काकाकाका....आआआआ.... 3202320232023202((((अअअअ).).).).—भारत सरकार के तत्कालीन पर्यावरण और वन मंत्रालय की अधिसूचना संख्यांक का.आ. 19(अ), तारीख 6 जनवरी, 2011 का संशोधन करने के िलए, निम्नलिखित प्रारूप अधिसूचना, जिसे कें (ीय सरकार, पर्यावरण (संरक्षण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ पठित पर्यावरण (संरक्षण) अिधिनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उपधारा (2) के खंड (v) द्वारा प्रदत्त शक्तियों का प्रयोग करते 4ए, जनसाधारण की जानकारी के िलए, िजनके उससे प्रभावित होने की संभावना है, जारी करने का प्रस्ताव करती है, और यह सूचना दी जाती है कि कें (ीय सरकार द्वारा उक्त अिधसूचना पर, उस तारीख से, जिसको भारत के राजपत्र की, जिसमें उक्त अधिसूचना अंत9वष्ट है, प्रतियां जनता को उपलब्ध करा दी जाती हैं, साठ दिन की समाप्ति पर या उसके पश्चात् विचार किया जाएगा ;
प्रारूप अधिसूचना में अंत9वष्ट प्रस्तावों पर कोई आक्षेप करने या सुझाव देने के लिए हितबD कोई Eयक्ति, इस प्रकार विनिGदष्ट अविध के भीतर, उन्हें लिखित में सचिव, पर्यावरण, वन और जलवायु परिवर्तन मंत्रालय, इंदिरा पर्यावरण भवन, जोरबाग़ रोड, लोदी रोड, नई दिल्ली-110003 को या ई-मेल पते : [email protected] पर भेज सके गा ।

का.आ. 19(अ), तारीख 6 जनवरी, 2011 के अधीन भारत सरकार के तत्कालीन पर्यावरण और वन मंत्रालय की अधिसूचना में,--
(क) पैरा 3 में,--
(i) मद (ix) के स्थान पर, निम्निलिखत मद रखी जाएगी, अर्थात् :--
"(ix) अपवादिक मामलों में स्मारकों/संस्मारकों के सन्निर्माण के और के वल मामला-दर-मामला आधार पर संबंधित राज्य सरकार द्वारा सहबD सुविधाओं के सिवाय, शापिग और आवासीय परिक्षेत्र, होटल और मनोरंजन संबंधी Lियाकलाप जैसे वाणिज्यिक प्रयोजनों के लिए पुनरूDार";

(ii) मद (xiii) के स्थान पर, निम्निलिखत मद रखी जाएगी, अर्थात् :--
"(xiii) स्मारकों/संस्मारकों के विकास और संबंधित राज्य सरकार द्वारा सहबD सुविधाओं के विकास के लिए चMानों/पहाड़ियों/प्राकृ तिक भू-दृश्यों के उपयोग के िसवाय, बलुई टीलों, पहाड़ियों, प्राकृ तिक भू-दृश्यों, िजसके अंतर्गत सुन्दरीकरण, आमोद-प्रमोद और अन्य ऐसे प्रयोजन भी हैं, की सजावट या परिवर्तन";
(ख) पैरा 4 के उपपैरा में मद (झ) के पश्चात्, निम्निलिखत मद अंत:स्थापित की जाएगी, अर्थात् :--
"(ञ) अपवादिक मामलों में, सी.आर.जेड़-IV(ए) क्षेत्रों में संबD राज्य सरकार द्वारा स्मारकों/संस्मारकों और सहबD सुविधाओं का पर्याप्त पर्यावरणीय रक्षोपायों के साथ निम्निलिखत के अधीन रहते 4ए निर्माण, अर्थात् :--
(i) संबD राज्य सरकार, सी.आर.जेड़ क्षेत्र में परियोजना स्थािपत करने के िलए, ऐसे वैकल्पिक ब्यौरों के साथ, जो विभिन्न पैरामीटरों के आधार पर, जिसके अंतर्गत पर्यावरणीय पैरामीटर भी है, और महत्वपूर्ण मैट्रिक्स पर आधारित वैकल्पिक स्थलों के ब्यौरों के साथ, राज्य तटीय जोन प्रबंधन प्राधिकरण को, उसकी परीक्षा के लिए और पर्यावरणीय समाघात निर्धारण रिपोर्ट तैयार करने के लिए निदTश निबंधन अभिप्राप्त करने के लिए पर्यावरण और वन मंत्रालय को सिफारिश करने के लिए प्रमाणिकता प्रस्तुत करेगी;
(ii) निदTश निबंधन मंजूर किए जाने पर संबंधित राज्य सरकार, पर्यावरण समाघात निर्धारण अधिसूचना अधिकथित प्रLिया के अनुसार प्रस्तावित परियोजना के लिए सार्वजनिक सुनवाई करने हेतु राज्य प्रदूषण नियंत्रण बोर्ड को पर्यावरणीय प्रबंधन योजना सहित प्रारूप पर्यावरणीय समाघात निर्धारण योजना सहित प्रारूप पर्यावरणीय समाघात निर्धारण रिपोर्ट, आपदा प्रबंधन योजना सहित प्रारूप जोखिम निर्धारण रिपोर्ट, जिसके अंतर्गत आपाल काल के दौरान ऑन साइट और ऑफ साइट आपातकालीन योजना और निष्Lमण भी है, प्रस्तुत करेगी ;
(iii) संबD राज्य सरकार, राज्य तटीय जोन प्रबंधन प्राधिकरण को, सार्वजनिक सुनवाई के दौरान जनता द्वारा उठाए गए सुसंगत मुद्दों पर निवेदन करने के पश्चात् अंतिम पर्यावरणीय समाघात निर्धारण रिपोर्ट, पर्यावरणीय प्रबंधन योजना, जोखिम निर्धारण रिपोर्ट और आपदा प्रबंधन योजना, उनके द्वारा परीक्षा करने के लिए और पर्यावरण और वन मंत्रालय को सिफारिश करके , प्रस्तुत करेगी ।"।
टिप्पण साधारणतया सीआरजेड-iv क्षेत्र में स्मारकों/संस्मारकों के सन्निमार्ण को हतोत्सािहत किया जाएगा और के वल अपवादिक मामलों में ही पर्याप्त पर्यावरणीय रक्षोपायों के साथ उसे अनुZात किया जाएगा ।

