संसंसंसं.... 3333----14141414एफएफएफएफ././././अिधसूचना अिधसूचना अिधसूचना अिधसूचना ((((न्यून्यून्यून्यूट्रासूटिकल्सट्रासूटिकल्सट्रासूटिकल्सट्रासूटिकल्स)/)/)/)/एफएफएफएफ....एसएसएसएस....एसएसएसएस....एएएए....आईआईआईआई....----2013201320132013....————खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िविनयम, 2011 का और संशोधन करने के िलए, कतिपय विनियमों का निम्नलिखित प्रारूप, जिसे भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, कें 'ीय सरकार के पूर्व अनुमोदन से, खाद्य सुरक्षा और मानक अिधिनयम, 2006 (2006 का 34) की धारा 16 की उपधारा (2) के साथ पठित धारा 92 की उपधारा (2) के खंड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते 4ए, बनाने का प्रस्ताव करती है, उक्त धारा की उपधारा (1) की अपेक्षानुसार उन सभी 8यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है, प्रकाशित की जाती है और यह सूचना दी जाती है कि उक्त प्रारूप विनियमों पर उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें उक्त अधिसूचना प्रकाशित की गई है, जनता को उपलब्ध करा दी जाती है, साठ दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;

आक्षेप और सुझाव, यदि कोई हों, मुख्य कार्यकारी अधिकारी, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण, खाद्य और औषधि प्रशासन, कोटला रोड, नई दिल्ली-110002 को भेजे जा सकें गे ;

आक्षेपों और सुझावों पर, जो उक्त प्रारूप विनियमों की बाबत उपयु र्क्त विनिFदष्ट अवधि की समाप्ति से पहले किसी 8यक्ति से प्राप्त होते हैं, पूवJक्त प्राधिकरण द्वारा विचार किया जाएगा ।

1. (1) इन िवनियमों का संक्षिप्त नाम खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) संशोधन िविनयम, 2014 है ।

(2) ये राजपत्र में उनके अंितम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) िविनयम, 2011 (जिसे इसमें इसके पश्चात् उक्त िविनयम कहा गया है) में, डेयरी और सदृश्य उत्पाद से संबंिधत िविनयम 2.1 में,--

(क) िशशुपोषण के िलए आहार से संबंिधत उपिविनयम 2.1.9 में,--

(i) शिशु फामू र्ला से संबंिधत खंड 2 में, पहले पैरे के पश्चात्, निम्निलिखत पैरा अंत:स्थापित किया जाएगा, अर्थात् :--

(1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] "उसमें Qमश: 17 िम.Rा. प्रति 100 के .कै ल (डाकसैहेग्साइनइक अम्ल की कु ल वसीय अम्लों का 0.3 प्रतिशत के समतुल्य) के स्तर पर Qिप्थोडियम कोहनी और माTटएल्ला एल्पाइन से डाकसैहेग्साइनाइक अम्ल (ए.आर.ए.) के Uोत के रूप शैवाल और फं गल तेल अंतVवष्ट होगा ।";

(ii) फालो-अप फामू र्ला से संबंधित खंड 5 में, पहले पैरे के पश्चात्, निम्निलिखत पैरा अंत:स्थापित किया जाएगा, अर्थात् :-- "उसमें Qमश: 17 िम.Rा. प्रति 100 के .कै ल (डाकसैहेग्साइनइक अम्ल की कु ल वसीय अम्लों का 0.3 प्रतिशत के समतुल्य) के स्तर पर Qिप्थोडियम कोहनी और माTटएल्ला एल्पाइन से डाकसैहेग्साइनाइक अम्ल (ए.आर.ए.) के Uोत के रूप शैवाल और फं गल तेल अंतVवष्ट होगा ।"।

3. उक्त िविनयमों में, खाद्य योज्यकों से संबंधित विनियम 3.1 में,--

(I) कृ त्रिम मधुकारक से संबंधित उपविनियम 3.1.3 के कृ त्रिम मधुकारकों का प्रयोग और विQय से संबंधित पैरा (1) में,--

