सासासासा....काकाकाका....निनिनिनि.... 850850850850(अ)(अ)(अ)(अ)....--------महापत्तन न्यास अधिनियम, 1963 (1963 का 38) की धारा 132 की उपधारा (प्) के साथ पठित, धारा 124 की उपधारा (I) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतदद्वारा कोलकाता पत्तन न्यास कर्मचारी (आचरण) संशोधन विनियम, 2014 कोलकाता पत्तन न्यास कर्मचारी (आचरण) संशोधन विनियम, 2014 अनुमोदित करती है, कोलकाता पत्तन न्यास कर्मचारी (आचरण) संशोधन विनियम, 2014 कोलकाता पत्तन न्यास कर्मचारी (आचरण) संशोधन विनियम, 2014 जो कि कोलकाता पत्तन न्यास के न्यासी बोर्ड द्वारा बनाया गया है तथा इस अधिसूचना के साथ संलग्न अनुसूची में दर्शाया गया है ।
2. उक्त संशोधन-विनियम सरकारी राजपत्र में इस अधिसूचना के प्रकाशन की तिथि सेे प्रवृत्त होंगे।

1. लघुशीर्ष एवं प्रारम्भ :-
(i) ये विनियम कोलकाता पत्तन न्यास कर्मचारी(आचरण) संशोधन विनियम, 2014 कहलाएंगे ।
(ii) ये विनियम राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे।
2. विनियम 15 के उप-विनियम 2 एवं उसके अधीन उल्लिखित व्याख्या निम्नलिखित द्वारा प्रतिस्थापित होंगे - "15 (2)-जब कोई कर्मचारी चल सम्पत्ति के बारे में चाहे अपने निजी नाम या अपने परिवार के सदस्य के नाम से सौदा करता है तो उसे सौदा करने की तारीख से एक महीने के अन्दर ऐसे सौदे की रिपोर्ट निर्धारित प्राधिकारी को देनी होगी, यदि ऐसी सम्पत्ति का मूल्य कर्मचारी के दो महीने के मूल वेतन से ज्यादा हो।
परंतु निर्धारित प्राधिकारी की पूर्व मंजूरी कर्मचारी द्वारा प्राप्त करनी होगी, यदि सौदा ऐसे व्यक्ति के साथ किया जा रहा हो, जिनसे उनका सरकारी सम्बन्ध हो।''
''व्याख्या (I) उप विनियम (1) के प्रयोजन हेतु "चल सम्पत्ति" की अभिव्यक्ति में निम्नलिखित शामिल हैं - THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2 (ग) मोटरकार, मोटर साइकिल, घोडे या वाहन के अन्य साधन और (घ) रेफ्रिजरेटर, रेडियो, रेडियोग्राम और टी.वी. सेट।'' [फा. सं. पीआर-12016/8/2013-पीई- I]

पाद टिप्पणीपाद टिप्पणीपाद टिप्पणीपाद टिप्पणी - कोलकाता पत्तन न्यास कर्मचारी आचरण विनियम, 1987 का मूल विनियम भारत सरकार के शासकीय राजपत्र (असाधारण) में दिनांक 29 जून, 1987 के सा.का.नि. सं. 608(अ) के जरिए प्रकाशित हुआ था और तदुपरांत परवर्ती संशोधन अधिसूचना सं. सा.का.नि. सं. 124(अ) दिनांक 24 फरवरी, 1989 सा.का.नि. सं. 572(अ) दिनांक 13 जून, 1990 सा.का.नि. सं. 603(अ) दिनांक 7 अक्तूबर, 1998 और सा.का.नि सं. 386(अ) दिनांक 8 मई, 2003 के अंतर्गत हुआ।

NOTIFICATION
New Delhi, the 22nd November, 2014
G.S.R. 850(E)— In exercise of the powers conferred by sub-section (1) of Section 124 read with sub-section (1) of Section 132 of the Major Port Trusts Act, 1963 (38 of 1963), the Central Government hereby approves the Kolkata Port Trust Employees' (Conduct) Amendment Regulations, 2014 made by the Board of Trustees for the Port of Kolkata and set out in the schedule annexed to this notification. 2. The said amendment Regulations shall come into force on the date of publication of this notification in the Official Gazette.
SCHEDULE
KOLKATA PORT TRUST
Kolkata Port Trust Employees' (Conduct) Amendment Regulations, 2014 1. Short title and commencement:—
(i) These Regulations may be called the KoPT Employees' (Conduct) Amendment Regulations, 2014. (ii) These Regulations shall come into effect from the date of publication in the Official Gazette.
2. In Regulation 15, Sub regulation 2 and the Explanation there under shall be substituted by the following :— "15(2) – Where an employee enters into transaction in respect of movable property either in his own name or in the name of the member of his family, he shall, within one month from the date of such transaction, report the same to the prescribed authority, if the value of such property exceed two months basic pay of an employee; Provided that the previous sanction of the prescribed authority shall be obtained by the employee if such transaction is with a person having an official dealing with him." "Explanation : (I) For the purpose of the sub-regulation (I) the expression "movable property" includes:—
(a) Jewellery, insurance policies, the annual premia of which exceeds two months basic pay of an employee shares, securities and debentures.
(b) All loans, whether secured or not advanced or taken by the employee (c) Motor cars, motor cycles, horses or any other means of conveyance, and (d) Refrigerators, radios, radiograms and T.V. set."

No. 603(E) dated 7th October, 1998 and G.S.R. No. 386(E) dated 8th May, 2003.
