सा.का.सा.का.सा.का.सा.का.िनिनिनिन....861(861(861(861(अअअअ).).).).—के न्(cid:9)ीय मोटर यान िनयम, 1989 का और संशोधन करने के िलए, कितपय नियमों का निम्नलिखित प्रारूप, िजसे के न्(cid:9)ीय सरकार, मोटर यान अिधिनयम, 1988 (1988 का 59) की धारा 64 के खंड (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:30)ए बनाने का प्रस्ताव करती है, उक्त अिधिनयम की धारा 212 की उप-धारा (1) की अपेक्षानुसार उन सभी 'क्तियों की जानकारी के िलए िजनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों को उस तारीख से, िजसको भारत के उस राजपत्र की प्रतियां, जिसमें यह अिधसूचना प्रकाशित की गई थी, जनता को उपलब्ध करा दी जाती हैं, दस दिन की अविध की समाप्ति के प2ात् िवचार किया जाएगा ;
इन प्रारूप नियमों पर आक्षेप या सुझाव, यदि कोई हों, संयुक्त सिचव (परिवहन), सड़क परिवहन और राजमार्ग मंत्रालय, परिवहन भवन, संसद् मार्ग, नई दिल्ली-110001 को ऊपर िव9नदिष्ट अविध के भीतर भेजे जा सकें गे ;
के न्(cid:9)ीय सरकार द्वारा उक्त प्रारूप नियमों की बाबत, ऐसे किन्ही आक्षेपों और सुझावों पर, जो किसी 'क्ति से पूव>क्त अविध की समाप्ति से पूर्व प्राप्त हों, िवचार किया जाएगा ।
प्रारूपप्रारूपप्रारूपप्रारूप िनयमिनयमिनयमिनयम
1. (1) इन नियमों का संक्षिप्त नाम के न्(cid:9)ीय मोटर यान (………….. संशोधन) िनयम, 2014 है ।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे।
2. के न्(cid:9)ीय मोटर यान िनयम, 1989 के िनयम (िजसे इसमें इसके पश्चात् उक्त िनयम कहा गया है) 8 के पश्चात् िनम्निलिखत िनयम अंत:स्थािपत किया जाएगा, अर्थात् :—
''8क ई-रिक्शा या ई-कार्ट चलाने के लिए अपेक्षित न्यूनतम प्रशिक्षण : नियम 8 में अंत9वष्ट कोई बात ई-रिक्शा या ई-कार्ट चलाने के िलए अनुIप्ति प्राप्त करने हेतु लागू नहK होगी परंतु आवेदक ने कम से कम दस दिन की अवधि के िलए प्रशिक्षण प्राप्त किया हो और 4752 GI/2014

यथास्थिित, रिजस्ट्रीकृ त ई-रिक्शा या ई-कार्ट संगम, या ई-रिक्शा या ई-कार्ट का उत्पादन करने वाले िव9नमाता से प्रशिक्षण का प्रमाणपत्र प्राप्त किया हो''।
3. उक्त िनयमों के नियम 47 में उपनियम (1) के पश्चात्, िनम्निलिखत परंतुक अंत:स्थािपत किया जाएगा, अर्थात् : —
''परंतु ऐसे ई-रिक्शा और ई-काटP के मॉडलों के संबंध में, जो के न्(cid:9)ीय मोटर यान (16वां संशोधन) िनयम, 2014 के प्रकाशन और का.आ. 2590 (अ), तारीख 8 अक्तूबर, 2014 द्वारा प्रकाशित अधिसूचना से पूर्व विद्यमान हैं, के न्(cid:9)ीय मोटर यान (................ संशोधन) नियम, 2014 के प्रकाशन की तारीख से ही छह मास की अवधि के लिए, इस उपनियम के अधीन रजिस्ट्रीकरण के लिए आवेदन प्ररूप 20 में रजिस्ट्रीकरण प्राधिकारी को किस्म अनुमोदन प्रमाण पत्र अभिप्राप्त करने के पश्चात् नब्वे दिन की अवधि के भीतर किया जाएगा और उसके साथ निम्नलिखित संलग्न होंगे,-
(i) विनिर्माता या \यौहारी या रजिस्ट्रीकृ त ई-रिक्शा या ई-कार्ट संगम द्वारा जारी किया गया प्ररूप 22 में सड़क-उपयुक्तता प्रमाण पत्र ;
(ii) रजिस्ट्रीकरण के आवेदन के साथ विनिर्माता या \यौहारी या रजिस्ट्रीकृ त ई-रिक्शा या ई-कार्ट संगम द्वारा प्ररूप 21 में जारी वि_य प्रमाण पत्र ।'' ।

टिप्पणःटिप्पणःटिप्पणःटिप्पणः मूल िनयम भारत के राजपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) में अधिसूचना संख्यांक सा.का.िन. 590(अ), तारीख 2 जून, 1989 द्वारा प्रकाशित किए गए थे और अंितम संशोधन सा.का.िन. सं. 810(अ), तारीख 17 नवम्बर, 2014 द्वारा किया गया ।

NOTIFICATION
New Delhi, the 2nd December, 2014
G.S.R.861(E).–– The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by clause (a) of section 64, of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules will be taken into consideration after the expiry of a period of ten days from the date on which the copies of this notification, as published in the Official Gazette, are made available to the public;
Objections or suggestions, if any, to these draft rules may be sent to the Joint Secretary (Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110001, within the period specified above;
The objections or suggestions which may be received from any person with respect to the said draft rules within the expiry of the period aforesaid will be considered by the Central Government.
DRAFT RULES
1. (1) These rules may be called the Central Motor Vehicles (……..Amendment) Rules, 2014.
(2) These rules shall come into force on the date of their final publication in the Official Gazette.
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), after rule 8, the following rule shall be inserted, namely;
"8A Minimum training required for driving E-rickshaw or E-cart: Nothing contained in rule 8 shall apply to the applicant for obtaining a licence to drive E-rickshaw or E-cart provided the applicant has undergone training at least for a period of ten days and obtained a certificate of training from the registered E-rickshaw or E-cart Association, or a manufacturer producing E-rickshaw or E-cart, as the case may be"
3. In rule 47 of the said rules, after sub rule (1), the following proviso shall be inserted, namely:-
"Provided that for a period of six months, on and from the date of publication of the Central Motor Vehicles (…….Amendment) Rules, 2014, in respect of the models of the E-rickshaws and E-carts existing prior to publication of the Central Motor Vehicles (Sixteenth Amendment) Rules, 2014 and the notification published भारत का राजपत्रा : असाधरण

vide S.O. 2590 (E) dated the 8th October, 2014, the application for registration under this sub-rule shall be made in Form 20 to the registering authority within a period of ninety days after obtaining the type approval certificate and shall be accompanied by._
(i) road-worthiness certificate in Form 22 to be issued by manufacturer or dealer or registered E- rickshaw or E-cart Association; and
(ii) sale certificate in Form 21 to be issued by manufacturer or dealer or registered E-rickshaw or E-cart Association for presentation along with the application for registration.".
