 15 अक्तूबर, 2013 द्वारा जवाब भी भेजा है। बीपीसीएल और जेएनपीटी द्वारा प्रेशित सूचना/स्पश्टीकरणों की जांच की जा रही है और इस मामले पर विचार करने में प्राधिकरण को कुछ और समय लगेगा।
4. इसी बीच, पोत परिवहन मंत्रालय (एमओएस) में सरकार ने प्रषुल्क दिषानिर्देष, 2005 की वैधता 31 मार्च, 2014 तक अथवा अगले आदेष तक विस्तारित की है। एमओएस द्वारा दी गई सलाह अनुसार, इस प्राधिकरण ने अपने आदेष सं. टीएएमपी/21/2009-डब्ल्यूएस, दिनांक 20 दिसम्बर, 2013, जिसे जी.सं. 340 द्वारा 26 दिसम्बर, 2013 को भारत के राजपत्र में अधिसूचित किया गया है, द्वारा प्रषुल्क दिषानिर्देष, 2005 की वैधता को विस्तारित किया है।
5. मौजूदा दरमान की वैधता 31 दिसम्बर, 2013 को समाप्त हो चुकी है। अंतिम रूप से विचार किए जाने के लिए इस मामले हेतु अपेक्षित समय को स्वीकार करते हुए, ऊपर स्पश्ट की गई स्थिति के मद्देनजर और यह भी स्वीकार करते हुए कि प्रषुल्क दिषानिर्देष, 2005 की वैधता 31 मार्च, 2014 तक विस्तारित की गई है, यह प्राधिकरण बीपीसीएल के मौजूदा दरमान की वैधता को 31 मार्च, 2014 तक अथवा संषोधित दरमान के कार्यान्वयन की तारीख तक, जो भी पहले हो, विस्तारित करता है।
6. यदि स्वीकार्य लागत और स्वीकार्य प्रतिलाभ से अधिक कोई अतिरिक्त अधिषेश 1 अप्रैल 2013 के बाद प्रकट होता है तो इसके कार्यनिश्पादन की समीक्षा के दौरान, ऐसा अतिरिक्त अधिषेश निर्धारित किए जाने वाले प्रषुल्क में पूर्णतः समायोजित किया जाएगा।

NOTIFICATON
Mumbai, the 4th February, 2014
No. TAMP/10/2010-BPCL.—In exercise of the powers conferred under Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of the tariff at the liquid cargo jetty operated by the Bharat Petroleum Corporation Limited at the Jawaharlal Nehru Port Trust as in the Order appended hereto.

This relates to extension of the validity of the existing tariff at the liquid cargo jetty operated by the Bharat Petroleum Corporation Limited (BPCL) at the Jawaharlal Nehru Port Trust (JNPT).
2. The existing tariff at the said liquid cargo jetty was last approved by this Authority vide Order No.TAMP/10/2010-BPCL dated 3 September, 2010 which was notified in the Gazette of India on 12 October, 2010. The Order prescribes the validity of the SOR till 31 March, 2013. This Authority has extended the validity of SOR of BPCL twice. This Authority has last extended the validity of the existing SOR of BPCL till 31 December 2013 vide its Order dated 29 October, 2013.
3. The BPCL has filed its proposal vide its letters dated 16 October, 2012 and 18 February, 2013 which is registered as tariff case and is taken on consultation. Joint hearing on the proposal was held on 30 August, 2013. As agreed at the joint hearing, the BPCL and JNPT were requested to initiate action and furnish information on a few points and also furnish the additional information/clarifications sought vide our letter dated 18 June, 2013 by 6 September, 2013. The BPCL vide letters dated 2 September, 2013 and 3 September, 2013 has furnished its response भारत का राजपत्रा : असाधरण

to the queries raised vide our letter dated 18 June, 2013. The JNPT has also furnished its response vide its letter dated 15 October, 2013. The information/clarifications furnished by BPCL and JNPT is being examined and it will take some more time for the case to mature for consideration of the Authority.
4. In the meantime, the Government in Ministry of Shipping (MOS) has extended the validity of Tariff Guidelines, 2005 till 31 March, 2014 or until further orders. As advised by the MOS, this Authority has extended the validity of Tariff Guidelines, 2005 vide its Order No. TAMP/21/2009-WS, dated 20 December, 2013 which is notified in the Gazette of India on 26 December, 2013 vide G. No. 340.
5. The validity of the existing SOR expired on 31 December, 2013. Recognizing the time required for this case to mature for final consideration, in view of the position explained above and also recognising that the validity of the Tariff Guidelines, 2005 is extended till 31 March, 2014, this Authority extends the validity of the existing SOR of the BPCL from the date of its expiry till 31 March, 2014 or till the effective date of implementation of the revised Scale of Rates, whichever is earlier.
6. If any additional surplus over and above the admissible cost and permissible return emerges for the period post 1 April, 2013, during the review of its performance, such additional surplus will be set off fully in the tariff to be determined.
