काकाकाका....आआआआ.... 3119(अ)3119(अ)3119(अ)3119(अ)....--------यतः, केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1192 (अ), तारीख 3 दिसम्बर, 2001 तथा का.आ. 465 (अ), 26 अप्रैल 2002 द्वारा महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्या 7 के नागपुर-हैदराबाद सेक्षन के 36.600 कि.मी. से 64.000 कि.मी, 0.000 कि.मी. से 9.200 कि.मी. और 64.000 कि.मी. से 175.640 कि.मी. तक का राष्ट्रीय राजमार्ग का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात्‌ "प्राधिकरण" संदर्भित किया गया है) को सौंपा हैं;

और यतः, केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के नियम (3) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार की अधिसूचना द्वारा निम्नलिखित अनुसार खण्डों का उपयोग करने के लिए यांत्रिक वाहनों पर शुल्क उद्‌ग्रहीत एवं संग्रहीत करने हेतु महाराष्ट्र राज्य में राष्ट्रीय राजमार्ग संख्या 7 पर 36.600 कि.मी. से 94.000 कि.मी. तक के खण्ड के लिए [का.आ.सं. 843 (अ), तारीख 27 अप्रैल, 2011 द्वारा (कुल लम्बाई 57.400 कि.मी. है)] प्राधिकरण को प्राधिकृत किया था।

और यतः, प्राधिकरण ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 14 के प्रावधान के अनुसरण में, प्रचालन, अनुरक्षण और हस्तांतरण (ओएमटी) आधार पर महाराष्ट्र राज्य में बोरखेड़ी-जाम-वार्डनेर सेक्षन के 36.600 कि.मी. से 93.750 कि.मी. (कुल लम्बाई 57.150 कि.मी.) तक (जिसे इसमें इसके पश्चात्‌ "उक्त खण्ड" संदर्भित किया गया है) के प्रचालन और अनुरक्षण हेतु 30.05.2014 को प्रस्तुत की गयी बोली के लिए मैसर्स बोरखेड़ी वार्डनेर पाथवेज (प्रा.) लमिटेड, जिसका पंजीकृत कार्यालय 76, माल रोड, महू, मध्यप्रदेष, भारत में है (जिसे इसमें इसके पश्चात्‌ "रियायतग्राही" संदर्भित किया गया है), के साथ 25.08.2014 को करार तथा 16.10.2014 को अनुपूरक करार किया है (जिसे इसमें इसके पश्चात्‌ "उक्त करार" संदर्भित किया गया है)।

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम 2008, जिसे सा.का.नि. 838 (अ), दिनांक 05.12.2008 द्वारा प्रकाषित किया गया था और जिनमें बोली प्रस्तुत किए जाने की तारीख तक इसमें किए गए संषोधन भी शामिल हैं, के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और अधिसूचना संख्या का. आ. सं. 843 (अ), तारीख 27 अप्रैल, 2011 का अधिक्रमण करते हुए, सिवाए उन बातों के जो ऐसे अधिक्रमण से पहले कर ली गई हों अथवा करने से लोप करा दी गई हों, उक्त राष्ट्रीय राजमार्ग के उक्त खण्ड के निर्माण, अनुरक्षण, प्रबंध और प्रचालन पर हुए व्यय, निवेषित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम, यातायात का दबाव एवं प्राधिकरण तथा रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए, एतद्‌द्वारा यह अधिसूचित करती है कि सड़क खण्ड की निवल लम्बाई 56.445 कि.मी. (705 मीटर की उन संरचनाओं को छोड़कर जिनकी लम्बाई 60 मीटर से अधिक है) और संरचनाओं की कुल लम्बाई 0.705 कि.मी. के अनुरूप राजमार्ग की समकक्ष लम्बाई 7.050 कि.मी. के लिए, चार या अधिक लेन के खण्डों के उपयोग के लिए सारणी 1 के स्तम्भ (2) में विनिर्दिष्ट दरों (जिसे इसमें इसके पश्चात्‌ "आधार दर" संदर्भित किया गया है) पर शुल्क उद्‌ग्रहीत और संग्रहीत किया जाएगा और उक्त रियायतग्राही को प्राधिकरण द्वारा घोषित वाणिज्यिक प्रचालन की तारीख को और उस तारीख से अथवा इस अधिसूचना के राजपत्र में प्रकाषन पर, जो भी बाद में हो, करार में यथा विनिर्दिष्ट समाप्ति की तारीख तक, शुल्क को संग्रहीत तथा प्रतिधारित करने के लिए प्राधिकृत करती है;

