सा.का.िन.सा.का.िन.सा.का.िन.सा.का.िन. 851851851851(अ).(अ).(अ).(अ). —के न्(cid:16)ीय सरकार, के न्(cid:16)ीय मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 110 द्वारा प्रदत्त शक्तियों का प्रयोग करते +ए के न्(cid:16)ीय मोटर यान नियम, 1989 का और संशोधन करने के िलए, िनम्निलिखत कितपय प्रा/प नियम को उक्त अधिनियम की धारा 212 की उपधारा (1) की अपेक्षानुसार उन सभी 6क्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है ; और यह सूचना दी जाती है कि उक्त प्रा/प नियम पर, उस तारीख से जिसको उस अधिसूचना से युक्त भारत के राजपत्र की यथा प्रकाशित प्रतियां जनता को उपलब्ध करा दी जाती हैं उससे तीस दिन की समाप्ति पर विचार किया जाएगा ;
2. आक्षेप और सुझाव, यदि कोई हों, संयुक्त सचिव (परिवहन), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद मार्ग, नई दिल्ली-110001 को भेजे जा सकें गे ।
3. उक्त प्रा/प नियमों के संबंध में किसी 6क्ति से प्राप्त आक्षेप और सुझाव पर के न्(cid:16)ीय सरकार द्वारा उपरोक्त अवधि के समाप्त होने के पहले विचार कर िलया जाएगा ;
प्रा(cid:22)प नियमप्रा(cid:22)प नियमप्रा(cid:22)प नियमप्रा(cid:22)प नियम
1. (1) इन नियमों का संक्षिप्त नाम के न्(cid:16)ीय मोटर यान, (संशोधन) िनयम, 2014 है ।
(2) इन नियमों में जब तक कि अन्यथा उपबंधित न हो, ये नियम राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. के न्(cid:16)ीय मोटर यान, नियम, 1989 के नियम (जिसे इसमें इसके पश्चात् मूल िनयम कहा गया है) के िनयम 115 के उपिनयम (2) के खंड (ii) की सारणी (डीजल यान) के नीचे की प्रविष्टि के स्थान पर िनम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:-

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "मुक्त गतिवर्Qन परीक्षण को नियम 116 के उपनियम (3) के अधीन अनुमोदित टाइप मीटर का प्रयोग करके कार्यान्वियत किया जाएगा, —
(क) यान के िनकास नली में नमूना परीक्षण या बिना नमूना परीक्षण तीन बार मुक्त गतिवर्Qन के द्वारा सम्प्रवाहन करके किया जाएगा, और तीनों सम्प्रवाहन के अधिकतम आर पी एम का औसत लेखबQ किया जाएगा ;
(ख) उसके पश्चात्, तीन पहिया यानों के संबंध में भार रहित अधिकतम प्राप्त आर पी एम को औसत आरपीएम के मान औसत + 500 के बैंडविथ के भीतर रहेगा और अन्य प्रवर्ग के यानो के संबंध में आर पी एम का औसत मान + 300 होगा ;
(ग) (ख) में उल्लिखित मुक्त गतिवर्Qन परीक्षण को कम से कम तीन बार दोहराया जाएगा ;
(घ) लेखबQ किए गए धुएं का घनत्व वह होगा जो इन उक्त तीन बार पढ़े गए का अंकगणितीय औसत मान प्राप्त हो ;
(ड.) लेखबQ धुएं के घनत्व को सीमा के भीतर नहX होने की दशा में, परीक्षण को तेल स्तर मापी छड़ी Zूब की जांच द्वारा इंजन तेल के तापमापन के साथ दौहराया जाएगा जो कम से कम 60 सेल्सियस होगा :
परंतु यह कि उपरोक्त परीक्षण भारत प्र/प-4 यानों के बोर्ड पर विकृ त ]िया निदानसूचक (ओ.बी.डी.) उपदर्शन लैंप (एमआईएल) यदि चालू है रहने पर नहX किया जाएगा । ऐसी दशा में यान की आवश्यकता की मरम्मत या सेवी करके उसे उपरोक्त परीक्षण के लिए पुनः प्रस्तुत किया जाएगा ।
परंतु यह कि के वल अनुमोदन टाइप के प्रयोजन के लिए उन सभी नई माडलों के इस उप नियम के अनुपालन में पुनः टाइप अनुमोदन किए जाने की आवश्यकता नहX होगी जो इन नियमों की अधिसूचना की तारीख से पहले अनुमोदित है और सा.का.नि. 103(अ), तारीख 23 फरवरी, 2012 के अनुसार गतिवर्Qन धु ंए मुक्त होनी की आपेक्षाओं को पूरा करतें हैं" ।
3. मूल नियम के नियम, 115 ख में, --
(क) उप िनयम (क), खंड (2), के उपखंड (क) के पैरा (ii) के स्थान पर िनम्निलिखत पैरा रखे जाएंगे, अर्थात् : —
"(ii) 1 अप्रैल, 2000 को या उसके पcात् 30 सितम्बर, 2010 तक निdमत यानों के िलए, टाइप अनुमोदन के लिए वे सन्नियम वही होंगे जो भारत स्टेज-2 में विनिfदष्ट सन्नियम हैं ।";
(ख) उप नियम (ख) के खंड (2) उपखंड (ग) में पैरा (ii) के स्थान पर िनम्नलिखित पैरा रखा जाएगा, अर्थात् : —
"(ii) 1 अप्रैल, 2000 को या उसके पश्चात् 30 िसतम्बर, 2010 तक निdमत यानों के िलए, टाइप अनुमोदन के लिए वे सन्नियम वही होंगे जो भारत स्टेज-2 में विनिfदष्ट सन्नियम हैं ।";
