यह मुरूगांव पत्तन न्यास में बर्थ सं. 5क और 6क में बहुउद्देषीय बल्क कार्गो टर्मिनल के लिए साऊथ वेस्ट पोर्ट लिमिटेड (एसडब्ल्यूपीएल) के मौजूदा दरमान की वैधता के विस्तार से संबंधित है।
2. उक्त बहुउद्देषीय कार्गो टर्मिनल के लिए मौजूदा दरमान इस प्राधिकरण द्वारा पिछली बार आदेष सं. टीएएमपी/12/2010-एसडब्ल्यूपीएल दिनांक 3 नवम्बर, 2010, जिसे 30 दिसम्बर, 2010 को भारत के राजपत्र में अधिसूचित किया गया था, द्वारा अनुमोदित किया गया था। यह आदेष दरमान की वैधता 31 मार्च, 2013 तक निर्धारित करता है। यह प्राधिकरण एसडब्ल्यूपीएल के दरमान की वैधता दो बार विस्तारित कर चुका है। इस प्राधिकरण ने एसडब्ल्यूपीएल के मौजूदा दरमान की वैधता अपने आदेष दिनांक 29 अक्तूबर, 2013, द्वारा 31 दिसम्बर, 2013 तक विस्तारित की थी।
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]5. एसडब्ल्यूपीएल के मौजूदा दरमान की विस्तारित वैधता 31 दिसम्बर, 2013 को समाप्त हो चुकी है। यह स्वीकार करते हुए कि ऊपर स्पश्ट की गई स्थिति के मद्देनजर मामले को अंतिम रूप दिए जाने में समय लगेगा और यह भी स्वीकार करते हुए कि प्रषुल्क दिषानिर्देष, 2005 की वैधता 31 मार्च, 2014 तक विस्तारित की गई है, यह प्राधिकरण एसडब्ल्यूपीएल के मौजूदा दरमान की वैधता को 31 मार्च, 2014 तक अथवा संषोधित दरमान के कार्यान्वयन की प्रभावी तारीख तक, जो भी पहले हो, विस्तारित करता है।
6. यदि स्वीकार्य लागत और स्वीकार्य प्रतिलाभ से अधिक कोई अतिरिक्त अधिषेश 1 अप्रैल, 2013 के बाद प्रकट होता है तो इसके कार्यनिश्पादन की समीक्षा के दौरान, ऐसा अतिरिक्त अधिषेश निर्धारित किए जाने वाले प्रषुल्क में पूर्णतः समायोजित किया जाएगा।

Mumbai, the 4th February, 2014
No. TAMP/12/2010 -SWPL.—In exercise of the powers conferred under Section 48 of the Major Port Trusts Act, 1963 (38 of 1963), the Tariff Authority for Major Ports hereby extends the validity of its Scale of Rates of South West Port Limited for multipurpose bulk cargo terminal at berth Nos. 5A and 6A in the Mormugao Port Trust as in the Order appended hereto.

This relates to extension of the validity of the existing Scale of Rates (SOR) of South West Port Limited (SWPL) for the multipurpose bulk cargo terminal at berth Nos. 5A and 6A in the Mormugao Port Trust.
2. The existing SOR for the said multipurpose cargo terminal was last approved by this Authority vide Order No.TAMP/12/2010-SWPL, dated 3 November, 2010 which was notified in the Gazette of India on 30 December, 2010. The Order prescribes the validity of the SOR till 31 March, 2013. This Authority has extended the validity of SOR of SWPL twice. This Authority has last extended the validity of the existing SOR of SWPL till 31 December, 2013 vide its Order dated 29 October, 2013.
3. The proposal filed by the SWPL vide its letters dated 30 April, 2013 and 17 May, 2013 is registered as a tariff case on 22 May, 2013 and is taken on consultation. The proposal is being scrutinised for seeking additional information/clarification. Joint hearing on the proposal is to be fixed. In view of that it will take time for case to mature for consideration of this Authority.
4. In the meantime, the Government in Ministry of Shipping (MOS) has extended the validity of Tariff Guidelines, 2005 till 31 March, 2014 or until further orders. As advised by the MOS, this Authority has extended the validity of Tariff Guidelines, 2005 vide its Order No. TAMP/21/2009-WS, dated 20 December, 2013 which is notified in the Gazette of India on 26 December, 2013 vide G. No. 340.
5. The extended validity of the existing SOR of SWPL expired on 31 December, 2013. Recognising the time required for the case to mature for consideration in view of the position explained above and also recognising that the validity of Tariff Guidelines, 2005 is extended till 31 March, 2014, this Authority extends the validity of the existing SOR of the SWPL from the date of its expiry till 31 March, 2014 or till the effective date of implementation of the revised Scale of Rates, whichever is earlier.
6. If any additional surplus over and above the admissible cost and permissible return emerges for the period post 1 April, 2013, during the review of its performance, such additional surplus will be set off fully in the tariff to be determined.