(1) नीचे उद्‌ग्रहीत तथा संग्रहीत शुल्क ऐसे प्रत्येक टोल प्लाजा (प्लाजाओं) के लिए विनिर्दिष्ट दूरी के लिए निम्नलिखित टोल प्लाजा पर शोध्य और संदेय होगा :

(2) उपर्युक्त के अतिरिक्त, निम्नलिखित संरचनाओं के उपयोग के लिए, जिनकी लम्बाई 60 मीटर से अधिक है, ऐसी संरचनाओं की लम्बाई को समकरण गुणक 10 से गुणा करके संरचनाओं की लम्बाई को राजमार्ग की समकक्ष लम्बाई में परिवर्तित करते हुए निम्नलिखित टोल प्लाजा (प्लाजाओं) पर निम्नलिखित शुल्क भी शोध्य और संदेय होगा।

3. जिस व्यक्ति का अपना यांत्रिक वाहन, गैर-वाणिज्यिक प्रयोजनों के लिए पंजी—त हुआ हो और वह टोल प्लाजा से बीस किलोमीटर तक की दूरी में ही रहता हो, उसके लिए वर्ष 2014-15 के लिए मासिक पास की दर 225.00 रूपए (दो सौ पच्चीस रूपए मात्र) होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के उपबंधों के अनुसार उसमें प्रत्येक वर्ष संशोधन किया जायेगा।

4. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर जारी किया जाएगा, अर्थात्‌ :

5 जिस जिले में टोल प्लाजा पड़ता है उस जिले में पंजी—त वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।

6. जो यांत्रिक वाहन अपनी श्रेणी के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदा हुआ होगा उसके चालक अथवा मालिक अथवा प्रभारी व्यक्ति को अधिक भार से लदे हुए वाहन को राष्ट्रीय राजमार्ग पर प्रवेष कराने के लिए टोल संग्रहण एजेंसी को ऐसे यांत्रिक वाहन के लिए लागू शुल्क के दस गुणा के बराबर शुल्क का भुगतान करना होगा, और उसे राजमार्ग खण्ड का उपयोग करने की तब तक अनुमति नहीं होगी जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा नहीं दिया जाए ।

7. यांत्रिक वाहनों के श्रेणी, उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों की श्रेणी, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं उक्त नियम में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।

8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।

9. ऊपर सारणी-1 में यथा-उल्लिखित, आधार वर्ष 2007-08 के लिए प्रति किलोमीटर शुल्क की आधार दर के आधार पर, यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और छूट की गणना प्राधिकरण द्वारा की जाएगी। प्राधिकरण द्वारा उसे रियायतग्राही के माध्यम से अंग्रेजी और स्थानीय भाषा के कम-से'-कम एक-एक समाचार पत्र में प्रकाषित करवाया जाएगा। तत्पष्चात्‌ उक्त नियमों के नियम 5 तथा रियायत करार के प्रावधानों के अनुसार उसमें वार्षिक तौर संषोधन तथा प्रकाषित किया जाएगा, परन्तु शर्त यह है कि शुल्क में पिछली बार की गई वृद्धि की तारीख से (छह) महीने की अवधि के भीतर कोई वृद्धि नहीं की जाएगी।

10. 01.08.2014 के अनुसार, वाणिज्यिक प्रचालन की तारीख से वसूल की जानेवाली परियोजना की पूंजीगत लागत का वर्तमान मूल्य 290.60 करोड़ रुपए (दो सौ नब्बे करोड़ साठ लाख मात्र) है। वाणिज्यिक प्रचालन की तारीख से टोल का संग्रहण रियायतग्राही द्वारा राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 तथा बोली की नियत तारीख तक उसमें किए गए संषोधनों के अधीन की गई व्यवस्था के अनुसार किया जाएगा। वाणिज्यिक प्रचालन की तारीख को एनपीवी तक पहुंचने के लिए 12% प्रतिवर्ष की कटौती की दर से रियायत शुल्क के जरिए पूंजीगत लागत की वसूली की जाएगी। जिस दिन पूंजीगत लागत की वसूली हो जाएगी उस दिन से लिए जाने वाली टोल की दरों को घटाकर 40% कर दिया जाएगा और रियायत करार/खण्ड (क्लॉज) 21.1.1 के अनुसार 10% की वार्षिक वृद्धि लागू हो जाएगी। यदि किसी कारण से वाणिज्यिक प्रचालन की तारीख को पहले कर दिया जाता है/आगे बढ़ा दिया जाता है तो वसूल की जानेवाली पूंजीगत लागत का फिर से हिसाब लगाया जाएगा और इसके बारे में इंजीनियर/स्वतंत्र इंजीनियरों द्वारा वाणिज्यिक प्रचालन की वास्तविक तारीख के बाद 30 दिनों के अन्दर रियायतग्राही को सूचित किया जाएगा।

