काकाकाका....आआआआ....3052(3052(3052(3052(अअअअ).).).).————जबकि मैसर्स लेन्को तीस्ता हाइ(cid:23)ो पावर िलिमटेड, आवेदक, िजसका पंजीकृ त कार्यालय लेन्को हाऊस, प्लॉट संख्या 4, सॉ(cid:30)टवेयर यूिनट ले आऊट, हाइटेक िसटी, माधापुर, हैदराबाद-50008 में है, ने निम्नलिखित पारेषण लाइन के निर्माण के िलए विद्युत अिधिनयम, 2003 की धारा 164 के अन्तर्गत अनुमोदन के िलए आवेदन किया हैः-
(i) सि,िम में तीस्ता-VI जल विद्युत परियोजना (500 मेगावाट) विद्युत घर से पीजीसीआईएल के रंगपो पूलिग स्टेशन तक 220 के वी डी/सी सम2पत पारेषण लाइन।
2. और जबकि, भारत सरकार, विद्युत मंत्रालय ने दिनांक 04.06.2013 के अपने पत्र संख्या 11/06/2012-जी (लेन्को) के माध्यम से सि,िम में तीस्ता-VI जल विद्युत परियोजना (500 मेगावाट) विद्युत गृह से पीजीसीआईएल के रंगपो पूलिग स्टेशन तक 220 के वी डी/सी सम2पत पारेषण लाइन के निर्माण के संबंध में विद्युत अिधिनयम, 2003 की धारा 68 की उप- धारा (i) के अन्तर्गत पूर्व में अनुमोदन प्रदान किया था।
और जबकि आवेदक ने अब विद्युत अिधिनयम, 2003 की धारा 164 के अन्तर्गत उसे वे सभी शक्तियां प्रदान करने का अनुरोध किया है जो काय7 के िलए सरकार द्वारा स्थापित अथवा अनुरक्षित या इस प्रकार स्थापित अथवा अनुरक्षित किए जाने के िलए टेली<ाफ के उद्देश्य से टेली<ाफ लाइनें िबछाने और खम्भे लगाने के संबंध में भारतीय टेली<ाफ अिधिनयम, 1885 के अन्तर्गत टेली<ाफ प्राधिकरण के पास होती हैं। स्कीम के अन्तर्गत शािमल पारेषण लाइन निम्नलिखित गाँवों, नगरों और शहरों के भीतर से, ऊपर से, आस-पास से और बीच में से होती Gई गुजरेंगीः

अतः अब सावधानीपूर्वक िवचार-विमर्श करने के पKात्, भारत सरकार, विद्युत मंत्रालय, विद्युत के अन्तर्राज्यीय पारेषण हेतु उपयु र्क्त उल्लिखित लाइन की संस्थापना के िलए निम्नलिखित िनबंधन एवं शत7 के अध्यधीन विद्युत अिधिनयम, 2003 की धारा 164 के अन्तर्गत आवेदक को वे सभी शक्तियां प्रदान करता है जो सरकार द्वारा स्थापित अथवा अनुरक्षित टेली<ाफ अथवा स्थापित अथवा अनुरक्षित किए जाने वाले दूरसंचार के उद्देश्यों के िलए टेली<ाफ लाइनें िबछाने और खम्भे लगाने के संबंध में भारतीय टेली<ाफ अिधिनयम, 1885 के अन्तर्गत टेली<ाफ प्राधिकरण के पास होती हैं, अर्थात्:-
(i) यह अनुमोदन 25 वर्ष के िलए प्रदान किया जाता है,
(ii) आवेदक को प्रस्तावित लाइन के निर्माण से पूर्व संबंिधत प्राधिकरणों अर्थात् स्थानीय निकायों, रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की स्वीकृ ति प्राप्त करनी होगी।
(iii) आवेदक को पारेषण, प्रचालन एवं अनुरक्षण, खुली पGंच आदि के संबंध में उपयु र्क्त आयोग के विनियमों/संहिताओं का अनुपालन करना होगा।
(iv) आवेदक को सुिबनखोर में तीस्ता-VI जल विद्युत परियोजना (500 मेगावाट) विद्युत घर से सि,िम में पीजीसीआईएल के रंगपो पूलिग स्टेशन तक 220 के वी डी/सी पारेषण लाइन के निर्माण का उत्तरदायित्व है। काय7 का ब्यौरा मई 24-30 मई, 2014 के भारत के राजपत्र में प्रकाशित किया गया है।
(v) आवेदक संबंिधत राज्यों के मुख्य वैद्युत निरीक्षक के अनुमोदन के पKात् लाइनों का प्रचालन करेगा।
(vi) यह अनुमोदन विद्युत अिधिनयम, 2003 के प्रावधानों और उसके अन्तर्गत बनाए गए नियमों की अपेक्षाओं का आवेदक द्वारा अनुपालन किए जाने के अध्यधीन है।

S.O.3052(E).— Whereas M/s. Lanco Teesta Hydro Power Ltd., the applicant with its Registered Office at Lanco House, Plot No. 4, Software Units Layout, Hitech City, Madhapur, Hyderabad-500081 has applied for approval under Section 164 of the Electricity Act, 2003 for construction of (the following Transmission lines:
(i) 220kV D/c dedicated transmission line from Teesta-VI HEP(500 MW) power house to Rangpo Pooling Station of PGCIL in Sikkim.
2. And whereas Government of India, Ministry of Power vide letter No. 11/6/2012-PG(LANCO) dated 04.06.2013 had granted prior approval under sub-section (i) of Section 68 of the Electricity Act, 2003 in respect of construction of 220kV D/c dedicated transmission line from Teesta-VI HEP(500MW) power house to Rangpo Pooling Station of PGCIL in Sikkim.

3. And whereas the applicant has now requested to confer upon him all the powers under section 164 of the Electricity Act, 2003 which telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained by the Government or to be so established or maintained for the works. The transmission line covered under the scheme will pass through, over, around and between the following villages, towns and cities:-

Now, therefore, after careful consideration, Government of India, Ministry of Power, confers, under Section 164 of the Electricity Act, 2003, all the powers on the applicant which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained by the Government or to be so established or maintained subject to following terms and conditions for installing the above mentioned line for inter-state transmission of electricity, namely:-
(i) the approval is granted for 25 years; (ii) the Applicant shall have to seek the consent of the concerned authorities i.e. local bodies, Railways, National
Highways, State Highways etc. before erection of proposed lines;
(iii) the Applicant shall have to follow regulations /codes of the appropriate commission regarding transmission,
O&M, open access etc;
(iv) the Applicant shall have the responsibility of construction of 220kV D/c transmission line from Teesta-VI HEP(500 MW) power house at Subinkhore to Rangpo Pooling Station of PGCIL in Sikkim. The details of the works are published in the Gazette of India of May 24 – May 30, 2014.
(v) the Applicant shall operate the lines after approval of Chief Electrical Inspector of respective States; (vi) the approval is subject to compliance by the Applicant of the requirement of the provisions of The Electricity Act, 2003 and the rules made there under.
