काकाकाका....आआआआ.... 3107(अ)3107(अ)3107(अ)3107(अ)....----भारत सरकार ने, पेट्रोलियम और खनिज पाइपलाइन (भूमि में उपयोग के अधिकार का अर्जन) अधिनियम, 1962 (1962 का 50) (जिसे इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 3 की उप-धारा (1) के अधीन जारी भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2043(अ), दिनांक 08.08.2014 द्वारा, उस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में, मैसर्स रिलायंस इण्डस्ट्रीज लिमिटेड के मध्य प्रदेश राज्य के जिला शहडोल के अन्तर्गत सोहागपुर (पूर्व) और सोहागपुर (पश्चिम) में स्थित सी.बी.एम. ब्लाकों से देश के विभिन्न हिस्सों में उपभोक्ताओं तक प्राकृतिक गैस के परिवहन के लिए, मैसर्स रिलायंस गैस पाइपलाइन्स लिमिटेड द्वारा शहडोल (मध्य प्रदेश)-जयसिंह नगर-बेउहारी-गुरह-फूलपुर (उत्तर प्रदेश) गैस पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थीं ;
और, उक्त राजपत्र अधिसूचना की प्रतियाँ जनता को तारीख 23.09.2014 को अथवा उससे पूर्व उपलब्ध करा दी गई थीं;
और, पाइपलाइन बिछाने के सम्बन्ध में, जनता की ओर से कोई आक्षेप प्राप्त नहीं हुआ है;
और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 6 की उप-धारा (1) के अधीन भारत सरकार को अपनी रिपोर्ट दे दी है;
और, भारत सरकार ने, उक्त रिपोर्ट पर विचार करने के पश्चात् और यह समाधान हो जाने पर कि उक्त भूमि पाइपलाइन बिछाने के लिए अपेक्षित है, उसमें उपयोग के अधिकार का अर्जन करने का विनिश्चिय किया है;
अतः अब, भारत सरकार, उक्त अधिनियम की धारा 6 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के लिए उपयोग के अधिकार का अर्जन किया जाता है;
और, भारत सरकार उक्त अधिनियम की धारा 6 की उप-धारा (4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की तारीख से भारत सरकार में निहित होने के बजाए, सभी विल्लंगमों से मुक्त, मैसर्स रिलायंस गैंस पाइपलाइन्स लिमिटेड में निहित होगा।

NOTIFICATION
New Delhi, the 8th Decembeer, 2014
S.O. 3107(E).—Whereas by notification of Government of India in Ministry of Petroleum and Natural Gas, number S.O. 2043(E), dated 08-08-2014, issued under sub-section (1) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962) (hereinafter referred to as the said Act), Government of India declared its intention to acquire the Right of User in the land, specified in the Schedule appended to that notification for the purpose of laying Shahdol (Madhya Pradesh)– Jaysingh Nagar–Beohari–Gurh–Phulpur (Uttar Pradesh) gas pipeline for transportation of natural gas from the Sohagpur (East) and Sohagpur (West) C.B.M. blocks of M/s. Reliance Industries Limited situated under Shahdol district in Madhya Pradesh State by M/s. Reliance Gas Pipelines Limited to the consumers in various parts of the country;
And whereas, the copies of the said Gazette notification were made available to the public on or before 23-09-2014;
And whereas, no objections have been received from the public to the laying of the pipeline;
And whereas, the Competent Authority has, under sub-section (1) of Section 6 of the said Act, submitted report to the Government of India;
And whereas, Government of India, after considering the said report and on being satisfied that the said land is required for laying the pipeline, has decided to acquire the Right of User therein;
Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 6 of the said Act, Government of India hereby declares that the Right of User in the land, specified in the Schedule, appended to this notification, is hereby acquired for laying the pipeline;
And further, in exercise of the powers conferred by sub-section (4) of Section 6 of the said Act, Government of India hereby directs that the Right of User in the said land for laying the pipeline shall, instead of vesting in Government of India, vest on the date of publication of the declaration, in M/S Reliance Gas Pipelines Limited, free from all encumbrances.