(क) "िविनयम 2.4.5 (24, 25, 26, 27, 28 और 29)" शब्दों, अंकों और कोष्ठकों के स्थान पर, "िविनयम 2.4.5 (24, 25, 26, 27, 28, 29 और 50)" शब्द, अंक और कोष्ठक रखे जाएंगे ;

(ख) सारणी में, Qम संख्या 5 और उससे संबंधित प्रविष्टि के पश्चात्, निम्नलिखित Qम संख्यांक और प्रविष्टियां अंत:स्थािपत की जाएगी, अर्थात् :--

(II) उपिविनयम 3.1.6 में, विभिन्न खाद्य पदाथX में, काबJक्सिमेथाइल सेलुलोस के उपयोग से संबंिधत खंड (12) के पश्चात्, निम्निलिखत खंड अंत:स्थापित किया जाएगा, अर्थात् :--

"(13) विभिन्न खाद्य पदाथX में आहारी रेशे (डेक्स्ट्रीन घुलनशील रेशे) का उपयोग

आहारी रेशे (डेक्स्ट्रीन घुलनशील रेशे) निम्निलिखत खाद्य उत्पादों में नीचे दी गई सारणी के स्तंभ (3) तक वVणत स्तर तक उपयोग किया जा सके गा और उस पर खाद्य सुरक्षा और मानक (पैके जिग और लेबलिग) िविनयम, 2011 के िविनयम 2.4.5 (51) में यथा उपबंधित लेबल घोषणा होगी और संघटकों (गें\/मक्का) का Uोत को गैर जनरिक रूप से उपांतरित किया जाना चािहए ।

परंतु यदि उपरोक्त उत्पादों में आहारी रेशों के उaच Uोत के दावे को उपदVशत किया गया है तो ऐसे उत्पादों में 3 Rा./100 Rा.

या 1.5 Rा./100 के .कै ल के सबसे अन्यून और 6 Rा./100 Rा. या 3 Rा./100 के .कै ल से अनधिक अंतVवष्ट होगा ।"।

4. उक्त विनियमों के खाद्य योज्यकों की सूची से संबंधित परिशिष्ट क की सारणी 2 की Qम सं. ङ में सुQोलोस और उससे संबंधित प्रविष्टियों से संबंधित मद सं. 4 के पश्चात्, निम्नलिखित मद संख्या और प्रविष्टियां अंत:स्थापित की जाएगी, अर्थात् :--

New Delhi, the 11th December, 2014

No. 3-14F/Notification (Nutraceuticals)/FSSAI-2013.—The following draft of certain regulations further to amend the Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011, which the Food Safety and Standards Authority of India, with the previous approval of the Central Government, proposes to make, in exercise of the powers conferred by clause (e) of sub-section (2) of Section 92 read with sub-section (2) of Section 16 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required by sub section (1) of the said section for information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of a period of sixty days from the date on which copies of the Official Gazette in which this notification is published, are made available to the public;

Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi – 110 002;

The objections and suggestions, which may be received from any person with respect to the said draft regulations before the expiry of the period specified above, shall be considered by the aforesaid Authority.

Draft Regulations

1. (1) These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives) Amendment Regulations, 2014.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In Food Safety and Standards (Food Product Standards and Food Additives) Regulations, 2011(hereinafter referred to as the said regulations), in regulation 2.1 relating to dairy products and analogues,-

(a) in sub- regulation 2.1.9 relating to foods for infant nutrition,—

(i) in clause 2 relating to infant formula, after the first paragraph, the following paragraph shall be inserted, namely:—

"It may contain algal and fungal oil as sources of Docosahexaenoic Acid (DHA) and Arachidonic Acid (ARA) from Crypthecodium cohnii and Mortiella alpine, respectively at the level of 17mg per 100 Kcal (equivalent to 0.3 per cent. of total fatty acids of DHA) and ARA as ratio of ARA:DHA as 2:1.";

(ii) in clause 5 relating to follow-up formula–Complementary food, after the first paragraph, the following paragraph shall be inserted, namely:—

"It may contain algal and fungal oil as sources of Docosahexaenoic Acid (DHA) and Arachidonic Acid (ARA) from Crypthecodium cohnii and Mortiella alpine respectively at the level of 17mg per 100 Kcal (equivalent to 0.3 per cent of Total Fatty acids of DHA) and ARA as ratio of ARA: DHA as 2:1."

