BÉEÉ.+ÉÉ. 3056(+É).—केन्द्रीय सरकार ने कोयला धारक क्षेत्र (अर्जन और विकास), अधिनियम, १९५७ (१९५७ का २०), (जिसे इस में इसके पश्चात~ उक्त अधिनियम कहा गया है) की धारा ४ की उपधारा (१) के अधीन भारत सरकार में कोयला मंत्रालय के द्वारा जारी की गई अधिसूचना, संख्यांक का.आ. २५१६, तारीख ३१ जुलाई, २०१२ जो भारत के राजपत्र के भाग II, खण्ड ३ , उप-खण्ड (ii), तारीख ४ अगस्त, २०१२ में प्रकाशित की गई थी, उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट परिक्षेत्र की भूमि में जिसका माप २४९.७०१ हेक्टर (लगभग) या ६१७.०१ एकड़ (लगभग) है, कोयले का पूर्वेक्षण करने के अपने आशय की सूचना दी थी;

और केन्द्रीय सरकार का यह समाधान हो गया है कि इस अधिसूचना से संलग्न अनुसूची में विहित उक्त भूमि में कोयला अभिप्राप्त है;

अत:, अब, केन्द्रीय सरकार, उक्त अधिनियम की धारा ७ की उपधारा (१) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, उक्त भूमि के उससे संलग्न अनुसूची में वर्णित २४९.७०१ हेक्टर (लगभग) या ६१७.०१ एकड़ (लगभग) माप वाली भूमि में या उस पर के सभी अधिकार अर्जन करने की अपने आशय की सूचना देती है ; जो निम्न है :

(क) उक्त माप वाली भूमि के सभी अधिकार अनुसूची "क" में वर्णित २१९.१९८ हेक्टर (लगभग) या ५४१.६४ एकड़ (लगभग);

(ख) उक्त माप वाली भूमि के खनन अधिकार अनुसूची "ख" में वर्णित १५.५९३ हेक्टर (लगभग) या ३८.५३ एकड़ (लगभग);

(ग) उक्त माप वाली भूमि के सतही अधिकार अनुसूची "ग" में वर्णित १४.९१ हेक्टर (लगभग) या ३६.८४ एकड (लगभग) ।

+ÉVÉÇxÉ BÉEÉÒ ¤ÉɤÉiÉ +ÉÉ{ÉÉÊkɪÉÉÄ.—

"८. (१) कोई व्यक्ति जो किसी भूमि में जिसकी बाबत धारा ७ के अधीन अधिसूचना जारी की गयी है, हितबद्ध है, अधिसूचना के जारी किए जाने से तीस दिन के भीतर सम्पूर्ण भूमि या उसके किसी भाग या ऐसी भूमि में या उस पर के किन्हीं अधिकारों का अर्जन के किए जाने के बारे में आक्षेप कर सकेगा।

º{É−]ÉÒBÉE®hÉ.- इस धारा के अन्तर्गत यह आपत्ति नहीं मानी जायेगी, कि कोई व्यक्ति किसी भूमि में कोयले उत्पादन के लिए स्वयं खनन संक्रियाएं करना चाहता है और ऐसी संक्रियाएं केन्द्रीय सरकार या किसी अन्य व्यक्ति को नहीं करनी चाहिएं ।

(२) उप-धारा (१) के अधीन प्रत्येक आक्षेप सक्षम अधिकारी को लिखित रूप में की जायेगी और सक्षम अधिकारी को या आक्षेपकर्ता को स्वयं सुने जाने, विधि व्यवासयी द्वारा सुनवाई का अवसर देगा और ऐसी सभी आपतियों को सुनने के पश्चात~ और ऐसी अतिरिक्त जाँच यदि कोई हो, करने के पश्चात~ जो वह आवश्यक समझता है, वह या तो धारा ७ की उप-धारा (१) के अधीन अधिसूचित भूमि के या ऐसी भूमि में या उस भूमि पर अधिकारों की बाबत एक रिपोर्ट या ऐसी भूमि के विभिन्न टुकड़े या ऐसी भूमि में या उस पर अधिकारों की बाबत आपतियों पर अपने द्वारा अभिनिर्धारित कार्यवाहियों के अभिलेख के साथ अपनी सिफारिशों विभिन्न रिपोर्ट केन्द्रीय सरकार को उसके विनिश्चय के लिए देगा ।

