BÉEÉ.+ÉÉ.3062(+É).—केंद्रीय सरकार, पर्यावरण (संरक्षण) अधिनियम, १९८६ (१९८६ का २९) की धारा ३ की उपधारा (३) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के पर्यावरण और वन मंत्रालय की अधिसूचना संख्यांक का.आ. १५३३(अ), तारीख १४ सितंबर, २००६ (जिसे इसमें इसके पश्चात्् उक्त राजपत्र अधिसूचना कहा गया है) के अनुसरण में राज्य स्तर पर्यावरण प्रभाव निर्धारण प्राधिकरण हिमाचल प्रदेश (जिसे इसमें इसके पश्चात्् प्राधिकरण हिमाचल प्रदेश कहा गया है) का गठन करती है, जिसमें निम्नलिखित सदस्य होंगे :--

७. रा.वि.मू.स. हिमाचल प्रदेश ऐसी शक्तियों का प्रयोग और ऐसी प्रक्रिया का पालन करेगा, जो उक्त राजपत्र अधिसूचना में विनिर्दिष्ट हो ।

८. रा.वि.मू.स. हिमाचल प्रदेश सामूहिक उत्तरदायित्व के सिद्धांत पर कार्य करेगा और अध्यक्ष प्रत्येक मामले में मतैक्यता पर पहुंचने का प्रयास करेगा और यदि मतैक्यता पर नहीं पहुंचा जा सकता है तो बहुमत की राय अभिभावी होगी ।

९. हिमाचल प्रदेश सरकार प्राधिकरण के लिए सचिवालय के रूप में कार्य करने के लिए हिमाचल प्रदेश को अभिकरण के रूप में अधिसूचित करेगी और उसके सभी कानूनी कृत्यों की बाबत सभी वित्तीय तथा संभार तंत्र सहायता जिसके अंतर्गत वास सुविधा, परिवहन और अन्य सुविधाएं भी हैं, प्रदान करेगी ।

१०. प्राधिकरण, हिमाचल प्रदेश के अध्यक्ष और सदस्य की आसीन फीस, यात्रा भत्ता और मंहगाई भत्ता का संदाय हिमाचल प्रदेश राज्य सरकार के नियमों के अनुसार किया जाएगा ।

NOTIFICATION

New Delhi, the 2nd December, 2014

S.O. 3062(E).—In exercise of the powers conferred by sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said Gazette Notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority (SEIAA), Himachal Pradesh (hereinafter referred to as the Authority, Himachal Pradesh) comprising of the following Members, namely:—

2. The Chairman and Members of the Authority, Himachal Pradesh shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

3. The Authority, Himachal Pradesh shall exercise the powers and follow the procedures as specified in the said Gazette notification.

4. The Authority, Himachal Pradesh shall base its decision on the recommendations of the State level Expert Appraisal Committee (SEAC) constituted under paragraph 5 for the State of Himachal Pradesh.

5. For the purpose of assisting the Authority, Himachal Pradesh, the Central Government, in consultation with the State Government of Himachal Pradesh, hereby constitutes the State level Expert Appraisal Committee, Himachal Pradesh (hereinafter referred to as SEAC, Himachal Pradesh) comprising of the following Members, namely :—

6. The Chairman and Members of SEAC, Himachal Pradesh shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.

7. The SEAC, Himachal Pradesh shall exercise the powers and follow the procedures as specified in the said Gazette notification.

8. The SEAC, Himachal Pradesh shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.

9. The State Government of Himachal Pradesh shall notify an agency to act as Secretariat for the Authority, Himachal Pradesh and SEAC, Himachal Pradesh and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions.

10. The sitting fee, travelling allowance and dearness allowance to the Chairman and Member of the Authority, Himachal Pradesh and the Chairman and Members of SEAC, Himachal Pradesh shall be paid in accordance with the concerned rules of the State Government of Himachal Pradesh.