3. In the said regulations, in regulation 3.1 relating to Food Additives, –

(I) in sub-regulation 3.1.3 relating to artificial sweeteners, in paragraph (1) relating to use and sale of artificial sweeteners ,—

(a) for the words, figures and brackets "the regulation 2.4.5 (24, 25, 26, 27, 28 & 29)", the words, figures and brackets "the regulation 2.4.5 (24, 25, 26, 27, 28, 29 and 50)" shall be substituted;

(b) in the table after serial number V and the entries relating thereto, the following serial number and the entries shall be inserted, namely:—

(II) in sub regulation 3.1.6, after clause (12) relating to use of Carboxymethyl Cellulose in various foods, the following clause shall be inserted, namely:—

"(13) Use of Dietary Fibre (Dextrin-soluble fibre) in various foods

Dietary Fibre (Dextrin) may be used in the following food products in the level mentioned in column (3) of the table given below and shall bear the label declaration as provided in the regulation 2.4.5 (51) of the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, and the source of the ingredients (wheat/maize) should be non-genetically modified (GM).

Provided that if in above products it is intended to make claims on high Source of dietary fibre, such products shall contain not less than 3g/100g or 1.5g/100Kcal and not more than 6g/100g or 3g/100Kcal.".

4. In said regulations, in Appendix A relating to list of food additives, in Table 2, in serial number E, after item number 4 relating to Sucralose and the entries relating thereto, the following item number and the entries shall be inserted, namely:—

"(50) खाद्य उत्पाद के प्रत्येक पैके ज पर, जिसमें आइसोमाल्टोस अंतVवष्ट है, निम्निलिखत घोषणाएं होंगी, अर्थात् :--

आइसोमाल्टोस ..................... (कै लोरी) अंतVवष्ट हैं ।

(51) नमकीन और खाने के लिए तैयार खाद्यान्नों वाले सूखा नाश्ते, नूडल्स, पास्ता, सेलड ^ेसिग या टापिग और स्प्रेड ; फिलर या कै रियर के रूप में टेबल टाप फाइबर, अनाज और अन्य खाद्य स्नैक्स या मसालेदार नमकीन और बेकरी उत्पाद, जिसके अंतर्गत बिस्कु ट, कु कीज, ब्रेड, मि'ण के क और पेस्ट्री, जिसमें डायटरी फाइबर (डेक्सट्रीन घुलनशील रेशे हैं) सम्मिलित हैं, के प्रत्येक पैके ज पर निम्नलिखित घोषणाएं होंगी, अर्थात् :--

डायटरी फाइबर (डेक्सट्रीन) ............... (घुलनशील डायटरी फाइबर का Uोत) अंतVवष्ट हैं ।

Draft Regulations

1. (1) These regulations may be called the Food Safety and Standards (Packaging and labelling) (Amendment) Regulations, 2014.

2. In Food Safety and Standards (Packaging and Labelling) Regulations, 2011 (hereinafter referred to as the said regulations), in regulation 2.4 relating to specific requirement/restriction on manner of labelling, in sub regulation 2.4.5, after sub-clause (49), the following shall be inserted, namely:—

"(50) Every package of food product containing Isomaltulose shall bear the following declarations, namely:—

Contains Isomaltulose-----(calories)

(51) Every Package of flakes and ready to eat dry breakfast cereals, noodles, pasta, salad dressings/toppings and spreads; table top fibre as filler or carrier, cereals and other snack food/savouries and bakery products including biscuits, cookies, bread, cake mix and pastries containing added Dietary Fibre (Dextrin-soluble fibre) shall bear the following declarations, namely:—

Contains Dietary Fibre (Dextrin)----- (Source of soluble Dietary fibre)