(३) इस धारा के प्रयोजनों के लिए वह व्यक्ति किसी भूमि में हितबद्व समझा जायगा जो प्रतिकर में हित का दावा करने का हकदार होता यदि भूमि या किसी ऐसी भूमि में या उस भूमि पर अधिकार को, इस अधिनियम के अधीन अर्जित कर लिया जाता है । "

क६ - क७ यह रेखा मौजा बड़ा मुड़ जोड़ा संख्यांक ३ की प्लाट संख्यांक ४४८ के भीतरी बिन्दु क६ से आरंभ होकर प्लाट संख्यांक ४५८, ४५९, ४६०, ४६४, ४६३, ४३२ सड़क को पार करती हुई, प्लाट संख्यांक ७७५, ७७६ और ७७७ की उत्तरी-पूर्वी सीमा से गुजरती है और प्लाट संख्यांक ७७८, ७८६, ७८७, ७९०, ८२२, ८२३, ८२४, ८२५, ८२७, ८२८, ८३१, ९१८, ९१७, ९१६, ९१५, ९१४, ९२०, ९२२ को पार करती हुई मौजा बड़ा मुड़ जोड़ा संख्यांक ३ एवं अमरभीटा संख्यांक ७ की सम्मिलित सीमा पर बिन्दु क७ पर मिलती है।

क७ - क८ यह रेखा मौजा बड़ा मुड़ जोड़ा संख्यांक ३ और अमरभीटा संख्यांक ७ की सम्मिलित सीमा पर बिन्दु क७ से आरंभ होकर दोनों मौजा की सम्मिलित सीमा से गुजरती हुई मौजा बड़ा मुड़ जोड़ा संख्यांक ३, अमरभीटा संख्यांक ७ और सिमलौंग पहाड़ संख्या ५ की त्रिसंधि स्तंभ पर बिन्दु क८ पर मिलती है।

क८ - क९ यह रेखा मौजा बड़ा मुड़ जोड़ा संख्यांक ३, अमरभीटा संख्यांक ७ और सिमलौंग पहाड़ संख्यांक ५ की त्रिसंधि स्तंभ पर बिन्दु क८ से आरंभ होकर मौजा अमरभीटा संख्यांक ७ और सिमलौंग पहाड़ संख्यांक ५ की सम्मिलित सीमा से गुजरती हुई, मौजा अमरभीटा संख्यांक ७ सिमलौंग पहाड़ संख्यांक ५ और तेतली संख्यांक ६ की त्रिसंधि स्तंभ पर बिन्दु क९ पर मिलती है।

क९ - क१० यह रेखा मौजा अमरभीटा संख्यांक ७, सिमलौंग पहाड़ संख्यांक ५ और तेतली संख्यांक ६ की त्रिसंधि स्तंभ पर बिन्दु क९ से प्रारंभ होकर मौजा तेतली संख्यांक ६ एवं सिमलौंग पहाड़ संख्यांक ५ की सम्मिलित सीमा से गुजरती हुई, मौजा तेतली संख्यांक ६, बेहम्डा संख्यांक १८, बड़ा घाघरी संख्यांक २० तथा सिमलौंग पहाड़ संख्यांक ५ की त्रिसंधि स्तंभ पर बिन्दु क१० पर मिलती है।

क१० - क११ यह रेखा मौजा तेतली संख्यांक ६, बेहड़ा संख्यांक १८, बड़ा घाघरी संख्यांक २० और सिमलौंग पहाड़ संख्यांक ५ की त्रिसंधि स्तंभ पर बिन्दु क१० से आरंभ होकर, मौजा बड़ा घाघरी संख्यांक २० और बेहड़ा संख्यांक १८ की सम्मिलित सीमा के साथ - साथ गुजरती हुई, मौजा बड़ा घाघरी संख्यांक २० और बेहड़ा संख्यांक १८ की सम्मिलित सीमा पर बिन्दु क११ पर मिलती है ।

क११ - क१२ यह रेखा मौजा बड़ा घाघरी संख्यांक २० और बेहड़ा संख्यांक १८ की सम्मिलित सीमा पर बिन्दु क११ से आरंभ होकर मौजा बड़ा घाघरी संख्यांक २० की प्लाट संख्यांक १९८ की पूर्वी सीमा, १९९,२०२ की उतरी सीमा, २०२, २१३, २१४, २२३, २२२, २२१, २५०, २४७ की पूर्वी सीमा, २४४, ३०७, ३०३, ३००, २९८ की उत्तरी सीमा, २९८ की पूर्वी ३२२, ३३० की उत्तरी सीमा ३३०, ३३१ की पूर्वी सीमा ३३४ की उत्तरी सीमा तथा ३३५ की पश्चिमी सीमा से गुजरती हुई मौजा बड़ा घाघरी संख्यांक २० और बेहड़ा संख्यांक १८ की सम्मिलित सीमा पर बिन्दु क१२ पर मिलती हैं।