4. मूल नियम के नियम 115 ग के उपनियम (3) के खंड (क) में उपखंड (ii) के स्थान पर िनम्निलिखत उपखंड रखा जाएगा, अर्थात् : —
"(ii) 1 अप्रैल, 2000 को या उसके पश्चात् 30 सितम्बर, 2010 तक निdमत यानों के िलए, टाइप अनुमोदन के लिए वे सन्नियम वही होंगे जो भारत स्टेज-2 में विनिfदष्ट सन्नियम हैं ।"।

NOTIFICATION
New Delhi, the 28th November, 2014
G.S.R. 851(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989,
which the Central Government proposes to make in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification as published in the Gazette of India, are made available to the public;
2. Objection and suggestion, if any, may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi – 110 001.
3. Any objection or suggestion which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government;
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (Amendment) Rules, 2014.
(2) Save as otherwise provided, these rules shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 115, in sub-rule (2), in clause (ii), for the entry below TABLE (Diesel vehicles) the following entry shall be substituted, namely:—
"The free acceleration test shall be carried out using meter type-approved under sub-rule (3) of rule 116,- (a) three times flushing by free acceleration to be undertaken with or without the sampling probe in the vehicle exhaust, and average maximum rpm of the three flushings to be recorded;
(b) thereafter, during each free acceleration, maximum no-load rpm reached shall be within the bandwidth of ±500 rpm of the average value in respect of 3-wheeled vehicles and ±300 rpm of the average value for all other categories of vehicles;
(c) the free acceleration test, mentioned in (b) above, shall be repeated minimum three times;
(d) the smoke density to be recorded shall be arithmetic mean of these three readings;
(e) In case the smoke density recorded is not within the limits, then the test may be repeated with engine oil temperature measured by a probe in the oil level dipstick tube to be at least 60º C:
Provided that, the above test shall not be carried out if the On Board Diagnostic (OBD) Malfunction Indicator Lamp (MIL) of BS-IV vehicles is switched on. In such cases, the vehicle needs to be repaired or serviced and re-submitted for the above test:
Provided further that only for Type Approval purposes, all new models type-approved before the publication of this notification and compiled with the requirements of free acceleration smoke as per G.S.R. 103 (E) dated 23rd February, 2012, need not be re type-approved for compliance to this sub rule.".
3. In the principal rules, in rule 115B,-
(a) in sub-rule A, in clause (II), in sub-clause (a), for paragraph (ii), the following paragraph shall be substituted, namely:—
"(ii) for the vehicles manufactured on or after the 1st April, 2000, and upto the 30th September, 2010, the type approval norms as specified in the Bharat Stage-II norms.";
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)](b) in sub-rule B, clause II, in sub-clause (c), for paragraph (ii), the following paragraph shall be substituted, namely:—
"(ii) For the vehicles manufactured on and after the 1st April, 2000 and upto the 30th September, 2010, the type approval norms as specified in the Bharat Stage II norms."
4. In the principal rules, in rule 115C, in sub-rule (3), in clause (a), for sub-clause (ii), the following sub-clause shall be substituted, namely:—
"(ii) for the vehicles manufactured on or after the 1st April, 2000, and upto the 30th September, 2010, the type approval norms as specified in the Bharat Stage-II norms.".