NOTIFICATION
New Delhi, the 11th December, 2014
S.O. 3202(E).—The following draft notification to amend the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O.19(E) , dated the 6th January, 2011, which the Central Government proposes to issue in exercise of the powers conferred by sub- section1) and clause (v) of sub-section (2) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub- rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby and notice is hereby given that the said notification will be taken into consideration by the Central Government on and after expiry of sixty days from the date on which copies of the Gazette of India containing this notification are made available to the public;
Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing within the period so specified to the Secretary, Ministry of Environment, Forests and Climate Change, Indira Paryavaran Bhawan, Jorbagh Road, New Delhi – 110003, or at e- mail address: [email protected].

Draft Notification
In the notification of the Government of India in the erstwhile Ministry of Environment and Forest under S.O 19(E), dated the 6th January, 2011,-
(a) in paragraph 3,-
(i) for item (ix) , the following item shall be substituted, namely:-
"(ix) Reclamation for commercial purposes such as shopping and housing complexes, hotels and entertainment activities except for construction of memorials/monuments and allied facilities only in exceptional cases by the concerned State Government, on a case to case basis";
(ii) for item (xiii), the following item shall be substituted, namely:-
"(xiii) Dressing or altering the sand dunes, hills, natural features including landscape change for beautification, recreation and other such purpose except utilising the rocks/ hills/ natural features for development of memorials/ monuments and allied facilities by the concerned State Government";
(b) in paragraph 4, in sub-paragraph (ii), after item (i) the following item shall be inserted, namely :-
"(j) Construction of memorials/ monuments and allied facilities by the concerned State Government in CRZ-IV (A) areas in exceptional cases, with adequate environmental safeguards, subject to the following, namely:-
(i) The concerned State Government shall submit justification for locating the project in CRZ area along with details of alternate sites considered and weightage matrix on various parameters including environmental parameters to State CZMA for their examination and recommendation to MoEF to obtain Terms of Reference (ToRs) to prepare an environmental impact assessment report;
(ii) On grant of ToRs, the concerned State Government shall submit the draft Environmental Impact Assessment report (EIA) with Environmental Management Plan (EMP), draft Risk Assessment Report with Disaster Management Plan (DMP) including on site and off site emergency plan and evacuation during emergency to the State Pollution Control Board for conduct of public hearing for the proposed project in accordance with the procedure laid down under the Environment Impact Assessment notification;
(iii) The concerned State Government shall submit final EIA, EMP, Risk Assessment and DMP after addressing the relevant issues raised by the public during the public hearing, to State CZMA for their examination and recommendation to MoEF".
Note: Construction of memorials/monuments would be generally discouraged in CRZ-IV areas and the same would be allowed only in exceptional cases with adequate environmental safeguards.