क१२ - क१३ यह रेखा मौजा बड़ा घाघरी संख्यांक २० और बेहड़ा संख्यांक १८ की सम्मिलित सीमा बिन्दु क१२ से आरंभ होकर उक्त दोनों मौजा की सम्मिलित सीमा, मौजा बड़ा घाघरी संख्यांक २० की प्लाट संख्यांक ३४० की पूर्वी, ३४३, ३४२ की उत्तरी सीमा, ३४२, ३५२ की पूर्वी सीमा से गुजरती हुई मौजा बड़ा घाघरी संख्या २० एवं मौजा छोटा घाघरी संख्यांक १९ की सम्मिलित सीमा पर बिन्दु क१३ पर मिलती है।

क१३ - क१४ यह रेखा मौजा बड़ा घाघरी संख्यांक २० और छोटा घाघरी संख्यांक १९ की सम्मिलित सीमा पर बिन्दु क१३ से आरंभ होकर मौजा छोटा घाघरी संख्यांक १९ की प्लाट संख्यांक ५४ की पूर्वी ५२ ,५१, ३८ की उतरी, ३८, ४४, ७१, ६८ की पूर्वी, ८२ की उत्तरी एवं पूर्वी, १४२ सड़क की उत्तरी - पूर्वी सीमा से गुजरती हुई प्लाट संख्यांक ८३ और १४२ सड़क की सम्मिलित सीमा पर बिन्दु क१४ पर मिलती है।

क१४ - क१५ यह रेखा मौजा छोटा घाघरी संख्यांक १९ की प्लाट संख्यांक ८३ और १४२ सड़क की सम्मिलित सीमा पर बिन्दु क१४ से आरंभ होकर प्लाट संख्यांक १४२ सड़क को पार करती हुई, प्लाट संख्यांक ४२३ की पूर्वी सीमा से गुजरती है और पुन: प्लाट संख्यांक ४२३ को पार करती हुई प्लाट संख्यांक ३४७, ३४६ और ४२३ की सम्मिलित सीमा पर बिन्दु क१५ पर मिलती है।

क१५ - क१६ यह रेखा मौजा छोटा घाघरी संख्यांक १९ की प्लाट संख्यांक ३४७, ३४६ और ४२३ की सम्मिलित सीमा पर बिन्दु क१५ से आरंभ होकर प्लाट संख्यांक ३४७ और ४२३ की दक्षिणी सीमा से गुजरती हुई प्लाट संख्यांक ४२३, ४४४ और ४२२ की सम्मिलित सीमा पर बिन्दु क१६ पर मिलती है।

क१६ - क१७ यह रेखा मौजा छोटा घाघरी संख्यांक १९ की प्लाट संख्यांक ४२३, ४४४ और ४२२ की सम्मिलित सीमा पर बिन्दु क१६ से आरंभ होकर प्लाट संख्यांक ४४४ की पूर्वी ४९४ की पूर्वी एवं उत्तरी सीमा से गुजरती हुई मौजा छोटा घाघरी संख्यांक १९ और बड़ा घाघरी संख्यांक २० की सम्मिलित सीमा पर बिन्दु क१७ पर मिलती है। क१७ - क१८ यह रेखा मौजा छोटा घाघरी संख्यांक १९ और बड़ा घाघरी संख्यांक २० की सम्मिलित सीमा पर बिन्दु क१७ से शुरू होकर मौजा बड़ा घाघरी संख्यांक २० की प्लाट संख्यांक ३७२, ३७०, ३८०, ३७९ की दक्षिणी सीमा से गुजरती हुई प्लाट संख्यांक ३७९, ४१५ और ४१६ की सम्मिलित सीमा पर बिन्दु क१८ पर मिलती है।

