सासासासा....काकाकाका....िनिनिनिन.... 891891891891((((अअअअ).).).).————के न्(cid:12)ीय सरकार, कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम, 1952 (1952 का 19) की धारा 7 की उपधारा (1) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते -ए और /म और रोजगार मंत्रालय के सा.का.िन. 321 (अ) तारीख 6 मई, 2014 और सा.का.िन. 360(अ) तारीख 6 मई, 2014 को, उन बातों के सिवाय अधि1ांत करते -ए जिन्हें ऐसे अधि1मण से पहले किया गया है या करने का लोप किया गया है, कर्मचारी भविष्य िनिध योजना 1952 का और संशोधन करने के िलए िनम्निलिखत िनयम बनाती है, अर्थात् :-
1. (1) इस स्कीम का संक्षिप्त नाम कर्मचारी भविष्य निधि (पांचवा संशोधन) स्कीम, 2014 है ।
(2) ये 1 अप्रैल, 2011 से प्रवृत्त होगा ।
2. कर्मचारी भविष्य निधि योजना 1952 के पैरा 60 के उप-पैरा (6) में निम्निलिखत परंतुक अन्तःस्थापित किया जाएगा, अर्थात् :-
''परंतु अप्रचलित खाते के संबंध में यदि किसी दावे का निपटारा उस दावे के निपटारे के लिए आवेदन के प्राप्त होने के तीस दिन से अधिक के लिए लंबित रहता है, वहां उप-पैरा (2) के अनुसार तीस दिन को अपवDजत करते -ए विलम्ब के िलए ब्याज को खाते में जमा किया जाएगा ।''

New Delhi, the 12th December, 2014
G.S.R. 891(E).—In exercise of the powers conferred by section 5, read with sub-section (1) of section 7 of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952) and in supersession of Ministry of Labour and Employment's G.S.R.321(E) dated the 6th May, 2014 and G.S.R.360(E) dated the 6th May, 2014, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following Scheme, further to amend the Employees' Provident Funds Scheme, 1952, namely: -
1. (1) This Scheme may be called the Employees' Provident Funds (Fifth Amendment) Scheme, 2014.
(2) It shall come into force from 1st April, 2011.
2. In the Employees' Provident Funds Scheme, 1952, in sub-paragraph (6) of paragraph 60 the following proviso shall be inserted, namely:-
"Provided that if the settlement of claim in respect of inoperative account is delayed for more than thirty days from the date of receipt of the application for settlement of claim, interest shall be credited to the account in accordance with sub paragraph (2) for delay period excluding the period of thirty days."