NOTIFICATION

S.O. 3119(E).—Whereas, by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1192(E), dated 3rd December, 2001 and S.O.465(E), dated 26th April,2002 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government, has entrusted the section of National Highway from km. 36.600 to km 64.000, km 0.000 to km 9.200 and km 64.000 to km 175.640 of Nagpur – Hyderabad Section of National Highway No. 7 in the State of Maharashtra to the National Highways Authority of India (hereinafter referred to as the "Authority");

And whereas, in exercise of the powers conferred by Section 7 of the National Highway Act, 1956 (48 of 1956) read with Rule (3) of the National Highway Fee (Determination of Rates and Collection) Rules 2008, the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows: [Vide S.O.No. 843(E), dated 27th April, 2011 for the stretch from km.36.600 to km. 94.000 (total length being 57.400 km) in the State of Maharashtra on National Highway No. 7.]4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an Agreement on 25.08.2014 and Supplementary Agreement on 16.10.2014(hereinafter referred to as said agreement) with M/s Borkhedi Wardner Pathways (P) Ltd., having registered office at 76, Mall Road, Mhow, Madhya Pradesh, India (hereinafter referred to as the "Concessionaire"), for the bid submitted on 30.05.2014 for the Operation and Maintenance of Borkhedi-Jam-Wardner Section from km 36.600 to km 93.750 (Total Length 57.150 km) in the State of Maharashtra (hereinafter referred to as the "said section") on Operate, Maintain and Transfer (OMT) basis.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide GSR 838 (E) dated 05.12.2008 and its amendment till bid submission date and in supersession of the Notification Number S.O. No. 843(E), dated 27th April, 2011, except as respect things done or omitted to be done before such supercession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said Section of the said National Highway, interest on the capital invested, reasonable return, the volume of traffic and the period of said agreement entered into between the Authority and the Concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said Section at the rates specified in columns (2) of the Table 1 for net road section length of 56.445 km (excluding 705 m of structures having length more than 60m) and equivalent highway length of 7.050 km corresponding to structures having total length of 0.705 km for use of the four and more lane sections (hereinafter referred to as "base rate") and authorizes the said Concessionaire to collect and retain the said fees on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for the distance specified for each such Toll Plaza(s):

In addition to above, the following fee shall also be due and payable for the use of the following structures having length more than 60m at the following Toll Plaza(s), by converting the length of structures into an equivalent length of highway by multiplying the length of such structures by an equalization factor of 10:

The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred Twenty Five[भाग II—खण्ड 3 (ii)] भारत का राजपत्रा : असाधरण 5 only) for the year 2014-15, and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008.

4. For multiple journey on the highway section, passes shall be issued at the following rates, namely.

Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle. 6. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 7. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rule. 8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rule. 9. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority through the Concessionaire in at least one newspaper, each in English and vernacular language and thereafter revised and published annually in accordance with the rule 5 of the said rules and provisions of the Concession Agreement provided that no revision shall be effected within a period of six months from the date of the preceding revision of Fee. 10. The present value of Capital Cost of the Project to be recovered from the date of COD is Rs. 290.60 crore (Rupee Two Hundred Ninty Crore Sixty Lakhs only) as on 01.08.2014. From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. The Capital Cost shall be recovered through Concession Fee by discounting @ 12% per annum to arrive at NPV as on the date of commercial operation (COD). After the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of rate being charged. The Concession Fee shall also be reduced to 40% of the amount payable and annual increment of 10% as per Clause 21.1.1 of Concession Agreement shall be applicable. In case, due to any reason, COD is advanced/postponed, the Capital Cost to be recovered shall be reworked and intimated to the Concessionaire within 30 days after actual COD, by the Engineer/Independent Engineers.