क१८ - क१९ यह रेखा मौजा बड़ा घाघरी संख्यांक २० की प्लाट संख्यांक ३७९, ४१५ और ४१६ की सम्मिलित सीमा पर बिन्दु क१८ से आरंभ होकर प्लाट संख्यांक ३७९ की पश्चिमी ३९१, ४०३, ४०४ और ३९८ की दक्षिणी ११५ की पूर्वी, ११५ और ११६ की दक्षिणी ११६ की पश्चिमी, ११७ की उत्तरी और पश्चिमी सीमा से गुजरती हुई प्लाट संख्यांक ११७, १४६ सड़क और ९७ की सम्मिलित सीमा पर बिन्दु क१९ पर मिलती है।

क१९ - क२० यह रेखा मौजा बड़ा घाघरी संख्यांक २० के प्लाट संख्यांक ११७, १४६ सड़क और ९७ की सम्मिलित सीमा पर बिन्दु क१९ से आरंभ होकर प्लाट संख्यांक ९७, ५६, ५८, ५९, ४३७, ६३ की उत्तरी सीमा ८७, ६४, ६५, ६६, ६७ की पूर्वी सीमा ८७ की उत्तरी सीमा से गुजरती हुई प्लाट संख्यांक ८७, ८५ और ८९ की सम्मिलित सीमा पर बिन्दु क२० मिलती है।

क२० - क२१ यह रेखा मौजा बड़ा घाघरी संख्यांक २० की प्लाट संख्यांक ८७, ८५ और ८९ की सम्मिलित सीमा पर बिन्दु क२० से आरंभ होकर प्लाट संख्यांक ८५, ८२ की पश्चिमी, ८३ की दक्षिणी सीमा, ५ की पश्चिमी सीमा से गुजरती हुई प्लाट संख्यांक ४ और ३ की सम्मिलित सीमा पर बिन्दु क२१ पर मिलती है।

क२४ - क२५ यह रेखा मौजा सिमलौंग पहाड़ संख्यांक ५ की प्लाट संख्यांक ११९, १०० और ९९ की सम्मिलित सीमा पर बिन्दु क२४ से आरंभ होकर प्लाट संख्यांक ११९ की पश्चिमी सीमा, १०० की उत्तरी १००, १०१, १०२ की पश्चिमी सीमा से गुजरती हुई और प्लाट संख्यांक १७२ सड़क को पार करती हुई प्लाट संख्यांक १७२ सड़क और १७३ की सम्मिलित सीमा पर बिन्दु क२५ पर मिलती है।

क२५ - क२६ यह रेखा मौजा सिमलौंग पहाड़ संख्यांक ५ की प्लाट संख्यांक १७२ सड़क और १७३ की सम्मिलित सीमा पर बिन्दु क२५ से आरंभ होकर प्लाट संख्यांक १७३ की उत्तरी सीमा से गुजरती हुई मौजा सिमलौंग संख्यांक ४ और मौजा सिमलौंग पहाड़ संख्यांक ५ की सम्मिलित सीमा पर बिन्दु क२६ पर मिलती है ।

क२६ - क२७ यह रेखा मौजा सिमलौंग संख्यांक ४ और सिमलौंग पहाड़ संख्यांक ५ की सम्मिलित सीमा पर बिन्दु क२६ से आरंभ होकर पुन: उक्त दोनों मौजा की सम्मिलित सीमा से गुजरती हुई मौजा सिमलौंग संख्यांक ४, सिमलौंग पहाड़ संख्यांक ५ और सिमलढ़ाब संख्यांक २१ की त्रिसंधि स्तंभ पर बिन्दु क२७ पर मिलती है।

क२७ - क२८ यह रेखा मौजा सिमलौंग संख्यांक ४ सिमलौंग पहाड़ संख्यांक ५ और सिमलढ़ाव संख्यांक २१ की त्रिसंधि स्तभ से बिन्दु क२७ से आरंभ होकर मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक ६२६ की पश्चिमी, उत्तरी तथा पूर्वी सीमा से गुजरती हुई प्लाट संख्यांक ६२६, ६०७ और ६०८ की सम्मिलित सीमा पर बिन्दु क२८ पर मिलती है।

क२८ - क२९ यह रेखा मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक ६२६, ६०७ और ६०८ की सम्मिलित सीमा पर बिन्दु क२८ से शुरू होकर प्लाट संख्यांक ६०८ की उत्तरी सीमा से गुजरती हुई ५४३ सड़क को पार करती हुई, प्लाट संख्यांक ५४३ सड़क, ५४० तथा ४८१ सड़क की सम्मिलित सीमा पर बिन्दु क२९ पर मिलती है।

क२९ - क३० यह रेखा मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक ५४३ सड़क, ५४० और ४८१ सड़क की सम्मिलित सीमा पर बिन्दु क२९ से शुरू होकर प्लाट संख्यांक ५४३ सड़क की पश्चिमी सीमा से गुजरती हुई प्लाट संख्यांक ५४३ सड़क, ४८६ सड़क तथा ५३६ की सम्मिलित सीमा पर बिन्दु क३० पर मिलती है।

क३० - क३१ यह रेखा मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक ५४३ सड़क, ४८६ सड़क तथा ५३६ की सम्मिलित सीमा पर बिन्दु क३० से आरंभ होकर प्लाट संख्यांक ४८६ सड़क की दक्षिणी तथा पश्चिमी सीमा से गुजरती हुई प्लाट संख्यांक ४८३ और ४८६ सड़क की सम्मिलित सीमा पर बिन्दु क३१ पर मिलती है।

क३१ - क१ यह रेखा मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक ४८३ और ४८६ सड़क की सम्मिलित सीमा से आरंभ होकर प्लाट संख्यांक ४८६ सड़क, ३३३, ३०२, ३०१, २९८, ३०८ को पार करती हुई प्लाट संख्यांक ३०७ में बिन्दु क१ पर मिलती है।

खण्ड संख्यांक २: ख१ - ख २ यह रेखा मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक २६९, २७० और ३२५ की सम्मिलित सीमा ख१ से आरंभ होकर प्लाट संख्यांक ३२५ और १ की पूर्वी सीमा से गुजरती हुई मौजा सिमलौंग संख्यांक ४ की प्लाट संख्यांक १, २ और मौजा बड़ा मुड़ जोड़ा संख्यांक ३ की प्लाट संख्यांक ३२४ की सम्मिलित सीमा पर बिन्दु ख२ पर मिलती है।

NOTIFICATION

New Delhi, the 9th July, 2014

S.O. 3056(E).—Whereas by notification of the Government of India in the Ministry of Coal number S.O. 2516, the dated the 31st July, 2012, issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act) and published in the Gazette of India, Part II, Section 3, Sub-section (ii), dated the 4th August, 2012 the Central Government gave notice of its intention to prospect for coal in 249.701 hectares (approximately) or 617.01 acres (approximately) of the lands in the locality specified in the Schedule annexed to that notification;

And whereas, the Central Government is satisfied that coal is obtainable in a part of the said land specified in the Schedule appended to this notification.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central Government hereby gives notice of its intention to acquire the land measuring 249.701 hectares (approximately) or 617.01 acres (approximately) and all rights in or over the said land described in the Schedule appended hereto as described below :–

(a) all rights over 541.64 acres or 219.198 hectares of land mentioned in Schedule A ; (b) mining rights over 38.53 acres or 15.593 hectares of land mentioned in Schedule B ; (c) surface rights over 36.84 acres or 14.91 hectares of land mentioned in Schedule C.

Note 1: The plan bearing number ECL/SIML/MOUZA/NOTI /07A, dated the 23rd Novermber, 2012 of the area covered by this notification may be inspected at the office of the Deputy Commissioner, District Pakur (Jharkhand), or in the Office of the Coal Controller, 1, Council House Street, Kolkata – 700 001 or in the Office of the Director Technical (Operation), Eastern Coalfields Limited, Sanctoria, Post Office -Dishergarh, District Burdwan – 713 333. (West Bengal).

Note 2: Attention is hereby invited to the provisions of section 8 of the said Act which provides as follows:-

Objections to acquisition.—

"8. (1) Any person interested in any land in respect of which a notification under section 7 has been issued may, within thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or over such land.

Explanation.- It shall not be an objection within the meaning of this section for any person to say that he himself desires to undertake mining operations in the land for the production of coal and that such operations should not be undertaken by the Central Government or by any other person.

(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land, or make different reports in respect of different parcels of such land or of rights in or over such land, to the Central Government, containing his recommendations on the objections, together with the record of the proceedings held by him, for the decision of that Government.

(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an interest in compensation if the land or any rights in or over such land were acquired under this Act."

Note 3 : The Coal Controller, 1, Council House Street, Kolkatta- 700001 has been appointed by the Central Government as the competent authority under section 3 of the said Act, vide notification number S.O. 2520, dated 27th May, 1983, published in Part II, Section 3, sub-section(ii) of the Gazette of India, dated the 11th June, 1983.
